congressman west to write those harsh words? he joins us. >> what a blistering facebook posting. what's up with that? >> well, first of all, merry christmas to you, greta. and it's not about being blistering. i grew up in the united states military and you have to be able to call it as you see it. and i'm very concerned about this very device i have rhetoric that the president is using when he tense to talk about equality and fairness and this thing that i think is really contrary to the principles that i mentioned as far as life, liberty and pursuit of happiness because the government cannot guarantee happiness. if we believe there are people in washington, d.c. who are going to be the arbitors and trying to create fairness. we remember talking about a chick anyone every pot. and economic social justice, then we get away from having the right kind of monetary policy, fiscal and tax policy that can turn in dismal economic situation around in our country. >> is it that we don't all sort

of have the same definition of fairness? where if i can take from what you say, fairness should be an opportunity to achieve, whereas the president might think that fairness is that everyone have an education so everyone can go on to achieve. is it that simply a difference in definition of fairness or do you think the president is almost deliberately sinking the ship? >> i think when you listen to the president's speech where he's talking about supply-side economics has failed, really, it is his economic policies of that failed. the fact that the president has added $4.4 trillion of new debt which is more from what george washington to bill clinton. the thing we have to remember, and remembering the great quote from abraham lincoln, talking about the two definitionings of liberty. of, where some believe it's doing with the fruits of their own labor and other people think it's you can do what you wish with another person's fruits of their labor. and in that same word there is

two separate definitions, which is liberty and tyranny, and lincoln talked about that in 1864. >> have you had a conversation withs the president and talked with him and asked him about his ideology and compared yours with his? >> i would be happy to sit down with the president and talk about the two different i had logical bases that we look at. i believe in a constitutional republic. i don't believe in a nanny state. i don't believe in manipulating the american people for political gain. i believe web have to be honest with them and tell them the truth and i don't think the president sees it that way. i think that the president believes that this is about gaining votes. that's not what i see if if we e going to get the fiscal situation for america turned around so we can have better days for our children and grandchildren. >> can you say whether you think the president is helping the country, hurting the country, or maintaining the status quo in your opinion? >> well, let's look at the numbers. since january of 2009 we've seen a 41% increase in people that

are on food stamps. we've seen a 16% increase of people on poverty. we see 48.5% of america now on government aid. we talked about the 3 years of trillion dollar-plus deficits and he's added $4.4 trillion of new debt. he's not doing the thing to turn the country around but instead he wants to continue to blame house republicans. we have about 25 pees of legislation sitting over in the senate now that will help turn around the job situation in america. as a matter of fact, tonight we just passed another piece of legislation that will preclude us from here in washington d.c. to have agencies institute legislation that will have major economic impact on the private sector. >> i realize a lot can happen or change but who do you view at the moment for the potential candidates for your party's nomination do you believe is the best candidate, the most able to beat the president? >> well, i'm going to leave that

up to the pundits and the poll centers. >> but your voice is important. >> i don't think only that important. >> well, you are. you are a member of the freshman class of the house that's had an enormous impact on the house, whether for good, bad or indifferent and people are curious what you think. they tune in to listen to what you have to say. i think they want to know what you think about this race. >> let me put it this way. it's not about the individual. this is what i think we have to have in a candidate to go up against president obama. they have to impeccable charisma and persona that can deliver our message and can really lay out a plan by which we can turn the country around and get it back on the right track and getting the american people believing in those of us who are elected to be truly leaders and not just politicians. so i think those are the type of character or qualities that i would be looking for for someone to hold. the president has an incredible megaphone, he has a platform and

people will watch than mr. trump. anybody can have a debate. it depends on who sees it, obviously, and whether the candidates decide to commit to it. they make those decisions based on a lot of reasons and white now we are seeing more of them that are saying yes than no. >> at the risk of having everyone, i don't know, disagree with me but i will say it anyway, we haven't seen trump's debate. who knows, maybe he will dazzle us and do it better than any of us could. >> but one thing is the timing. it's two days after christmas and very late in the game. they have had requests on the table for months, maybe a year they are saying yes or no to. the other thing is trump himself. he's been a polarizing figure throughout this. he questioned president obama's birth stat us and he's now known primarily as an entertainer and real estate magnet as well. but he's said he's pretty sure are who he is going to endorse and he said republicans, if you choose the wrong one, i'm going to run as an independent. that makes it hard to sell him as a moderator.

