start of the war in afghanistan and this is so unusual because we hear about a lot of drone strikes that happen to go wrong. this was helicopter and fighter jets and we haven't heard about incoming fire from the pakistani military. this is huge news, in terms of this already damaged relationship. >> clayton: and furthermore, we have confirmed of course the border agents confirmed they've stopped n.a.t.o. trucks coming across the border to resupply this space and a huge blow and further fractures the relations with pakistani. cross border drone strikes into afghanistan and monitoring what's going on in yemen, that whole area. the pakistanis are furious what happened and they've closed the border crossings and that's important to the u.s. because it's a vital supply chain and how our troops in afghanistan can get the supplies they need.

will they be able to function, it's happened before, a year ago when two pakistani soldiers were killed and they also closed the cross border and what happened was people were killed because terrorists seized on this moment and were able to intercept things. so people are hoping at that doesn't happen again. >> dave: again, the two main reasons it's important, the supply routes and the situation, they have nukes. pakistani government has nukes and we give them billions each year in foreign aid and what will happen now. a statement from the pentagon. u.s. diplomatic and military leaders each stressed in addition to their sympathies and commitment to review the incidence, the importance of the u.s.-pakistani partnership which serves the mutual interests of our people and these leaders pledge today remain in close contact with their pakistani counterparts as we work true this

the number, the spread. >> dave: not close. >> alisyn: between mitt romney in terms of polls of g.o.p. voters and newt gingrich. 21%, 14% to newt gingrich. >> clayton: 41%. so newt gingrich and ron paul tied for second place that that poll. >> dave: that's a lot of distance. newt gingrich is the 6th person to lead the polls if you include donald trump going all the way back and seems a little reactionary. i can't imagine mitt romney isn't just furious this morning over how hard he's worked in that state. >> clayton: possibly, but isn't it like lobbying to get class cuty. >> alisyn: which i did. >> clayton: but you did. who is going to make the decision on school council. would you mind-- a they sat down with

candidates and discussed things with them. and they may have agreed to news gingrich's position. and herman cain in the wake of everything with milwaukee, sitting down that with that editorial board. he close to cancel the meeting with the union ap canceled it and back on again. no more editorial boards for a little while until i figure out what's going on with libya. >> alisyn: speaking who is praising gingrich's strengths. strange politics makes strange bedfellows, bill clinton gave an interview why he thinks that newt gingrich is having a renaissance and talks about his strengths. remember, they were arch rivals when they had all sorts of tensions. now he talks about his

strengths and newt gingrich starts outside the box. >> dave: this is bill clinton on his immigration stance. >> clayton:. >> he's articulate and trying to think of a reason-- last night i watched the national security debate last night and newt said two things that would make an independent voter say, well, i've got to consider that. he said okay. i don't want to legitimize people who-- immigrants who came here undocumented illegally. on the other hand, a lot of those people have been here for years, worked hard, paid taxes, they've got kids in the schools, and they're not criminals, we're going to have a hard time sending them all home there are millions of them. so, i'd like to have a process where they could be here legally, but not have a path to citizenship. that sort of splits the

difference between the immigration reforms proposed by president bush and president obama which would give a path to citizenship and would be a version of what president raggen did. n -- president reagan did. would that help him or hurt him? may not help him in the primary if bill clinton is supporting what he says. >> alisyn: it's not like he's going against time. >> dave: does it help. >> clayton: right, today's point primary. in the general, how does it help him with independent voters who strongly support bill clinton and he left office with 67% approval rating and well looikd individual ap president. yesterday newt gingrich on our show-- i'm sorry, michele bachmann held up a letter accusing newt gingrich of something interesting and now the firestorm has started as a

result of it, take a look. >> it's people who have been here for 25 years, that would be completely different than the letter that he published in the wall street journal. there was no clarification, that it would be people that are here 25 years and that would be completely different than the statement he publicly made less than a year ago that he believed people should have the pathway to citizenship. >> what does that letter say? so the letter was newt gingrich back in 2004 supporting president bush's plan for a guest worker program. the guest worker program would basically legitimize workers here allowing them to stay and work here and not give them an immediate path to citizenship. here is a quote from that letter that gingrich signed in 2004. propose proposed a new legal path to work in the u.s. through a temporary working program. watching willing workers with willing employers, we applaud the president and believes to

establish a humane, orderly and economically sensible immigration, that will focus on genuine threat. i thought you were were going to read along with me. michelle bk patton basically says it's a smoking been, shows that he believed in this back in 2004 what he says is his sort of evolved position on illegal immigration. >> dave: i don't know that it's evolved. i think he's acknowledged he's felt this way for daimler-chrysler cade agreeing with some of the things reagan thought about immigration. look, she clearly did present something new in the argument, but newt is not backing down. here is what he told us. two things are going on here, either the congresswoman is intentionally lying to people or she does not understand immigration reform. either way, it is sad to see from a presidential candidate, i think questions remains this, for the republican candidates that don't agree

