naval aeuf kwraeuters called it the bird gauge. apparently it crashed during a training exercise around the time of world war ii and sank to the bottom of the lake. jenna: pretty good condition if you look at it. jon: apparently because of the cold water great condition. jenna: wow, thanks for joining us everybody. jon: "america live" starts right now. megyn: fox news alert out of california an apparent massive ballistic missile seen streaking across the sky off the coast last night. now the u.s. military is saying it does not know who launched it. welcome to "america live." i'm megyn kelly. these are images of the mysterious incident. so far no clear explanation from the pentagon, from the navy, or the missile defense agency, which told fox news it did not launch any test missiles at the time these photos were taken. now the passenger is -- the pentagon is saying they cannot

back up a response from norad that there is no threat right now to the homeland. the pentagon is saying they cannot back it up because they have received a good enough explanation about what this was in the air. we hung up with a source that suggested to us that it may have been an accidental launch either from a navy sub or possibly a russian sub, this is off the coast of california. we are told that typically the missile command center can spot a launch within ten seconds of the missile breaking water. we'll have much more on this developing story, details just coming in in minutes. also developing this hour new details on a controversial case out of oklahoma, a federal judge has blocked a brand-new ban approved by the voters on the use of sharia law in state court decisions. voters just approved this by 70% a week ago in oklahoma. as soon as it had passed the head of the local counsel and islamic and american relations or cair went to court to stop

that law from becoming part of the oklahoma state constitution. now this judge has said it may indeed -- at least they need to slow things down to evaluate the claim that this violates the oklahoma constitution and cair's constitutional rights. trace gallagher has more live from our west coast newsroom. trace. >> reporter: for now, megyn the state board of elections can't certify the result because this restraining order which lasts for 14 days, the full hearing by the way comes up on november 22nd. the judge giving both sides a chance to ready their arguments. the measure passed by 70% of voters in oklahoma and says the courts should rely on state and federal law when deciding cases and forbids judges from using international or sharia law care. the islamic relations mitty says it violates the first amendment clause that bans the government from making laws respecting the establishment of religion.

other muslims say this measure singles out the muslim faith but does not singette out other faiths. listen. >> the judge might look at the law and say, you know what we'll take the rabbi testimony and we'll take the preacher testimony but your testimony is null and void because you're muslim. >> reporter: but the oklahoma lawmaker who sponsored this measure says the courts are increasingly consulting and using sharia law to decide matters pertaining to u.s. muslims in this country. listen to him. >> 70% of oklahoma citizens want to save their courts and have courts follow and interpret the law that is before them and not to legislate from the bench. >> reporter: just for a little context there, sharia law is based on the koran, the keeping of the prophet mohammed. in various countries writ is

washington has been aware of the risk of cargo, but did not put pressure on officials because of the big, business cost. 26-tons shipped worldwide every year, one insider told us that a full security check of all the packages would be devastating to the air cargo industry and to the global economy. they say they are acting in a safe way in an informed way. department of homeland security yesterday making these added restrictions to cargo transport, extending the cargo ban, not just yemen but also to include somalia another hotbed of terrorism in that region. a been on toner cartridges used in that latest plot over a certain size, and also greater concentration on what is being called, quote, high-risk cargo from elsewhere. the u.s. also says that it can't tell the rest of the world what it can do, it can only advice

and maybe do it's own pressuring. in fact yesterday, megyn, european union security chiefs met in brussels and are working on their own plans which can include a few other measures. blacklisting of countries with terror links sending packages elsewhere. getting better access to chipping database sis so they can find dangerous items from anyone to any where. they are worried about the cost of a broader security effort. one word from the german interior minister sums it all up. if it is going to be more expensive then it will be more expensive. no security is for free. megyn: flight concerns for president obama. he's in jakarta, indonesia, the city where he spent part of his childhood. his visit is being cut short due to the nearby volcano that started erupting a few weeks ago. there is concern that the volcano's ash plume could ground

flights. his next stop is the g-20 summit in south korea. his flight time has been moved up. new worries about the big tax battle shaping up in washington. the bush-era tax cuts are set to expire on december 31st. republicans want to extend all tax cuts for all americans. president obama is saying we cannot afford that. if both sides cannot reach a deal this is going to get very expensive. stu varney varney & company is my guest now. stu, now they are suggesting, this is from a senior fellow at the tax center. i think it's highly likely they will not be able to resolve this this year despite the resolution of the people in the congress, even the lame duck people who say we will get it resolved by january. >> reporter: this is the most important financial issue of the immediate future. if there is no deal on the bush tax cuts, then everybody always taxes go up, as of january the

