today. it's 6:00 a.m. on the east coast now. lots of voting going on today. >> there is. some took place already. let's take a quick look but also in a few hours, thousands of other voters to the tune of maybe 320,000, 250,000 of which are probably going to be voting in the republican primary. there's no drama on the democratic side. some votes have already been cast. let's take a look at our guest list first before we tell you who is out in front by a single digit. steve forbes will be here in a matter of minutes. who better to unwind what bain capital's mission statement was, what mitt romney did and what is true capitalism and what is cannibalism. >> you know, according to all the polls, it looks like it's going to be a big win for mitt romney. the question is how big and really the battle is over second place so newt gingrich and rick santorum would both like to wind up in second place. we'll talk to them about that. and then from the other side of the political sfekt rum, debbie wasserman schultz is going to be joining us talking about the primary from the democrat point of view.

>> allen west will respond to debbie wasserman schultz, of course, they're both from florida and he's a republican, though, so he may have a contrary point of view. laura ingraham will be here at the top of your 8:00 hour and frank luntz will be doing some analysis with voters specifically in new hampshire. who they like in this primary. a major white house shakeup. president obama's chief of stiff william daley on his way out turning in his resignation after one year on the job. the president reportedly did not see this one coming. daley's tenure was supposed to last at least through the 2012 election. they scaled back his duties in november. maybe it wasn't a surprise. daley says he'll return to his native chicago where he will co-chair the president's re-election team and be replaced by the budget director. we're learning more about the islamic extremist accused of planning terror attacks in tampa. >> the infidels, the jews, the pagans, the hindus, the buddhas and the atheists they're the worst of creation.

we will fight the church. looked at as evil. >> the views of the 25-year-old so extreme his fellow muslims banned him from two mosques. an internet video shows his violent confrontation with protesters from the controversial westboro baptist church and he was busted in an f.b.i. sting last weekend accused of trying to use car bombs and assault weapons to attack multiple targets in tampa. born in kosovo, it's believed he's a lone wolf. facing a possible life sentence, if convicted. mother nature bearing her claws down in texas. wild weather dumping several inches of rain in houston leaving cars under several feet of water. roads closed, many people lost power there. the worst is believed to be over. and while many had a miserable start to the week, there is one group happy for the water in the drought stricken region. farmers say it couldn't have come at a better time. the tsa defending the decision to confiscate a cupcake from a

woman as she boards a flight. the cupcake was packed in a glass jar. the problem, the tsa considered icing a gel and only small amounts of gel are allowed in a carry-on. is it three ounces, i think? she could have weighed that cupcake. i wonder if she would have put it in a plastic bag. >> what if you have a glazed donut? that's barely iced. >> if you put it in your checked bag, i think you can take it with. >> you know everything. >> exactly four minutes ago, the polls opened in the great state of new hampshire and there you can see where our live coverage is emanating from and so far, this is a tradition going back -- >> if you don't mind whispering, they're all asleep. >> this is a tradition that comes -- >> they're all having a secret party. >> what they tried to do in dixville notch, new hampshire was because so many railroad employees had to go to work early, they voted right at midnight. generally it takes one minute and the final results are in from dixville notch, romney by two, huntsman by two, gingrich

got one, as did ron paul. >> all right. let's go down to hart's location. that's the other place that opened the polls at midnight for a minute. romney had five. paul had four. huntsman had two. perry had one and gingrich had one. now, earlier, brian schooled me on the fact -- i was a little upset 9 out of 75 people showed up to vote in the first town but apparently, they continue to open the polls all day long. maybe they'll be a better percentage of voter turnout. >> is it a good indicator of who is going to wind up winning? in dixville notch, they got it right last time with barack obama but in 2004 in the primary, they picked wesley clark over john kerry. in 2000, they picked bill bradley over al gore and back in 1996 in the general election, they picked bob dole to be president over a guy named bill clinton who eventually won. >> so you know that mitt romney has been under attack especially by newt gingrich joined in by rick perry and rick santorum over his years at bain capital. in fact, in about two weeks, there's going to be a movie

coming out, 28 minutes long that discusses the negative side of what mitt romney did according to newt gingrich's super pac at his days at bain capital. >> it doesn't have a happy ending. >> i don't really think super pacs try to get -- make the other guy look good. steve, i don't want to jump to conclusions but mitt romney in particular said something yesterday when taken out of context sounds really bad. i want you to judge if these comments could hurt him here on primary day in new hampshire. >> i want individuals to have their own insurance. that means the insurance company will have an incentive to keep you healthy. it also means that if you don't like what they do, you can fire them. i like being able to fire people that provide services to me. you know, if someone doesn't give me the good service that i need, i want to say, you know, i'm going to get somebody else to provide that service to me. and so that's one thing i'd change. >> so that's free enterprise, folks. that's the way it works. if we go into a store and they treat us poorly, then you probably think to yourself, i