with newt. what is your plan? how will you deport 11 million illegals. is there any system under which that will work. >> alisyn: we asked michele bachmann that yesterday. >> clayton: there is no answer to that. >> alisyn: she worked around she would prioritize. criminal records and-- >> some of the questions we asked, she didn't really answer a lot of viewerses e-mails and tweets that she was dodging that. and karl rove says you're not going to get rid of 11 million americans, not going to happen. 11 million illegal immigrants, it's impossible to happen. that will continue. and two things about to happen not getting press because of the holiday right now. this payroll tax extension which that battle is coming up in the next few weeks and so it unemployment benefits and 99 weeks, whether or not that will run out. about to happen in january.

highest earners, bush tax cuts, republican refused to trem rarely extend and increase for working americans next year and came down to the bush tax points, that was the sticking point. >> clayton: and like the teacher in the peanuts, wa, wa, wa. this drives americans nuts. the bickering back and forth they can't stand. the super committee was bound to fail from the beginning. >> dave: it was. >> clayton: senators simpson from simpson-bowles says you had individuals on the deficit reduction panel, it was stacked from the beginning. >> dave: 600 billion dollars in defense department cuts in the next ten years, didn't they realize this was coming. >> alisyn: yeah. >> clayton: we are going to talk to our political panel.

in for rick with the weather. >> we have some unsettled weather to talk about. a large cool front that slowly heads ebay from the great lakes all the way down into the gulf coast. you can see a lot of rain with this system falling heavily across city of detroit, and western ohio so we could be looking at major delays along the airports, some pretty wig hubs in columbus and detroit and also some thunderstorms across parts of the southeast like alabama and mississippi. this system is going to be a slow mover. throughout the day it's going to continue to rain and then split into two pieces and interesting, one is going to head towards young and the second piece is going to continue to linger around the southeast the next several days, pulling in cold air, tuesday morning or late monday night, could see snow across tennessee and parts of alabama. we'll look at snowfall in the deep south.

like she's trying to get attention attacking the guy up front on immigration reform. newt has been around so long, he's got a stance on practically every issue in washington. this is an issue that changed over time and we see it coming out in this controversy. >> clayton: her argument he has had a shifting position on immigration. he supported a version of this-- >> he has a long record for voters to see where he's changing on views from one end. spectrum to the other. and michele bachmann using this opportunity to boost her polls and to get more press for herself and it's working. >> clayton: is it workening iowa. michele bachmann was the sweetheart in iowa. won the straw poll, obviously born in iowa, what's happened. 8% in a recent poll in iowa. >> she's looking what did

happen to rick perry, looking at beginning of the end. the attacks on him worked and immigration, why not with newt gingrich and the reality the republican party has moved so far on the right on immigration, from where they were when bush was president and no longer acceptable i don't know where they think they'll pick up any hispanic or latino votes. >> you bring up a great point and we can circle back and rick, i'll give you the final word on that topic. julie brings up an interesting point, karl rove says we've hurt the party. if we say we'll boot out 11 million immigrants. >> i think you've got newt gingrich thinking more like mitt romney, let me think about it. you heard almost a bit of compassion out of newt gingrich in the debate the other night talking about the issue you can't break up

families you have to find out a way for families to stay intact. a lot of wiggle room, but he left it to go back closer to the center if he would make it into the general election. >> so all of this is historying, left to right, back to the center for the primary election. rehe minds voters why they think they want a third party candidate. somebody who's not in either of these two parties of course, knowing the tea party movement is a part of that as well. is there a way for a third party candidate? the wall street journal painting a perfect storm scenario right now because the dissatisfaction with both parties is through the roof. now it's up at 81%. >> listen, people are frustrated. concerned about the economy. unemployment is high. a record number of people are on food stamps, but for a third party candidate to come in, that would hand the election to president obama. again, and the last thing we need is four more years of his

failed leadership. we need to get out of the situation we're in and not just hand him the reelection. >> ed koch said this about michael bloomberg, a major chance of a third party winning. i believe he offerings independence and money and finance. and ron paul doesn't get traction for republicans, he's got 18% ever voters said they would support him in a third party candidacy. does it hurt republicans more than it helps democrats or third party? >> who runs, don't forget ralph nader cost al gore the election. it depends who the candidate is. it's virtually impossible to become the president if you're on the third party. you can get the electoral college to support you.

