spent 20 years working on the fishing industry. none of the fishing industry areas will be in the district that i would be running in. i can't walk away from the fishing industry, i can't walk away from the people i've become personally close to, say i'm sorry, i good to worry about the pikestone valley, i don't have time to do you. megyn: there you have it, barney frank, congressman in the united states house of representatives for three decades announcing his retirement today suddenly and we are getting new reaction on his decision to retire after 16 terms in the house. welcome, i'm megyn kelly. you heard the congressman giving some of his reasons for retirement but there are new questions already on what his retirement means. mr. frank now joining a growing line of democrats who have decided to leave office in recent months. so what does this mean for the balance of power?

congress? rich lowry is the editor of national review and fox news contributor. rich, he is now, according to our capitol hill producer, the 17th democrat to announce his retirement, versus just a handful of republicans on the other side. what is the significance of those numbers? and of this announcement today by one of the longest serving democrats in the house? >> i know, i think it's a sign that barney frank sees the writing on the wall and realizes he's very unlikely to wield meaningful power again. i mean, when you've been in the majority, used to being chairman, it's really hard to be out of power, an he's probably going to be out of power for a while now, and then then also, he was talking very frankly in his news dproans about how redistricting factored into his decision and he was saying he was just sort of uncomfortable representing new people. i don't quite buy that. i just think it's going to mean more work to win reelection. if you're someone like barney frank for who 25

years is basically unopposed in that district and last time around, 2010, have a stiff challenge, frank won comfortably in the end but having to work every two years to win reelection when you've been so safe, so long, is not a happy prospect when you're a long time serving member like barney frank. megyn: it's interesting to hear him suggest he doesn't want to represent new people or that's how not interesting to him when you look at some of the exchanges he had with his old people, his existing constituents, like this famous -- infamous, i guess, it's up to the viewer to decide, one of his exchanges in august 2009. remember this? >> when you ask me that question i'm going to revert to my ethnic heritage and answer your question with a question: on what planet do you spend most of your time? >> i'm trying to have a conversation with you would be like trying to argue with a dining room table. i have no interest in doing it! >> [applause]

megyn: that was in the leadup to the health care law that ultimately passed, of course. and i think if memory serves that woman wound up running for congress, too, she became so inspired by that exchange. in any event, he's been quite a figure in american politics, rich. are we to believe there's anything more behind this other than he's done? >> i think he's done. and he's not going to have meaningful power again in the near future. megyn: do you think he believes that the democrats will not be winning back the house in the next election? >> i believe that has to be part of his calculation. and we saw from that clip, megyn, look, he's very smart, even his fiercest critics acknowledge that, he's very sharp turfed and witty, but he's also very arrogant, very ideological and very partisan and of course partisans, he'll be remembered for for being the first voluntary, open -- openly gay member of

congress and also remembered in my mind for being one of the main defenders of freddy and fannie when they basically bought all of washington, fended off any meaningful regulation and helped destroy the u.s. housing market and caused this recession we're still suffering from. megyn: he wound up having -- and i will use the term, infamous exchange with o'reilly on that subject and denied that, but that did become one of the things he became known for, that along with dodd-frank, that stands for chris dodd and barney frank, that bill to crack down on wall street and that you hear so much about on the presidential trail right now, with the -- that the republicans rail on dodd-frank and say that's how it's stifling business and the economy and others saying it was high time we saw some reform in the financial services industry. rich, i'll give you the last word. >> he's not really fessed up to his role in the fanny and freddy mess and he never will, but now there's that -- now i'll use the word, infamous phrase, where he said we got to roll the dice, take more risks in the

subprime and low quality mortgages and that was just an utter disaster for this country. megyn: riff of rich lowry, thank you very much. >> thank you very much. megyn: folks, you can see the rest of the conference streaming live on foxnews.com/politics. another fox news alert now. we are learning that the supreme court is being asked to step in on a controversial case that could affect the balance of power in washington. it has to do with how congressional districts are being set up in texas, and there is a long history in this case, and it actually involves the u.s. supreme court. steve dreen, live in washington -- centanni, live from washington. >> you saw how redistricting involved barney frank was decision not to run again. there are redrawing of the congressional districts across the country and this one dispute in texas could go all the way to the u.s. supreme court. now, the issue is a map for