might not go shopping there anymore. that's kind of the way it works. but when you're running for president of the united states, you have to be careful with every single word that you say because everything is taken out of context and turned and twisted. now, usually, it's only the democrats that we do that against the republicans and the republicans would do that against the democrats. now the other republican opponents pounced on that statement that mitt romney made and here are some of their attacks now about that firing statement. >> governor romney enjoys firing people. i enjoy creating jobs. >> you're a victim of bain capital's down sizing. it's the ultimate insult for mitt romney to come to south carolina and tell you he feels your pain. because he caused it. >> i think there's a real difference between people who build in a free market and people who go around, take financial advantage, leave behind broken families, broken towns, people on unemployment. >> even the democrats have already taken that single line out of context and edited it

along with some really ominous music to make mr. mitt romney look pretty bad. i would imagine because it's completely out of context and, you know, truth -- the truth on media people, the politifax people, they will go look, these ads are disingenuous and stuff like that. it will probably be a big flare-up today, maybe tomorrow but you got to figure by the weekend, this thing will have run its course. >> i don't know. i don't know. i mean, i don't -- >> it's flat out a lie. they were talking about obama care of all things. >> yeah, i just don't know if it will be over. i mean, this political season is like no other. we can't say -- we can't make hardly any predictions anymore because just things continue to happen that you don't -- that are out of your control. i mean, the republicans are not going to let this die because the other ones want to win this race and rick perry has it as his ring tone now. i like being able to fire people. that's his ring tone. it's very interesting when the republicans are pouncing on the same thing because they may be helping barack obama. >> right.

>> or they could be stealing mitt romney if he gets the nominee. but in the big picture, it will be interesting to see if -- you remember how newt gingrich was hurt by the attack ads of him. this is the first time that mitt romney has been hit with a sustained attack for a few days, almost 10 days now. will it affect him in the polls, he had a 40 point lead in some polls before. it's dropped about eight points, according to some although american research has it higher. coming up shortly, newt gingrich and rick santorum will further explain what they feel is bad about that statement. >> fantastic. >> meanwhile, yesterday, we played a little clip for you of chris christie when he was confronted by some of the occupiers at a town hall meeting over the weekend, got a lot of air play. chris christie in charge. got some laugh lines as well. yesterday, the protesters were back and mitt romney gave him a little taste of chris christie. watch this. >> how about you talk? instead of shouting, why don't you say what you mean? madam, what do you think?

ok, whats that? ok and who is the president who is spending more money to campaign than any in the history of america? the answer is that this president is spending money and he spent money. we have had over the history of this country a public funding plan for our presidents and you know what, this president has been the first one to throw aside the public funding program to break all those barriers and to spend massively more than any president in history. you know what? this country is too important to hand over to president obama in the second term. >> everybody experienced the same thing, turbulence getting in their event, once leaving the event and once he was on stage, you had rick santorum, ron paul said it was really packed. you didn't see any hostility and then you have mitt romney and newt gingrich canceled his event yesterday. >> and mitt romney when you watch what he did, he did something like what chris christie had done the day before but it would be like a comedian at a comedy club where suddenly you got a heckler and you turn it to your advantage. remember, everybody in that room for the most part is there to hear him so they were very supportive and they turned on

support from steve forbes but why doesn't he support, that is, a fellow businessman like mitt romney? joining me is chairman and ceo of forbes inc., steve forbes. >> good morning, gretchen, how are you? >> very fine. you said a long time ago you were supporting rick perry. you've known him for 10 years and you were impressed with his tort reform in texas but why are you keeping with him when a lot of people say hey, you're a business guy, too, you should be for mitt romney. >> well, i think that rick perry has shown not only does he have good ideas like the flat tax, like regulatory reform, but he's demonstrated in texas he knows how to create an environment for job creation starting with the tort reform keeping bad taxes away and the like. so he's demonstrated he can perform in the public square. it's one thing to have an idea. quite another to be able to carry through an idea. and while he's had a rough patch so far, i think south carolina is going to be wide open after this mish mash in new hampshire and has a chance to get back in the fray again. >> uh-huh. what is it about mitt romney that he fails to take on tax reform in the way that you would like him to? >> yes. i hope he comes around to it but

he hasn't yet. his tax plan is almost, you know, weak tea compared to the bourbon of rick perry and the others. he's wrong on health care and wish he would get rid of that individual mandate he did in massachusetts and other things. if he sharpens up his message which i think he will have after all the criticism he's taking but so far, he hasn't. rick perry has excellent ideas out there. he has very good record. the second largest state in the union and the most successful large economy in the union. so it's performance and policy. >> i'm going to bring you back to the fact that you are a very successful businessperson. now "the wall street journal" opening the book on mitt romney also a successful businessperson and his time at bain capital. private equity firm. they're saying look, you know, he had a lot of successes. made a lot of money for his investors but also had some busts and people lost jobs. is that just the way business works or is it a negative for him? >> they're going to portray it as a negative and if he's the nominee, it's a good thing to go