these people do it out of egos sometimes, do it to be spoilers, do it for their parties, but realistic-- even with michael bloomberg and all of his money, he realizes can't win. >> that would be bad news for republicans, discussing it, if bloomberg were to run, i think that would be bad news for obama. mike bloomberg is socially liberal and sound like obama on social issues and a businessman who has run new york city and looks like somebody who can get the job done which could take away from obama, but third party candidates have basically been personalities for the last 20 years. the it revolves around one candidate and the difficulty is building a party around that and we have a seen it even with the tea party. obviously, a movement that has major roots, but basically

coalesced into the republican party. that's part of the problem that the republicans are having. it's extremely difficult to third party structure. >> the point with bloomberg, obama must be laying await at night. bloomberg would probably take the jewish vote from president obama because obama is hostile towards-- exactly right. hostile towards israel and comments he made recently about benjamin netanyahu that he has to deal with him like's he an a burden. >> clayton: would that hurt him with independents as well if bloomberg jumped into the race? >> right, he's not had a successful third term. >> people here don't like him. question, can michael bloomberg translate around the kupt. i don't know the answer. i know he's a smart business man, a shrewd businessman. is he going to invest his

this is thing is wildly up for grabs, i'm not sure how much a newspaper endorsement does. >> dave: i'm not sure, but what's interesting about that poll you mentioned around 20% of the voters said they were solidified on who they were going to vote for. so it allowed for a lot of movement, but the only direction romney's gone in new hampshire is up and up and up. >> alisyn: praise from newt gingrich. bill clinton stat down with news max and talked about why his formal rival, newt gingrich, they were at loggerheads when bill clinton was president and newt was the speaker, talking about why voters are responding to newt gingrich, basically he is a unique and out of the box thinker. let's listen to bill clinton. >> he's articulate and tries to think after conservative version of an idea that will solve a legitimate problem. for example, last night. i watched the national security debate last night,

and newt said two things that would make an independent voter say, well, i've got to consider that. he said, okay. i don't want to legitimize people who-- immigrants who came here undocumented illegally. on the other hand, a lot of those people have been here for years and they've worked hard. paid taxes and got kids in the schools and they're not criminals. we're going to have a hard time sending them home. there are millions of them. so, i had a he like to have where they can be here legally and not have a path to citizenship. splits immigration reforms proposed by president bush and president obama which would give a path to citizenship and a version of what president reagan did. >> clayton: newt gingrich responding yesterday to what michele bachmann had to say on our air yesterday. she held up a letter she says basically shows that he had supported amnesty back in 2004

about eight years ago and newt gingri gingrich, actually we have that and play it first and get the response. she said on our air yesterday morning. >> he's only talked about people who have been here for 25 years, that would be completely different than the letter than he published in the wall street journal. there is no clarification it would be people here 25 years and completely different from the statement he publicly made less than a year ago, that he believes that people should have the pathway to citizenship. >> look, this is not a departure for newt gingrich. like it or hate his position, it's pretty consistent over the last couple of decades. i wonder though about that clinton statement because you've already got the image of newt and nancy pelosi in that commercial and already, some that he is pea the most liberal of the candidates. could at that actually hurt him in the primary? >> it's tough to say. in terms of what michele bachmann did yesterday. definitely garnered some

headlines on our show. newt gingriches campaign talked to fox news channel yesterday and fired back, at her claim that he wants amnesty and here is what newt gingrich-- oh, sorry, first we're going to read what the letter said. michele bachmann held up the letter and says here is the smoking gun, he wants amnesty. president bush proposed a new legal path to work in the u.s. through a temporary worker program that will match willing workers with willing employers. we applaud the president and believed it holds great promise to reduce illegal immigration and establish a humane sensible to homeland security assets to focus on genuine threats. >> newt gingrich says he doesn't define it as amnesty, basically allowing them to legally work here, a guest worker program is what president bush called it. >> clayton: of course she saw that on the stage and called that amnesty. he said yesterday in defending

his position, two things are going on here, either the congresswoman is intentionally lying to people or she does not understand immigration reform. either way, sad to see this from a presidential candidate. i can't wait to see that next debate. likely side by side on that. >> dave: and how long will immigration last, or will it simply shift to the economy. what's going to get them elected is not going to be immigration, but for the time being an issue for newt. >> alisyn: the news that's happening. the in pakistan the country buried 24 troops. right now the obama administration is promising a full investigation into this attack and, but in response, pakistan is closed. and they demanded that the u.s. leave an air base in the

country, within 15 days. and if the attack is confirmed, it would be the deadliest friendly fire incident by n.a.t.o. against pakistani soldiers since the start of the war in afghanistan. and well, he calls it the scareiest night of his life. one of three american students arrested in egypt now opening up about that ordeal. 19-year-old derrick sweeney was the last of the three students to return to the u.s. last night. he told reporters that egyptian prison guards abused them and threatened them at gun point and remember, the three boys were arrested for allegedly throwing fire bombs at government security forces in tahrir square and sweeney and his mother joy will be joining us live right here on "fox & friends" in the next hour. sw.w.a.t. teams raided a home in hopes of finding clues. dale smith's father, her