new districts drawn up by the texas legislature back in may. it was challenged by minority groups that claim the legislature's plan would diminish minority voting power and a 3-judge panel in texas apparently agreed and drew up an entirely new map on its own. members of the republican-dominated legislature deny the map would limit authority and the state attorney general greg abbott is asking the supreme court to throw out that map and go back to the one passed by lawmakers. in his request for a stay abbott says the map is a judicial creation with no regard to the lines drawn through the political process, as circuit judge jerry smith aptly described, it is a union away plan that imposes an extreme redistricting scheme for the texas house of representatives. now, there's no word on whether the u.s. supreme court will hear the case but abbott claims there's little time to waste with the presidential election less than one year away. he writes in his appeal, failure to stay implementation of an unlawful map will

irreparably harm the people of texas, if an election is permitted to go forward based on an unlawfully redistricting plan. this court-ordered map will remain in place as the legal battles are fought. abbott's appeal to the u.s. supreme court was filed just today, megyn. megyn: i sat there for four plus hours while the u.s. supreme court heard another case involving texas redistricting. one has got to think these judges are about done with considering redistricting cases. thank you, steve. >> you bet. megyn: at the capitol, leading senators are now in a showdown at the white house over detaining terror suspects. a live look at the senate floor here, where they're debating requiring any suspected terrorist be held fully in military custody. with the white house threatening a veto, claiming it limits the white house's ability to prosecute the war on terror. senators john mccain and carl leferin firing back with this op-ed statement in the "washington post" that reads in part, quote, this year's bill includes pay

raises for our troops, funding for equipment to protect them from roadside bombs and medical care and other benefits for them and their families. it would be extremely unfortunate if descrements -- disagreements over the detainee provisions prevented us from passing this bill and fulfilling those duties. the senate expected to take a full vote on this bill later today. we'll keep you updated. egyptians today are casting votes in their very first election since the ouster of long time leader hosni mubarek. greg palkot, streaming live to us from cairo. >> reporter: megyn, polls are set to close in less than an hour, those hours extended by two hours of heavy demand, big turn yowvment we're told there is going to be 60 percent, way up from the last parliamentary election where it was 10-15 percent. that was backed up to us on the ground when we went to one polling station earlier today. take a look at what we saw. >> we're in the daha

neighborhood of cairo, where there is a massive turnout for the first free election since the fall of egyptian president hosni mubarek. it is a lengthy process, there are many ballots, it's con clamped, there are many parties, candidates. it's controversial. some say this vote shouldn't happen at all and it is potentially dangerous. there is a massive turnout of soldiers, of police. they call it maximum security. but the folks here seem to be defying all the odds, they seem to want to give democracy a chance. they're voting here at this school. >> we went to a few other polling stations, we saw some confusion, we heard about some irregularities, there have been reports of some violence, but experts we talked to tonight say they're observing the elections and it's looking good. we're also told that muslim brotherhood, the promised party, had the big vote in getting the vote out. they could get as much as 40 percent in the popularmentry election. now, as for the military

leader, tantawi, a big demand of the protestors that have been staging violence in the last week is that he and his military council should step down. we ran into them today, we had an exclusive exchange with him, we confronted him with that. he sounded pretty secure. take a listen: >> some people say the military council should step down. what do you think about? >> we are going to stay. we are not going to leave, even today. >> when will you leave? is this something that -- >> i announced yesterday. >> reporter: the comment 245 he's -- the comment that he's referring to is yesterday he said he would step down next july, that is when this election process is over and he says the military will take a back seat. we will see about that. there is another day of voting tomorrow. we'll get results from this parliamentary election, this round at least, on wednesday, and behind me, megyn, tahrir square has been the scene this year of a lot of violence, some of

megyn: breaking news out of detroit today. general motors announcing it will now offer free loaner cars to all chevy volt owners who might be concerned about their cars catching on fire. the move comes in the middle of a government investigation into the type of batteries used to power the electric car. gm says it's trying reassure customers that its cars are safe, after one of them caught on fire during the crash test, six months ago. well, we are following a developing story at the white house now where there's a major meeting underway on europe's debt crisis, the american economy, and analysts say

what's happening? >> well, what's happening right now is that italy is the focus, the newest, latest focus of concern, because it's going to need somewhere around a trillion dollars in support to get through the next year and a half under the leadership of its new president, mario monte. megyn: they're going to knock on the door of the e.u. saying we're part of the e.u., help us out. >> that's right. and what they're doing first though is laying the ground work for the international monetary fund. we provide the largest share of the money to the imf as a guarantor for that trillion dollars. megyn: so america has -- >> we're in this now, up to our ears in it, as if we didn't have enough demands on our capital. and the europeans have to decide, basically, whether or not they're going to have a democratically elected union and move forward, because right now, what many people don't understand is there's a technocrat who? charge, who's been installed

