or among them. but his trial has already started. that's all to come unless breaking news changes everything on "studio b." fox news is america's election headquarters. happy election day to you. today after months, did you vote yet, by the way, after months of campaigning of polling and picture taking the american people finally cast their ballots. at stake, control of the u.s. congress. and america's political future for the next couple of years. here is are we stand: 45 house of representatives up for grabs. that is every single seat, 435 with voting power in the house. in the senate side, 37 seats in play, a little more than a thirds of senate and there are 37 races across the nation. the vice president today offered an interesting take on house this election could shake out. we will lose some seats but we

can hang on to the congress, and hang, we will keep the senate, and i think we can hang on to the house of representatives. if we get a turn out. and that's what we need. we need a congress that is not going to go in and rip aparting we have done. >> you republicans confident they will gain control of the u.s. house of representatives already have a plan to put an end to some of president obama's policies including spending and serb parts of the health care law. we have team fox coverage now, the chief correspondent is covering the illinois senate race and in las vegas following the nevada senate race. but first to the white house. mike tell us about the type of outreach the president is trying to do with interviews today. >>reporter: he has been on a variety of radio stations reaching out to a young audience, and urban radio stations freeing out to african-american ought conferences and in las vegas he reached out to latino audience. take a listen.

>> the latino vote is crucial. obviously, when you look at some of the stuff that has been going on during this election campaign that has tried to fan anti-immigrant sentiment, a lot of latinos feel under assault. >>reporter: he appealed to the voters in the las vegas area to vote for harry reid for senate in a tough re-election bid and for a local congressman for re-election and the rest of up to the voters. >>shepard: and the president will speak to the american public in a news conference tomorrow. what do we know? >>reporter: aides say today, election day, is about the american public sending a message to washington, dc, sending a message to the president, and the white house, so at 1:00 o'clock tomorrow afternoon, eastern time the president will take questions from reporters, talk about his reaction to the election, and the way forward from there. obviously the president of the united states is not on the ballot. his name does not appear on the ballot but aides say he is

obviously a huge figure in this election. we will hear his reaction to it tomorrow afternoon. >>shepard: thank you from the north lawn, a beautiful day at the white house. good to see you. and now the showdown in the midwest. the race to fill president obama's one time senate seat in the state of illinois. the democrat there, giannoulias running against a republican congressman kirk and the president won the state decisively in 2008 but that does not translate into support for democratic candidates now. illinois is home to planet blagojevich and campaign there has unique challenges and charges of corruption. for more on that the fox report chief corporate is live in chicago. >>jonathan: this is an absolutely crucial senate race. the potential embarrassment for the democrats and the white house has of course in losing president obama's former senate seat potentially is not lost on anyone. that is why it is such a tough campaign, why it is such a long

campaign, and that is why so much money has been spent on so many negative political ads and this is taking place, of course, against illinois' long standing tradition of political corruption. >> we are, unfortunately, the king of corruption. >> a professor simpson studied corruption in illinois politics for 40 years. >> we are the most corrupt city, the most corrupt county, and the most corrupt state in the united states. >> it's hard to argue with that. an average of two illinois politicians have been convicted of crimes every single year for the past four decades. >> i am not interested in resigning. the governor blagojevich is the highest profile recent case accused of all manner of corruption practices including trying to sell president obama's former senate seat. now the election for that seat is beset by scandal and

allegations against both the republican and democratic candidates. >> my kirk lied about going to war. >> would you call someone who left $21 million to convicted mobsters? >> the giannoulias and kirk campaigns have spent combined $14 million on those sort of tv ads in the last week alone. democratic officials are saying publicly this is just another senate seat that they want to hang on to like all the others in play tonight. privately, those democrats and republicans, of course, know the senate seat in illinois, president obama's former seat, is so much more than that. >>shepard: thank you from the second city, jonathan. thank you. analysts call this "the race" to watch, the most powerful man in the senate with close ties to the president against a tea party challenger, riding a wave of antiestablishment anger.