grover's demand, was that they not have any increased taxes. on the wealthiest 1% of americans, guess what the republicans were willing to violate grover's pledge and put forward a plan that would have cut rates for all americans and included a net tax increase of over 300 billion dollars. guess what, the democrats made a demand as well. president obama said he would veto any bill that didn't include 1 trillion dollars in new tax increases and they never swerved from it and occupy wall street got its way and grover didn't. >> alisyn: what boggles the mind. as we know both sides agreed to reform the tax code and broadening the tax base and doing away with deductions and they would have had more revenue. what does it matter where it comes from? >> well, that's exactly the point. for the democrats it does matter where it comes from, it's about making the--

about taxes wealth and taxes success in america and it's about making millionaires pay their fair share, those are the goals are occupy wall street. when the republicans were willing to cut deductions and even structured their plan to make those, those deductions come from the wealthiest two top tax brackets. >> alisyn: and they're taking advantage of the deduction so it would have hit the wealthiest people. >> dave: but his point is that our proposal was far to the right of the simpson bowles model that most have based projections off of. far to the right of it they're saying that republicans wouldn't come closer to that proposal? >> you know, that's just flat untrue. the republicans actually made a proposal to the left of simpson-bowles in terms of the between spending cuts and tax increases the point is that the republicans made a major concession when they agreed to break the pledge and put 300 billion dollars of tax, new taxes on the table. if the democrats were serious what they would have done,

they would have come back and said, okay, we'll, instead of lowering the rate to 28% how about 30% and instead of 300 billion how about 500 billion in taxes and would have had negotiation, but never swerved from that 1 trillion dollars and raising rates on the top financial-- >> and is there a way now to revert to bowles-simpson. >> probably not. i think the way this is going to get settled is the upcoming election. we're going to take this to the american people and take the case to the american people and they think the tea party is waning and now they've got a grass roots for bigger government and more spending and it's going to be, and class warfare is the path to victory, and we'll find out next november. >> alisyn: thanks, mamark, great to see you. >> dave: thank you. >> alisyn: if you want a baby genius, i know you have two already. >> dave: i do. >> alisyn: have better timing. we're going to share the findings of a new study on that. >> dave: i'm listening.

. . >> clayton: all right. welcome back to "fox & friends," listen to this story. a florida inmate got time off for good eating. 345 pound george mccovery was sentenced to 29 days in jail for driving with a suspended license and the judge offered him an alternative. and sentenced after he was expressed he would like to lose weight. joining us now on the phone is the lake county judge who offered that deal, judge donna miller. good morning, your honor. >> good morning. >> alisyn: tell us what you were thinking giving this defendant a day off for every pound he would lose? >> first of all. i took the prosecutor's suggestion of 29 days and when he told me he was in and out of the hospital for high blood pressure and he had to lose

weight. i said you have to do at least 20 days. after 20 days i'll mark a day off for each pound you lose and i thought maybe five or six pounds. on the 20th say the jail called me, you're not going to believe this, he lost 25 pounds. >> clayton: judge, what about the critics, what does losing weight have to do with serving time driving with a suspended license and doesn't seem like the two go hand in hand. >> he was going to have health issues, maybe, lose his life early because of his weight, and this kind of like turned his life around at least temporarily and committed to himself again he's going to turn his life around and not get in more trouble and do the right thing for himself. so i think it washed out well. >> dave: and it's not just losing weight, you've offered other incentives, starting jogging and taking a dance class and tutoring math and writing christmas cards.

you have standards though and your offense is too serious to allow something like this? >> absolutely, one of my bay lives told me i sent more people to jail in my courtroom than any other consumers, so when jail is necessary, i do jail. >> alisyn: explain to us what taking a dance class was. >> that was a young person who had a dream of being a dancer, wasn't getting along in school, taking people's cars and going for joyrides and so, her principal and i got her hooked up with a dance studio and it just gave her the self-esteem and the direction so she didn't need to get in trouble, she had a direction. >> clayton: judge, do you see a correlation between the types of programs that you install in your sentences and recidivism, people coming back to prison after they've done a dance class? >> the people i went to jail rather than prison and of course, i don't always get to follow-up with people, but

there. >> clayton: does it matter at the end of the day. >> dave: it does help newt. i think it's more of a slap in the face. >> alisyn: if you're on the fence, if you're a new hampshire voter and tried to decide between them. >> it's a conservative newspaper, let's be clear. if you read the editorial board every day, this may really sway your opinion of it. perhaps the same as the wall street journal would. and an interesting support commentary, in an interview with news max with the stand on immigration, and bill clinton sees it as a bit of a compassionate one, and sees could be an advantage. listen to him. >> he's articulate and tries to think of a conservative version of an idea that will solve a legitimate problem. for example, last night. i watched the national security debate last night. and newt said two things that would make an independent voter say, well, i've got to consider that. he said, okay, i don't want to

legitimize people who-- immigrants who came here undocumented illegally. on the other hand. a lot of those people have been here for years and worked hard. paid taxes. kids in the schools and they're not criminals we're going to have a hard time sending home. there are millions of them. so i'd like to have a process where they could be here legally and not have a path to citizenship. that sort of splits the difference between the immigration he reforms proposed by president bush and president obama which would give a path to citizenship and a version of what president reagan did. >> to the independent voter, yeah, it will help the independent voter, but will it hurt him with the republican voters? >> it's hard to say. >> so many people like bill clinton, he left office with 67% approval rating even among republicans he was well-liked even among democrats.

