military aircraft and taken to high level meetings with u.s. and afghan officials, not just that but that he was paid an undisclosed sum of money. the white house now says he was not paid any u.s. money, but others are disputing that. the president of afghanistan is denying reports that he personally sat down with this imposter. but sources say the man actually did meet with hamid karzai until they found out he was a prod. press reports out there on progress being made with respect to discussions and negotiations with the taliban in afghanistan may have been based in part on these bogus meetings, on these meetings with this imposter. who exactly is this man, and how on earth did he get away with this? we're going to have a live report just ahead. stay tuned. h-pb and this is another fox news alert for you, new reaction

from the white house to the dramatic confrontation and deadly exchange of fire between north korea and south korea. the obama administration saying the north is not living up to its obligations after it attacked a small south korean islands. the gunfire sending people running for their lives killing two south korean marines. now the worry is that north korea will do something new to ramp this thing up. our own jennifer griffin is live at the pentagon. >> reporter: the eye tack began about 2:00pm local time. both president obama and the admiral of the joint chiefs were woken up that the north koreans fired 200 shells on a small island on the west coast of south korea. half of the shells were fired by each side. the white house demanded an immediate halt to what it

described as the north's belligerent action. it went on for 90 minutes. the u.n. security council has not yet decided to meet. some of the injured were civilians. >> i was lying down and watching television and i heard the bang, bang sound. when the bomb went off nearby house and when my house broke down i thought that i will die and i stepped out of the house, so i stayed still. >> it was not just one location hit by artilleries, fires were everywhere and it was chaotic. i tried calling my wife at home and i could just hear darling and the phone was disconnected right there. >> reporter: the pentagon has 30,000 u.s. troops in in between north and south korea. there have been 200 border incidents since an arm is advertise was signed. this is the worst attack by north korea when it sank a south

korean friget killing sailors. it is taking very seriously at the pentagon. it is widely believed that this attack today as well as the revelations over the weekend about the centrifuges that could provide a second track to getting nuclear weapons for the north, that all of this is related to the succession of kim jong-il to his 27-year-old son. he's trying to bolster up the credibility of the son. the white house stuck not wanting to give kim jong-il too much attention. megyn: more than one hundred thousand ex-pats live in seoul and south korea is our 7th largest trading partner. what could happen next in this

alabama teen who vanished back in 2005. more than five years after her disappearance no one stands charged with her alleged murder. phil keating joins us on the phone from aruba. what do we know. >> reporter: i spoke with john kelly the attorney for beth twitty, natalee holloway's mother overall the years. he received the statement within the past hour, so perhaps the comment from beth twitty is forthcoming. her dad, dave holloway add been quoted he really believed this was going to be id as his daughter's jawbone with one tooth in it. according to dutch investigators this is in fact the jawbone of a young adult. we don't know the race, or the age. according to the dutch forensic experts over in the haig they say it's definitely not natalee holloway. they compared the jaw bones with

the dental records of the then 18-year-old girl in 2005 when she disappeared here on vacation with all of her high school graduates coming in from alabama having a big, fun weekend. she was last seen partying and leading with of course some suspects in a car. the prime suspect here of course is joran van der sloot who remains in prison awaiting murder trial for stephanie flores, the 21-year-ol 21-year-f he'21-year-oldperuvian, on the r anniversary of natalee holloway's disappearance. the solicitor general told me he is disappointed that they can't give the family closure. he says most definitely had this hr-pb identified as natalee holloway it would not have shown cause of death so very likely it would not have led to criminal charges once and for all being charged against the prime

suspect joran van der sloot. megyn: phil, thank you. remember, folks natalee holloway vanished on may 31st, 2005. in june of that same year joran van der sloot and two other aruban nationals were arrested in section with her disappearance. they were eventually released, then rearrested in november 2007. in december of that same year aruban officials closed the case and just four months ago joran van der sloot was arrested in connection with the murder of a peruvian woman who was said to have discovered something on his laptop relating to the disappearance of tphol tphol. natalee holloway. a critical decisions now on the governor's desk in pennsylvania. that state is considering a major step to expand the right to defend one's selffrom attack. greg jarrett has been looking into this and he says it comes with controversy. >> reporter: it sure does. it's bedrock law in america that your home is your castle, you

have the right to defend yourself there. it's called the castle doctrine and allows you to use deadly force to protect your person and property, but pennsylvania now may soon expand that right well beyond your home, your car, to your business, and indeed anywhere out in public as long as you have a right, a legal right to be there. in other words, if you're out on a public street in pennsylvania, and you perceive a threat, if this law passes, you would be permitted to use force, even deadly force against that threat. and here is the key provision. removing what is called the duty to retreat. and i'll quote it. no person should be required to surrender his or her personal safety to a criminal, nor should a person be required to needlessly retreat in the face of intrusion or attack outside the person's home or vehicle. in other words, you can stand your ground out on a public street, and that's not all. you would be protected from