>> let's assume he has all the candidates. but he doesn't have them all , but if he does, his questions, if he posed essentially the same questions to all of them, does it matter? >> no. anyone can make an interesting presidential debate if they ask the right questions and engage the candidates the right way. if you are a candidate running for president right now you have to make a calculation based on what is the up side or the downside. the up side is obviously cozying up to donald trump, perhaps getting his endorsement and do you get tarnished by the trump brand and are you taking away from other campaign time? you can sit in the fox greenroom and get more exposure than this debate is going to get. >> i was surprised that the campaigns don't want to do it, that they -- i would want to play it both ways. i don't want to offend donald dd trump, and it seems like there's another way to get out of it, i have other plans, with my family

with the holidays and christmas or it's a week out from iowa caucus, can't miss it, i have to visit 75 other counties. some of them are a little more dramatic and in his face. >> ron paul has been in a feud with him and he's easy to dismiss. and i think jon huntsman gets some political benefit out of this because he's a a twitter war with donald trump and that's a good thing because it's at least one thing. people are taking notice of the campaign. and mitt romney, there's little chance he was going to do it but he could have been moral subsequent in explaining it in a way that doesn't necessarily make the donald a little angry at you >> the more something thing is it actually -- i hate to use the word pitiful, but the fact that the candidates, in order to get attraction is the only way you can do it is to take a twitter to fight with donald trump or to slap him around the media. it means they aren't getting campaign funds to run adds, it means they aren't engaged in huge debate and you would be better off to engage the president in a fight. >> there will be more debates,

our debate and the fox debate coming before iowa. they will play it out. nobody said there aren't enough debates but what the candidates have said is not all of the debates are created equal, not all are worth accepting. and you have a twitter, you have the cable news world and you have other ways to reach voteners mass quantities than just through presidential debates. >> i'm die to go see what the people of iowa say. they always say the people of iowa are independent and people of new hampshire are indifferent. i'm wondering if the people of iowa think we are basically all nuts and they are happy to have any debate there, brings attention to the economy and the issues. i wonder what the people of iowa think. >> you can reach more goose news by doing your own events than going on with donald trump. you want to maximize every media appearance and minimizing the downside and for some the trump debate doesn't get it done. >> and santorum is in.

what does he get out of it? >> santorum would love any debate he is by himself or close to by himself. >> that's a good ad. >> it's a chance to reach more voters. unless you are going to make a big point utah to of not going, go there and make your pitch and maybe more people will sign on. he would love if we would fine him an alternative to newt gingrich all of a sudden. >> and i'm not sure he won't have a surprise showing in iowa. he's been to every county and he has a lot of the things that they have in agreement with the evangelical vote. i'm not so sure he won't surprise everybody. >> you have made it this far, you certainly have a chance, that's an argument you can make. you would think if he was ready to make a move we would have seen it in the polling already but what we've nine iowa many times is this stuff colesses very quickly. things move so fast in the final months and we are in the middle of it. >> that's today. who knows if it will change tomorrow. thank you.

washington examiner's offices today and met with the editorial board. we talked about a whole range of issues. >> he is now saying he has signed the front and the back of a paycheck means what? >> that's the governor saying that he understand the economy. he signed the back of a paycheck as an employee and he signed the front as an employer. he knows how to create jobs and hire, et cetera. there's been criticism of him in the past he was really kind after turn around artist or that he would just buy businesses and kind of take all the profits he could out of them and sell them. and he's pointed out that he has been a net job creator, which is true, over the course of his business career. >> what has happened to his campaign? how did he let speaker gingrich sort of move up and pass him in all these polls? he was leading all the polls and coasting. he said he couldn't seem to move up or down, but what happened? >> we actually asked him that today, it was the first question. he said he didn't know but he theorized a little bit.

