there it is. was this necessary or way to extreme? we report, you decide. >> heather: and the first, count down on capitol hill. time is running out for the super committee to find a way to cut $1.2 trillion from the federal budget over the next ten years. so far-reaching a deal by tonight, it remains elusive. nobody is closing the door on negotiations but the prospect of failure in the nation's capitol is looming larger. that is where we find molly henneberg. >> molly: multiple sources tell fox there have been discussions how to wind down this super committee without a deal. there is hope one aide says, but the timing is getting tricky. super committee members to have vote on any deal by the last tick of the clock on wednesday night. before they can vote two things have to happen. number one they have to get it to the congressional budget

committee. budget office or cbo to estimate the deal's effect on the deficit. >> then number two, the super committee by law has to have 48 hours to go over the cbo's calculation. that means they have to get to the proposal to the cbo by tonight or tomorrow morning in order to get it back by monday night and get the 48-hour clock ticking. all that is moot if they can't reach a deal. based on what they said this morning, they don't see very close. >> republicans offered both entitlement reform and tax reform but we thought we could thought there could be a could lessens over the savings which amounted to $640 billion, democrats were not willing to cut a dollar without raising taxes. >> we are not a tax cut committee. we are deficit reduction committee. the extension of the bush tax

cuts is a huge tax cut for the wealthy at the extension of the average person in this country. we think that is wrong. if they will take that off the table, we could have a $1.2 trillion agreement by tomorrow morning. >> molly: despite differences, neither side wants to be seen walking away from the negotiations or giving up too soon. >> heather: it's turning into a super super mess. and racing to finish a deal, taking a look at the political stakes were our panel. that will come up a little bit later. >> gregg: a fox news alert. protestors still out in force this hour in egypt's tahrir square. you are looking at live pictures from the square. a huge number of people there. some of them chanting. others standing around and waiting for something to happen. no visible signs of violence

yet. police launching a major assault to evict protestors camped out. three people died in the attacks. they have been calling on the ruling military to announce whether it will transfer power to an elected government. they joining us on the phone from cairo. we were showing live pictures. talk to us about what is happening now, what is expected to happen over the next several hours. >> reporter: iust came back from tahrir square where the battle is still raging on the streets between cairo square and information ministry. i saw police firing tear gas and beating protestors. over the last two days, i saw wounded people going into a makeshift hospital. i saw people run back to the square fighting for their freedom. i saw swimming on the streets,

during the iran uprising. iran is a rogue state outside the system. getting $1.3 billion a year. it's america's funding to crack down -- israel is big part of this. israel is seen as a democratic agent. they know they would not tolerate constant atrocities. so pushing for democracy in egypt and elsewhere in the arab world or sponsoring state terror across the arab world, israel is free to commit war crimes without facing consequences. of course, the suez ka ka natural and silence over american aggression in places like iraq. americans have interests in

over power to civilians by september and it didn't happened. they postponed for ratification of a constitution and election of a new president sometime in 2013 or later. then the military essentially gave itself control over civilian politics in that proposed constitution. now as we look at these things, is this a classic example of how power corrupts, especially when the military begins to entertain rule? >> absolutely. gregg, especially when the protestors are not united, that is the secret here. what we envy egypt three forces. one is the military council that controls the government. two, the islam i can muslim brotherhood. three, the young civil society we see on the streets. what has happened over the past few months, the islamists want a

transfer of power to an islamic state and seculars want it to a secular state. the military is playing once against the other. we have seen on friday that seculars are telling the military you have to transfer power to a secular democratic government. >> is it possible that the egyptian generals will try to exploit this and welcome all the chaos in the streets as a pretext to can sl elections which are scheduled to begin on next monday and run through march. might that move, if it happens, ignited an even larger egyptian revolt? >> it would be likely the ministry is going to cancel the elections but the problem is not going to be the legislative elections. the problem is twofold. one is constitution, what kind of constitution. two, the presidential elections,