being sued by your attacker, or the attacker's family. well, some district attorneys are calling this a defense attorney's dream, giving criminals a built-inch defense whenever there is a shooting. some say it would escalate the level of violence out on the public streets by letting thugs claim that they perceived a threat so they could similarly open fire. governor ed rendell is really struggling over this one. he hasn't made up his mind as to whether he's going to sign the bill into law. the nra is urging its passage, while gun control groups want a veto of it and governor rendell has about a week to make up his mind. megyn, i do want to make clear there is a caveat to this. the use of force rules are still in effect out on the public streets. in other words, if you're facing a nonlethal threat, you know you're not allowed to use lethal force if somebody slaps you in the face, for example you can't pull out a gun and kill them.

it involves the cargo area of delta. our viewers are familiar with the cargo problems we've been having since that attempted attack using cargo just a couple of weeks ago. and now we see that a canine has alerted to something in the delta cargo area at logan airport. what exactly was it? what set the dog off, exactly how big is the response? we don't know. all we can see is the pictures you're seeing and a one-line piece of information that is just coming into our urgent q. this looks like some sort of a bomb squad on the scene. but that is about all we can tell. we don't know much more. they are investigating. you can see them suiting up the one gentleman who we presume has got to dangerous work in front of him. how many hits the dog got we don't know, all we know is that it alerted to something. again this is the delta cargo area, logan airport. we are making calls right now to find out exactly what they think is going on here and how big the

response is, and as soon as we know more you will too. in the meantime there is harsh new criticism of president obama's response in the midst of the gulf oil spill coming from bobby jindal. on sean hannity yesterday and glenn beck. here is jindal on sean hannity. >> this is absurd, his first visit he gets off air force one. he is clearly angry, they tipped off washington reporters to wafrp. he's mad about the oil, mad about a slow response, that's not it at all. what he's made about is he might look back. he's mad at me about a routine letter we sent the day before about all things, about food

stamps. he was so angry. at the same time he was getting mad at me rahm emanuel was cursino out by people. i said we are mad about the lack of a plan. megyn: he expanded on that on a radio show. >> the first visit down there, he pulls me aside in a publicity stunt he is angry. i can understand if he was angry about the bureaucratic response, the oil spill, the loss of life i would have understood that. that would have made sense to me. he was angry about a bureaucratic letter about food stamps. he said careful this is going to get bad for all of us. you have a white house and president more worried about perception and politics rather than actually cutting through the web tape.

susan estritch. they say the president is thin skinned and more worried about perception than about policy. >> why did bobby jindal wait until now, months and months later to say something about this? you know, megyn that is the part i didn't get. megyn: he's promoting a book, now. >> you mean he's trying to sell some books on barack obama. i am shocked to hear that. maybe he's interested in a little press, you know, i mean barack obama wanted nothing more than to stop the oil spill. megyn: do you think he's making it up? do you think the governor of louisiana is making up lies about the president? >> no. i think he's searching in his mind for a tidbit somewhere as most authors on the road today, you know, how do i come up with a tidbit that will have enough juice to it that i can get hanna

tee and beck and megyn and susan and everybody else talking about my book. you and i talked about this during the oil spill. i thought the president didn't do enough to deal with the perception issue. i thought he was too busy during the oil spill meeting with people and trying to do the right thing, but not paying enough attention to perception. you know, i mean he deals with incoming garbage every day, you know. bobby jindal's six-month little criticism i don't think carries much water. megyn: he's attempting to paint a portrait of a president who can't take criticism. he said specifically that president obama pulled him aside and said don't go on tv and criticize me. he didn't want him going on television and publicly airing criticisms of the president. maureen dodd, liberal hard left columnist for "the new york times." >> sometimes. megyn: she came out in i think june of 2010 and said this

president is thin skinned. that is just a fact. and some on the left say it's not the case, but is this further evidence of it? >> well, i don't know, megyn, you know i don't know him well enough to know if he's thin skinned. i will tell you based on my experience in politics, virtually every politician i know is thin skinned. megyn: they don't always do something about it. it may bother you to high heavens to have people criticizing you or saying bad things about that. george bush certainly went through that. i didn't hear him coming out and criticizing msnbc the way president obama does with fox, or sean hanna knee, or glenn beck. >> it gets you rating. megyn: i'm not complaining, it's an interesting phenomenon that we've seen with the president. >> i think the media has become a player in the politics of washington, and certainly fox news. i frankly think it's a waste of the president's time to worry about, you know, fox news or msnbc or anything else.