he said maybe people have known me for a long time, you have new people come in and the republicans get very excited about them and they zoom up in the polls for a while and then they come back down after people get to know him. that's his working theory about this. but the fact is there is a large number of republicans who are willing to just bend over backwards not to support mitt romney right now. we haven't had any voting yet but if that continues into iowa, new hampshire, south carolina, he could be in real trouble. >> but on the other hand speaker gingrich also have some former colleagues, senator tom coborn served in the house with him and he came out this weekend and some of his former colleagues have strong feelings for him that are not good feels for a candidate. >> that was on fox news sunday. it is clear senator coborn still nurses wounds from fights he had with gingrich back in the 1990s. there's a huge insider-outsider divide as far as newt gingrich is concerned. when you talk to insiders,

either journalists or people who worked with him, they remember tantrums and arrogance and all sorts of bad things about gingrich. you go to iowa and south carolina and you talk to people who have never met newt gingrich, they have just watched it, they remember he won the house in 1994 in a historic election. he helped balance the budget and create a surplus. he passed welfare reform with bill clinton. he kind of pushed him to do that. they remember the accomplishments much newt gingrich and not the petty stuff. >> are those legitimate accomplishments? in washington we can get isn't that correcty with each other and if you have one bad day everybody spreads it around and think the person can be a jerk when it's just one bad day in seven years. did he accomplish things or is he assume the accomplishments of others? >> he absolutely did. he had the vision to even imagine a republican victory taking over the house after 40 years of democratic rule.

he's the single most important person in that. as far as the balanced budget is concerned and welfare are concerned, welfare reform, republicans. a situation in which they basically dragged bill clinton kicking and screaming to do these things. these are major accomplishments. the clinton presidency. but he think he can say he and newt gingrich played a role in that. >> what is his strategy now, mitt romney? things have changed. did he indicated to he's going to change the strategy of his campaign? >> the fact he met with us is part of the new strategy. he is talking to the press more. he gave a speech today to the republican jewish coalition. he's agreed to interview with chris wallace on fox news sunday. so he's opening up to the media a little more. he has a lot of money to run television ads that he's starting to d he told us today he's planning on doing that virtually continually from now

on. >> he was going to do us today but it was going to be about twelve hours before we were going to air it and we were fearful by the time twelve hours rolled around it would be dated so we tried to trade off for the future and ask for the future. >> he is incredibly tightly scheduled. he had an event in phoenix, went to l.a., flew overnight to washington and going back that same night for an event in san francisco. he's been flying all over the place. >> commercial or private? i mean it's not easy private but it's much easier than flying commercial. >> private. >> private? i don't mean to undermine it, but it's still tough. >> but flying overnight, if everybody has done, it you sit in the chair overnight and arrive at six in the morning, you are wasted. he flew overnight to washington, met with us and went to speak to the others after that. >> is he edgy? i thought he was a little bit with bret baier but how was he today? >> he was fine. there wasn't that edginess.

i think what he showed with brett was a bad idea because brett was asking him the kind of questions that's going to continue to face. these are legitimateñi questions about his record as governor of massachusetts. the romney campaign, if you talk to them a long time, they believe these questions have been asked and answered. they say we've told you the answers to these questions, why do you keep asking them? well, there's no questions created by the questions. he has to understand he will keep facing these for the next several months if he continues in the primary. >> and especially before the 4th. >> it all starts again before the general election. >> it sure does. thank you. >> thank you. >> bad news tore former illinois governor blagojevich. he was convicted of 18 counts of corruption. they include allegations that he tried to sell president obama's senate seat. during the sentencing hearing he made a plea to the judge for mercy. he said he made terrible mistakes and admitted to breaking the law.

the judge said that did not mitigate his crimes. blagojevich spoke to reporters after hearing of his punishment. >> this is a time to be strong, this is a time to fight through adversity. this is a time for me to be strong for my children, to be strong for patty, and this is also a time for patty and me to get home so we can explain to our kids, our babies amy and annie, what what what happened,t means and where we go from here. we will keep fighting on lou the adversity. >> he has to report to prison by february 16. straight ahead, is president obama starting to sound like a broken record? he keeps saying that everyone must pay his fair share. does his message, though, is it now coming under sharp attack? senator jeff sessions goes on record next. and did the justice department mislead or outride lie about fast and furious? eric holder is about to get questioned. and they will talk about a square off on capitol hill. and plus a question and answer becomes a war of words.