who are the candidates. the military now has taken advantage of the fact that those that are protesting are not united. those on the streets today are basically the secularists. but as of friday they have cut a deal with the military and if you give us what we want, you could let those demonstrators for a few more days and few more weeks and it will be over. >> gregg: do you worry about the muslim brotherhood gaining control? >> they are gaining control. they were very smart. they convinced them to go ahead and start a demonstration last week. by friday they withdraw from the square. so you have the young men and women who are confronting the army and the armed forces and most others are standing on the side waiting for it to be over. >> gregg: what would be the best solution here? should the military cede power once a parliament is elected and

while the constitution is still being drafted. is that the best case? >> absolutely. military council should declare that they are going to go for the legislative elections. that they are going for the presidential elections on a specific day. that they are going to transfer that power to another wing of the election. at the same time the international community must partner with civil societies on the ground and make sure they have a say in the election, legislative and presidential otherwise we're going wind up in libya. >> we're seeing this night after night, hour after hour. the elections begin in eight days for the parliament. the trouble is, it's not a one-day or two-day election. it runs in various stages through march of next year. maybe, what about this scenario -- could a civilian council serve to provide some interim leadership and take the heat off the military and how

might that council be formed? >> the nation will be ready to disband this government and form another one, called a transitional government. the civilians on the ground are going to request they will be represented. muslim brotherhood will do the same but those that are going to have real power are going to win the elections. muslim brotherhood are the best organized and therefore they are going to be majority in the parliament. >> gregg: screen left, cairo egypt we are following the violence on an hourly occasion in syria. let's switch to that. defense minister who used to be the prime minister says that syria's president assad has reached a point of no return. that is a quote. he says he faces the same faith as saddam hussein, moammar khadafy. in fact he says assad's regime

will fall within months. is he right? >> look, his projection is that there is no going back is correct. the syrian people are like in the '80s are determined to get assad out of power. the problem who is going to held syrian society. we pressured the militarys in egypt and tunisia people. we withdraw from iraq in a few weeks, the iranians hero challenging us will be linking up with the syrian regime. that is what assad is waiting for in a few weeks from now. >> gregg: thank you very much for your insights. >> heather: back at home, police in washington state appear to be at a standstill in their search missing toddler. he vanished nearly two weeks ago. bellevue police hope that newly

released photos of the child may reveal his whereabouts. those photos are revealing a different side of sky's mother. so laura what is the latest in this case? >> frustrations have definitely been mounting as the boy's mother has refused to take a lie detector test and refused further interviews. investigators say the mother's account of what happened that day have fallen apart. the bellevue police department releasing new photos of two-year-old looking more like he would today. they say the more recent shots will spur more tips. the mother gave police to help her find her missing child and glamorous blonde. they look strikingly different.

it shows her with much darker hair, wearing a gray sweatshirt. these photos are more accurate the day she disappeared. they told police she left him alone in the car on the side of the road after her vehicle ran out of gas. when she returned, she says her son was gone. the police said the car had plenty of gas. >> when i first saw the pictures pop up, i thought they were the wrong pictures. is it true there has been an intensified search this weekend for the boy? >> there has been and it's because of the photos we've been showing to you. we want to put them back on the screen. it is a much different looking picture. new photos released by police generated more tips which led search teams to a heavily wooded park for the very first time. nearly 2300 tips have poured in

since november 6. police say they won't have to go far to find this boy. >> our investigative efforts have led us around the globe to find this disappearance, so far we don't have any reason to believe that the answer lies any further away than our own backyard. >> reporter: if you have any information you are urged to call the bellevue police department. >> heather: hopefully someone will call and we will bring the boy home safely. >> gregg: a horrific scene at a college football game. police releasing new information on that deadly tailgating accident at yale university. we'll have the very latest coming up. >> heather: plus, the streets are filling up with shoppers hoping to get a jumpstart on the holiday sales. hold on -- a backlash against black friday. retailers are fed up with the whole ordeal.

