guessed this would happen. a bombshell just dropped in the senate massive nearly 2,000 page omnibus spending bill now dead. harry reid did a head count and does not have votes to push the bill through. karl rove joining us live. who would have guessed this would have happened tonight. your thoughts that the omnibus bill is dead? >> harry reid went out and blamed republicans for its failure. i wish it was all the republicans' credit. there are 42 republicans and three, bennet of utah, bone of missouri and voinovich of ohio all three retiring indicated they would vote for omnibus. reid was unable to do it because he had defections inside the democrats, at least two on public record five or more thought to be -- to have told reid they could not vote for this bill. reid had this come down because the only thing bipartisan about this bill was

the opposition to it. >> greta: interesting, two issues i see. one substantive, whether it is a good bill. two, the process. first the process. it was dumped on everybody about 36 hours ago. it is about 2,000 pages. essentially we are back to the health care stimulus situation in terms of process. people are asked to vote on this important bill, no one had a chance to study it and make sure waits a good bill. >> right there's a bigger failure of process, we are over two months into the fiscal year, not a single one of the 13 appropriations bills has been passed by both houses and send to the president. i'm not aware of a single one that has passed either house. we are funding the government not through the normal order of budget process with careful examination of appropriations bill. you are right they are trying to wad this up on the eve of christmas jam it through threatening people if they don't vote for it, they may be

stuck here for christmas. harry reid strikes me as sometimes he has a weird sense of humor. i never thought of him as the this is the guy who tried to steal christmas this year. >> the government will be unfunded unless they do a continuing resolution quickly. as of this week unfunded meaning government would shutdown. let me read a portion of secretary of state clinton's statement before the bill was killed. she said the omnibus provides critical funding to achieve our key national security objectives in afghanistan and pakistan. provides sufficient funding for transition in iraq this is something that should have been done before october 1st, when the year started. all these important things she is talking about is because our senate didn't do its this is the first time since 1974 that the house of representatives has failed to meet its statutory responsibility of passing a

budget framework typically done in february, march at the latest. huge failure of the congress to deal with the budget in a responsible fashion. continuing resolution of senator mcconnell the republican leader suggested one that would go to february 18th, would fun the government through february 18th. these things that secretary clinton was talking about could be done unthat continuing resolution. this was sort of one last desperate attempt by her to try to influence in a positive direction. sort of like, if you don't do this, everything bad is going to happen. the government can be funded by a continuing resolution. they've already may the mistake by allowing us to get into the fiscal year that started october 1. we into the fiscal year without a budget. >> greta: just a process. they want to scotch tape together some continuing resolution to keep the government going because they didn't do their job. what in the world did we send them to washington for?

they wanted to duck this because the election was coming up. if they are not going to do their job or try to shove it down people's throat we don't need anybody to make decisions if no one is going to look at it. >> you are right. let's not compound the failure by rushing through a budget bill that nobody has had a chance to read and few have had a chance to examine and discuss. and nobody knows what the real implications are. at this point having messed this up so badly earlier this year, the best thing congress could do is give the government a continuing resolution and give the new congress, which starts january 5, a couple of weeks or more, in this instance it would be six weeks to get in pass it, pass an omnibus bill that passes the smell test or do something with appropriations bills and cover the rest with a cr or some other form of funding. >> greta: now the substance. senator mccain came out tonight, and the republicans are gloating to some degree,

about the fact they have aborted this omnibus bill. he gives thanks to the tea party movement. there are 6,000 earmarks. how influential, if at all, do you think the tea party movement has been to kill this bill? >> i think enormously important. not just the tea party movement which is like this size. but the tea party sentiment. people who never joined a tea party group but share this view that the government spending is way out of control. this is clearly what dove the election. it is clearly driving these democrats from red states like nebraska and missouri and north dakota who are saying i can't vote for a bad bill like this. they know in 2012, the meant about reining in government spending is going to be around. >> greta: that's the news in the senate just breaking. the omnibus bill is dead. they have to figure out a way to fun the government or we close it down this weekend. now the house side. right now they are debating

