>> bret: thanks for inviting us into your home tonight. that is it for "special report," fair, balanced, and unafraid. captions by closed captioning services and tomorrow night. >>. >> bill: o'reilly factor is on. tonight. what has been said many has been true. he's not a conservative. >> the far right going after newt gingrich, but why? what did he do to the conservative movement? some thoughts. >> you're throwing away the great process of the melting pot. everybody speaks english, i think it can kill the united states of america. >> pat buchanan off the air apparently for stuff he's written in his new book about the rise of minorities in the usa. we'll hear both sides of this controversy and attack on an

asian teenager, a father turns in his own son. now, he may be having second thoughts. >> we'll analyze. caution, you're about to enter the no spin zone. the factor begins right now. >> hi, i'm bill o'reilly. thanks for watching tonight. why are some americans demeaning newt gingrich? that is the subject of the talking points memo. first, latest polls from florida, polling 750 likely voters yesterday found mitt romney favored by 39%, and obviously polls vary for governor romney. he's being helped by far right
5:02 am
america. you've heard ann coulter smash newt gingrich believing he's not committed to the cause and he would get hammer by president obama in the general election. and the former house majority leader once a close ally of newt gingrich. >> what has been said about newt is pretty much true. he hasn't been down because republicans won't vote for him. >> why? >> because he's not really a conservative. when he was speaker he was erratic and undisciplined. >> bill: talking points believes ideology will not play a role in the election. but it is the independent votes that will win the election. hard to say whether newt gingrich could win over independents. and indies don't care mr. obama is a social justice
5:03 am
guy, they just want performance, particularly in the economy. looks like america will improve next nine months and that will help the president. if the republican candidate is a controversial person that may help mr. obama. however, there is no doubt some conservative voters reject tom delay and ann coultering saying, seeing mr. gingrich as someone would will not take anything from the president or media that support him that. is the speaker's main attraction. but i must say i am surprised by the right wing. i have known the speaker about 10 years to me he's a bonafide conservative. he may wander off the reservation sometimes but that shows he's not a zombie f a year ago someone told me committed right would be attacking newt gingrich on ideology, i would have laughed. scorn fully. but that is what's happening today. that is the message. now, top story tonight
5:04 am
reaction from washington laura ingram, who is a conservative american. are you are you surprised ann coulter and tom delay are going after gingrich? >> gingrich ruffled a lot of grerjs for a lot of reasons here in washington. remember he was the boogie man of the left. they thought he was a pretty effective spokesman for conservatives. i looked at the cover of the "weekly standard" from 1995 there was a cover of gingrich with him with some kind of gun, a permanent offense. basically he was face in the mid-90s of conservatism. he's the character of the left but embraced by the right. you look at the club for girls web site. they say he was a follower, defender of the free yernt prize principles but then, he kind of wanders off, right,?
5:05 am
supporting tax credits for bio fuels and hydrogen cars and stuff like that. there are things like that this he does that kind of makes you wonder if it gets into office is he going to start pushing through a cap and trade program? >> there are tax credits for alta tiff energy i think is a good thing for the nation. >> right. right. i'm just telling you what they're thinking. right. bill. let's not forget, yesterday in florida i believe in sarasota, 4200 people showed up to see gingrich. >> bill: but that doesn't mean anything. mill skbrer i, me alone i sold out shows there. they're lively down there. >> they want fun. >> yes. true romney picked up a lot in the polls because he had a great debate performance. >> bill: i just think florida is a different situation than south carolina. but look. chris christie hammers, hammers newt gingrich.
5:06 am
and george will, and elliott abe rams worked in the reagan administration. now, bob dole today. bob dole. who knew? >> yes. yes. >> a war hero but not to be the most conservative. >> bill: he doesn't like newt gingrich. they don't like him. >> yeah. i know. i understand they don't like him. i'm not endorsing anyone in this race. >> bill: i know him. >> i think that, again, there are a lot of conservative who's look at gingrich and say, okay. now, if he gets into office, and he starts doing this kind of crazy phone calling stuff or stuff that kind of... >> bill: have you to say the speaker said yesterday in florida he was on the space coast if elected we're going to have monday colonies before 2020. >> i have people would like to put--i'd like to put in those
5:07 am
moon conlol yeens. i'm a space person. i like space and think we should be doing more in space fchl you're a conservative and concerned about our standings you can make an argument this is a great idea. not one you have to sink millions of dollars in debt. they're worried gingrich could represent the face of conservatism. that is what they're doing. >> bill: did you see coulter here? >> i missed it. i know she's been really, really, yeah. >> the end of the world? >> bill: right. right. i'm talking to coulter off cam rachl i go you're tough on gingrich. you know? i'm surprised because i was. coulter came out and started to bang gingrich like she bangs the left i went look. do you know what this is all about? i'm not giving away anything. it's all about coulter and
5:08 am
other people in the republican high yarky who have the dog in the heart. they zpiz president obama. >> they want to beat obama. >> bill: they do not think he can beat obama in the general election. and they don't think women and minorities are going to live him a look and think romney is a smoother presentation. >> women turned out for gingrich in south carolina. >> bill: but it's different. >> look. it is what it is. all i'm say going back to mid-90s newt gingrich was the face of conservatism. >> bill: do you agree it's all about electibility here? >> yeah. i think a lot of people think romney is in his demeanor is a moderate demeanor but there is a good case he'll govern as a conservative. and gingrich is beligerent.
