candidates on the virginia primary ballot. two. why newt is last off. president obama is waking up in hawaii. mid-70's, nice and sunny, starting a ten day vacation, but not before locking back. rick: he sat down this week for an interest with barbara walters and add meted he made a few mistakes. listen to what he said. >> probably once a day i say, i think that when i first came in to office, we made a decision not to scare the american people with how bad the economy might get but i think i could have done a better job preparing the american people to let them know, this is going to be a long haul. this is not your typical recession. >> this is really, really interesting interview.

lost. that frustrated a lot of people around the country and they want to see action on behalf of some of the issues. >> that is the same old sentiment that has been echoed since the day he took office, which was, i inherited a bad situation. and maybe i tried to compromise too much and the other side does not play ball. >>dave: you look at the first two years, the president had a filibuster proof majority with numbers in the house and the senate and he did not exactly lock for compromise. he said i'm going to pass health care whether you like it or not, i will ram through the $1 trillion stimulus, whether you like it or not. so was the effort right away compromised? or did this happen by nature of what happened in 2010 when congress went to the republicans, or, the house of representatives did. >> the idea of unity does not work out. in washington.

so you might as well not run on that. rick: and hope which is the thing everybody said, there is hope with this but throw years later are you still hanging on to that. romney yesterday in new hampshire firing back at what his ideas are to what the president had to say. >> i'm afraid the president and the vice president and their colleagues are living in fantasy land. the reason i am running is to help middle income members have god jobs and rising income. their record over the last three years has been abysmal, with 25 million americans can attest that the obama policies have not worked. this recession has taken too long to come out, the slowest recovery since hoover and for the vice president to be proud of their record is extraordinary. >>dave: what will emerge is romney's time at the capital; that a positive or negative testify? gingrich forced romney to find why that is a positive and why some businesses failing, some succeeding, is what you want.

that is american enterprise at its finest. we shell see. what are the other top g.o.p. candidates up to? for more on that we go to peter who is live in washington, dc. peter, two people are on the virginia ballot? two people? >>peter: everyone has gone home for christmas because they were done with their work. it does look like i am sitting in the dark. rick: maybe they didn't pay the bill at the capitol hill. >>peter: super tuesday on march 6 will not be so super for gingrich or rick perry because they failed to qualify for the virginia g.o.p. primary ballot. gingrich surged to the front of the pack and now considered a grant runner but this certainly does not help his cause. all the candidateds needed to

qualify was 10 thousand signatures in a state with eight million people, and governor perry's communications director points out his boss entered the race in mid-august and it will not affect qualifying for the ballot if other states because this is isolated instance. romney, and current congressman ron paul, they did make the 10,000 signature threshhold and they will be on the primary ballot. and paul is leading in iowa with 29 percent according to the american research group and he says that was not expected. >> i'm supposed to say i'm not surprised and i expected it. i'm surprised but very pleased. i was convinced the message would be popular and necessary. i was not sure i would be the messenger to deliver it. the crowds are getting bigger. >>peter: so, president obama won virginia in 2008 beating senator john mccain by a spread of 6 1/2 points and we are just talking about the

primary it could have a major impact in a future general election if rick perry or gingrich gets the g.o.p. nomination. because virginia has 13 electoral votes and you only need 270 to win. >>dave: this speaks to the problem with gingrich, the organization factor. karl rove tacked about that, a lack of organization there, and will this be what ultimate textually spills his fit? his doom? i don't. we will talk to karl about that. >> yesterday, you were saying what? rick: donald trump has been a democrat and a republican. no longer. now he is registered as an independent. is this possibly covering his bases. now maybe he is setting the stage for what could be an independent run which many have speculated and he nasa not ruled out. >> we talked about a lot of republicans and democrats have

decided to swarm the independence realm. >>dave: 2.5 million voters left the republican and democrat party for the independent. rick: and 50 percent of younger party are registered as independents. >>dave: and more democrats have left, and trip says he is registered as an independent saying for a year now if he is not satisfied with who the republican candidate is, he may elect to run as an independent. this change in party affiliation preserves his right to do so after the finale, will of "the apprentice," in may. it is maddening we continue to hear about this. maybe it, maybe he genuinely means this and he may run but if there is the wrong candidate who is nominated, who is it? stand up and say who you want to

be nominated. who is that person that with force him to run in is it ron paul? is it romney? we know he sports gingrich. who is the wrong candidate? >> give us a call. he watches our show. >>dave: he is always on, on monday. >> why don't we talk to him today, people? and now the headlines, 'tis the season for junior traveling headaches. snow and ice making for dangerous road conditions in wisconsin and you can see the highways there are barely visible. not fun to drive in. the snow piling up in parts of new mexico, colorado, california, and texas. and not good news for the millions people who will be hitting the roads to spend christmas with loved ones. as for air travel, well, there are in delays reported right new. right now. but, it is still early obviously and that could change. i will monitor american airlines today. after coming under fire the re-election campaign of

president obama is saying "thanks, but no thanks," to jon corzine's, cash facing criticism the minute from the former new jersey governor was tainted by his firm, and the mf global collapse so obama for america and the dnc have reindependenced the money, $70,000, to corzine and his wife. the justice department rejected south carolina's new voter i.d. law requiring voters to show photo identification at the polls. the feds say that makes it harder for minorities to vote. south carolina can challenge the decision or pass a new law. the attorney general vowing to fight this one. >> the 15-year-old girl who survived being swept away in the tsunami in indonesia has tracked down her parents and telling a very, very, very horrible story after being separated, the girl who was only eight, said she was like basically adopted by a woman and forced to beg on the

streets and she stopped bringing the money the woman said, fine, go find out who your real parents are and she did and she was reunited with them. we heard this story yesterday, and i thought it sounded weird. rick: seven years ago on christmas, it made for such a terrifying christmas. seven years ago when the tsunami happened and seven years ago a great christmas story for the family to find their daughter. you assumed she was gone along with half a million others. >> she could not remember who her parents were, but she talked to someone in a cafe and she explained her story and the cafe guy knew the grandfather. dave date end of 2012 is right around the corner, so what can you expect from the economy? peter is here to break it down. five easy indicators to look for.

