up. >> but first we begin with new reaction after a stunning development in the 2012 g.o.p. presidential race. did you hear about this one? this is a doozy. front runner news gingrich failing to make the primary ballot in the key battle ground state of virginia and he's not alone. several of the major candidates also denied, the gingrich campaign releasing a statement. quote. only a failed system excludes four out of the and voters access to the battle. voters deserve the right to vote for any top contender especially leading candidates. and a question to ask, why didn't they qualify? >> kelly, they didn't have enough signatures to get on the g.o.p. ballot, the g.o.p. primary ballot, rather, in virginia. you need 10,000 total signatures from registered voters and within those, you need from 400 from all 11 counties in the state.

mitt romney and ron paul got those and rick perry and newt gingrich did not and gingrich is saying we'll work with the government of vig to pursue an aggressive writing campaign to make sure all the voters of virginia can vote for the the analysts of their choice. but analysts say this is not good for gingrich. >> this is a problem. if you're the front runner and you can't organize your campaign so that you can meet these filing deadlines, it's elemental, the fundamental thing you do. >> the university of virginia's larry sabato. director of center for policy says another way to look at the fiasco, republicans found out they're only going campaigns to have what it takes to compete organizally, host will be romney and paul, kelly? >> wow, it's quite, quite startling to see the developments and what's the reaction from the perry campaign this morning? >> well, the perry campaign

pointed out in an e-mail to fox that their candidate got in the race mid august and saying that this is an isolated situation and it will not impact governor perry's qualifying for the ballots in every other state and while gingrich says he's going to push down for a write in campaign in virginia, perry's folks are saying they're looking at the law to determine whether an appeal or a challenge is warranted. kelly. >> kelly: and we thank you for that. of course, that's going to take place on super tuesday, march 6th. we'll see what happens with the g.o.p. and the state of virginia. thanks, peter. >> yeah. >> jamie: well, there's a lot more, kelly, to talk about this. let's bring in the panelist. great to see both of you, in black, i think you both got the memo there. are you mourning the fact that this happened? i have to start with you, angela and ask what this means for the g.o.p. >> well, it's not bad for the g.o.p., but it's bad for newt

gingrich. i mean, it questions his organizational skills, his political skills, not to be on the ballot in virginia, and you only need 10,000 signatures and now newt gingrich is bashing the process and also, jamie, he's not on the ballot in missouri and that was by choice and gingrich says that, you know, missouri's primary is a beauty contest he doesn't need to be a part of so i think it's very bad for newt gingrich, but not for the g.o.p. >> you know, you shared, angela, some of your thoughts ahead of the show with us and kirsten let me show you the poll, virginia and where the g.o.p. voters stand right now. if you look at the statistical margin of error, really, newt gingrich and mitt romney are neck and neck here. >> so, what will it mean, do you think, for newt gingrich. angela takes it a step further and basically related her thoughts to us, that she thinks if you can't abide by the rules in a place like virginia, we know is strict to get on the prime are you you probably don't

have the organizational skills to be president. am i misquoting you angela? >> no, you're not. >> jamie: kirsten? >> you're right. it's inexcusable, his home state where he's lived the last 12 years, odd enough in itself. and his claims it's the failed system and the top candidates have been kept off is actually inaccurate. three of the candidates that he referenced didn't try to get on the ballot. >> how about that? you took my next question, unbelievable, they didn't attempt to, why? because they didn't feel it's important for the race? >> they don't have the money or organization to get it done and putting all of their resources into iowa to try to, you know, get the biggest bang for their buck out of there and raise money off of that and i think it was just a lack of resources. and, but it's a pretty-- it's a pretty serious problem and well, you know, last time in 2008, six candidates in both parties managed to get on the ballot, including dennis kucinich who didn't have a lot of resources, so, you know, i