the tax extension. that seems to be a little bit of a mess. >> yes. earlier today the house democratic leadership was prepared to bring the bill to the floor. in order to do that in the house of representatives you have to have a report from the rules committee, a procedural question that defines how this bill is going to be considered? what amendments and what the implications of those amendments were? congresswoman slaughter of new york in close cooperation with speaker pelosi came forward with a rule that would have said you can vote for the democrat alternative on the estate tax. if you do in essence that passes the bill and sends it back to the senate. all heck broke loose with democrats saying we don't want to be automatically on record as supporting the bill even if we vote for the change in the estate tax. they had to go back to leadership. the leadership had to figure out how it was gonna be handled. they've got a new rule. now that procedural rule has

been passed by a margin of 214-201, now the house has taken up the substance of the bill and will consider an an amendment by earl pomeroy, democrat from north dakota to make what will at the end of the day, affect only a difference of 3/10 of 1% of the estates in america. but will jack up the tax rate on it and lower the amount of exclusion all for the purpose of sort of scoring points again the wealth any in america and penalizing people who have been in my opinion, saved and created over their lifetimes and paid tax on every bit of their activity and now are going to be taxed a second time for the simple purpose of grabbing revenue when they die. >> greta: what is going to happen in the house? is this going back to the senate? >> i think pomeroy goes down. amendment goes down and they pass the the senate bill in is

not a guarantee this is somewhere less than 50/50. lessc8af likely alternative is they pass pomeroy and send it back to the senate. i don't think the senate is going to adopt it. so we are going to be at loggerheads there. another alternative pass the pomeroy amendment, it back to the senate and cave. i find that unlikely. most likely outcome they end this process. there's a new fox poll out showing that by a margin of 68% of the american people support this tax cut compromise. abc at 69%. pew a days ago 60%, bloomberg 69. gallup 66. all polls similar to fox. in the fox poll, republicans, independents and democrats were all between 67 and 69% in support. if they reject the american people on this, particularly this late in the year with all the ramifications this has for january, if we don't get this

tax situation solved everybody's attacks are going up on january 1. even if later in the year we are able to pass it and make it retroactive people are going to pay more than they should pay particularly people at the bottom end of the scale. >> greta: we'll be watching this happening now in the house of representatives. a lot of activity a lot of intrigue. very important to all americans. karl, thank you. >> thank you. >> greta: republicans are declaring victory. almost gloating about killing the omnibus bill. are the earmarks a bipartisan addiction that could bankrupt all of us? governor huckabee is next. nikki haley just had a meeting with president obama and hit him with a tough question.

the spending bill. is senator mccaskill right are politicians across the board addicted to pork? governor huckabee joins us live. good evening. republicans are gloating about this win. >> they should be. this was a big victory. not so much for the republicans. it was a big victory for the american people who overwhelmingly said november 2nd, stop the spending. the earmarks not going to change the big picture of the budget. but it was an important vote to say we are listening to those people who threw the democrats on our their rear ends november 2nd. i thought it was an important vote. claire is half right, claire mccaskill. have historically been just as guilty coming up with their snouts to the trough. >> greta: she has been up front saying she doesn't like the earmarks. >> earmarks are not inherently

bad it is the process. if you are transparent, if you can defend them if you put them up front and let them go through a full hearing and get debated. and you can successfully convince 99 other senators that having something dedicated to the forever memory of john murtha for a public service center is an important use of taxpayer money, that's one thing. that is not how it is done. it is slipped in. put in some big package. so you have to vote for the earmarks in order to vote for making sure the soldiers are gonna get their next month's pay. >> greta: can we admit that business about transparency is a big fat lie? when you dump a 1900 page bill, and say now vote for it. can we quit lying to the american people about transparency? >> there was no transparency here. it was interesting the senate was going to be forced into reading the bill it was going to take 50 hours reading

through the night. >> greta: we would have had a better shot they would have read it, although the chamber was empty probably. >> one of the things i would love to see the congress do is what florida does. every expenditure is posted on the internet. anyone can see it. >> greta: how soon before the vote? if you put it the last minute, if you have to vote five minutes later it is not transparent. >> president obama promised during the campaign there would be nothing that would be done without a five-day opportunity for the public to review it. if he keeps his promise you would at least have five days. >> greta: can he force the house and senate to do that? >> he might not after january. he could have when he had the house and senate in his party's power. the bigger picture is, why wouldn't the republicans go along with him on that? >> there's some sort of undercurrent noise about the senate and house might have to