you have to worry about korea. the only point i would add, the only substantive point is that it is certainly the case that in times of crisis there is a long tradition across party lines, you know, you didn't hear me criticizing george w. bush in the days after 9/11, i mean there is something to be said in a time of crisis. megyn: how about after katrina? how about what? megyn: was president bush criticized publicly in the days after katrina? president bush, you know he was criticized and many say justifiably, others disagree. whatever your opinion he was criticized. the question is, you know this president when it was his turn and the gulf oil spill and men died he came out and he was upset that he was getting publicly criticized and telling the governor of louisiana, don't do it. >> but the governor of louisiana did it any way, lots of people do it, this president has been

south is bringing potential for more tornadoes. we had a report of eight tornadoes yesterday and a report of tornado for central smith county as well as jasper county in east central, mississippi. including the city of stringer. we are getting reports of damage, as the cell has moved eastward at 25 miles per hour. this tornado warning good until the top of the hour, megyn, warnings mean that we are spotting tornadoes, spotting strong rotation on radar or by trained weather spotter. our other big story, we've got a huge travel day tomorrow and we've got a big system across the west. let's switch sources. i'm going to show you blizzard warnings okay across utah, very rare to see much of the state of utah into colorado under a blizzard warning, but as we zoom out we have got blizzard warnings across six different states across the u.s. megyn: wow. >> reporter: what does this mean? we're going to see blizzard conditions for an extended period of time starting this

in the delta cargo area at the airport. these are live pictures. we've seen fire and police teams on the spot. we've just got even a report that the cargo area was being evacuated as a precaution. greg jarrett following the latest in our new york city newsroom with new details. greg. >> reporter: we can tell you that this is the harbor side drive area of the delta airlines cargo. so it's well away from any of the passenger terminals, and so far there is no word on whether any flights have been delayed or whether there are evacuations underway beyond the delta airlines cargo area. of course last month federal officials said that terrorists were attempting to send bombs to the united states in ink cartridges and shipped as cargo. so all of the major airports across the nation have been on high alert for their cargo areas. apparently a canine unit picked up a scent likely to be a potential bomb. the bomb squad is on the scene.

hamid karzai, and now what. >> reporter: he's a man named mullah akhtar mohammed mansour, a top deputy to mullah omar. this was supposed to be a promising step toward a substantial peace process. the talks were very much in their early stage and coalition and nato officials are now saying we were always ve vetting him, we were never sure of his identity. it looks as if they were pretty confident at one point. megyn: how does this happen? not surprisingly of course the taliban is celebrating saying quote the american and their allies are very stupid and anyone could fool them. this is from attallah ban spokesman. of course they are spiking the ball in the end zone saying look

how we duped the americans and others by having this guy meet with top officials about peace talks in afghanistan. one does have to ask, math thaourbgs how does it happen? >> reporter: you know there's never been any real success in penetrating the real leadership of the taliban. people don't know what they look like, their pictures aren't published. americans and british and other intelligence agencies have no idea what they look like. megyn: how did we figure it out? >> reporter: apparently there are two stories, one he either ended up meeting with people who knew who it was, who knew who the real person was and says this wasn't him. the other version of events told is they got suspicious and circulated people, the afghan government and they said, oh, no that isn't him. this imposter ran into somebody who had met the mullah akhtar mohammed mansour when he was in the taliban government here and they said, oh, no, that isn't

him. one afghan official told me today, maybe this man was a reufpt of mullah akhtar mohammed mansour, maybe he'll come back. maybe there is something there. megyn: maybe they were using this guy to test the waters as to what our settlement terms might be. let's hope it was at least that. matthew, thank you. a brand-new post midterm election poll shows support beer the tea party is growing and how. according to the usa today gallop poll 28% of likely voters want to have the tea party to have the most influence on policies the next year. that is exactly the same time as president obama should set the agenda. and it's way ahead of that republicans or democrats should set the agenda. what a long way shef they've come since this.

stone calls them crazy orin sane. they best not dismiss these people they are the real deal. >> if you advice president obama, you've seen the numbers come out, what do you tell him? >> hope for more division on the right. the proof is going to be not in the pudding here, the proof is going to be in the voting. and i'm really interested to see how those tea party members are going to vote when they have an r, not a t or an i next to their name starting in january. megyn: speaking of the numbers, and my apologies to our folks in the control room to keep having to put this graphic up. look at the numbers, it really does show, number one, they've got 28% who say president obama should set the agenda. tea party members have almost as much as 27%. 23% believe republicans should do it. 16% say the democrats should be setting the agenda in the coming years. the tea party does not support president obama's policies. there is no doubt about that.