>> alisyn: i don't think it's surprising that bill clinton fastened on liberal tenants of newt gingriches tenants and sn something that bill clinton probably agrees with as well. >> and michele bachmann is calling it. >> a liberal position. >> a liberal position and she called it that following the debate performance the other night and she was on our air and held up a letter basically saying that newt gingrich waffled on his position, she had this 2004 letter which says he supports amnesty, take a look. don't take my word for it. >> only people who have been here for 25 years, that would be completely different than the letter that he published the in the wall street journal. there was he no clarification that it would be people here 25 years and that would be completely different than the statement that he publicly made less than a year ago, that he believed that people should have this pathway to citizenship. >> so basically yesterday on our air she made some headlines because she acted as

though that was a smoking gun and found a letter from 2004 in which newt gingrich supported president bush's guest worker program and let's read that letter so you can decide yourself. here is what newt gingrich said in 2004. president bush proposed a new legal path to work in the u.s. through a temporary worker program which will watch mr. ing employers. and establish a humane orderly and economically sensible approach to migration and free up border security assets focus on genuine threats, do you interpret that as amnesty. >> clayton: he came out right away. >> dave: and must have been watching. >> clayton: absolutely, two things are going on here, either the congresswoman is intentionally lying to people or she doesn't understand immigration reform, either way it's sad to see from a presidential candidate. so, let us know what you think about that. does his position support

for romney than a plus for gingrich and tough because new hampshire is so important for romney and he's kind of waffled whether or not he's going to go big into iowa and he frankly could survive a loss there. he could not survive a lost in new hampshire though, it is his fire wall, of course, he was the governor for four years of the neighboring state of massachusetts and he had met with a publisher of a newspaper including having dinner with him about a week ago, he was wooing the paper and for him, once again, as you say, in 2008 and once again in 2011 to fail to get their endorsement is bad news for him. it's not fatal, but it's not good. >> one more question on this, you know, you see ron paul, actually pundits looking what's going on with ron paul up there. looks like he could be in a safe second place up there. and ticking up in the numbers and other candidates have

dropped. newt gingrich and ron paul second in polls right now. we see bill clinton coming in third and other pots are important in the primary race, second and third place up there. >> also, would i not spend too much time trying to handicap new hampshire, my experience, a long ways, is that the focus in new hampshire really starts after the iowa caucuses. the iowa caucuses are on tuesday, january third and new hampshire is a week later and people will assess what happened in iowa and they'll take a look at candidates, who then would be focusing all of their time for a week in new hampshire and the famous line in new hampshire, what do you think of some candidates, i don't know i've only seen them four times and expect to have up close and personal exchange with the candidates. i think it will happen the first week in january. and again, the person having the most riding in new sham

shire, is mitt romney and if he were to lose or barely lose, a blow to his campaign and that he's trying to fill that he's the front runner and candidate. >> alisyn: let's talk about the the super committee and their failure and dueling op-eds in "the washington post," one for a suspect on the super committee and one for a group of republicans, pointing fingers whose fault it was and it sounds like one place they agree the sticking point with the bush era tax cuts. something they couldn't get past. is that how you understand why this fell apart? >> i would say there were two problems and the bush era tax cuts was certainly one of them because of the republicans, a big deal for them. offered a concession for the first time, a very conservative republican senator from pennsylvania said we're willing to agree to revenue increases, let's lower the rates, eliminate the

deductions and take 250 of that money every ten years and we'll contribute that and count that to try to reduce the debt. the suspects say it wasn't enough money, but the real issue is that the democrats then insisted, yeah, but you've got to keep the bush tax rates. you can't lower the rates and then raise the rates a year later. it was crazy in that sense. and so, the democrats were insisting that the bush tax rates on the wealthy expire and go up to 39% in 2013. on the other hand, the republicans say one of the big issues was entitlement reform and that the democrats wouldn't agree to entitlement reform and to the major cuts in benefits, maybe increases in eligibility age for social security, and medicare and i think those are the two issues, the bush tax cuts and medicare and social security entitlement reform. >> and the blame game will continue on fox news sunday because john kyle is on the program. i think he's a particular

interest because he was selected some said because he wasn't worried about reelection and he's retiring and so he would not be worried about these pledges, but, still no deal. also, dick durbin and john boehner huntsman on the program. interesting stuff because that he debate continues as you know, about payroll tax cuts and also the unemployment benefits. >> let me quickly say, that's the real key at this point, not the long-term thing. at the end of the year, the payroll tax and unemployment insurance benefits lapse, if those do lapse a lot of people say it could throw the country back into recession. >> clayton: a debate. >> alisyn: we will be watching fox news sunday. >> thanks, chris. coming up on the show she doused a crowd of shoppers with pepper spray and now she turned herself in. will she face charges? >> he's calling it the scareiest night of his life. derrick sweeney, one of the american students arrested in cairo is now back home this morning and he's telling his tale of abuse and he's going