think, i saw the gingrich campaign was claiming it's too own herrous for them to get the correct address so you have to have your address match what's on the voter rolls, but that's not a great argument in a republican primary, you know, for all of the voter fraud. >> it's not a great, it's not a great argument and the problem is, too, that listen, newt gingrich would be great against obama, i think, and when it deals with policy and the fact that he's proven himself dealing with the contract with america. however, if you can't get on the ballot in one state and in another state, you don't think it's important, that's a problem, it's like he's snubbed his nose at the people in the show me state. >> i imagine virginia is not happy about it, what do you do as a candidate, angela. do you campaign at some point, ignore it completely and focus on iowa and new hampshire as kirsten raised? >> you can't afford to ignore it completely. as i stated earlier, newt

gingrich and mitt romney, neck and neck in the polls. if you recall, in alaska with the senatorial race wrote in lisa murkowski and she won. ingenuity gingrich should work with the virginia republican state party and vigorousry complain about and he has to do dual, iowa and virginia. >> jamie: the write in campaign option is doctoring interesting, isn't it, kirsten. >> i think it's illegal from what i've seen in the virginia code and a couple of people reported on this, you cannot in a primary have a write in campaign, so it looks like that's not even anption for him. and even if it was, i think it would be, it still makes him look very disorganized and if somehow, you he did become the candidate. virginia is a very, very important state, a state that typically goes republican and went to obama last time. >> last time, yes. >> and definitely in play. >> and kirsten, what does the president do where virginia is concerned? >> well, what he's been doing. he was just recently there, and

campaigning and i think that they're, you know, still going to try to win virginia, and north carolina like he did last time. which we were both. expected to go republican, but it's going to be a tough, it's going to be tough. >> i think the lesson learned, really, you need the ground troops to get this done and this particular point, you need the signatures, going forward need people handing out stuff and go there, angela. so the three that didn't attempt, santorum and huntsman, bachmann, could they get any traction in virginia? >> i don't think so, i think it's a bit too late for them. i mean, the primary is february 7th. and i still think that newt gingrich is a walking with the republican party and kirsten, it might be illegal. you can walk around certain things and i think that newt gingrich should do that after rick perry. he's not on the ballot and he's looking at legal options. that's a mistake, you don't get

warriors to solve the problem, you get people to solve the problem. >> what's the problem? why were ron paul and mitt romney able to get on the ballot, but gingrich and perry couldn't? i mean, it doesn't make any sense. >> organization. >> jamie: and they're-- >> they're arguing the problem is with the system, but, you know, ron paul was able to do it and mitt romney was able to do it. >> jamie: well, some people-- >> able. >> there's a problem. >> the reason why they're able to do it because ron paul has a lot of grass roots people working for him and look, mitt romney is an establishment candidate and well-organized. >> jamie: got to leave it there, ladies. for sure you need the organizationment we'll keep an eye on the organization and they're strict and some critics say they should review the rules in virginia. thanks so much, great to see you. kelly. >> both president obama and his republican rival is using their weekly radio and internet addresses on this christmas eve to thank the troops for their valuable service and the first lady joining the president to offer her best wishes.

>> jamie: winter weather a causing a mess and crews in wisconsin are salting and clearing the highways as best they can, several accidents on highway 29 north of madison, including one that sent a car skidding into a ditch. and there's also snow in texas and stranding, rather, several hundred travelers at an el paso bus station and the problem is so bad. it's jeopardizing some folks' travel plans. >> extremely frustrating. i mean, i was supposed to go see friends, family, and you know, and i'm not going to be able to do. half of everything i planned to do due to the fact i'm being delayed. >> jamie: the the situation so so bad the salvation army showed up with supplies and red cross helping anyone stranded find some shelter. >> kelly: well, iran flexing military muscle in key international waters and iran's navy kicking off a ten day drill in the persian gulf near the straits of hormuz. about a third of the danger traffic uses the water way and