to lead the italian government. there isn't a single elected official in the italian government right now. and angela merkel, chancellor of germany, and sarkozy, the president of france, he and merkel are basically trying to drive through without the approval of the entire european union a much tighter, more consolidated european union that can issue eurobonds. megyn: how does that affect stuff? >> how does it effect us? about one third of our trade is with the europeans. megyn: -- megyn: so if th euroo euro collapses or there's a big blowup over there, because england, they don't want any part of it, they didn't cause the problem in italy, they don't want to fix the problem in italy, they are worried about the collapse of the euro and we don't want to see that happen but we also don't want the imf to bail out. >> that's right, because we are so overextended in the bailouts of our own and the

europeans have got to make decisions. they should be democratic decisions. you know, this president is fond of saying he can't wait. right now, you have angela merkel and nicolas sarkozy saying we can't wait to the entire european union and the 17 nations that make up the eurozone, the currencies, the euronations. it is -- this is a fragile, pivotal moment in european history, and it has to be watched very carefully. megyn: could the euro collapse? >> indeed it could. indeed it could. megyn: what would that do to the economy here? >> there are those that suggest that, for example, going back to the issue of trade between our two countries, the atlantic market, that is europe and the united states, comprise about half of the world economy. but we're talking about at the margin, what would be affected, that is, exports and imports between the two. so we can -- this can be easily overstated. but it's a very serious issue, and we're going to have to deal with it. but what is interesting to

watch is this president, who has said that he wants to be above the discussions here on debt, a president who has not put forward proposals on how to reduce a budget decifit in this country since he's been president, is now talking to the euro leaders, the head of the european council, the european commission, the political leaders, who basically don't have the standing to solve their own problems, let alone work together with this president to solve the problems that exist. megyn: i don't know if -- obviously president obama -- obviously it's going to have a negative effect on the united states economy, clearly it works to his actual beand political benefit to get that solved. >> but his administration, and the treasury secretary, timothy geithner, has said of the europeans, they don't have the political will to solve it. but he could be looking straight at his own country. that is, you, me, our fellow citizens, saying we haven't manifested the political will to solve our fiscal crisis, either. so this is an interesting moment in history between

megyn: well, new developments in the search for baby lisa irwin in missouri, with very little progress in finding her, family and volunteers are now turning their hopes to a psychic. trace gallagher reporting now from our west coast newsroom. a psychic or so she claims, snrais >> reporter: that's right, megyn. not only has the psychic come up with an interesting development, but they have contacted police and are willing to follow up on her lead. the psyching is from waxtahachie texas, she's never been to kansas but she says on the night that baby lisa disappeared she out this -- had this out of body experience and witnessed the whole thing. she said that the mom, bradley, drank too much,

the gop will hurt millions of working americans and on the other side, senator jon kyl became one of the highest profile republicans to come out against the extension. take a listen: >> i can't believe that. at a time when working families in this country are struggling paycheck to paycheck, that the republican position is they'll raise the payroll tax on working families? i think that that just defies logic. >> the problem here is that the payroll tax doesn't go into general revenue. it supports social security. and you can't keep extending the payroll tax holiday and have a secure social security. megyn: brad blakeman is former deputy assistant to president george w. bush and dick harputlan is south carolina democratic party compare. it's sort of a flip, right, of the usual positions you see where the republicans are pushing for tax breaks and the democrats who maybe don't necessarily want the tax breaks and so on. anyway the democrats want

this tax break, brad and republicans are hedging, saying we like tax breaks, maybe not that tax break and we're not sure and democrats saying we can't lose on this, because if we lose on this, you're going to hear about it in the campaign from now until november. is there a real risk to the republicans there? >> no, i don't think so, because all tax cuts are not created equally. as jon kyl pointed out correctly, this doesn't go into the general fund, this is robbing peter to pay paul, it's hurting the social security system, it's creating more debt, and the democrats, what they want, megyn, quite frankly, is to create welfare, and they've done it with the unemployment insurance benefits, it's a campaign tactic, they don't want to cut off supporters but all good things come to an end. instead of creating americans dependent upon the government, let's create jobs so they can contribute, and that's the difference between the payroll tax and extending unemployment, and a comprehensive plan to fix the economy. and that includes cutting -- rather, cutting taxes,