1st. now -- >> anyone who pays taxes. >> reporter: anybody who pays taxes will see their taxes go up on january the 1st if there is no deal. megyn: i want to show our viewers. we made a graphic so you can see how this may affect you if this happens, okay. look at it here. the bottom tax bracket goes from 10% to 15% . the top goes to 35% to 39.6%. married couples lose 43% of their standard deduction, which is something that president bush took away. capital gains tax you pay 15% now it goes up to 20%. dividend taxes go from 15% to 39.6%. that i think is for the top earners. nonetheless a bunch of people will get hit. >> reporter: everybody who pays tax will see their taxes go up on january the 1st if there is no deal. before the election it looked like there was a deal. megyn: we talked about that.

>> reporter: extend the middle tax ruts forever, maybe them permanent. extend the tax cuts for the rich two or more years. after the election that deal seems to have broken down. some republicans are now dugging in their heels and want an even text made permanent for all taxpayers, and for the democrats, some are now saying, it's too much, we can't afford it. you k-pt give tax cuts to the rich -- can't give tax cuts to the rich. megyn: at all. >> reporter: well not to expend them. have their taxes go up for the rich on january the 1st. so that consensus is breaking apart. we've only got a two-week window of opportunity to fix it and get some kind of a deal. megyn: because if they don't reach a deal, stu and we get to even late december without a deal in place, it's not like payroll departments can instantaneously say, oh they have a tkaoefplt they are changing payrolls right now to accommodate. >> reporter: it must be fixed on

that two-week session of the lame duck congress. if it does not everybody's taxes will go up january 1st and there will be a significant impact on the overall economy. >> what is the game plan by the republicans. they think they have president obama in between a rock and hard place because -- do they think they have a mandate from last tuesday. >> reporter: yes, they do. megyn: the deal seemed like a reasonable one. you give the rich a couple year's extension because we are in bad economic times and the middle class a permanent one. >> reporter: the republicans want to stand on principle. they feel they have the momentum to make all of the cuts permanent. they do not want to so the tax cuts for the rich haoeufd off, by furniture indicated as they say, because in a couple of years you've got to go back and do it all over again. megyn: fight the same battle. >> reporter: do they get the tax cut or don't they. they want it all permanent right now. democrats won't have it at this moment. but they've got to get together to form a compromise of some sort. megyn: this is risky, the democrats, pushed this off, pushed this off, they wanted to

megyn: fox news alert out of california. new information on this apparent missile launch off the coast of california that was seen streaking across the sky last night. the military's northern command just released a statement, trace gallagher has been pouring over it. trace, what do they say. >> reporter: i can tell you this, megyn we have called every military base in the western region. we have called norad and north comm, those are responsible for defense in the united states and canada. north comm sent us a lengthy statement. they said we can confirm there is no threat to our nation. we asked them how they know that

and they didn't give us an answer to that. they went onto say, from all indications this was not, i repeat not a launch by a foreign military, but they won't say who this launch is from or if it even was a missile launch. you can see there that contrail that is following a flashy object. that is short for concentration tail from ankle engine. we've had experts say it looks like an intercontinental ballistic missile. was it a mistake? they have not found out. norad has satellites in the sky, in space, radar in the ground. they can tell if you're throwing a large frisbee on the beach. so they know, have a pretty good idea of what this was and we're going to find out what they say coming up in the minutes ahead. megyn: all right, trace, thank you. i should mention we are going to have captain chuck nash with us

moments away on that breaking news. there are new concerns involving the healthcare overhaul today. the nation's largest doctor's group which backs the overhaul now says that looming medicare cuts will be catastrophic for seniors. the democrats had taken money out of this bill to pay for the medicare services saying they needed to do that to reduce the deficit. now it seems we may be heading deeper into the red. i've confused even myself. i'll tell you what is going on. dr.~marc siegl is here, here is the deal, there is this medicare fix. the bottom line is every year they are supposed to put the payments by huge amounts. >> it keeps increasing every year. megyn: every year they postpone it. nobody wants to do that. the seniors are going to get hurt. it doesn't really hurt the doctors, it hurts the seniors. >> doctors can't work with that kind of cut. megyn: as it turns out doctors want to get paid too every year they postpone it.