and another thing to another person. i think what we should do is look to have a more fair, legitimate, honest system for running our government and we need to do that in a way that i think allows the american people to see exactly what the president is proposing is fair precisely. he has no long-term plan. this is only a short term, one-year stimulus plan through the payroll holiday. and he's demanding if you don't agree with that, somehow you don't believe in fairness. i don't think that is what we need right now. we need a policy that would allow this country to prosper, allow the workers in america to have jobs, to allow more energy to be created at a reasonable price, to eliminate unnecessary regulations, have a tax system that's fair and allow the growth and prosperity to eliminate this debt cloud that's over the country. he's providing no leadership on those big issues. >> i'm all in favor of fairness. but when a term gets thrown

around fair share, fair share, fair share, and i'm trying to think, you know, the president should define it exactly what that means or anyone who uses it. the republicans should define it, as well. it's become simply a weapon now with any sort of sense in rootedness or policy or in any sort of effort to truly figure out how we get out of this mess. >> i've got to say that's a very insight mull comment you made. i think it applies to republicans and democrats. we use that word too lightly. we need to ask each other what do we mean specifically? you are correct in terms of policy. >> the president is out in the middle of the west, giving a speech. love it when they go to the middle west, that's where i'm front and up here at the capitol they are fighting over something else. has there been any discussion about fair share, and what to do with jobs between the white house and capitol hill in the last couple months? >> i don't think so. there may be some talking between the white house and

harry reid and the senate leader and the republican leadership and round and round we go, but, no, i don't think the president has laid out a plan that would put america on a sound course for the future that he can ask us to adopt in a way that would make our tax system simpler and fairer and more productive. to create more american energy and more american jobs. those kind of things require some work and some leadership. we can do it with the president's leadership, but he's not providing that. >> it seems typically what a president does or somebody does is play a plan on the table and everyone debates it and decides about what we can live with, can't live with, and what works or doesn't. and i don't have the sense anybody is laying anything on the table. and we are totally at the campaign level. they just fire shots at each other. i don't see any underlying problem solving resolution going on. >> i believe that's a fair assessment. i think you are right about

that. the president, earlier than any president i have ever seen, seem to be of in a full-time campaign mode. he's picked out a few issue that he thinks highlights his agenda. he believes he has a clever position on continuing the payroll tax and actually expanding it more than double. the original proposal was to make it more than twice as big as before and it's a dangerous trend to weaken social security, in my opinion, and also increases our debt. so we've got to be really careful how we do that. and we are not seeing, i think, the kind of balanced leadership we need. >> it's clear -- but at some point i believe you will endorse some republicans or who do you like? >> i like both of our leading candidates today. >> that's okay, come on, who do you like better? who do you like better? >> i don't know. >> you don't really? >> i've talked with friends and talked around in certificate expels we see talents in both of the leading candidates and other candidates, too. but in recent days you are

looking at the two leaders. we see strengths and weakness necessary all of them. >> forget who you like or the strengths. who do you think has a better chance, general election which is entire election. who has a better chance to beat president obama in your opinion? >> that's a tough question. i think that it's hard to say, really. let's say newt gingrich. somebody that people would contend he might make a mistake. he may go over the top and he might not be our best candidates. he's polarizing. >> have you ever seen that, by the way? >> well, he has been aggressive. sometimes his plans haven't worked. but people know he's a fighter. he could catch the mood of the american people and be the strongest candidate in november. mitt romney is a solid candidate. the american people i think will go to like him know as they know know him better. he's the kind of manager i think

they have got the nerve to say things like, well, bush did it. i know with your legal experience you know the difference between a controlled delivery, what you get with drugs when people, law enforcement go in and they set up a buy, they deliver the drugs, and then as soon as they do they arrest everybody. these guys have got the nerve to say, well, bush did this. they did some controlled deliveries. they did it in conjunction with mexico. these guys, they were not being -- they were either very stupid or very corrupt. >> now, that stack you got last week, right? those documents? >> well, they turned them over i think friday. >> attorney general eric holder is going to testify tomorrow and there's a new allegation or suggestion that in addition to this gunrunning operation there is also now a suggestion that maybe the d. a. was involved in some money laundering which is a whole another thing. but i'm curious, the big question is for the fast and furious, who authorized it and