through now because it will steel him up for the campaign in fall. he'll have to be able to handle this. one way to handle it is go on the offense in terms of reaganist and pro growth policies. in terms of bain itself, i have not looked at the particulars but the whole nature of that business, most businesses eventually succumb and if you can save it, that's great. if you can start when it succeeds, that's great. it's like baseball, 7 times out of 10, you're not going to get that hit. and the same is true in what he did in terms of equity capital. but the key thing is did he create jobs overall? because a lot of those companies, they're going to portray him, as you know, killing jobs and that kind of thing would have gone under if you didn't have somebody in to try to save it. sometimes you have to tighten the belt to save the company. >> ok, a lot of talk today about the statements that mitt romney made yesterday. taken out of context. that he likes to fire people. do you think that has legs because you're guy rick perry pounced on it as well as the dnc and other republican candidates. >> well, he's going to have to -- in the campaign, i've lived

through a couple of them. everything you say will be held against you. it's part of the process but the thing is how does he handle it? newt gingrich felt he was unfairly attacked. people want to see how you handle the pressure of a job where the pressure is constant and so in terms of romney, i think again, what he's going to have to do is come up with his own offense, not be on defense and say this is how we create jobs, i've been there. i know what works and what doesn't work and come out with a bold tax plan and the like. even if this dies out in the republican primaries, democrats, you know, are going to hammer that again and again in the fall. >> there's a thing called videotape and they have it forever speaking of videotape, another successful business person, jack welch is supporting romney. this is what he said about why. >> in my lifetime, mitt romney is the most qualified leader i've ever seen run for the presidency of the united states.

bain, the company -- the consulting company gets in trouble in 1990, mitt, come back and fix it. back to bain capital. bain capital than its best years ever. run for governor, wins the governorship. $370 million in debt. he gets it out and gets a surplus. we haven't had anybody do all these things! >> i mean, how ironic that we do have this successful businessperson mitt romney who is now going to be portrayed in a totally different way or do you agree with jack? >> well, what he points out and he was criticized in his first 10 years at g.e., he was known as neutron jack, you know, wiping out jobs. but he re-created that company in a way that made it highly successful, one of the few companies in the world that is diversified all over the place and has had success over 100 year period and he contributed to that. but again, you're going to have things that are not going to work out. you're going to have to have times where you tighten the belt

david gregory did the next day as well. in fact, during david gregory's debate, 41 questions were asked. 25 of the questions came from the left. 25! 13 were neutral and only three from the right point of view so by an 8-1 margin, they asked leftie questions. >> well, remember, steve, these are the people, evan thomas "newsweek", obama is sort of a god. terry moran, abc news. obama had to step down from wherever he was. step down into the oval office. over 90% of these people are going to be voting for obama in november. they're on a mission. they try to put themselves forth as objective newscasters and questioners. they're not! they have an objective and that is to make sure that these knuckle dragging war monger

republicans don't manage to capture the white house this november. >> yeah. you know, what was interesting about the line of questioning, you could -- rather than just ask a question that would wind up getting their policy answer, they tried so desperately to engage the republicans to yell at each other and snipe at each other and get an argument going. sure, it's a great tv show. i don't know what it does for the democracy. >> steve, look for this. as i understand it, in these debates, there has not been one question from one moderator saying could you please detail for us the problems you see with obamacare? and how those problems can be resolved. not once have they asked the candidate about obamacare. they want to find out whether or not they're going to allow contraceptives to be sold at the cvs down there on the corner. >> right. but neil, excellent question. you have to figure when it's time for the presidential, the

with investigators invoking his fifth amendment right when questioned about the bombing. great. >> it sounds like the plot of "24" a suspect holds an elderly couple hostage in their own home. it happened in fayetteville, arkansas and things got worse from there much the woman says the suspect forced her to rob a bank by strapping what he says was a bomb to her ankle. when she got there, she alerted employees the bomb squad removed the device. they're now testing it. cops do not have a suspect. >> all right. what would you do if you saw a driver swerve off the road and crash his car into the road? five men in miami did not hesitate before they jumped in the biscayne bay to try to save him. >> it was dead and then they kept pushing on his chest to get the water out of his lungs! and they got him alive. >> doctors say the 81-year-old driver will be ok. no word yet on what caused him to lose control of the car. >> check out this video, a

idaho that they were going to build their dream house on it. out of nowhere, they got the permits to build the house and the e.p.a. said wait a minute, that's wetlands, what are you talking about? it's absolutely dry. >> it's very bizarre. in the intro that you just showed, a true picture of the property, it doesn't appear to be wet. there's no water next to it and there's no water on it. that's a picture of the land right there. >> right. >> here's the law. the law is that when the e.p.a. makes a scientific determination that land is wet, the courts shall not second guess that because supposedly, under the law, the e.p.a. has certain expertise that the court doesn't have. so you say ok, i want to challenge that. i want to bring in my own engineers who will demonstrate to a judge that the land is not wet and capable of sustaining a building and the e.p.a. said you're not entitled to a hearing! that's really what the oral argument was about yesterday in the supreme court where justice alito said how can this happen in the united states of america? >> where's the due process? >> that the government can come in and say you can't use your