cutting our spending, reducing the decifit. that's what will gin up the economy. megyn: dick, as the south carolina democratic party chair, what do you hope happens on this vote that thewant to force this week? >> well, i hope that the republicans extend the obama tax cuts, and extend this thousand dollars per average working family while the republicans continue to want to extend the tax cuts for multi millionaires. they don't want to help the average american. and here's the problem. the problem is unlike the republican, we want this to succeed. the republicans are constantly finding a way to thwart barack obama's effort to put this country's economic -- put it back on its feet economically. this will put a thousand -- keep a thousand dollars in the pockets of average americans who will then spend it on things that will generate jobs. this idea that a multi millionaire is going to, if he saves a thousand dollars or $2000, is going to do anything other than buy pate

and cham champagne with it -- >> pa tevment! brad, there was a payroll tax holiday put in place last year and republicans have come out and say where is the evidence that that created jobs? or helped the economy? >> there is no evidence, other than, again, we rob peter to pay paul, we create more debt for social security which is already in big trouble, and by the way, my friend just misspoke. it's now the obama tax cuts? i thought it of the bush tax cuts that obama had. don't you remember that, dismik it of the bush tax cuts, wasn't it? >> the payroll tax cuts is the obama tax cuts. >> i'm talking about what obama did. didn't he reup the bush tax cuts? >> he reuped the bush tax cuts. let me say something about that. he did that because the country at the time needed it. this idea that these tax cuts ought to go on forever -- >> but we don't need it anymore? >> no, no, what we're talking -- look. it's not all or nothing. and what every american has

to be called upon, for some sack fierks if we're going to get out of the mess we're in. it's not rich against poor, it's not middle class against rich. >> it is. >> brad -- the problem i have with all of this is it's this or that. what we need to do is compromise. i suggest barack obama is ready to compromise. i think that john boehner offered to talk about this and compromise. the problem is, we both have, on both sides of the aisle, people who are extreme and will not negotiate and won't talk. i ask that john boehner and mitch mcconnell come together with the the and come up with a comprehensive tax plan. >> it takes two to tango. this president doesn't lead. this president goes off into -- >> otherwise we're -- otherwise we're going down this terrible road. megyn: there's a piece in the "wall street journal," if this social security payroll tax is extended in the way that the president and the democrats want, it will cost the government $111.7 billion. $111.7 billion. now, that's a big number,

brad. >> it is. megyn: is that something that the republicans can get behind, if for no other reason than to save themselves politically? because you can hear, you know, dick and other democrats are going to come out and say they protected the rich, you know, at every turn, but when it came to giving the middle class tax break, they said no, that's where we have to draw the line and tighten our belts. >> it's time to create opportunity, not dependency, it's time to give the american people the tough love they need across the board, rich, poor, middle class, everybody needs to sacrifice in a bad economy. but it's got to be cutting taxes, cutting spending, reducing the decifit. it can't be one and forget about the others, and the fact of the matter is, the president had a perfect opportunity to show leadership on the decifit, he refused to do it, he went off to the apec summit, went globe trotting, instead of being where he needed to be, and democrats all over washington have told me, they don't understand why this president refused to take the bull by the horns and lead and create some kind of record upon which he

megyn: well, new developments today in a missing persons case that's getting national attention. police in florida, raiding a home, hoping for new clues in the search for missing mom michelle parker, the mother of three, disappearing on november 17th, just hours after her case against her ex-fiance over an engage mentoring appeared on the tv show "the peoples court", the home targeted by police belongs to her ex-fiance's father. pat brosnan is ceo of brosnan risk consultants. so police are saying the

this time he came in pretty much in line with the conservative ideology of the party. particularly iowa. iowans are anti-illegal immigration and to a certain extent he's trying to stay there in case he wants to play there. megyn: how can the romney campaign say there has been no change. >> there has been a change and the tape is always there. it goes with a series of things and this is part of why a lot of conservatives don't trust him because there have been a lot of alterations to his positions over the years and that caused lack of support for him. megyn: we just got done a segment with larry sabato that talked about the key endorsement of the "union leader" newspaper in new hampshire of gingrich. their editorial page director said romney doesn't want to

offend anybody or everybody. he wants to be liked. imagine what that would be like as president. somebody who plays it safe. is that the problem for mitt romney? he says what people want to hear, then this political opponents just have a heyday * with it? >> that's right. ed touched on it. larry sabato touched on it. mitt ram any has a trust problem. the "union leader" has been watching mitt romney like i have. they know he has been on the other side of every issue. iowa is far more important than the romney campaign has let on. they have taken a page from the kerry playbook. you read the poll numbers. they sound impressive. but when you dive into them. 16% or more of the voters in those polls say we can change our mind.