5:09 am
that would be bad for the movement. i think they want to defeat obama. >> bill: you're not going to endorse anyone? >> no. i vnlt. i have learned more about this campaign than these candidates every day z i am still learning and i'm going to learn a little bit more. >> bill: you're on a learning curve? >> i endorsed romney last time around and i made a decision i wanted to have an ongoing conservation about these candidates including rick santorum. >> bill: miss laura, thank you. michelle bachmann is going to be here. is she happy she's out of the political brawl? who does she think is going to win? and also, megyn kelly, is it brea
5:12 am
>> bill: congress woman michelle bachmann announced she will seek reelection this year. are you happy you're out of the nastiness? if you were a contender you'd be getting hammered. are you happy you're out of that? >> that is part of the frey. you do get the snot beaten out of you. this is the toughest job in the world. you have to be a tough individual. i actually enjoyed the process. it made me a better person.
5:13 am
>> bill: do you wish now you were quote getting the snot beat out of you? do you wish that were happening to you right now? >> i would wish i was going to be on the debate stage. i love the debates and wish i could have been a part of every debate. i wanted to answer every question. it's a wonder profl ses. it helps explain positions to people across the united states and explains why barack obama can't have a second term. it's a wonderful process. >> bill: now, laura, the right going after newt gingrich hard. and there is bob dole, and ann coulter and all hammering gingrich. are you surprise bid that? why do you think that is happening? >> it's going to continue. until the voters make their decision about whot nominee will be. this will keep us and will continue. >> bill: why is the right going after what used to be a
5:14 am
standard there on the right? i'm surprised. i didn't think they're going to do that. >> i think you're going to see them go after whoever rises to the top. >> bill: why would conservative republicans go after whoever rises to the top? they want -- i'm not talking media here, michelle. aum talking about republicans who don't want president obama reelected going after newt gingrich in a big way. i think that is pretty surprising. >> i think it's whoever is at the top. people are divided up into various camps and you're going to see names going after certain candidates. for me, i intend to play a unifying role. i want this party to come together. i want indeps to be attracted to our candidate because i'm committed to making sure barack obama doesn't have a second term. i said across the campaign. >> bill: right now, against obama of all four -- all four, you don't want to answer just
5:15 am
say it. people understand. you've got four guys competing. right now your opinion who is a stronger cadet? >> i am not going to answer that question because i do believe i do believe as i said through the campaign that this is a last exit ramp for the country. if we don't get it right this time we may not be able to get our way back. but this process is doing the veting that needs to be done. >> bill: mitt romney is rising in polls. and going down a little bit because i think of ann coulter and bob dole and chris christie. they're putting doubt in minds of the conservative hierarchy in florida and if these people don't like it, if all of them
5:16 am
don't like it, and it's personal very personal there must be something wrong there. and i don't know how the speaker intends to mitigate that. >> well, whoever goes to the top, if you go all the way back to august, whoever goes to the top they don't stay there long and they go straight down spre. a short shelf life. it's almost as if voters have whip lash going from one candidate to nornl. they go with one candidate and then, they'll hear some information and move away z so people are looking for perfection. but at a certain point they'll recognize you have to have a standard there and i think florida's result will be decisive. i think it will be decisive. >> bill: that is interesting. you say whoever wins florida is going to get the nomination? >> i don't -- i think -- . >> bill: congress woman, it
5:17 am
will be decisive. >> i think it could be a rallying point there. is a long way to go to get the number of delegates the fact is that you have to have money to be able to get the mother ship going. >> bill: all right. always a pleasure to speak with you. thank you for coming on. >> thank you. >> bill: there is a brand new poll question. we're asking you has the factor been fair so far in covering the campaigns? yes or no? have we been fair? i would like to you vote f you say no tell us why and send us an e mail. coming up, we'll take a no spin look in just a moment.
