chief among them arizona senator mccain who had some very strong words for democrats, just yesterday. >> american people said just 42 days ago, enough! are we tone-deaf?my+(] are we stricken with amnesia? what is going on here? >> sean: senator mccain has released the so-called top 10 pork barrel projects in the bill. they include $350,000 for swine waste management in north carolina. $165,000 for maple research in vermont. over a million dollars for cranberry and blueberry research in new jersey. $413,000 for peanut research in alabama. $125,000 to buy fishing equipment in guam. today we learned that congress's approval rating has reached an all time low, 13%. the scary part about this number is that gallup conned the poll before this bill was unveiled. -- conducted this poll before

political cowardice. they didn't want to take the votes before the election. by the way, we have no budget. there's a billion dollars in this pork barrel bill to start implementing obamacare. again, in direct contradiction to the votes of november 2nd. it is really -- i think this is a seminole moment. i say to my republican friends. they gave us a second chance last november. you saw the approval rating of congress is down to 13%. they gave us a second chance. if we republicans allow this to go through and i'm not sure they are gonna give us another chance. >> sean: president obama was elected. the first omnibus bill had 9,000 earmarks in it. let me play president obama on the campaign trail. you may remember some of these highlights. >> our earmark system, what's called pork barrel spending in washington is fraught with abuse. it badly needs reform. i pledge to slash earmarks by

handful of powerful senators, who are appropriators. without the input of any of the rest of us. none of the authorization that of that comes from the various committees, jammed into as you mentioned whatever it is, 2,000 page -- 1,924 page bill. then presented to us. not only violated all his other pledges but he has refused to tell the democrats to have some transparency and -- about this -- it is real an an egregious process. >> sean: is this bill going to pass, senator? >> right now i would say that it may, because we have five or six republican senators who may vote for it and a bunch of department dats obviously. if the american people speak up. if our tea partiers get going. come on up on my website, facebook, twitter, tell the democrats and republicans in congress to stop this.

earlier today the senate overwhelmingly pass the tax bill with an 81-19 vote. now legislation is passed on to the house where it could hit a major roadblock. president obama's political clout has been hit hard by

house democrats furious over the so-called compromise. it is not just his friends on the left who are unhappy. house republicans are also split on whether or not to support the bill. incoming house budget chair congressman paul ryan said the bill must pass one way or the other. >> this is better than the alternative. the alternative is a massive tax increase. there's a lot of stuff in here that i don't like. of this pack can the mass majority of republican tax policies. >> sean: not all share congressman ryan's position. michelle bachmann introduced legislation that would make the tax rates permanent while repealing death tax and gift tax and joins us to explain. welcome back. >> always great to see you, thanks. >> sean: you are against this legislation? you are going to vote against it? >> i will be voting it. again, the legislation is not paid for. the problem is spending that is not paid for that is adding to the deficit.

it is an excess of 800 billion dollars. it also blows a hole in the social security trust financed of about 100 -- 110 billion dollars in addition to the 57 billion we will be paying out in unemployment benefits. >> sean: pence is against it, king, a lot of conservatives have come out it. i might have a dispute with you over the 800 billion. doesn't that include the projected income revenues by raising taxes? >> yes, it includes continuing the tax rates as they currently are, which says again, we need to cut spending. we all recognize that's the first priority. i'm for expend the current tax rates. that's a good thing. in fact, i would like to drop them even below what they currently are. what we want do is add to that mix of increased spending by blowing a hole in the social security trust fun. and by adding to the

unemployment benefits additional 57 billion dollars. what it would do, is have us say to the voters that voted clearly and forthrightly in november that at this point we still aren't listening. >> sean: did we get an answer what came out of the senate bill? were the ethanol subsidies thrown in, the final one that voted on? were the rum subsidies in there? has anyone had a chance to read this? >> that's part of the problem. that's what people were furious about in november. they want us to chain the way we do business here. they want us to have committee hearings in the open. this bill neglected to do. this is all fashioned behind closed doors. we get this, we aren't able to read the bill. yes, i understand it still has the ethanol subsidies. >> sean: your bill you proposed today. you would make the tax cuts permanent. eliminate the death and gift tax. do you have enough support to

get in bill? i now congressman pence in the house and senator demint they have a bill that would make the tax cuts permanent. there's no chance nancy pelosi is going to allow that vote to take place on the floor, is she? >> very unlikely. my bill would also keep the -- lower the corporate tax rate from the current 34% down to 25% that. would be a huge inducement for creating jobs here in the country. we need to have a pro jobs piece of legislation not what president obama is putting forward. >> sean: is any republican gonna support this pork laden, lard-filled omnibus bill that the senate is pushing today? >> i haven't heard of one republican in the house that has any plan to support this bill. i would highly urge any of them not to. this is a terrible vote. it is 1.1 beyond, as you said,