the drills come after mounting criticism offer iran's nuclear program and iran says the war games are an attempt to show off the military prowess, and it could bring iranian ships closer to u.s. navel vessels in the area. >> jamie: powerful republican guard force is attacking tens of thousands of protesters demanding the nation's president be put on trial. the troops firing rifles and tear gas and water cannons at the marching crowd and witnesses say at least 30 people were injured in an attack. protesters object to a deal under which yemen's president would step down from power and return for immunity from prosecution. >> kelly: and tens of thousands of russian protesters gathered in moscow today, raging against the suspected election fraud. protest leaders are pushing for a rerun of the december 4th parliamentary election and punishment for officials who are accused of fraud. and recent demonstrations there have weakened prime minister vladimir putin's authority as he seeks to reclaim the presidency

in next march's vote. >> christmas eve. so holiday shopping should pretty much be done, right? wrong. millions of us procrastinating consumers still have gifts to buy. that could be good for retailers, they are hoping for a last minute buying binge that will help make their season bright. casey stegall streaming live from the grove in los angeles you must be in your christmas sweater looking for kelly and my gift. must be. >> i am, of course, i am not one of those procrastinators and now you mention it, jamie, i have one more thing to add to your stocking and hear that sound? it is the sound of money being made, consumer confidence is on the rise when you look at all of the numbers. analysts tell us that holiday spending is up roughly 7% this year over last. and e-commerce has risen about 15% and that's the online sales and lot of folks don't step foot

in the stars today. and economists say several yeens we're seeing promising numbers this year, many retailers offering hot deals to lure people into their stores, unemployment numbers have dropped, meaning more people are working, plus, fewer folks are in debt because of the economic down turn, not overextended as much, leaving more cash for christmas. >> consumers have reduced the debt servicing burdens immensely over the past three years, we have now seen the consumer dead servicing burden or installment credit payment, relative to income, the lowest it's been in 27 years. >> and those stores certainly don't mind people waiting until the last minute to buy, in fact, businesses anticipate the procrastinator rush especial when you consider that the national federation tells us that half of americans wait until this week right here to finish all of that shopping.

and another reason why there are so many deals to be had in this final stretch. >> i think the retailers are generating a lot of cash flow. their margins are going to be lower because of the deep discounting going on and you're getting the certificates mailed to your home. come in spend so many dollars and we'll give you 15% credit. >> and of course, this time of year is crucial, it is estimated that retailers, 40% of their profits for the entire year actually come from this holiday spending time and the numbers looking good and i know that a lot of folks are happy about that, jamie. >> jamie: that sounds incredible. big numbers, thanks, casey. merry christmas. >> reporter: yeah, big numbers, merry christmas. >> kelly: thanks for that, casey. police in fort myers, florida are looking for the person who shot and killed a man outside a busy shopping mall. investigators say the gunman used a high power assault rival and fired 40 to 50 shots. it all happened around 9 p.m.

when the mall was still full of shoppers. >> and i was shopping in guests and all of a sudden seeing everybody running around and screaming gun. and then all the gates started to shut and you got stuck in the store. so, and then you see cops running around with their guns. >> kelly: a very tough situation down there. police say the suspect drove off in a gray four-door vehicle. >> it was shoes causing mere riots at stores across the country. frenzied shoppers broke doors and in some cases trying to get their hands on nike's new air jordan sneakers and with our new york affiliate. wnyw has the story. >> this is the incredible scene at a mall in indianapolis, indiana. hundreds of people pushing their way in, knocking the doors off hinges and stomping people because they wanted new air jordan sneakers. that went on sale at midnight.

in richmond, california police were called to a mall when you're not going to believe this one, a guy allegedly fired shots in the air and when people ran for cover he could move up in the line. now we're told he has a good seat in jail. in a suburban of atlanta they broke down the doors and ran in and police used pepper spray on crowds and on staten island, crowds got unruly after kids got-- >> kids screaming and fighting and breaking down the fences. >> and santino and paul messina want today update their jordans and someone sole them fake tickets promising a better spot in line and paid $70 for nothing. >> and nothing to do with it, mall security nothing to do with it and someone came up with this idea. >> the kids were out of line. >> right at least one person arrested for disorderly conduct on staten island and some parents say selling sneakers at midnight is not smart. >> make them come out and shop