>> dave: we talked to you instantly after you got the phone call. now we're learning more about what happened. you told the associated press about the mistreatment you suffered in jail in cairo, what happened. >> yeah, the first night we didn't seem to be in the formal legal process. we got taken in by plain clothed people and we were threatened with force feeding gasoline, and we were hit in the face and the back of the neck, we had our jackets and shirts pulled over our heads so we couldn't see where we're going and ultimately spent about seven hours in the fetal position with our hands handcuffed behind our backs and people with guns said if we moved we would be shot. >> dave: you say were you force fed gasoline. >> they threatened to force feed us gasoline, and it was the bottle was held above our mouths, but fortunately, i didn't get any personally.

>> dave: joy, as a mom, what is it like to hear those words? >>. >> oh, you don't know. and the thing about it, he mentioned a little bit of this torture on the phone to me when we had an opportunity to speak on thanksgiving day and i knew i could not say anything to anybody until he was out of the country. the and all the more reason for it to be imperative for him to get on a plane and that's why when i thought oh, no, they'll stay there until sunday, this is not acceptable to me, he e-mail, called, talked to everybody i can to expedite this process and we're greatful for the the powers that about that made this happen. we're truly appreciative. >> dave: derrick, they arrested you and your friends, they suspected you were throwing molotov cocktails and they say you were found with a

bag full of empty bottles, a towel, camera, why were you holding those things. >> well, we were brought in off the streets, and we had a bag that was given to us by a friend of ours, and i don't know why that was in there. we, the authorities took our bags before they showed them to us so, i can either-- >> did you ever throw a molotov cocktail or any of your friends? >> no, we did not throw or handle or possess or even witness any molotov cocktails, we did not throw any and did not throw any stones or anyone to harm anyone or anything. >> dave: i understand you had to come back home with none of your possessions and you were studying abroad there. what's going to happen to all of your things? >> they were-- the police actually went back with some other students and got most of our stuff,

changed and ever since this story broke on 60 minutes. >> dave: joining us the man who broke that story, the author of a wonderful book "throw them all out" good morning to you, sir. >> good morning, how are you. >> dave: we're great. can you believe how this has changed in such a short time and have you spoken with congressman baird since that report? >> i've appeared with congress baird on, we've had media appearances together and i've had contact with the senate and house members, who are pushing this, yeah, it's pretty remarkable. and this is a practice that's gone on quietly. widespread for years and it helps explain how members of congress come in relatively middle class and leave rich and now, that sort of we've torn the cover off of it, suddenly you've got dozens of people co-sponsoring this legislation and hearings in the the house and the senate both going on at the same time. and really for the first time. it's pretty unprecedented. >> it almost seems like hypocritical.

in the last time they held a hearing for the stock act. no one showed up at the congressional hearing and suddenly all eyes on congress suddenly a new congressional hearing as a result of your investigation. i'll bet you'll see tons of congressional leaders sitting there so the cameras can catch them. right? >> i think you're he going to see that. my concern is i think the stock act is a step forward, but there are lots of methods that they use that should be illegal, frankly. that they use to make money, getting special access to to ipo's land deals, he understands not covered at all by the stock act. but it's a step forward and in the right direction. what's going to be interesting though on the senate side. several members of the governmental affairs committee said they think it's already illegal and it's not a big deal and the gentleman that's chairing those hearings in the house, is one of the individuals that i focused on in the book. and he said the same thing, so, we're certainly not at the point where they're even going to pass this act.

but at least it's getting a hearing and i think we need to keep the heat on or hope that it goes away that they put on a dog and pony show and it goes away and move on and keep doing what they've always done. >> your book was the impetus to get 60 minutes to do the segment that opened everybody's eyes to how it really works on capitol hill and congressman brian baird of washington state is no longer in congress. is there anybody who is a champion still of this, of cracking down on this sort of sweetheart deals and insider trading inside congress? >> well, you've got in the senate side for the first time, senator brown from massachusetts, senator gillibrand from new york, have co-sponsored it on the senate side and they're pushing it pr pretty aggressively and on the house side. six co-sponsors, somewhere near 60. a lot of those, by the way, not coincidentally, are in