when you take all the numbers today as president obama and the democratic agenda supporter what is the message you take away from it? you continue to sort of push forward with a left-wing agenda or try to moderate a little? >> you have to remember, megyn the overwhelming majority that voted in the last election that voted barack obama voted for the platform and the promises in his campaign that he made to be taken care of by the american people. some of the american people have obviously changed their mind because of what is going on with the economy. and i feel in the next two years as the economy improves we're going to see those poll numbers change greatly. as a matter of fact there won't be a tea party if we had a great economy. megyn: is that true, lars? the tea party believes like in government hands-off. it's not all about the job, the tea stands for taxed enough already. >> the real beauty in tea partyers is they believe in what the founders believed in a limited federal government, a

limited role of government in all parts of your life. hands-off as much as possible. small taxes, maximum individual liberty. the fact is these are all american values represented by the tea party. i don't care what leslie says. leslie, god bless you, this is a mess, your president promised all kinds of things, he's fulfilled very little of it and he's continued to screw up the economy. he owns this one now, and as many americans as megyn pointed out want the tea partyers to be making decisions as the guy who won the last presidential election. that should be embarrassing. megyn: the tea party may be having a bit of a honeymoon period, leslie because they did have significant victories in thisee hreb. now that they have actually got lawmakers that are tea party backed in the u.s. congress they are going to have to govern and make decisions on votes. what is the risk to them? what do they have to watch out for. megyn: megyn stop reading my mind i was thinking honeymoon

tpaoez. the tea party talks about less government. one of the ways we can reduce our deficit, balance the budget and turn the economy around is kitting huge entitlement programs, medicare, social security, et cetera. i don't think the tea party is going to do that, i don't think they can do that, if they do they'll see in two years being tossed out like the baby with the bath water because those are huge government programs, and that not earmarks is where a lot of reduction has to come in order to turn things around quicker. megyn: as soon as you suggest that in washington people go deaf. i don't know what you said even even entitlements. i've got to do. breaking news. authorities at boston's logan's international airport have evacuated a cargo area and about 25 staff after discovering not one but two suspicious packages. that's the first we're hearing that it's two suspicious

in the end, maybe as many as 6 million or more illegals. at its core the legislation would let undocumented immigrants who came to the united states as children become citizens. it's backed by the senate majority leader harry reid who during his tough reelection campaign solicited the support of hispanic supporters by promising a vote on the dream act. but standing in his way, republican senator jeff sessions circulating and opposition, called 10 things you need to know about the dream act. it's not limited to children, he claims, but adults up to age 41. he claims it prove sides safe harbor for any alien, i inincluding criminals. they will get work study programs. college preference will be given to illegals over u.s. citizens.

we are hearing strong words condemning a decision made by the developers of a mosque near ground zero. they want to use taxpayer dollars to help bankroll the building. >> reporter: there is a new anger and outrage over the so-called ground zero mosque over the plan for them to try and get federal taxpayer money to help build this project. here is a pot of $17 million designed to help revitalize slower manhattan because of the 9/11 attacks. they want $5 million of that. they intend to apply for that money. that's being condemned by several people today, among them new york republican congressman peter king. he's likely to become the incoming chairman of the homeland security committee.

>> first we want to figure outs what's happening here. is this asthma, is it a psychiatric reaction? could it be an allergy? if its is an allergy, what about an antihistamine, what about a mask. there is a lot to do to make the child comfortable. why is the child not having a reaction outside the school. megyn: would you care to cross examine? >> looking as the this issue many allergists have come forward and said there isn't an issue. suddenly if you smell perfume or cologne you will have this reaction. do you have agree? >> not entirely. there is an enzyme that needs to be checked. i would vote against it. i don't think it's likely at all. but it's easy enough. the burden of proof is for the

megyn: we get emails from people who say you have no idea what it's like to have an allergy. i had an asthma attack that nearly killed me from perfume sprays. >> the issue is we don't have proof this child is asthmatic. there isn't any medical corroboration this child suffers from a disability and would be protected under this law. dr. seeing sl touched upon its. there are so many factors here. it could be psychological or asthmatic. fit is asthmatics and life-threatening then the school has to accommodates. what about the children with peanut allergies? they go through shock and the schools have no peanut rules. it looks like an offensive odor, not something that's life-threatening. megyn: the school has to provide a reasonable accommodation. the school says it asked kids