>> jamie: incredible. >> and found not just the kennedy with the great intimate pictures, but every first family does and i was taken with that. >> jamie: you've actually been there and helped the bushes. laura bush was one of the people you worked with, what an honor. >> incredible honor. >> jamie: what was different about the way they decorated? >> well, mrs. bush was so incredibly elegant and just very, very gracious and i wasn't sure how involved she'd be with decorating. she was so involved. she really cared what it was going to look like for the american people, and she took time and he she helped us tinker until we got it just right and her secret was a snowy lobby, a grand lobby filled with snow-laden trees, just beautiful. >> jamie: what can we learn from the pictures and he will pts that go into making such a beautiful home? >> well, the fun thing is you get to see history in the context of christmas and get to learn about our first families in a way you may never have before. mrs. bush, lo laura bush always

got a coconut as a little girl and grandma would crack it over and make coconut pie for dessert as a little girl. and anecdotes and details makes it fun. >> how much fun do you spend decorate your house. >> it's high christmas season at the burke house. >> jamie: do you have little elves at home. who are your elves helpers. >> may have 13, jay 11 and brenna 8 and a great help this season and they love coming upping the white house still. too. some of the first ladies have fun kid ideas, also. >> jamie: in the book you talk about where the ornaments are stored. there's really a historical perspective in here. where is everything kept? how are they preserved? >> it's kind of super secret, but i'll reveal. there's an off site warehouse in maryland where they keep the overflow ornaments and decorations and the way the process works, you go there and you work for about three and a half days getting everything ready, so that when you get to the white house, you're just

>> welcome back. it's the bottom of the hour, time for the top of the news. firefighters in new jersey are working to put out the warehouse fire that broke out on wednesday and they say they don't know what started the fire, but say is an auto repair shop inside is likely responsible. >> 90-year-old prince phillip is recovering from surgery today. putting in a stent to ease a blocked coronary artery and said to be in good spirit and likely will spend at least one more night in the hospital. missing the royal family's christmas festivities. >> and thousands of christians are gathering in bethlehem as they do every year, the traditional birthplace of jesus. and for many, a midnight mass at church of the nativity.

>> in a 11th hour decision, a two month extension of the payroll tax cut. saving 160 million americans from a tax hike. it's seen as a political victory for president obama. the president arriving in hawaii last night to begin his christmas vacation with his family and doug luzader travelling with the president as well. joins us live from honolulu and doug, the president seems to be starting the vacation on a high note? >> yeah, the president coming on the heels after political victory and might make this delay all the more worthwhile. the president did arrive last night. aboard air horse one and he was in washington prior obviously and signed into law the two month extension of the payroll tax holiday that was the subject of such an intense debate so long, house republicans eventually backed down and their insistence that the tax cut be extended through all of 2012 immediately, but as the president pointed out, this is something we're going to see

play out again next year. >> vital unemployment insurance will continue for millions of americans and who are looking for work and when congress returns, i urge them to keep working without drama, without delay, to reach an agreement that extends this tax cut as well as unemployment insurance through all of 2012. >> and that's going to be easier said than done. while there is some agreement that that payroll tax cut holiday should be extended through 2012, there are significant questions how to go about paying for it and the president wants to do this without drama and sounds like we're going to see plenty of drama headed into 2012, kelly. >> kelly: that may be an understatement. any word on the president's vacation plans? >> you know, we don't get a whole lot of heads up on this stuff, but we know that last night the presidential motorcade took the first couple out to tirn with friends here in