rain coming down across east tennessee, and, also, parts of the state of alabama, and we could be looking at a risk for flash flooding there. because the rain will continue throughout most of the day, today. now, the system will actually split into two systems and we'll have one system move through, parts of new england, coming up shortly, the next two days and the second system is going to remain pretty much just very slow moving across the southeast and will shift the rain over to snow as early as monday, early afternoon and this is noon monday and the white stuff behind the system is snow across parts of northern mississippi, memphis, tennessee and portions of southern illinois, and you can look at accumulating snowfall, not significant, just about an inch or two, but, still, unusual to get some snow down here. otherwise, by tuesday, at noon, you could be seeing the snow coming down across parts of eastern tennessee, northern george aand even western parts of the carolinas and behind the system, we said it will be chilly, 43 will be your high, kansas city and 35, minneapolis

and the system, we'll be watching out for possible travel delays, coming up through columbus, pittsburgh and nashville, portland, oregon, you should be fine. guys, back to you. >> clayton: thanks, i was watching intently to see what the temperature was in new hampshire. because, it is a hot time in the old town this morning, if you are waking up there, this morning, there is a bit of a political battle brewing. if you picked up the union leader newspaper, this morning, the most influential conservative newspaper in the state, boom, on the front paint, endorsing newt gingrich. >> dave: yeah, for president, newt gingrich. here we are, 45 days out from new hampshire primary, and, for the second time in a row they say, no mitt romney, you are not our guy. they say, quote, newt gingrich is by no means the perfect candidate. he's the best candidate who's actually running and, again, the guy who was governor of neighboring massachusetts, who has had property in new hampshire, who spent more time than anyone in new hampshire and dominates the polls does not get the endorsement. >> alisyn: go even further,

because, not only did he spend a lot of time in new hampshire, he's lobbying the editorial staff of the union leader for an endorsement and maybe i'm saying it too strongly. he went last week to dinner with the editorial chief of the newspaper, what did he do wrong at the dinner? you have to wonder. i would have loved to have been a fly on the wall. >> dave: bad food or something. >> alisyn: maybe. hard to say, because the newspaper is sending a signal to mitt romney, that he's not their choice and, the question is, is the newspaper a king-maker? will it change the way people will vote in new hampshire? john mccain got their endorsement and won there. so... >> clayton: 2007. how important it is it? the newspaper endorses newt gingrich in the presidential primary. america is at a crucial crossroads and it will not be enough to replace barack obama, we are in need of innovative forward looking strategy and positive leadership he has shown

he's capable of providing. >> dave: and, ali asks, is the paper a king-maker? they'd have to be a miracle maker to change the polls, mitt romney at 41% to newt gingrich's 14%. that is an enormous gap and i think from the polls i have seen, the biggest gap of any state, right now. >> clayton: and ron paul, not to be outdone, climbing, climbing, climbing in new hampshire and they say it is because of young folks, he's 76 and got the young folks volunteering for free and, when kids are volunteering for you for free, i mean, you can't buy that -- i guess you can't, because it is free. but you can't buy that kind of support. >> dave: literally. >> alisyn: and newt gingrich, is getting, if not support but encouraging words from his former foe, bill clinton. bill clinton sat down with news max and talked about really the merits of newt gingrich and how newt gingrich is an outside of the box thinker, and thinks about issues all the time, bill

clinton said, let's listen to a little of that interview. >> he's articulate and he tries to think of a conservative version of an idea that will solve a legitimate problem, for example, i watched the national security debate last night, and, newt said two things that would make an independent voter say, well, i gotta consider that. he said, okay. i don't want to legitimize people who -- immigrants who came here undocumented. illegally. on the other hand, a lot of those people have been here years, worked hard, paid taxes, have kids in the schools, they are not criminals. we are going to have a hard time sending them home, there are millions of them, so i'd like to have a process where they could be here legally but not have a path to citizenship. that sort of splits the difference between the immigration performs by

president bush and president obama which would give a path to citizenship and would be a version of what raising ronald reagan did. >> dave: up next, controversying -- an interesting way a judge grants early release from jail or inmates. what is she doing? she offered a man arrested for driving on a suspended drivers license, she says, hey, you can get out a day early for every pound you lose, and this, man, you are staring at here lost 25 days in 20 days, judge donna miller set him free early. >> alisyn: we talked to judge miller about her creative sentencing and she has done lots of things, such as sentence somebody to take dance lessons, somebody to take up jogging, sentence somebody to tutor math, to write christmas cards and we asked her to explain some of that to us. >> i took the prosecutor's suggestion of the 29 days and then, when he said he was in and out of the hospital for high blood pressure, and we talked

for the "wall street journal," stephen moore. good morning, sir, where are we seeing this the most? >> hi, david, a great story, finally an optimistic story and, if you look around the country we are seeing such a surge in oil and natural gas production. you are getting a lot of the natural gas in the marcella shale area, and, states like pennsylvania and west virginia, and ohio. and, we are seeing a huge boom in oil production in states like north dakota. in fact amazing story, you know what state, dave has the lowest unemployment rate in the united states today. >> dave: i'll guess the one you just said. >> north dakota, 3.5% and anybody watching the show, if you don't have a job, go to north dakota. they have 20,000 job shortage there, there is a boom in economic revitalization in the state due to oil production and here's the amazing part of the story, this is an industry that is creating hundreds of thousands of jobs and is doing it, dave, without a single penny of government subsidy.