police now identifying the victim as 30-year-old nancy berry of salem, massachusetts killed when a u-haul truck slammed into her and two other tailgaters. one student remains hospitalized. a harvard employee treated and released. >> i saw it coming in. they with pin balling coming in. >> we thought it was an accident and you saw all the people laying on the ground. >> gregg: police have not yet released information about the u-haul driver who is in custody. >> heather: switching gears. the holiday season, shopping season is almost upon us on new york city streets. like this one right here. that is a live shot. it will be packed with people looking for good deals. there should be plenty to go around on black friday. some stores apparently have

sorrowd on the idea. brenda butner joins us. first of all, i have to ask you have you participated in any of those sales and gone out at 4:00 in the morning? >> never. >> heather: i don't know who does? >> i shop in my pajamas. >> heather: online. you don't go to the store in your pajamas. [ laughter ] let's talk about the backlash. a lot is saying enough is enough. you have walmart opening up at 10:00 p.m. on thanksgiving night and toys 'r' us at 9:00 p.m. and target there are pushing by the employees we want a thanksgiving. we want this holiday. we don't want to work even though they are getting paid overtime. they are upset about that. the stores are trying to make a

margin. it's been tough for them. this is most important sales time of the year for them. you can't blame them either, but there are a lot of them, sears last year open from 7:00 to noon. i guess when you are supposed to put the turkey in. thanksgiving morning and it does them no good so they won't be involved in any of this year. a lot of stores are saying just forget it. there are some stores that won't do it. like nordstrom's one holiday at a time. >> heather: and this particular shopping str season they are making $465 billion in sales. that is only about a 2.8% increase over the last year? >> i mean in this tepid recovery

that is not bad. 2.8% is okay. any kind of gain over the last year will be all right. it will mean more hiring of temporary workers. so it's not anything to certainly to shrug your shoulders over. >> heather: it's not just the employees with expressing dissatisfaction but it's the customers, as well. that may be a little disenfranchised with the big box retailers forcing it upon us early. >> they don't have to go. >> shop in pajamas like you? >> that is the thing about the free market. they don't to have go. i suspect that walmart may be busy that night. >> heather: they feel like they are going to miss that big sale.

fire to protestors' tents in tahrir square and they are chasing people away. they are calling on the military to transfer power to the people. we'll have the latest on the developing story from egypt in tahrir square as it continues. >> gregg: well, you might say the witching hour is fast approaching for the super committee as the clock ticks down. optimism is fading. aides are saying the bipartisan panel is likely to announce tomorrow failure. let's bring in our political panel. kirsten powers. justin former spokesman for jeb bush. justin let me start with you. you saw the nokt porls poll,

three-quarters of americans including by the way more than half of republicans say they believe that any debt reduction deal should include tax increases. question, are those in your party who oppose tax increases on the wrong side of this issue and aren't they handing president obama a winning issue politically? >> well, governor chris christie said leaders don't read polls, they change polls. republicans have the belief that now is not the time to be taking more revenue from the american people. now is the time the federal government needs to get the fiscal house in order and reduce spending. that is the question, you asked is regarding the politics of this issue but at the end of the day, american people will recognize there is one party that forced the deficit reductions to take place. those are the republicans in congress and specifically in the house of representatives. there is another party that

basically been very complacent about the fact we have $15 trillion federal debt. >> gregg: for the longest time republicans rejected any kind of a tax increase. all of a sudden in the last three weeks they had a change of heart. they tried to compromise by offering a deal with 24 cents of every dollar in savings coming from tax inincreases and other 76 cents coming from cuts. democrats rejected it. is that a mistake? >> its mistake for them to not reach a deal. if there is a way to meet them in the middle it would be a mistake. i think i love the question that you just asked, the if you are question. i thought the answer was a little interesting, it doesn't matter what the american people think, that three-quarters of american people think we should be raising taxes. they think we should be raising