property the way you want and can't challenge what we say and you can't take the case to a neutral judge. prediction -- the landowners will prevail in this case. >> but they'll prevail to get a hearing. >> that's what i think will happen. it would be very nice if the supreme court just ended it and said, you know what, there's no basis for the e.p.a. to do this. this is the united states of america. all the local authorities say it's not a wetland and you can build on it. therefore you can build on it. i predict that the supreme court will say a judge will hold a hearing and then i think these landowners will prevail at the hearing because the e.p.a. will not be able to demonstrate the reasons for which it has declared dry earth to be a wetland. >> and in fact, they told us yesterday on this program that they've already had their experts look at it and they say yeah, it's dry. but this has -- this particular piece of -- of information that the court is considering could have an impact on anybody who owns property. >> yes, it could, steve. this will have an enormous impact on restraining the e.p.a. from interfering with private

this is the day the voters speak in new hampshire and as you can see behind me, they had a big flood come in the floor in the last couple of moments when the polls opened at 7:00. some folks vote even earlier here in new hampshire. up in the tiny village of dixville notch which is a little bit below the canadian border, they vote just past midnight and, of course, we have the results counted up there. here's the numbers. they're in tiny dixville notch, gingrich one, paul one, and there were also three votes cast for president obama. now, in the little town of hart's location not so far away, also voting a tad after midnight. 23 total votes cast there. romney pulling in five. paul four. huntsman two. perry one. gingrich one. and president obama pulled in 10 votes there much the secretary of state william gardner saying today in the g.o.p. primary about 250,000 people expected to vote on the democratic side, 75,000 people expected to vote. and, you know, as we get closer to the people heading to the polls, the anxiety can heighten in the area and yesterday, senator santorum and his family had a kind of scary experience.

they were surrounded by some occupy protesters and some younger ron paul supporters, all of them shouting bigot and shame. no one was hurt or arrested but it was clearly a very disconcerting experience for the family there. gingrich's security saw trouble at their campaign stop at their campaign headquarters so mr. gingrich was forced to cancel a stop there. meanwhile, the voters will spend the rest of the day going to the polls, casting their ballots, speaking, you know, with their voice here with the voters of new hampshire and the polls will wrap up at 8:00 tonight so we'll have a chance to find out who wins. back to you. >> all right, molly lyon live in new hampshire. thank you very much. >> right now, it's our privilege to bring in the former speaker of the house, newt gingrich from new hampshire. welcome back. >> good to be with you guys. this is quite a day up here. >> i can imagine the excitement you feel. what do you think is overmuching today? what would you walk away with? what percentage of the vote where you thought to yourself and your campaign this is good? >> well, i think first of all,

that the biggest story today is going to be how much governor romney falls short of any kind of reasonable expectation because he's been living here, literally bought a house. was the governor next door for years. and people expected this to be his fortress. i think it's not going to be much of a fortress. i'd like to be in the top three or four and i think we have a good chance to be in the top three or four and i think that sets the stage to then go to south carolina which i think will be the decisive showdown with governor romney. >> i know initially when you started your campaign, you said that you did not want to do any negative ads. that you didn't believe in it and you wanted to try to remain positive. but you would respond to negative labelling of you. well now you've changed your tune, i guess, after what happened in iowa. and now you're going to be going after mitt romney in particular very, very hard. your pac will go after him big in south carolina and now you yesterday going after his record at bain capital when he was chairman of that company. a lot of people are asking you this morning, mr. speaker, should you be focused on

president obama instead or is it right to show the differences between yourself and mitt romney? >> look, i think you have to always be realistic about what's going on. and governor romney's people spent $3 1/2 million in negative ads attacking me and 45% of all the ads in iowa were negative attacks on me. you can hardly unilaterally disarm and stand down and let them run over you and so i'm not running any negative ads. i am prepared to point out the difference between my record as a reagan conservative and his record as a moderate from massachusetts. i'm also prepared to raise questions that frankly "the wall street journal" outlined. these are facts, they're not something that we're making up. it's something that is accurate. "the wall street journal" reported in one case they put $30 million into a company, took $180 million out. that's a 6-1 return. and then the company was bankrupted. i think it's reasonable for people to raise questions. it's romney who spent a lot of time talking about his role as a

businessman, that that was one of his credentials so i think he owes us a press conference to explain it. >> why don't you hear this? yesterday you were asked a question, how do you feel about mitt romney making the statement i like firing people. i want to see if you could hear the whole thing in context and see if you think this is -- this is unfair to mitt romney or not. let's listen. >> i want individuals to have their own insurance. that means the insurance company will have an incentive to keep you healthy. it means if you don't like what they do, you can fire them. i like being able to fire people that provide services to me. if someone doesn't give me the good service i need, i want to say that i'll go to somebody else to provide service to me. that's one thing i'll change. >> now that you hear the whole soundbite, do you think it was taken out of context? >> absolutely, of course it was taken out of context. at the time, i couldn't imagine why anybody would have said what he was supposed to have said. you know, it wasn't very well

worded and i think what he was trying to say is that, you know, consumers having the right to choose between competitors is dramatically better than a government monopoly controlling your life. i think that sentiment is exactly right. it raises one of the points about why i'd be a better candidate. i think i can debate better than he can. i'm more careful in that kind of example. imagine if he had said that in a debate with barack obama, what a mess that would have been. so -- but i don't think it's fair to say that he likes firing people. he likes having the right to choose and that's probably what he meant to say. >> exactly. that's the context. i was driving around yesterday in my car and i was listening to rush limbaugh and he was talking about you and how you've gone after mitt romney and bain capital. he said you're using the language of the left to beat up romney over bain. he says it makes him uncomfortable because that's what the left will do if romney is the nominee. >> well, i don't think i'm using the language of the left. i'm using the language of classic american populism.