meanwhile, the obama administration in i opinion has bet on the wrong horse when it comes to energy production and lavish money on solar and wind and as you said, a lot of the companies like solyndra are going bankruptcy and we have the capacity, if we get our energy story right, could be and oil and natural gas exporter in the next ten years, we have so much of it in this country. >> dave: the obama administration as you said pouring billions of dollars into the green energy sector. does the oil and gas industry need government funding or do they simply need the government to get out of the way? >> they need the government to get out of the way, because a lot of what is going on now, especially with them a is to try to prevent it. you know you have covered the story of the pipeline, keystone pipeline the environmentalists have blocked, but what they need now is the interior department to allow permitting, so we can

start drilling on public lands and, by the way, if we allow that to happen, allow more drilling on public lands, and, for example, in the gulf of mexico, that doesn't just mean more energy production, here in the united states, and less we have to import from the middle east, but, it also means if we get it right, we could really raise trillions of dollars of royalties for the u.s. government. what a great way to reduce the national debt. >> dave: and meanwhile well, talk about all the green energy, in terms of the money pouring there, if there were some technologies that were going to work, wouldn't the private sector find it either way, without the government's help? >> i think so. i mean, look that is the way every other energy industry has developed. not with government support but basically by private entrepreneurs and the private entrepreneurs and the wild caters found the huge oil find in north dakota, which is, by way, larger than the oil production in prudhoe bay in

alaska. keep the government out and create a level playing field. i'm not against wind and soil lar power but let's not subsidize them. but determine which is the most economically viable. after literally billions of dollars of federal subsidies, to solar and wind power, dave we only get 2% of our electricity from wind and solar, it is nature market and never will be able to provide enough electric power for a $15 trillion industrial economy. >> dave: the idea seems simple. let the free market determine the winners and the losers. >> what a concept. >> dave: stephen moore, thank you, sir. newt gingrich is not the only one getting an endorsement, rick perry is about to land one as well. and president obama expressed thanks for many blessings, in his thanksgiving day address and left out one thing. god. is it a problem?

proclamation. i'm read it to our viewers, as we gather in our community and our homes, around the tribal or near the hearth we give thanks to each other and god for the many kindness and comforts that grace our lives and, by the way, he has also mentioned it in previous spoken addresses. so, the critics should be fair. he doesn't omit god from thanksgiving address, just this year he did. >> you are exactly right. and historically, we thing of president clinton and four of his eight thanksgiving addresses, mentioned god, george w. bush, in 7 of 8 of his thanksgiving addresses mentioned god but you know what i think is shocking, is seeing the contrast between these proclamations, even the ones that mention god, give thanks to others and give thanks to god, the contrast between these thanksgiving proclamations and the original thanksgiving proclamation. the addresses of washington, of lincoln and modern day presidencies.

they are shocking contrasts. and here's another thing, read this, from blew me away, guys, this is from president obama in that same address, that we began with, he says, that like much of america he's going to spend his thanksgiving day eating lots of good food, watching some football, and, reflecting on how lucky we are. taking time to reflect on how lucky we are? when you are addressing the nation? it is taking time to reflect about the wonderful blessings that god has given to us. and, you know, if is his way of thinking and doing an acting, in his family, that is fine, but, we have to recognize that we're electing a person with a set of values that is going to communicate to the country about those values. and, i think the contrast is quite sharp. >> clayton: also, other big news, in the world of religion, and, father, you are the perfect

person to answer this from the catholic church, because, today we're wondering if the mass there will cause confusion, because of the translation, it is about to change today, an updated version of the catholic mass, what will happen here and why should people be concerned or not about this? >> not concern, but people will be surprised that they haven't already known before, for many years, a new translation has been in the works. now, let's be clear here. this is not the catholic church trying something new. getting a new mass. what it is is taking a look at the original latin text, ancient text, and looking at the biblical language and saying what is the best english translation of this? 40 years ago, through vatican-2, there were a lot of changes and many people, translators, said, let's make it more accessible to the people. now, over lots of years, people have gone back, biblical scholars an served let's get back to the original latin text

know, a fresh clementine and lime juice and has a touch of sweetness and flesh flavor and gin and elderflower liqueur and club soda. >> alisyn: club soda. >> clayton: fried chicken and waffle sandwich this is man-tastic sandwich. >> you can have this for brunch after a night of drinks, it cures anything you have. we'll make the waffles and they have beer in them. you have the traditional recipe and add a bottom of beer. >> clayton: breakfast. my fraternity days. >> instead of you know, the milk in the normal recipe, we start off with the boar and you can change it up, you can use a hope or a dark beer or a local brew. >> alisyn: or vodka, like i do. >> dave: alcohol cooks off. >> it will cook off a little bit