understood. but the first sign that consumes are slowing down, a sign. >>peter: look at last month's data. in the last several month consumer spending has been outrunning their income and the savings rate is falling. in february the credit card bills come and they can not borrow against their house and they will have to slow down. >>juliet: we have trouble in europe creating havoc in the united states. >>peter: not isolated fromup's banks. if europe fall interests a full-scale crisis and banks fail or require bailouts, that will feedback into u.s. banks, credits drying up in europe now, and it could dry up further in the united states. >>juliet: it is slowing down in china, as well? >>guest: they have their own property bubble but it is exchange. the government owns the big bans, and at the love the -- lot of the banks are underwater.

and brazil is concerned about china and protectionism. china is pushing down the currency again so the latin americans are throwing up tariffs to insulate their industries. >>juliet: we will see higher gas prices. >>peter: $100 a barrel is a big tax but president obama does not think we should drill for oil in the united states but it is environmentally sound to import it from nigeria. >>juliet: a lot of people are going in the job force but too many co-eds and social workers. >>peter: the engineering firms are filled with foreign student whose go home and the high schools do not produce the technical trades. big labor shortage in manufacturing where there has been a resurgence because the high schools, frankly, are not doing their job. >>juliet: well wrap this up, now, but this is christmas eve and we would like good news, can

>>dave: a wonderful christmas story to tell you about from the state of arizona. a young 21-year-old university of arizona college student whoth some thought would be taken off life support, there were no signs of life, there was no sign of brain function, and, yes, you are looking at this young man who emerged from a coma in late october and could be home for christmas. rick: he was in a car crash in october, they had to fly him to phoenix and they thought they would have to pull the plug. and they said there were a couple of signs of life, and they gave it one more week before they made that kind tough decision, and he moved a couple of his fingers. >> i don't remember much from the coma. but after that, i remember, i could see myself blinking, going

to school, and work, anything like that. >>juliet: he is getting ready to go home for christmas. his doctors, obviously, were thrilled. >> the odds of him making it were very slim. no question. the longer he stayed in this deep coe month without reaction of the pupils, the less likely hood he would emerge. but in medicine, we see things that obviously are the exception to the rule and he was one. rick: amazing for that mom worried about that kind of a decision and now, three months later to sit with this gift. >>dave: some might argue he had a guardian angel and a survey out this weekend says that nearly eight in ten americans, 77 percent, say they do, in fact, believe in angels.

against holder. >>guest: merry christmas. >>dave: what do you hope to get out of the attorney general when you hope he testifies in front of the house next month? >>guest: well, honesty. first of all. i want to say i'm very proud of what issa and the committee are doing. they are doing their constitutional duty to oversight the executive branch of the government. we are not supposed to pass laws with our name but oversight the check and balance open the executive branch and we do just that in a very professional manner. >>dave: do you think holder survives this next couple of months? >>guest: i home he doesn't. not to be vindictive but he lost the confidence of members of congress, but of the millions of people that we represent. and it is not just "fast and furious," that could be the

crown jewel here but there is a pattern, now, a pattern of selectively enforcing the law. john adams said we are a country of laws not a country of men. and to man and his agency put his party, his ideology, and his boss above equal application of the law. that is the last thing you need in an attorney general. >>dave: and now his south carolina with the south carolina vote are i.d. law requiring i.d. to vote discriminates against minorities. and you have passed a law there in indiana that does require i.d.'s'. where is the attorney general going wrong there? >>guest: well, they passed a law here in indiana as indiana secretary of state formally i helped write it. we went to the united states supreme court, and it passed by a large margin from the judges there in 2008 and the reason the laws are constitutional, the reason the laws have hell --

held up, they are applied equally, they are applied reasonably, and the reason the lawsuits fail is because the plaintiffs can not find one person who is truly disenfranchised. another example of applying an ideology over equal application of the law. that is wrong. and meanwhile, he is trying to overturn state laws about elections in places like south carolina, and other places around the country and he won't go after known fraud like we have found in south bend, indiana, where his boss, president obama, may not have been, probably should not have been on the ballot in indiana because a petition fraud. >>dave: a bizarre pigs -- mission trying to strike down this. and now the payroll tax cut deal that speaker boehner brokered with the senate. many in your party are unhappy,

and many house republicans fear it. are you happy how this played out and confident in boehner's speakership going forward? >>guest: well, john boehner and the leadership team are doing a great job. we have to remember we are a third of a decision around that capitol. we have a democratic senate. we have a democratic president. and they are interested in politics over policy. the payroll tax cut extension which is not the correct term, it is really a social security nonpayment. that is what is happening. we are asking peoplement to pay into their social security and that will come out of future generations and come out, somewhere, later down the road, so it is bad policy. if we were to do it we want to pay for it honestly for a career. so you can account for it after. that is all we were talking about and that was the right thing to do. regardless of politics. >>dave: should be an interesting 60 days, congressman. merry christmas to you. thanks for being with it.