taxes what the republicans said. >> gregg: my point to you, so republicans did agree to increase taxes and democrats said, no, not good enough? >> i don't think it was necessary. >> gregg: a little greedy on it? >> no i think in order to pay down the deficit, whether you want to raise taxes or not. i don't think people want to raise taxes. it's just a reality. there are so many cuts this that you can actually do. because of where we are, we need to raise taxes. i don't want my taxes to go up, but i want to be paying interested on our debt. >> gregg: if a deal is not reached automatic spending cuts will kick in. now it's looks inevitable and maybe failure is good. take a look at cbo estimates. the automatic spending cuts that will be triggered. domestic programs 7.8% cuts.

defense programs, 10% cuts, medicare spending 2%. total savings, $68 billion then more savings in years to reach that $1.2 trillion. giving the huge spending increases, one can argue those automatic cuts are not at all excessive. so if the choice is between tax increase or these automatic cuts which i just identified, hey, why not the cuts? >> well, from made perspective i agree with that perspective. i believe that even if the super committee's efforts result in lack of an agreement, i have to commend them for the hard work they've done. ultimately the negotiations that have taken place, even if they are not successful will yield a result or yield agreement maybe in the coming session or coming months on other larger deficit

reduction. however, as you pointed out, even if they fail there will be $1.2 trillion of deficit reductions. i have to say thank you to the house republicans who forced that issue upon president obama who wanted a clean increase in the debt ceiling of the united states, but the house republicans insisted that we get our fiscal house in order so we can avoid the fate of greece and other countries in europe that are having a debt crisis right now. >> gregg: "wall street journal" made the argument about the automatic cuts. they say it would not be onerous and domestic programs received $300 billion windfall under the stimulus. so it would take back a little more than one fifth in 2013. even if $1.2 trillion cuts, total discretionary spending would still rise by $83 billion.

doesn't failure by the super committee actually result in success in cutting the debt? >> you mean because of the trigger? >> gregg: yes? >> either way it's going to be $1.2 trillion, but the bottom line $1.2 trillion really isn't enough. that is sort of the point. we have all of this lead-ups, that is nothing. it's not going to solve the problem whether they do it through the super committee or do it through the triggers. >> gregg: we're going to spend $44 trillion and we're already $15 trillion in debt. you may have the winning argument right there. thanks for doing that. >> i agree completely. >> gregg: you get to join in on the winning argument. good to see you both, thanks so

much. >> heather: fox news alert, a new party winning elections today in spain according to exit polls, spain is the euro zone's fourth largest economy but the new government is facing the task of moving the sluggish economy forward. spain is seeing its share of financial problems that could have drastic consequences on the global competent. gregg burke is streaming live from madrid. >> reporter: that is right. the socialist party candidate is actually just conceded. now, we're expecting to come to the balcony the winning candidate from the popular party. it's the end of the era. socialists have been in power for eight years. now popular party taking over in spain. popular party says it has one goal. they may be celebrating tonight and celebrating in a big way but

one goal to get spain out of the economic crisis and especially to do something about unemployment. it's currently over 20% in the country, that means about five million looking for work. the man at the moment is mariano hoy. he lost twice before. he is a longtime party activist. people say he doesn't have a whole lot of kha arise ma but he is up to the challenge. spain's challenges are many. they have to worry about unemployment but also the international markets. spain in the last couple weeks has seen the borrowing rates shoot up dangerously high. that could put it in the likes of greece and portugal. that would be a problem with such a big economy. finally, the spaniards, tonight is going to be a very late one for the popular party

is it social commentary? >> i think it's social commentary. if they are using an image, i'm not a lawyer, but using an image to try and sell something. >> they are doing this for shock. in fact, it's been very effective in the past. they are putting the shocking ads hoping for a better day. i think they are going to have a bigger problem, what if somebody issues something against them. >> and you need to get people to talk about the clothes, you can talk about you because they are running the ads. >> if they are offensive to people and they are, they should be pulled or just boycott the company. >> they have an ad on the west