main street has always been suspicious of wall street. small businesses have always worried about big businesses. i'm very uncomfortable when i see seven or eight banks get to occupy 80% of the market share and crowd out small independent banks. and i think people have a natural concern when they see financiers come in from out of town, take over a company. take all the profits and then leave people unemployed behind. there's a difference -- i'm for capitalism. i'm for free enterprise. i'm for entrepreneurs. there's a big difference between people who go out to create a company, even if they fail, if they try in the right direction, if they share in the hardships, if they're out there with the workers doing it together, that's one thing. but if somebody who is very wealthy comes in, takes over your company, takes out all the cash and leaves behind the unemployment, i think that's not a model we want to advocate and i don't think any conservative wants to get caught defending that kind of model. >> what constitutes acceptable capitalist behavior, then, in your mind? >> well, i think when you look

and we were tired with rick perry for last place, if you will here in new hampshire on the day of the iowa caucuses and since that time, we've climbed up and reached the pack and we're in most of the polls in the pack with governor huntsman and speaker gingrich and slightly behind ron paul. that's a great pickup for us. and we did that without spending a dime on broadcast television here so we -- we've done an amazing job where everybody else is spending money, newt has been endorsed by the union leader which is a huge, big deal up here in new hampshire. and we're in the mix with them having spent nothing so i feel pretty good. >> how important is a second place finish for you? what would that mean for south carolina? >> oh, my gosh, just the mention of that would be beyond our dreams to be very honest with you. we're hopeful to finish in the three, four, five, gingrich, myself and huntsman are sort of grouped together there and we can finish in that pack somewhere that's great. that would show we have the momentum and that, you know, our grassroots effort is still on the rise and obviously, south

same kind of insurance, you ought to be able to fire that person. if you had a guy, congresswoman, who was mowing your lawn, providing that service and he did a really lousy job and he kept, you know, running over the grass and just did a terrible job, wouldn't you fire that guy? >> well, mitt romney is consistently talking about his economic experience and his private sector experience as the reason that voters should put him in the white house. we think it's important to show that what his experience really is is dismantling companies, shipping jobs overseas, bankrupting companies deliberately and talking about how he enjoys firing people. i mean, i'm sorry, but i mean, no matter what the situation you're in and the reason you might sever your employee relationship with people, no one says they enjoy it. it's not an enjoyable experience and that's just evidence of how mitt romney is really out of touch with the struggle of working families, the difficulty that the middle class has in

and i understand capitalism and part of what happens in the free market is there is risk out there and people try to mitigate that risk but sometimes companies do fail but the great thing about america is we revolutionize with new innovation and ingenuity and a better company comes along and we're able to continue along a better path so i think the most important thing that we have to have a president with a vision, with the right type of tax policies and regulatory policies that will enable production in manufacturing and the trillion dollars of capital that's off shore to come back to the united states of america. so that we can get those americans back to work and not use taxpayer dollars to pick winners and losers in the marketplace or use taxpayer dollars for your own ideological agenda. >> speak of tax agenda and what not, sir, i know just before christmastime, you guys voted on that payroll tax extension of two months. you're going to take it up once you go back to washington, d.c. the republicans did vote with the way to pass it, but from what i've heard, you're not

happy with your own party leadership of what happened in the house. >> well, i'm not happy whatsoever because actually in the house, it was done by unanimous consent so we did not have the opportunity to vote on that two month extension which if you understand a two month extension for tax policy, that's one of the most insidious things you could ever think of so the american people will see the exact same dance coming about again in another two to three months. we voted for a one year extension that was paid for, that would not have any detrimental effect on social security but what did we get back from the senate to include senate republicans was something that is going to raise the fees on loan guarantees for the government sponsored enterprises so in other words, american home owners will be paying for this two month extension and you cannot run this country with policies based upon two month increments. that's what has me upset. >> you used harsher words when you've been describing this earlier and called it a pathetic policy and the g.o.p. leadership sold us down the road. what's going to happen when you

guys go back to capitol hill? what kind of words do you have for speaker boehner? >> well, i have the exact same words because when i flew back down to south florida, the wednesday before christmas, we were told that we would stand firm on that one year extension that we were passed which was passed bipartisan and the next thing i know, about 36 hours later, we were on a conference call where we were told that we would accept that two month extension by unanimous consent. my consent was not part of that and i think i was more than willing, we were not adjourned to go back to washington, d.c., continue to fight for a one year extension so we can deal with predictability and uncertainty. that's what we'll continue to do and can't knuckle under. >> year extension, we're told is going to collapse again with another stand-off in the next two months. great to see you. thanks so much. >> pleasure. thanks a lot, guys. >> we're coming down there and it looks warmer than it does here. >> you can come here.