the leader, harry reid, could be the first senate majority leader to lose an election in more than 50 years. sharron angle fighting for what could be her first term in the u.s. senate. analysts say nevada's economy is the huge factor. they have the highest unemployment rate in the country and leads in foreclosure and credit card delinquencies. and now, where is senator reid today? >> well, senator reid is in town here today. we caught up with him at a campaign offices, and he said he feels confident about the ground game and his get out the vote effort and he also believes he is going to get quite a bit of republican support this evening because he believes republicans in nevada are not thrilled with their choice of sharron angle. >>shepard: what about her? where is she? what is her function today? >>guest: right now she was in reno where she lives.

out-of-control spending practices that, frankly, we engaged in when republicans were in control. i fought against. and the voters rejected the republicans in 2006 and 2008. the moral of the story is, is that this election is a repudiation of obama and the democrats. it is not an affirmation of republicans. so, republicans have got to come through and satisfy those, this outcry, this anger and frustration, that's being expressed. by the way, they are not frightened. that is being expressed by the tea parties. >>shepard: how is it, though, that once this is over, once tomorrow is over, and we have the numbers, at least in many places you get the tea party folks and the establishment as sarah palin terms them, together, because as you mention

repealing health care law, the people on your side have admitted it is not possible to repeal it all but you can make changes. >>guest: well, our tea party people will understand that we can only do so much depending on what our majorities are, if we have it in both houses. but if we are good faith effort each day bringing up a spending cut, a repeal or replacement of the most onerous provisions of obamacare, if we are carrying out the monday date they will be happy but if we go back and there are republicans who still want earmarking and pork barrel spending which i have said many times is corruption. so, we can't do that. and that is their message and we better understand it. and it isn't just the tea party. they are the cat last, the messengers but this repudiation,

the obamacare, and spending, et cetera, is not just from tea partiers, it is from a majority of americans. >>shepard: many sources have said one of the concerns is that sarah palin would run for president, split the party, and allow the democrats to win again in 2012. how concerned are you and would you support a potential presidency of sarah palin? >>guest: if sarah palin wants to run, she will be a viable candidate. >>shepard: would you support her? >>guest: i have to wait until she runs. >>shepard: you are not sure if you would support her? >>guest: look, she is not even asking for me to support her. >>shepard: i understand. >>guest: i'm not, over two careers out i know sarah palin or no one else wants me to endorse her candidacy. i have the greatest respect, aexpetionz and appreciation for sarah palin and her family and i cannot tell you how proud i am of the work that she has done

and, look, she's going to have a significant impact. but the point here is that sarah palin has made a huge difference, she continues to be attacked by the liberal left media in the most unconscionable ways. >>shepard: for instance? a recent attack that you were mentioning? >>guest: well, it is just the incessant attacks from the liberal left at sarah palin and her family and todd, because they are afraid of her. >>shepard: could you give me an example of one that bothered you? >>guest: well, all, pick up any column in the "new york times" any day. i can tell you. >>shepard: i was going to ask about the reporting, many sources are telling us in the field, of concern of a divide of the republic party after this, with the tea party trying to

move the party to the right and the more mainstream politicians realizing they need the moderates. >>guest: the mainstream politicians, if you want to call them that, look, they have to get the message of this election. and the tea partiers are the messengers. >>shepard: what is the message? >>guest: the message is stop the spending. repeal and replace obamacare. reduce the regulations. make sure that taxes are low. reduce the role of government. give government back to local and state authorities. secure our border. there is a long list they have made themselves very clear as to what they expect of us. and all of that we should do. and, again, this is just so much baloney about a big split when the republican party if sarah palin decides to run. that is just desperation tactic on their part they are starting already. >>shepard: what is the first

place a new congress should attempt to cut so we can lower the deficit and get the economy back on track? >>guest: start with the corporation for public broadcasting. how about if we have an across-the-board cut to 2008. how about if we say that there, we will not implement a requirement that business owners provide health insurance for their employees, the kind that the federal government dictates, otherwise they will pay fines. move into that kind of stuff. and start repudiating and repealing the flow of regulations that continue to come out of the federal pure accuracy on a political agenda. >>shepard: senator john mccain, great to see you, thank you very much. >>guest: thank you, fun being with you. shell shell and the -- >>shepard: and the radical clerk on a list of suspects "to