5:21 am
>> bill: msnbc has taken pat buchanan off the air because of stuff he's written in a book called "suicide of a soup yes power". believing acceleration of minority immigration damaged the political process. sheer what he said yesterday. >> we seem at war with one another. i think you've got huge numbers of folks millions coming in every year from culture asks countries and civil saigss that have never been assimilated i think it could kill the united states of america. >> bill: joining us now from washington is andy rios. and i know you disagree with mr. buchanan. i don't think he should have been taken off the air because this isn't the first time he's
5:22 am
said this, he's been saying this for years. >> people were suspicious he was a white supremacist. writing this book is clear. >> bill: it's not clear to me. i think he's making a point the melting pot we're one nation under god is done. and he believes that is weakening the nation. i don't think he think that's white people are better than black people or minorities. i didn't get that at all that. is your opinion. you can think he's a white supremacist. you can think i'm a member of the micky mouse club. but should msnbc have taken the man off the air when he have said this for years? >> yes. but waits never so obvious. it was kind of there. but writing this book it is in black and white. it was written by a white extremist. if i didn't know he had written it i would think someone from the kkk had written it. >> bill: do you think msnbc is right to take him off the air?
5:23 am
>> he's an extremist. >> bill: so if you fire extremists msnbc would have nobody on. they're not extremists over there? you do watch the network? >> i do al sharpton. >> bill: not an extremist? >> i do not think he's an extremist. >> bill: al sharpton is and pat buchanan is? if you're going to say one san extremist and another who devoted his life to putting forth one point of view that is the reverend sharpton, certainly all right. what do you think kathy. let's dweel msnbc. i'm sure you say no. but what he's written is provocative. it is not? >> i'll tell you the assault on first amendment rights, this country founded by
5:24 am
founding father was the right to political free speech. and they, it was the first amendment was a right to free speech. let me tell you what happens in other countries. i was in cambodia. in the prison they rounded up intellectuals who said things they did not like z they put them in prison. you can see the bloodstains on the floor. >> bill: sure. >> that is what they do. we're a nation that believes in free exchange of ideas. >> bill: you're right buchanan has the right to say whatever he wants to say as long as it's not endangering someone. but msnbc is a private operation. they can hire and fire whoever they want. so it's their decision to put him on the air or not. my thing is that he is not saying anything now he hasn't said before and plenty of different forums. they knew it when they hired him. now they go well, we don't
5:25 am
like him. >> when reading this stuff getting ready for the interview i was reminded of how great he s what a great thinker to. shut him up because you're afraid... >> bill: what was great about him? >> he's talking about, he's not talking about superiority. he's talking about the lack of asimulation. america is a land founded on principles of people of all colors... the differences that our system is weakened. we use to have had a great immigration system. people went through a process, they learned our language and became americans. adopting the principles of freedom. now, we don't do that. now, we're separated. we're set against each other. >> bill: let me give kathy the last word. >> we're fighting each other? >> yes, i think so. >> the system is not broken.
5:26 am
it's always been like this. >> it has not, kathy. you must be really young. >> why, thank you. but no, every person coming to this country assimilated the same way. first generation doesn't learn the language, the children learn the language, eat the food and culture, assimilate. >> it's not the way it used to be. it does not teach the children about constitution or any of our constitution or history. no. it's different. >> bill: i'm in the taking sides. >> i know. i said it's not a race issue. it's a lack of asimulation. >> bill: i think people should check out pat buchanan's book. >> absolutely. it's a great book. jay leno tells a mitt romney joke and is sue on behalf of a religious community. then, megyn kelly, a park service is it violating the law by letting some occupiers

>> bill: jay leno has been you sued by a man who says the joke he told about mitt romney hurt his religion. >> the other day, they gave a behind the scenes look at the candidate homes and where they live. revealing. here is a look at some of the g.o.p. candidates homes. >> they're impressive. newt gingrich has a 5200 sta estate in virginia. >> ron paul put his ranch on the market. >> here is a look at mitt romney's summer tomorro tomorrow -- home. >> the building shown there is the golden dwrempl of a secret -- sacred site, i should say in the seek -- seikh religion.
5:31 am
and you can do this in the banner of satire. the question is are some people taking their religion in america too seriously? we know you can get killed for mocking mohammed in the middle east. and muslim countries you can be executed but here there is a more secular society. are some people overdoing it?. >> for example you don't overdo it. remember over christmas time russell kbreert dz a canadian spoof and had pamela anderson be the virgin mary? some viewers were upset by that and you were able to separate what you believe but... >> we thought it was stupid and didn't endorse it. i wasn't offended by it because it means nothing. it means nothing to me as a christian that. doesn't mean a thing. >> what i think have you here is that this guy is in california filing this lawsuit in a los angeles county supreme court.
5:32 am
i think what we have here is just oversensitivity to get a lot of that in california. there are people going out there. >> bill: it s that is why people file should have to pay court costs. i know a lot of people who take their religion ultraseriously. if you, you know tell a joke or this or that, they go crazy. >> and many times on this show i defend christianity. but there is a difference. there is a point. there is a fine line. couple things i think maybe they did this to get attention because it's not a very known religion across america. >> bill: he thinks this is going to help? >> possibly, yes this, will get people to be more understanding of the religion. >> so this is going to get people to be more understanding of seikh religion?