associations with anti-abortion groups, with the family research council, with pro life organizations. >> let me ask you this since you are an attorney. if the associate dean said that quote that i just read back in 2007, basically saying they were concerned about her politics, sounds like she has a case. >> and the circuit court of appeals agreed and said there's a question of fact and we're going to discuss that in a trial. it's an interesting thing, a lot of people in this country say listen, yes, i understand gender discrimination. i understand race discrimination. i understand ethnicity. i understand sexual orientation. but there's also a terrible amount of discrimination in this country with regard to people's political beliefs, with regard to their associations and that, too, is protected by the first amendment. and that is illegal if you use someone's political beliefs against them not to give them a job. >> so let's take a look at the federal campaign contributions by professors at top law schools.

91% of the harvard law professors gave to democrats. 94% of my alma mater at least undergraduate, stanford law professors gave to democrats. 78% of the university of iowa law professors gave to democrats. so i guess there's less people that gave to democrats. >> it was pointed out that there was only one republican on the faculty law staff at that school and it was also pointed out in the decision that one of the -- allegedly, one of the foremost opponents of her appointment to the law school was a person who was a law clerk to supreme court justice harry blackmon who wrote on the roe v. wade decision, the abortion and pro choice decision in america and so that's an issue that's going to be coming out in this trial. the issue is academic freedom, the issue is the right to associate with political organizations and not be punished in the workplace based upon that association whether you're a democrat, republican,

-- you go to a central location but you can go to mountainview, california, massachusetts and raleigh, north carolina. >> they really need engineers. >> yes. jobs that will pay well. i would think. stewart and stevenson. tell me about them. >> this is -- you were talking about, this is where they are looking for military personnel. i got to get this out. they have a job fair coming up january 18th in fort hood, texas, it pays $17 to $25 an hour. they need people that can do basically assembly, mechanical assembly, transmission mechanics, diesel mechanics, think of the skills that you got when you were overseas in iraq. those skills are highly, highly needed by a company like stewart and stevenson. here's the thing, they have that job fair coming up next week but some of the jobs will be in canada. you may have to go -- you may have to do some traveling for this one. hey, if you're a military veteran and came back from overseas, travel might be ok for you. >> right. >> the pay is decent. again, they've told me in five different ways this company has told me they're looking for military veterans so i want to get that out. >> they make between $17 and

$25 an hour. scott trade is looking for? >> financial associates. if you've got any type -- even if you're a recent college grad, they didn't say this. i'm saying this about scott trade, if you have financial experiencea business degree, they need associates. this is on-line trading like etrade, it's scottrade are looking for people that can guide the average investor more and more because the market has been a mess over the last four years. people want advice but can't afford heavy duty, you know, wall street managers. they need people who can help the average person to get a foot in the door. >> they have about 200 openings. caterpillar, leading manufacturer of construction. what do we have here? >> global company. all right, this is mining equipment, construction equipment, they make gas engines. they need -- look, they hired about 12,000 people since 2010. they've got a new texas factory that will be opening up this year. here comes texas again in this segment today. they're going to be opening up a new factory and they've already opened up a couple in 2011 but

there are parking attendants. we've seen a steady flow. lots of republicans vote not guilty this primary, as well as independents. the voting really kicked off a little after midnight in a tiny village way up in the northern part of the state, close to the canadian border, nine people voted this this morning. that's the entire population there. here is the numbers. romney came in with two votes, huntsman 2. gingrich, one and paul 1. in hearts location, 23 total votes cast there. romney got five. paul, 4. huntsman 2. perry one. gingrich one and president obama pull not guilty ten votes up there at hearts location. in these final hours before the voters have been going to the poll, things can get heated and senator rick santorum and his family had an unusual experience yesterday. they were leaving one of the restaurant stops they were making and surrounded by occupy protesters, as well some younger ron paul supporters.

republican voters that there is not that really big build-up of momentum and enthusiasm and passion for any of these candidates. we'll see if that changes when they head to south carolina. >> brian: let's talk about the president because bill daley called it quits and much of the surprise that the president said he tried to convince him not to. he refused to take his resignation. what's the real story? we know he had his power diminished a few months ago. >> yeah, well, if you believe that obama had to beg him to stay, then you believe that those shovel ready jobs are right around the corner. this was a bad arranged marriage from the very beginning. daley is one of those old style politicians who likes to work for the republicans and fashion a deal, get a deal on the table. but from the very beginning, word here in washington is that valerie jarrett and others thought to freeze him out of the process, which lends toes dysfunctionallity in this white