waikiki and went to a japan restaurants and beyond that, we'll wait to see what they do. typical obama staples in hawaii are of course, trips to the beach and shaved ice and probably more than one visit to the local golf course. >> all right, and to the president and you, doug, and as well as the first family, have a merry christmas. >> well, the big celebration, really, at the vatican and major preparations are underway there as pope benedict xvi prepares to kick off two weeks of celebration with a mass at st. peter's basilica. our greg burke has the assignment streaming live from rome. merry christmas to you. >> merry christmas, jamie, that's right. really just about two and a half hours away, one of the most solemn moments on the christian calendar. the christmas eve mass will begin in st. peter's basilica which is packed and pope benedict basically uses christmas as a teaching opportunity and earlier this week, even with the cardinals and the bishops in exchange of

christmas greetings, the pope talked about how the faith should bring joy to people's lives and when people don't have it, what a kind of desert it is. he talked about the fatigue in certain parts of europe and hearing about the joyous parts in the coming week and how it brings life and like to people and earlier this evening, the pope placed a candle on his window sill in silence and just a short time ago, that is to remind people to pray for peace during this period. he also blessed them with the candle. st. peter's square where the pope was, once again, will be center of attention over the next couple of weeks and the life size nativity seen has been unveiled and it's an interesting one this year, much like the one you see in bethlehem and only bigger and the idea that christ was born in a grotto or a cave. the center of attraction, not only for children, but so many pilgrims and tourists in rome and finally, jamie, it's a busy

been frozen, contained by our presence in iraq and because, politically it was not-- on the ministry level doing good surges and suppress the al-qaeda activities and we contain somewhat the influence of the slammist militia. as soon as we're out and there's no political consensus, everything is coming back. >> there are many critics of the withdrawal that there are supporters, and time to leave iraq. can you make a connection between the withdrawal and the violence that we're seeing right now? >> oh, everybody in the arab world makes that connection. this is not a secret and the issue is not the withdrawal it's what we have done, for the withdrawal so it will be success feel politically. and meaning, reconciliation between the sunni and shia, between the arabs and kurds. making sure in the sunni areas, it's contained and making sure and that's the most important thing, that the iranian influence in iraq will be

minimal. and unfortunately what we see is the iranian innuns, and the extremists responding. a spiraling process. >> what does it mean for peace in the region overall? >> that's the other more concerns issue for the united states. it's iranian influence coming to iraq, it's not going to stop in iraq, it's going to basically through the borders go to syria. and our whole plan of isolating the regime is going to fail now. because they're supporting the regime through iraq and connecting with hezbollah or other problems. so, the fact that these events are happening in iraq is not on the regional level not just for iraq. >> what can we do from here. even if we don't have troops on the ground with prime minister maliki. i don't want to say influence, they're their own country at this point, but can we have an impact that keeps us safe here at home? >> look, the real answer to this whole thing is to make sure to contain the iranian regime. that's where the problem is.

i mean, without iranian convention in iraq, most of the issues will be addressed so we need to be very clear. against iraq and the military exercises and all of that has to be-- we need to do a strategic change in our policy towards iran to get results in iraq and syria and in lebanon. >> jamie: tell me what that would look like for us. >> it would look like us telling iranian leadership there are red lines inside iraq. it will look like we reaching out to the sunni and shia and kurdish moderates equivalent of a spring in iraq. >> jamie: the way you describe it doctor, it sound like a sense of urgency. i'm glad we have a chance to talk about it. >> thank you for having me, merry christmas. >> jamie: merry christmas, to you. >> kelly: the holiday season usually means a barrage of parties followed by rough mornings after.

drinking. let's talk about the physiology of hangover and exactly what happens. i think that's more important. a ook, when you take alcohol, what it does it takes a lot of fluids, 70% of our body weight is just water. so, it takes a lot of this water and you start voiding it. and along with the water, you lose sodium and electrolytes and looks like you've worked out. and your taste buds feel thirsty, fatigued and potassium and muscle weakness and more importantly, your brain starts to almost shrink he when you start getting the headache and that's called the hangover. and now, this is my own personal advice. i think instead of these heaindf tiills, if you're planning to g out and drink, i don't recommend mixing drinks and too much if you're not in control and jamie has mentioned that moderation is the way to go and that's the take home message, but if you're drinking make sure you drink a lot of water before you go out.