5:33 am
suing jay leno? >> here is another thing i do think sometimes comedians fall under the umbrella of being funny then get away with stuff they shouldn't say. >> bill: did you think that? >> no. i thought it was funny. and when they did the jesus thing with tim tebow, that, i thought was over the top. >> this joke was a rich joke by the way. >> and they showed a secret temple it's not in new hampshire but it's in india. >> it's guilded in gold. and implying he's a rich guy running for president. >> come on. >> if anyone should be suing anyone it's mitt romney saying that is not my real house. >> everybody should sue. i'm tired. very owe say thchl i respect religion. you know that. but people got to have a little sense of humor. i mean, come on. you're not going to get any
5:34 am
points from the diety. it's not going to want to hang around with you. >> it's not consistent with the seikh religion which isn't good vengeance or any sort of, the religion is a very pacifist religion. >> and when talking about a story with this religion we get a ton of e mails who are very passionate about that. >> and this is their lism they don't want you running them down on any level. we have to be aware of that. my point here about the diety wants a sense of humor? look who is the number one cable person in the country that. is not sense of humor?

5:39 am
your job tone force the law? >> absolutely it's my job. >> is it against the law to camp? >> the courts have afforded us a great deal of discretion in how we enforce the law. >> so, the occupy wall street people breaking the law? >> technically, yes, they are. >> so the law says no carp camping out without a permit. >> yes. that is the disstix. if it's just a protest it's one thing, morphing into camping is another thing. and this, let's... >> bill: they've been living there six month autos there is no question national park service has the authority to kick them out. >> the congressman is correct. he is not up holding the letter of the law. >> if they're camping as they have been, it's clear he has authority to kick them out. he says he wants to be careful
5:40 am
because you don't want to kick out one group and not another group. in the beginning they started to camp waits one thing. he said he had reasons then. he didn't want to their cause. >> bill: that is bs and dumb. i can shred that guy in a minute. and what i'm concerned about that is the letter of the law. >> he has the right to kick them out. >> bill: right. but if he doesn't, which he isn't that opens up the door for every outfit to camp out on every park of the national park system under the guys of protest. >> especially now. now, he's let them. >> bill: me and shakers are going to go out. look it up. >> they don't want to camp with you. >> do you know where i'm going? yosemite in the nicest part. with me and the shakers.
5:41 am
>> is it different if there is no precedent for allowing protestors to camp. >> bill: i had a run in with these kooks. they're right in the middle of town. you can't get around them. >> they have missed and neighbors are upset. they're obsessive with rats. >> bill: and drugs all right in there is a sanitary problem there. >> they do. >> bill: and cops are under siege there. >> it's costing taxpayers in clean up costs. >> bill: we have to fire the national parks director. >> no. >> bill: no? >> the guy is now going to enforce the law. >> bill: now? >> he says he's going to start ticketing people. they're not going do a forible. >> bill: i'm sure they're going to a that ticket. >> have you to be somewhat open minded. protesting is at the heart of america. what americans do. whether awe agree with your -- would you
5:42 am
feel differently if this were pro lifers? oob yes. >> really? >>. >> bill: enforce the law or get out. >> he's not violating the law giving them a pass. he's using his discretion now they're going to get a nasty time. >> bunch of teenagers beat up an asian, there is a rivalry of let's roll tape on this. and not yet. hold on. chicago bunch of teenagers beat up an asian teenager. >> they said beat on them earlier. >> bill: the father sees it. turns his own son in. and now, we can roll tape.
5:43 am
>> bill: the kid is 17 charged as an adult. others are minors. so one guy he's in law enforcement 30 year that's father sees his kid is the one whose hood came off. he calls up and turns his son in but now, under illinois law, the, at 17 you get charged as an adult to $100,000 bail. >> bill: he can't make it. >> prosecutor charged as aggravated battery and aggravated robbery. and that means this kid is facing two to five years on each charge and $100,000 bail. others are in jufy and facing suspension. >> bill: they got them all but they're under 17. i feel for the dad. >> i do, too. he did the right thing. >> he did. >> this kid could have been
5:44 am
killed. >> if you watch the whole three to four minute tape it's so much more horrifying than the clip you just showed. >> bill: uncalled for. sadistic. he has to support his son, i understand. >> if future parents it's helps if you reach out to the prosecutor and talk about how maybe to charge this case prior to this. and there could have been some damage control with a lawyer. >> bill: good advice. >> on deck great american news quiz, then, newt gingrich calling on nancy pelosi over a veiled threat. coming right back.