when they redid healthcare the democrats tried to include a permanent fix in the house bill but then the congressional budget office came back and said that will mean the healthcare bill is not deficit neutral but it actually adds to the deficit and so the democrats said, get that the heck out of the bill. >> that is right. megyn: they took it out, passed the bill and didn't resolve that issue. sure enough that thing is coming up again this year and you guys are looking at 23% cut and who is going to get the shortened the seniors. megyn: doctors are -- the ama itself did a study that shows 17% of doctors without that cut are cutting the number of medicare patients they are seeing. seniors are in trouble. let me tell you something, the ama is a bunch of hypocrites, because they made a deal with president obama back in the spring of 2009 to get this included in chicago during the white coat ceremony. they sat down, they said, they wanted tort reform too, whatever happened to that we didn't get any tort reform and they didn't get this deal as all.

megyn: they wanted it to be a permanent fix that was in the healthcare bill so we won't have to go through this every year. >> it would have been $300 million more to the bill and everyone would have said it's not definite neutral. you can't write apply and script without making the actors happy. doctors are going to do what? see more and more patients when we are already full. and do what, take less and less money for seeing them. that is not going to happen in the real world and seniors know that. they have more and more medical problems, they are harder to take care them. i enjoy taking care of them but i need the time and need to get paid for it. megyn: it looks like chess. they wanted it to say it was deficit neutral. but there was this huge $300 billion cost to reimburse the doctors for medicare services that was over here. they were saying nobody look over here, we swear this isn't part of the -- even though it wasn't being addressed. yes it's deficit neutral i guess

but once you add in the real cost that they they are going to have to pass. >> they are going to do it as this band-aid. each time they delay it another six months. it was dade june 1st to december 1st. doctors get angrier and angrier. we don't think it's going to happen. president obama has said a lot of negative things on the air about doctors, i don't think he appreciates physicians properly. megyn: yeah is that? >> he made a point about some doctor amputating the wrong leg for money he said this at one point. the issues whether tons i wills are taken out for money. doctors are human beings and on the whole are a very hard-working group that try to take care of people. surgeons for many more years than i trained deserve to be paid for it. megyn: as a real, practical matter you have seniors who are on medicare who once can see you and now cannot even before this mess because you are just overwhelmed with numbers of patients. now you're looking at a 23 pherz cost in your reimbursement from medicare for the medicare

patients you still are seeing. >> they said 28% of seniors couldn't find a new primary doctor like me to go to to give them their medication. megyn: this is what the seniors are moving about with respect to their healthcare. >> that's why it's disingenuous to say your medical care will stay the same. how can it stay the same if your doctor doesn't stay the same, the doctor doesn't have the time to see you. a lot of seniors are seeing a robin hood situations here where services are being taken away from them, we'll restrict the services more, pay doctors less. we won't get the same level of care doing that. megyn: kathleen sebelius said she had a cabinet meeting where the president stressed preventing these disastrous cuts must be one of our top priorities. the white house want to prevent the cuts and i think the republicans want to prevent the cuts. the question is is it just a temporary band date and why can't the costs being dealt with.

>> the ama wants to too, they are coming out with ads. a lot of the people who wanted cuts could have done something. right now i predict another band-aid. doctors are very unhappy about that and many are dropping out of the ama. megyn: that's true we talked about that. dr.~marc siegl thank you so much. a guilty plea to report to you today involving the group acorn and charges that this left-wing voter advocacy group broke election laws in nevada. we'll have this right after this break. plus, eye on the white house, lots of names being tasked about as possible candidates this 2010. we will talk with president reagan's son about who he thinks will be the one republican who actually might be able to pose a real challenge to president obama. >> i don't need to run for office. i know that i don't need a title, in fact i love the freedom that i have, that i can sit here and i can tell you anything that i want to tell you and not have to worry so much about how it will affect my future political career, or my

megyn: quick update for you on the mystery missile launch in california. trace told us moments ago that northern command released a statement saying no foreign military was responsible for the launch. the navy released a statement just after that saying, it wasn't us. we've got calls in to the department of defense among others and we hope to have a little bit more on exactly what happened here. keep in mind as i told you this morning, what we heard from the pentagon first thing after nor rad told fox there was no threat to the homeland. the pentagon came become and said i can't back this up.