stay a little bit into the holiday and their vacation. i thought with 9.8% unemployment, you didn't do your job, this was due october 1st, and you didn't do the business on the tax bill for 10 years. i would be ashamed to suggest -- of course i would work through, i didn't do my job. >> my dad was a fireman he worked every year christmas day. we had to celebrate christmas eve as a result. these guys are like college freshmen who have gone to all from parties and they do all nighters and drink 10 cups of coffee all night and brag about how hard they worked. the first part of the semester until the last week it wasn't that much heavy lifting. >> greta: i think it is almost worse. i think it is done for a cowardly reason. because they didn't want to take a hard vote before the election. it is even worse. not like we were busy doing other legislation. these are the tough votes, taxes and spending. they didn't want the

constituents to know what they were going to do before the constituents went to vote in november. >> we have this contempt of a lame duck session. i believe that as soon as the elections are certified, that congress should cease as of that moment. a lame duck session is begging for trouble as we've seen in these last six weeks. the right thing to do is after the election you fire this congress, all who lost their election they pack up, go home and the new congress starts much seener or you have a period where everybody goes home and the people sigh a great sigh of relief. >> greta: government unfunded unless they do a continuing resolution. now all sides will be talking to each other because they don't want to be accused shutting down the government. >> they will end up with the continuing one payment resolution. they did it every machine they keep passing a continuing resolution. they have to. >> greta: i would be embarrassed.

good evening, sir. today you and the federal government slugging it out in federal court. about this health care law you want it declared unconstitutional the judge said if congress can do this because it is for everyone's benefit with why wouldn't they be able to make you buy and eat broccoli to stay healthy? >> i thought that was a great kpwhpbt. it does show he -- great comment. i does show he may be leaning our way. the argument that the justice department has in favor of this mandate that individual has to buy a health insurance product or pay a penalty. somehow by sitting there doing nothing, by not buying insurance you are affecting the economy. you are effecting everybody else in the cost of health care and so on. judge vincent said if you you are gonna say that, there are a lot of other things you could say that the federal government could be or should be aowed to order to you buy

or purchase as a product that might improve everybody's health. and he used broccoli as an example. i think it was that kind of day for us. as the arguments progressed at one point judge vincent said isn't this a giant expansion of the commerce clause? just quotes like that throughout -- sort of leads us to believe he's going to rule the individual mandate unconstitutional. but we haven't seen that yet, that's what we hope. >> greta: i'm mindful of the times that i've been in court over the years and i've heard questions that i thought was favorable to my viewpoint very happy and walked out only to learn a month or two later i was not successful. the questions were to brian get more information, not necessarily to suggest a view point on the final analysis. >> that's right. you can't be sure of anything this is a judge who has been thorough. lots of prepared questions today. this was not where he went in and let counsel just argue.

there were three. he asked lots of questions the judge did again and again. allowed the argument to go longer than the two hours originally scheduled. i thought we had a good day on the tougher of the issues. we talked about the question of the constitutionality of the medicaid provision whether or not state be forced to pay for this expanded coverage in this law. i thought again, our side had a good day by explaining there's an elephant in the room. there's a huge new provision in this law that we've never seen before involving the requirement that the statements -- that the states provide health coverage every bit of health service has to be there not just paying benefits. nobody knows how much that is going to cost or how much litigation is going to be over that. are they coercing the states or not? >> greta: monday the federal judge hudson in virginia in a separate lawsuit, you have 20

state in florida bringing suit, that case is nonbinding on your courthouse at all, your decision. was that decision mentioned at all by any party or by the judge today? >> it was mentioned by the parties counsel on both sides mentioned it from time to time alluded to it. on our side we talked about the fact he supported the position on the mandate being unconstitutional. they but up the severability question. the judge had another comment, again you never know. he twice raised the example in the issue of whether or not this is severable whether you can break off the individual mandate from the rest of it and not take the whole bill down of a swiss watch. he talked about the complex parts. if one part isn't working and it is the key to the rest of it, then the watch won't work. i think he's at least thinking seriously, judge vincent is,

about whether or not to chair the entire law unconstitutional or larger portions than judge hudson did. >> greta: even on that point, if he were to declare the mandate unconstitutional and if he were to sever that out and say the rest of the statute is constitutional, since that is so important in terms of the funding, i can't see how that wouldn't ins sense gut the whole statute that's how you lower the rates for everything else if the mandate is in force. >> right. no way, as we pointed out you can have part like the mandate go and not have insurance provisions collapse and several other portions as well. at the end of the day this is going to be a case when decided it is about individual liberty and state sovereignty. the judge gets that. he does care about those issues. he's also competent federal district judge been on the been. a long time. he's going to make sure he's comfortable with whatever his ruling is.