he went into new hampshire because without new hampshire there is no nomination. that's the situation romney is in. that was before the "union leader" endorsement of newt gingrich. megyn: how does this happen that mitt romney -- it's one thing if you have said something in the past that kind of agrees with the guy you are about to attack. but he came out back in '0 and said those in the u.s. illegally now are not going to be rounded up and box cared out. gingrich comes out at the last debate and says it's not vealistic to think we are going to ship 11 million people out of the country. romney says that's amnesty, that's a magnet and goes after gingrich on it. isn't there some discussion inside the romney camp if this comes up you better be careful because you said this and you don't want to do a 180 in front of the american people.

>> there should have been. he has done a lot of 180s. and he got burned so badly last time. i think no one expected him to talk about immigration this time. this was not going to be a big overwhelming issue. the economy and jobs would be the overwhelming issue. newt came out with a thoughtful position but not a good policy position. bachmann has attacked him and romney sees gingrich as a serious opponent and feels he has to take him on by being more to the right on this issue. megyn: is this going to help the democrats? you have romney moving further to the right on immigration. the one thing even though iowans may be anti-illegal i am graiption. the his andic population does not want to see talk of round up

illegals and shimg them away. if you have candidates forced to go first right on that. is this music to the ears of barack obama? >> it is. it's a key constituency for president obama. he's not going to change his position on this. mitt romney changed his position every day on this. other thing iowans and others will remember. we have newt romney saying i can't hire illegal immigrants, i'm running for offers. not because it was wrong. but because he was running for office. megyn: then the direct flip flopping and more importantly is the substance of it. michele bachmann, she said i want a fence. she said i want a double fence. i see your fence and raise you double fence. that makes play in iowa.

saying i taped his wife and she talked about the alleged abuse of me. and he said the syracuse police officer said the statute of limitation has run. espn said he had gone to the authorities we we didn't. do the cops have it right? can charges be brought against bernie fine? >> i defend people every single day right now and the evidence is much lighter and this. you have a tape-recording of the wife -- if you look at it in an isolated way, it may not prove anything. but when you add to it the testimony of the victim, of course it is a prosecutable case against the husband. i don't think it is a criminally prosecutable case against the wife. but at the time that was brought to the authorities, absolutely he could have been arrested based on the evidence of the victim himself. megyn: i don't know what the

statute of limb taightss is in new york state. this guy, this kid bobby davis was living in the fine's basement for a period of:00 years. he claims he was abused from the age of 13. then he said stop it. i ask you, mark, under that scenario, now he's in his 30s, could he come out and say i want to prosecute a case, i want to be the complainant in a case against bernie fine? >> he can say whatever he wants to say. as abhorrent as the alleged conduct, five years is the statute of limitation. those have run. against the wife, as abhorrent and reprehensible as her actions, i see no crime they can

bring. there is no mandatory reporting requirement of child abuse or sexual abuse unless you are a healthcare professional or teach were a professional obligation. megyn: he allegedly lived in the basement and is saying the wife witnesses at least one of the incidents. when you listened to her on the tape she seemed to acknowledge he has in her view a propensity for little boys. here is just one sound bite number one with the wife on that. listen. megyn: if they sue the fines, bernie and his wife lori, that tape suggests she had knowledge. >> here is what i would argue.

but in the state of new york, the on -- any time someone has a duty to look after a younger person, they have an obligation to report any kind of sexual abuse. a fireman, a hospital worker, a teacher. my argument would be this kid is living in her basement. she is de facto this guardian during the time when he's a minor. she now has an obligation to report this. even though there are a lot of laws about not testifying against your husband. those have to do with the criminal law. megyn: you are true criminal lawyers. a lot of civil lawyers come on, but you are actual criminal lawyers. if you are defending bernie fine. he gets charged. you have got some points that you can raise. there are questions about whether the first two accusers tried to shake this guy down for money. then the third guy who is

accusing him is facing charges of himself being a child molester and his far it is saying he's a liar. he's making the whole thing up. >> fortunately or unfortunately. unfortunately because i'm a citizen who cares about victims, there always is unless there is a busload of nuns or a confession, there is always something that could be dug into, there is always reasonable doubt that can be created. usually it's one-on-one. megyn: we are seeing that in the penn state case. still no charges were brought. >> the prosecutor's argument is one person made it up, maybe be two people made it up? maybe not. is coach fine the most unlucky man in the world to have all three people select him to be the victim of this?