i haven't received a good enough explanation as to exactly what it was in the sky that appears to be a missile launch. we are on it. as we know more so will you. the left wing organizing group acorn is paying the price for allegations of voter fraud. this former supervisor for the community group cutting a deal to settle charges that volunteers were illegally paid to registered voters during the 2008 presidential campaign. eric shawn has more live from our new york city newsroom. >> reporter: it's another voter fraud-related acorn play, this time the former original director of voter registration has pled to charges related to an illegal voter registration scheme from the 2008 presidential election. that is the activist group president obama once worked for. she has pled to two misdemeanor charges of conspiracy in necessity. the charges knocked down from felonies in connections to what prosecutors say was acorn's plan to illegally pay for signing up

voters there. acorn caught at blackjack, or 21, hey it is las vegas after all. acorn's field director christopher edwards pled guilty and testified against acorn and the executive saying they all went along with the plan. >> i was never told by amy or anyone else to stop the program nor was i told by amy or anyone else that there was any legal jeopardy concerning that program. >> reporter: you may remember that acorn's las vegas office came under fire for alleged fake registrations including signing up the starting line up of the dallas cowboys. acorn itself faces felony charges and potential trial. they are in las vegas in two weeks. you know, megyn we've been on top of this story on voter fraud for two years now and allegations. people send us information -- if people want to send us information our address is voter

the afternoon. 35 miles off the coast out near catalina island, and this, look at the picture, is what it cap you are taourd. there is video of this, we have the still to show you. the video you can clearly see at the top there, you can see the fiery object and then you see the con trail which is court for condensation trail. this kind of lit up the southern california sky. we have called every military base in the western region, not a single one knows anything about this or at least they are telling us they know nothing about this. we contacted norad. they have no idea what this is. norad is responsible for proceed spechting -- protecting this country from any kind of aerial attack at all. was it a mistake? we still don't know, megyn, we are still calling. nobody has yet taken responsibility for this at all, and north come has said this was not -- northcomm said this was

not from a foreign military. private, mistake, we are still checking to find out exactly what this is all about. megyn: wow, all right, trace thank you. president obama says that he had to expand government and push through big bail outs to save us from another great depression. a claim some openly mock. now former president george w. bush is explaining his own decision to bail out the banks and it might sound late familiar. here he is with nbc's matt lauer. >> reporter: you went with the tarp program. >> we did. >> reporter: they call it the bank bail out 0 and they hate it. >> i can understand that. the idea of spending taxpayer's money to give to wall street and the banks to save them, a lot of people think they created the crisis in the first place. i can understand the anst. megyn: the president went onto

say that when somebody tells you we are facing another, you know, possible depression or economic collapse you've got to do something. joining us now leslie marshall a sinned dated radio fox show host and fox news contributor, and lar hrars on a syndicated talk show host. to me that sounded awfully familiar from what we heard from president obama. >> probably, megyn because it is. where was the tell louisiana prompter there? megyn: george bush doesn't use a tell louisiana prompter. >> i'm teasing. basically they are reading from the same script. unfortunately the american people tonight want this, still don't want it, it hasn't been proven to be good for america. this is in the hands of both parties and both presidents, only right now obama is in office and getting blamed for what was written into law by george w bush, whom we just saw. megyn: does president bush get a

pass on tarp, the short form for the bank bail out where as president obama doesn't get a pass for the many bail outs that followed? >> no, i don't think he gets a pass for it. what we were told and every economics expert i've been able to find since then says in the fall of 08 we were fashion something that could have sucked down the entire economy. the fact is it was made and had bipartisan support from congress. maybe it was right, maybe it was wrong. i appreciate the fact that the president said he's going to stick to his guns it was necessary to do at the time. i don't like the idea of the government bailing out car companies or banks because they should be free to fail. we were being told that if aig and some of the others had collapsed they would have pulled down so much of the rest of the economy with them we would have had a major meltdown. megyn: here is what i want to know. i watched this interview with matt lauer last night, and it was very interesting, i don't know if you caught it, but president bush was the first one to sort of blame himself, and to