house, which i believe is something that needs to be covered more and talked about more because when you talk about this administration just completely disentangling itself from anything that's happening on capitol hill and just saying look, we're not going to work with them, well, who is to blame here? the president of the united states has got to have a team in lace or should, that actually works for not just his reelection, but for the american people. as far as i can tell, they're just not doing much more the american people. it's all about reelection all the time. >> steve: sure. there is that new book that comes out today, "the obamas "and looks like there is crazy stuff going on at the white house. okay. so jack lieu will be the temporary guy. it should be all hands on deck in an election year. >> it's very strange in an election year to change course when it comes to the chief of staff position. it's highly unusual. when i was out of college, i worked in the last two years of the reagan administration and the tumult there, that was kind of because of that controversy,

right? but at this point, you would think that the president has his team in place and is going to push that message out to the american voters and the american people. i think the managerial skills in this white house are abysmal and i think the american people have seen the fruits of it, which is nothing done. >> gretchen: that will be interesting because last night, the president continues to promise more change as part of his campaign strategy and listed awful his accomplishments, except some people were wondering how he could forget what we've been debating for much of the last year, which is the trillions of dollars of debt that we continue to face with no real solution for it right now. what do you make of it? >> his new mantra will be change is. so i say change is stagnation of voyages. change is america in steep decline. change is a health care system which is pushing doctors out of the work force and having them retire early. change is the fact that the middle east is in more chaos than before. change is iraq could be evolving

into civil war. >> brian: you got yourself fired as the dnc lead writer. >> debbie wasserman schultz, i wanted your job. >> brian: he also did leave off cutting defense. that's big change. >> yeah. change is undermining our military and even our secretary of defense saying these could be catastrophic cuts. look, these debates we've been seeing, guys, over the last several months, most of these questions in these debates are focused on topics that people aren't talking about, like contraception and the gay marriage. most people are saying, look, america is going off this cliff. how are we going to stop it and have security and wealth? and the president doesn't want to talk about his record. he wants to talk about oh, i'm just getting started here and the republicans are not working with me. we know that this white house has basically stated they're going to do one thing this year and that's the extension of the payroll tax cut. that's the only thing they're going to do with congress. everything else he's going to do on his own. that's going to be great for the american people. >> gretchen: the president may

have to answer some of those questions when the real debates start happening. when the republicans have a nominee and it's just two people standing up on the stage going against one another. but with all the eyes on the republicans, do you believe that too many eyes are off the president right now? >> absolutely. i mean, the idea that this guy goes day by day meeting with the dallas mavericks, we now learn about the lavish halloween party, the fact they spent probably over a million dollars in that failed olympic bid, all these things are coming out now about the high life living in the white house and the failure on the part of this president at every juncture to sit down and craft a deal with the republicans who were willing to work with him in the fall and in last spring. he's unwilling to do that because he wants to campaign against congress. to me that, is not just dysfunctionallity, that's a derelict of his duty and that's what the republicans should be talk about and i think when

>> steve: welcome back. the white house has been in damage control mode since the release of a new book today that reveals possible tension between the president, first lady, and their staff members. >> looks like these tend to overhype and sensationalize things and i think that's the case here. the fact of the matter is, and i think this is depicted in the book, that the relationship between the president and the first lady is incredibly strong. their commitment to each other, to their children and to the reasons why this president ran for office. >> steve: our next guest has direct knowledge of what probably went through the white house's mind when this book made news. anita mcbride is the former chief of staff for george bush and joinses from d.c good morning to you, eye nita.

>> good morning, steve. >> steve: here this white house thought their friends at the "new york times" were their friends and yet, this book comes from jody cantor, one of the writers there. >> well, jody cantor wrote a terrific piece about the obamas and their marriage for "new york times" sunday magazine a couple of years ago. i'm sure that contributed a little bit to a potential false sense of security among the staff to give her the kind of access that they gave her over a long period of time. 30 staff member, multiple interviews with each person. to paint a picture about life in the white house. of course, that's always a risk when you're going to talk to somebody outside. >> steve: sure. and it does -- i've only read the first 100 page, but it talks about tension between the first lady, the president, staff, stuff like that. but you say just in every white house, there are going to be tensions between the east wing, which is where the first lady has her office, and the west wing, where the oval office and the president sit. >> well, i think that there is a little bit of a natural tension until everybody feels out how

they can work with each other. i will say this, these are from the rule book of working with the east wing, number one, don't ever ignore the first lady. number two, don't ever put anything on her schedule she doesn't know anything about. and at the end of the day, all advisors have to realize the closest advisor is the president's spouse. at the end of the day, she's the only one who won't be fired. that's just sort of the reality. >> steve: that's right. now, of course, that the book is out there and people are going to start buying it, nugget also come up, one thing i saw was that when he was in the senate, barak obama thought it was too slow, rule bound. he wrote, shoot me now on a piece of paper during a particularly long and boring speech that was being given on the senate floor by joe biden. there is going to be some embarrassment with this book. >> well, again, with the access that she had and all of the interviews, there is certainly going to be at this time bits. i'm sure now they're saying they