>>shepard: yemen announcing it will prosecute over a terror crack down, the cleric linked to the suspect in ft. hood massacre, the botched times square bombing, and two of the hijackers from the attacks of 9/11 and accused of plotting to kill foreigners and being a member of al qaeda, the first formal legal action and news is that yemen will charge and prosecute him. the issue of today's election is the economy. no doubt. many republicans have shaped entire campaigns around tying democrats to the great recession. and a number of democrats are urging voters they should blame the republicans because it happened under their watch. for the foreclosure crisis and double digit unemployment

nationwide. and now, gerri's two cents on fox business network. where is the financial pain for voters the worst? >> we have developed maps to measure this, and look at this map, you can see year to date foreclosures, according to realty track, deepest in nevada where one in 13 homes are in folk so you know what that means. if you live in nevada one home on roar street is in foreclosure. arizona and florida and california in pain and we looked at unemployment, and the september numbers and we created a color coded map to look at the worst pain. here, again, nevada is 14.4 percent unemployment. michigan is hurting. california is in trouble, as well. 31 states have unemployment over 8 percent. the jobless low, a real comparison, 4.2 percent under george w. bush, very, very different world.

kentucky, senate race, this closes at 7:00, all the races we will talk about tonight are republican pickups of democratic seats. this is a republican seat rand paul ahead of con way, an ugly race, and all of that stuff but i have talked to top republicans who say all the republican seats they are worried to lose this is the one, the support for rand paul is soft. and at 7:30 the ohio governor's race, eastern time, strickland won with 60 percent of the vote four years ago and is in a doc -- dog fight with kasich and kasich has been leading. ohio is a key swing state depending on who is the governor it has implications for redistricting in 2011 and for the presidential race in 2012. >>shepard: i like those. >>reporter: will you be nicer

to me than to chris. >>shepard: well, this is the thing, he hates my rebels. he is rude. nina is nice. what do you like? >>guest: i am looking at wisconsin, senator feingold, a long time democrat, been in the senate for 18 years, co-author of mccain and feingold which has been picked apart by the court and we have the most expensive races of all times. overall. and feingold is in trouble. no one thought he would be in trouble six months ago and he is running against a businessman who makes plastic, no one took seriously six months ago. president obama won by 14 points in 2008 and that shows how deep the democrats' trouble is in the

midwest. the second race i would like to talk about is mississippi, gene taylor, also a democrat, he is interesting because he did everything he could to separate himself from the democrats not only saying he was going to run against nancy pelosi but actually admitting he voted for john mccain in 2008. >>shepard: he was antievery obama policy. >>reporter: and he is in trouble. my final race is my home state of california, fiorino but this is not a good spot for republicans tonight. if you have carly running against barbara boxer who is the epitome of liberal washington, right up there with nancy pelosi, she wrapped herself in obama's cloak in his ad standing with him and that is still a very tight race.

also, whitman spent up to $190 million for race for governor, part of that in get out the vote and if republicans lose that seat they have lost california for years to come. any chance. >>shepard: governor's race, california, florida, big states that mean a lot for redistricting, and power. >>reporter: and west virginia. >>shepard: steve? >> i will go east coast to west coast. in the east coast, connecticut, the republican challenger six or eight weeks ago was down 15 points. no one thought he had a shot and now the race is dead even, several polls in the last few days show foley is up. if he wins in connecticut we can all look at that and look across the country and say there is the beginning of a wave. in the midwest you have the third district, third congressional district in wisconsin held by democrat a well liked guy and he does not

make a lot of waves and is a moderate dome. and, again, recently, if we asked if he was in trouble, no one thought so and it was considered solid. and now the race has tightened and you have a scandal that exploded in wisconsin with allegations that kind's staff was involved in a pay to play effort that has rocked the campaign. and i think it's one of the seats that should remain democrat in a regular, in a typical midterm election year but if it doesn't, again, another sign that there is the wave. and the third one would be the washington senate race where republicans got their prized recruit and they wanted him and worked him and convinced him to run against murray, the incumbents and she has run a very good campaign. she has done very well in the debates, and beat him, i think, in the debates, and has made a strong case for herself in a

race that probably she should win but if there is this wave, if we see the things tip, in indiana, wisconsin, and connecticut, rossi, that wave could be enough to get him to a victory. shell --shipship can -- can you think of a situation where the democrats retape control of the house of representatives? >>reporter: no. the reliable pollsters, it plays out how they say. there aren't huge surprises. there were not big surprises in 2008 when it was a democratic wave. >>shepard: steve, a way where the democrats get the senate, as well? >>reporter: yes, the republicans, yes, there is a possibility that republicans get the senate. the key races are california, washington, and west virginia. republicans, i think they probably win in washington,