criticize himself on a lot of issues. he refused to place any blame or criticize our current president, president obama, he didn't think it was right an hasn't done that in the past two years he's been out of the office. the tone president bush struck, i'll start with you lars. i know they hate it, they are thinking, they are bailing out wall street and why should we do that. for lack of a better term feeling people's pain and explaining why he had to do it seemed to be sort of a similar message from what we've heard from president obama and delivered in a different way. was the former president more effective at communicating that, i feel your pain message than we've seen from president obama? >> won't that be ironic if the man who was cast for eight years as the bumbling communicator who couldn't communicate could without a tell louisiana prompter do a whole lot better job than even president obama gives himself credit for? right now president obama keeps saying that the only reason things aren't working and the only reason that the american public is not getting behind his policies is either, a, the

president hasn't explained it well enough, and i think hundreds of speeches and hundreds of interviews ought to have done it, for b, the american people aren't smart enough to understand just how good his solutions are and so he needs to keep explaining. i think neither one washes. i wish the president, the current president had a little more of a former president's humility. megyn: let me ask you that about that sort of humility. matt lauer asked him about katrina it's an infamous photo of president bush. if you hadn't heard, folks, president bush is promoting his new book, "decision points." he's going to be on with hannity tonight at 9:00. he was asked about president bush flying over new orleans looking out of the window, he didn't stop there. watch how the former president reacted. >> let's get to the picture that we may have seen more of you in the last couple of years of our presidency than any other picture. you're sitting in air force one, you're flying back towards washington, you fly right over new or phraoepbs and you look

out the window. >> huge mistake. >> it made you look so out of touch. >> detached and uncaring, no question about it. megyn: my question is about the tone. he has an ability, does he not to make you feel like okay he actually goes get why people were ticked off? >> you know what, megyn, i have to say if this george w bush had been my president for eight years i would have liked him better, and i think what happens is when they are commander in chief they are a very different tone than when they are running for that position and retired from that position. for me and many americans especially the people who were victims of katrina it's not the photo, it's that he didn't land. megyn: yeah, and he talked about that, you know how he should have. lars why are you shaeub being your head? even the president said he should have touched down and put boots on the ground and handled the whole heck of a job brownie thing differently. >> i think the president made a

huge miscalculation. landing at the time. we know what kind of resources it takes to have a presidential visit in the middle of that type of disaster. i think he made the right decision the first time around the president thinks he didn't. and again this is president bush not unwillingness to blame the proper people who should have been blamed and that is the folks on the ground at the state and local level. megyn: i don't think we want to relitigate katrina. i started going back to the tone. it's so rare to hear him say, he came right out and said just awful, it was terrible. it was a mistake, i shouldn't have done it. it's kind of refreshing to hear a leader talk that way . but lars as leslie points out he's not the current president. does president obama -- the point i'm trying to get to, would president obama benefit from doing some of that. >> yes. megyn: or is it different when you're the current president? megyn: you have to communicate that you're confident in the decisions you're making. you can't very well sit there and i wouldn't expect the president to say i don't know

a very big flag in there, and that was going to help block the people when they got there. megyn: so the family would never have to lay eyes on those hateful protestors. all they would see is american flags and hear patriotic music playing as they entered and exited the church. >> uh-huh. well the church is about a mile away, but this was the intersection at which the people from the westboro church were going to be. basically i asked the people to bring cd's. these young ladies from another business down there brought an entire sound system. we had a lot of background music. the people finally did get out of their van, they put up of their signs. megyn: when tow showed up to spew their hate what happened? >> well they opened up the van and they all came out and they started chanting, they started saying, i guess there is this one song about god hates america. they had little kids even

holding up these signs, and that was one of the reasons that i wanted to stop them, because i just continue imagine all these little kids, you know, seeing their daddies funeral and hearing god hates soldiers. the other two men pulled in front of them with the flag and the patriot flag was on the other side. when they got loud they gunned their motors so nobody heard them. after about 50 minutes they left. megyn: you said these men have gone to serve so we would be able to do this, come out and counter protest, and as a result they did not die in vein. >> that is correct. the thing is that these other people they may study law, know the law but you know what we live the law, and so it was just important for us to actually extend our own civil rights, you know -- in a dignified manner. the name of the operation was operation dignified protective stance. it said it all. you didn't want any fighting. that would have been disrespectful to the soldiers as