interview and i have to tell you, it was the toughest thing i've ever done in my life because i could not imagine the pain that you were going through and now you're chronicling that so raw in this book. why? why do the book? >> well, our daughter is amazing little girl, extraordinary little girl, but shortly after she passed away, we received so many letters and calls and e-mails from throughout the country with various stories about the wonderful things that she had done and the caring, giving heart that she had. we didn't know about many of the things that she -- acts of kindness that she had done. we thought we'd write an inspirational book of hope and just tell the world what an extraordinary, wonderful little girl that she was. she was only nine years old and third grade, but the things that she did to help others were extraordinary. >> gretchen: you write about how she wanted to be a veterinarian or a doctor, major league baseball career possibly was in her future, after she was

beyonce's back up singer. but she also a love for politics and she went with a purpose to see congresswoman gabrielle giffords, right? >> she wanted to learn more about her government. she looked up to miss giffords as a role model, just like she looked up to michelle obama and president obama. so she wanted to go to learn more what, she could do for her local community and her government in general. >> gretchen: i think this book will be so wonderful for people who have gone through immense pain in their life because one of the things you talk about at the end is how, after all of the flurry of news people and attention that the next month, february, was so tough for you, until you had a message from god one night. what did god say to you that night in your dream? >> christina came to me in my dream and it was a bright light and it was her face, her beautiful face and she told me to be happy and not to cry or be sad because she was in a great place and she was being taken care of. she was with my mother, her

grandma that she adored and try not to be sad anymore, to be happy, to move on, and that she was -- that we'd see each other once again. it was confirmation -- i'm a christian. i believe in heaven. i know she's in a better place, but just so hard to go through such a horrific tragedy and that just really helped our family in so many ways. >> gretchen: one of the ways that you're also helping to get through the pain is setting up this foundation. >> yes. >> gretchen: when i saw you last month, you said that it had helped to pay for a new playground at her school. now you've done something else wonderful in your hometown of tucson. what is it? >> we partner with the salvation army and we raise over 15,000 brand-new toys and bikes so less fortunate children could have a hanukkah and christmas gift this is season. we're really proud of that. we're going to build a children's theater in 2012 and we're just giving back to the commune and hope to take it nationwide. >> gretchen: i know you had a chance to see congresswoman giffords recently. what was it interaction like

when you see her? >> well, of it very comforting to see her and mark kelly. we just gave each other big hugs. our family, my family just wanted to let her know that we love her and that we pray for her every day and we know she's going to get better and better each day and we just want her to know we're rooting for her recovery. i think she felt good about the invest as well. >> gretchen: as one of the gentleman who treated me this morning, he said, please tell roxana wraps their arms around her. >> that's beautiful. i think people around the country and various other countries who sent us well wish, it's vest comforting for everyone to think of us and pray for us. we appreciate it so much. >> gretchen: the book is called "as good as she imagined, the story of christina taylor green." thank you so much. >> thank you. >> gretchen: the race for the republican nomination turning into a battle between

don't care. if you're independent, you're specifically saying i don't like either party, i don't want to be identified with either party. in 2008, barak obama won the majority of the independent voters and it's why he was elected. but bush did well among them in 2004 twice. why he won. it's critical segment of the population. they are younger than average, wealthier than average. >> brian: let me bring this up. they just did a survey to ask independents how they feel about they oppose cutting federal education, republicans would be somewhat against that. they also are not in favor of overturning obamacare. republican issue, it's almost 100% they are for overturning that. so republicans might have a tough time. >> but they're also against wasteful washington spending. they're particularly focused on the deficit and the debt. those are much stronger republican issues. i'd argue they're the key voting bloc this election cycle and republicans, if they focus on economic issue v a fair shot at

them. >> brian: you have two special guests with you. >> yes, i do. i have the most important voters in america. new hampshire moms. let me ask the two of you. sue, who do you support in this election cycle? >> newt. >> it's interesting 'cause you call him newt rather than newt gingrich. when did you come to support him? >> as soon as he announced he was running. i've been a supporter from day one. >> what is it specifically about him that you support? >> his knowledge about the ways around washington and i just think he really knows what's going on and can get things done. >> you don't support newt gingrich. you support? >> i support mitt romney. >> and the reason why? >> i supported mitt romney since he was governor of massachusetts. he obviously did a lot of great things, very fiscally responsible. the deficit is no longer in the state of massachusetts and his values and what he stands for as an american.

job. a question for you, are the attacks about mitt romney's days at bane capital, are they taking a toll like newt gingrich's days in congress were with him in iowa? are they taking a toll in new hampshire and south carolina, do you think? >> in new hampshire, they came too late to have a significant impact. most surveys show mitt romney's lead, which is very large, still decreasing by two to five. but in the end i believe he'll win tonight. the question is south carolina. south carolina is anyone's game. any one of three candidates, gingrich, romney or rick santorum could win that state. >> brian: do you believe like some of the conventional wisdom is, that for mitt romney to walk away with a convincing win, he's got to get at least 37% of the vote? is that your magic number, too? >> i don't have a imagine -- i've never supported a conventional wisdom because, as you know, the conventional wisdom is usually wrong. all mitt romney needs to do here is win by at least double digits and in the end, south carolina is not going to make the decision based on new hampshire.