who is the highest person to know about it? and did that person know about it before it was authorized or after? those are the simple questions, right? >> exactly. and you have talked to darryl about it and darryl issa has done a terrific job being relentless in pushing this forward. and we will have a chance to go forward. >> but that question doesn't get answered. >> it does. >> this has been going on for a year. >> it has. >> this is an awful lot of man hours being expended on this. >> that's right. >> even to xerox that for the justice department on capitol hill. those questions, when you pose those questions, what are the answers you get? >> well, they are evasive. they provide documents like this, the 2 pages of grassley's letter, 92 letters over and over. but the question is do we want an attorney general who is either so crazy that he would

authorize something like this or who didn't even know about it and is so incompetent we would still want him there anyway? and some people say they get to play in these partisan games. let me tell you, back after it was disclosed that the national security letter process had been abused, maybe 3,000 times, some of us let the white house know it's time for a change. we can't have this with republicans and we've got doug casey has attorney general. >> you think holder should go? >> absolutely. there should be no question he should go. >> you know, i have known him for years. he was a judge here in d.c. >> is that when he was represent being the terrorists? >> i know when he was on the bench he was a well-respected judge. what i don't understand is why you can't get your simple questions answered and why he doesn't order them to be answered and why you get a

ridiculous document. >> this is a game. >> and why you get this game. it's just stunning to me and why the president, if eric holder won't do it, why the president doesn't order him to. it is such a waste of money, such a game. it's such a poor statement about so many things. >> and then they hold us off on producing documents that they provided to some of our enemies but they won't even produce to congress. and then you've got him out there refusing to prosecute named, but unindicted co-conspirators. you even had a 5th circuit been saying basically there's sufficient evidence to go forward against these guys and he won't even prosecute them. >> are there any democratic members of congress to say even privately that holder needs to go? >> they haven't yet and i had the nerve to say that to senator schumer back in july of 2007.

jason joins us. good evening, sir. >> good evening to you. >> you represent two employees, at least right now, and you expect to expand it to more employees. what is their claim? >> right. we are going to try to represent a class of 3,000 employees of mf global in the united states and abroad, and the claim is that jon corzine and the board of directors breached their fiduciary duties to these employees. they encouraged them to put their retirement savings, and most of their pay, in company stock. he misled them about the financial condition of the company, blew up the company with a $6 billion risky bet on european sovereign debt, now our retirement savings, is up in smoke. >> there are a couple issues. number one is these employees are out of money and feel they y have been wronged by jon corzine and the company and others. but you have money that was squandered or lost by the company or others.

do you contend that your employees would be head of these customers when everything is sorted out? because there's not a lot of money there. not everybody is going to get satisfied. do your clients come ahead of the customers that lost money in mf global for before? >> well, we are in federal court in the southern district of new york. the customers are in bankruptcy. there's a trustee who is appointed to try to locate their money and trace it. it may be at jp morgan and other banks. we are separate and apart from that. core design personally is responsible, as is the board of directors. so we are going to go after them personally. the man is worth hundreds of millions of dollars. he's the one that called the shots and took this bet. there's insurance coverage for this. so we are going after the individuals personally, separate and apart from the customers. >> all right. so it's an entirely different pot. it's not the pot, the value of the company, but to go after those personally and not the company? >> right. mf global is in bankruptcy, there's a trustee, and that's

separate and apart. it's actually a few blocks away from the courthouse that we are talking about so it's completely separate and apart. >> has former senator jon corzine said anything yet or has he gone dark since the october 31st bankruptcy filing? >> jon corzine is a wall. he has been southeastern no to to -- has been going to be at the house of representatives. i assume he will take the fifth. he went to a company that was a leading commodities broker, thought he would make it in the next investment bank. he bet the farm on this european sovereign debt, it's all gone, and jon corzine, we will be looking at his personal assets and make him accountable. >> but there's a big difference between being a bad company guy, a bad investor or an accident or whatever and being deceitful and misleading and hiding and all that. which category are you saying that senator jon corzine fits