pentagon. what do we know? >> reporter: we don't know a lot. we are checking into it. the pentagon has not given us a definitive explanation for this giant contrail that appeared to be the launching of a missile off the coast of california. it had all the earmarks of a large missile being launched. but the pentagon says they don't know who launched it or why or from where. there are per test missiles at vandenberg, they say it wasn't there. and the norad, the northern air defense organization says they are checking to see what it was. they put out this statement. at this time we are unable to provide specific details. but we are working to determine the exact nature of this event. we can confirm there is no indication of any threats to our

nation. now, of course there could be the possibility of an accidental launch of a missile from a navy ship or navy submarine. but the navy denies any involvement in this. they put out a carefully worded statement. we can look at what the navy says. we checked and confirmed the condensation trail was not associated with any navy operation. now, that doesn't exactly preclude the possibility of some kind of accident that is yet to be explained. but it just says it's in the connected with any navy operation. we checked with nasa. they haven't launched anything. they admit the thing is going up, not going down. so that's not likely. and we checked with the faa on the possibility of a commercial launch of a satellite and they didn't have licenses issues for commercial launched. so at this point no definitive explanation. megyn: let me confirm one thing with you.

norad is saying we don't perceive any threat to the homeland. but what we heard earlier is fox news reached out directly to the pentagon and colonel dave lapan, a pentagon spoargsman, said i can't back that up, that statement from norad because i haven't received a good enough explanation about what this was. is it true the building you are in at pentagon, they are not going as far as norad saying there is no threat to the homeland. > homeland. >> reporter: they are not saying there is a threat. he's saying he does not know what it was. norad saying they don't have any indication there was any threat. if there are missiles being launched and we don't know by whom or from where, that could indicate a threat. if there was a mistake made, that could be a threat. but norad says there was no threat in this case. obviously nothing was hit and nobody was hurt. but it does raise serious

questions. megyn: good reporting, we appreciate it. one man who may be able to help us separate fact from fiction is chuck nash. he's a retired u.s. navy captain and fox news analyst. this is bizarre. you have norad saying there is no threat to the homeland and the pentagon says we can't confirm that because we don't know what it was. >> this is a head scratcher. i think it's disingenuous to say we don't know what's going on. somebody knows what's going on, they are just trying to figure out how to explain it. the system that we have to monitor worldwide monitor events such as this and the unbelievable quickness that this can identify in advance, declare it as a launch, then actually give you very detailed information and then hand it off automatically to other systems which can tell you where it many

headed, i -- where it's headed. they have been around for a while. now the question is, what is it, and just how bad is it? because either somebody accidentally launched something or someone intentionally launched something and it could be somebody trying to make a point on some kind of a foreign weapons system off one of our coasts. it could have been an accidental launch from a u.s. system and everybody saying well, it wasn't one of our operations. you have got to parse this. it's early on. they are working through this. megyn: maybe we can get this navy statement. i want to ask captain nash about it. he point out they were parsing their words. look at this. we checked and confirmed the condensation trail was not associated with any navy operation. is that too parsed for you? they don't speak to what

megyn: this is a fox news alert. a u.s. coast guard is telling us a cruise ship stranded off the coast of mexico will arrive in mexico tomorrow afternoon. the coast guard says passengers have plenty of food and water. and that some of the ship's functions are fully restored. none of the 4,500 people onboard are hurt. but the ship had problems with its air-conditioning, hot water and telephone service. two mexican tugboats are expected to reach the ship and they will tow it into the mexican port. the u.s.s. reagan is getting ready to send food and supplies to this ship. what a situation.

character and who is. he should get a slap on the wrist and allowed to proceed. megyn: why does he have unpaid administrative leave. why doesn't this boil down to the principal sitting down with him saying you can't be swearing at the kids. do a better job next time and that many the end of it. >> because it's not that minor. joey is not separating the guilt phase from the penalty phase. the guilt phase is -- did he use profanity? did he threaten physical violence? the answer is yes. the sentencing phase is you are a wonderful teacher, teenagers are difficult. this is an isolated incident for which he showed remorse and yes he deserves a less penalty than someone else. but clearly what he did, profanity, abuse of discretion, he's guilty fan * the kids say he made me feel scared.