exchange with president obama and asked him a blunt question. good evening governor elect. >> hey greta, how are you? >> greta: well. what was the question about health care? >> first of all, he sent the press out of the room. he allowed a one-on-one conversation with all the new governors. i appreciate the fact he allowed us to ask any question we wanted. i told him south carolina could not afford obama care. south carolina businesses could not an for the mandate and i asked if he would repeal the law? he said as long as he was president he would not. i believe in not just saying no but giving options. i asked if south carolina gave options whether it be tort reform, whether it would be making sure we reformed medicaid or allowed insurance to cross state lines all those type things would they allow us to opt-out? he said yes if it met three parameters:

having a state exchange, allowing us pooling and dealing with preexisting conditions. >> greta: let me go back to the first part when you said the state of south carolina can't afford the mandate? he said no. did he say here's how you can pay for this? >> no. he actually was very adamant and just said no, as long as i'm president i'm not going to repeal the law. i told him the citizens could not afford it. the businesses of south carolina could not afford it to add those types of rolls on the medicaid program was not something we could sustain. i needed to lead and find another way out. >> greta: if it isn't repealed and you can't afford it and there are no other options on the table that he is accepting that you have offered what happens to your state? >> a couple of things. i think every governor as we

see we are losing faith in congress it is up to our governors to step up. i'm supporting my attorney general and his fight to make sure we repeal the obama care statute. i think i won't stop until we see that happen. second, also make sure i have asked my federal delegation and they've agreed to not fun obamacare we are going to try to push it to 2012 to not tpupd it. third, since he's given -- to fund it. third, since he's given me an option, to fan a market-based solution to allow the citizens to control it and opt-out and give him every option we can. we are not at a point where we can say no we need solutions to make them understand these types of situations are best handled by the states. we don't need the government to mandate on individuals of our state. >> greta: do you have the sense he was list and considering it? or was he drawing the line in the sand and saying tough luck,

go home and come up with a better idea if you come back with it great? do you have a sense he had a true understanding of the financial pressure on your state? >> he certainly drew a line in the sand on repeal. it was adamant and very matter of fact. when i asked him if which could opt-out there was a pause and look if you can come up with this, i will talk to you blood pressure. he saw what happened in november. it is the job of the governors to give options. i'm going to do everything i can to make sure we have options. i don't individual mandates. i want market-based solutions and allowing companies to cross state lines so my citizens have every options available. >> greta: the idea of everyone being in it was to reduce the cost for everyone. since october 225 companies or unions have been given the right to opt-out. they've been given waivers. if your state was given the

right to opt-out now we are getting less and less people buying this mandate so it is dismantling this health care or not going to help bring down the cost across the nation. do you agree? >> i think as elected officials they need to remember who they work for. the people of the state and the country. the people of this country had a mandate in november. she said we don't want increased spending, increased taxes and we want our freedoms and liberties. it is the job of elected officials to listen. what we saw in november was a clear mandate on the fact we done want extra expenses on our states. clear mandate to say stop the spending. certainly a no health care. whether a republican or democrat. it was individuals saying we want the right to choose. i think it is up to the governors to say we are not going to allow this to happen. we can handle this through solutions on our own. it is our job to protect the liberties of people.

i think president obama should admit this was a mistake. step back and tell the people this was a mistake and start over. >> greta: give me a thumbnail sketch what is the economic status of your state as you take over do you owe? >> i are going to see a billion dollar shortfall, a 20% shortfall for our state. we are seeing numbers that we've never soon before -- never seen before. unemployment numbers that are 10%. hard cuts across the board. i love the opportunity we have with that. allowing us to go back to the basics. say what is the role of government? government was intended to secure the rights and freedom of the people people. never intended to be all s to all people. every governor should step back and say what an opportunity we have to sit back and look at every agency and say what do we have to have appear work our way up?