probably end up winning in west virginia, both of those are toss ups. if there is a wave, they get there. >>shepard: that wave, is it your sense we will know when polls start to close on the east coast, and we could have some idea as we begin to get exit polling data in the afternoon. >>reporter: as the person in charge of exit polling in 2006 and 2004, it did not go so well. i am very leery. i know we will report on it but it is a matter of which people decide to actually talk to the pollsters as they exit. i'm very leery but i want do see actual votes. west virginia, you took that away from us because you take the goodies, it will be key. if manchin holds on to the senate seat, the robert byrd seat of auto-plus years, then the republicans probably cannot get senate. if raese takes it all bets are

what happened? i think what we are seeing from where we were six weeks ago, republicans were saying they would win 100 seatses in the house, they would sake -- take the senate to where we are now closing in on the polls, a number of rates are swinging our way, and we have the wind at our back and great early vote numbers, and 11 key states, including california and illinois and ohio and we are seeing great turn out but as we are seeing the momentum is going our way. going into election day and this morning. >>shepard: the polls indicate, not a day to talk about polls but i will talk about agenda, it has, the agenda you put forward, you can make the argument that you have been the most successful as passing legislation of any congress in a long time, and a white house and congress working together and now the people in large part, at

least the majority, are furious about it and that is the reason the polls suggest you are going down in flames, will there be reanying of agenda and some compromise to be had if, in fact there is a republican house? >> well, we will continue to focus on getting our vote out today, and coming tomorrow but regardless of what happens tonight we will continue to fight for middle class families as we have, and we will fight harder for middle-class families to ensure the special interests do not control the agenda, and we are going to continue to reach out as we have in the past. and there are a lot of places that are right for compromise, places where republicans and democrats can agree, republicans have expressed support in the past. places like the middle-class tax cut, deficit reduction where we have seen resistance in the past 20 months to moving forward on those seemingly agreeable issues, from republicans, and we low pressure we can get more cooperation starting tomorrow. >> well will talk about the cooperation but i have to make a

>>shepard: the national press secretary for the democratic committee, the middle-class, there is in question it is hurting in a big way and even on historical levels now. is there something that you as a member of the dnc believe the republicans, the democrats can come together on, try to solve some of the problems of the middle class rather than being at political odds with each other? >>guest: there are a lot of places to come together to help the middle-class. we have heard some things from our republican colleagues about what that are agenda is, whether that is a political agenda defeating the president or being unwilling to compromise. we know the american people want to us work together to help them, help middle-class families. one of the ways that i think we can do that, regardless of the outcome of tonight, is to move

forward on middle class tax cuts this is an area where we both should agree. there is some disagreement about the higher level tax cuts, and we think it will add to the deficit unnecessarily, and republicans disagree with that, but where we do agree is that the middle-class deserves a tax cut. we should move forward on that. and we have a deficit commission that the president has authorized, and we should look at their recommendations and go forward with that. and there are a lot of places where we can come together, question is, is there the will? we have in the seen the well from republicans in the last 20 months despite ourests to reach out and we will continue to reach out because that is what the american people expect of us, they expect us to address their problems, not our own political problems. >>shepard: the president's former senate seat in illinois is in jeopardy tonight of going to the other side. what is the message that the democrats are receiving from this and what sort of actions might change as a result of the

voting which we are anticipating? >>guest: people are casting their ballots in illinois and we see a very encouraging signs for democrats who should be very pumped up on what we are seeing not just in early vote numbers and in illinois where we have taken a lead, but, also, in turn out this afternoon, just in cook county, we are seeing disproportionately high voterses turning out in cook county compared to the overall proportion of the electorate. so we are in good shape. the results are still taking shape and they have not been written yet. we feel like we are in a strong position, but, again, regardless of what happens tonight, we are going to continue to work for families and we will continue to reach out to republicans to help us do that. and we hope they accept our offer to work together. >>shepard: thank you for being here. we are keeping a very close eye on the hot senate race in the state of kentucky, the democrat there going up against the republican rand paul, the tea party's backed candidate, a lot
