[ female announcer ] try aleve d for strong all day sinus and headache relief. jenna: thanks for joining us everybody. jon: "america live" starts right now. megyn: new developments this hour on another big turn for the republican race for the white house where it seems you can't bet on anything except volatility. welcome to "america live." i'm megyn kelly. stapbrick santorum three wins last night. three huge victories that undermine the idea that mitt romney and newt gingrich are the only two men left standing in this race, and the belief by some that romney is the resum tiff nominee. chris stirewalt is our fox news digital editor. it was a great night for rick santorum.

it was a great night for him by any measure, chris. when you sort of look through the weeds. if you're going to win three primaries, it's the number one prioritnot number one with nonbinding primaries, and caucuses. >> rick santorum didn't get anything last night, what he did get in a larger sense is the boost that he needs to make the case that he should be the conservative, not newt gingrich. he should be the conservative to go toe-to-toe with mitt romney down the stretch in what promises now to be potentially a long nominating process for the republicans. megyn: it's not so much about santorum taking out romney, it's about him making progress in the race against gingrich. you read your power play piece on foxnews.com, you said fair to

miserably, why do you say that? >> he wasn't on the ballot in missouri. even though missouri didn't kaupbt he wasn't on the ballot to get any of the attention. he finished behind ron paul in minnesota. very poor showing in colorado. not in line to get any delegates when any of the states start awarding their delegates. so it's bad. what gingrich is trying to do is lay in wait for the campaign to come to him. he's campaigning in ohio. he's going to campaign in super tuesday states, like his home state of georgia, like tennessee, oklahoma. he'll be out there hoping that the race comes to him so that he can do what rick santorum did last night, which is have the groundwork done so that when the race catches up to where he is, that he can have a big night on super tuesday, but the truth of the matter is now that newt gingrich, who thought that he had settled this question, claimed he had settled this question after his big win in south carolina, that he would be the not romney in this case. rick santorum said not so fast

and he's back in the miss. megyn: santorum said why should i get out. i won iowa, romney won new hampshire. why does that mean i should get out. i think he felt validated by the results last night. when you're an american voter and are deciding who to vote for do you look at delegate count, who has the most. do you look at momentum, santorum won the last three. do you look at, oh they are nonbinding. what factors in when somebody goes to the polls? >> reporter: here is the thing for republican voters right now, megyn. they are back and forth. they can't decide, do they want to end this quickly, take mitt romney. do they want to go with newt gingrich, do they want to go with santorum. they korpb fused and divided on the subject. it's so important to these republicans that they beat barack obama. they are not sure which of the three guys can do the job best.

i'm sure you all want that too. what you probably do want is the delegate totals, momentum and perspective like you just got from chris stirewalt and you can get that on foxnews.com/politics. fox news alert on the deadly situation in syria. have you been following this? because you need to. government forces launch a new round of attacks today against proceed democracy demonstrators there. for nearly a year syria's government has sustained a violent crackdown on protestors that want to overthrow the president there, bashar al-assad, and the violence has begun to spiral completely out of control. today marks the fifth day of intense fighting in the city of homs, where some say if you are alive you're beating the odds. reports say that among the dead are several newborn babies who died inside offing cu incubators in a hospital after shelling knocked out power. reports of at least 5400 deaths

since the fighting began, and over 200 in just the past few days. leland vittert reports live for us from jerusalem today. >> reporter: it seems as if it is possible things are about to go from bad to worse inside the city of homs. it is now surrounded by tanks, there is a siege laid to the city. food supplies are running low. there is not much water. electricity has been shut off. their hospitals are not often in existence or operation. they have been destroyed. the video is amateur video uploaded by people who are risking their own lives trying to show the rest of the world what is going outside in their city right now. they estimate every day there's between 100 and 200 civilians killed inside the city of homs. you right remember that yesterday the president of syria promised the russian foreign minister that he was committed on stopping the violence. today things are worse and

worse. television has begun a media blitz to go on the offense on their thoughts of what is going on. residents of homs were begging the army to come in and continue the assault. calling them terrorists or armed gangs that are trying to destroy their lives. the people inside homs, all they want is a chance to a better life and to have bashar al-assad thrown out of office. where we go from here it seems the international community at least for the next couple of days has its hands tie after that u.n. vote that russia and china vetoed the resolution. there is a chance that you could have an infantry assault on homs with hundreds if not thousands dead, back to you. megyn: as leland just mentioned there was a u.n. draft resolution to tamp down the bloodshed in syria. that was vetoed not once but twice by china and russia this past weekend.

while the two nations face serious criticism over that decision they are not the only ones feeling the heat for the resolutions utter failure. susan rice, the am bass der to the u.n. is taking criticism for that resolution's defeat. we have a former spokesman for the last four ambassadors to the u.n. joins us with his take on why he believes that this woman, susan rice, should be called onto resign, and if she doesn't she should be fired. we are waiting for the start of the daily press briefing at the white house right now, where the press secretary jay carney is expected to again face questions over the obama administration's controversial new contraception policy when it comes to catholic institutions. the policy has infuriated the catholic church and catholics on the left and the right across this country. this as we are seeing some suggestions today in the wake of several days of controversy now that the white house could be

seeking a way out of this firestorm over requiring all employers, even religious ones to offer contraception coverage with no co-pay for their employees. this would include sterilizations and so on. not catholic churches but universities, hospitals and other related institutions. here is the senior obama campaign, david axelrod. >> we will look for a way to move forward that both guarantees women that basic preventative care that they need and respects the prerogatives of religious institutions. megyn:ed henry is live on the north lawn. you know,ed, they don't want to do anything that would infringe on religious liberties. but it's not like this issue caught the white house by surprise. you know, for a longtime the church and catholic institutions on the one be side and planned parenthood and other institutions on the other side were lobbying the white house about this exact issue.

then it made a decision, and kathleen sebelius said the decision is you will have to pay for it, catholic institutions with no co-pay. and now, you know, the way axelrod was talking about it it was like, we'll find a way now that it's been called to our attention. >> reporter: megyn they are trying to make it seem like there is maybe a compromise in the works. but when you lessen closely to what david axelrod is saying, you're right this should not be a surprise to the white house. there had been criticism out there and the bishops and other -ts warning if this moved forward it would be a problem. if you listen closely what david axle road said and what jay karen see said yesterday alternate the briefing they are not signaling any change to the policy, they are trying to show that they will they are willing to compromise. but it seems to be this policy is going to go forward and religious groups have several months to deal with it and see how they are going to comply with the law.

a lot of people are not buying that. you heard rick santorum on fox saying he believes the president is basically hostile to people of faith. that is the charge from rick santorum, and then house speaker john boehner a few moments ago said on the house floor if the white house does not repeal this policy, congress will. >> the president does not recertificates the department's attack on religious freedom, then the congress, acting on behalf of the american people and the constitution that we're sworn to uphold and defend must. this attack by the federal government on religious freedom in our country must not stand and will not stand. >> reporter: now jay carney at the podium yesterday, we can anticipate in the next few moments when he takes the podium again, has been saying consistently that they are not aeu bridging religious freedom and they want to work with the groups to try to implement it in a fairway. has you've been suggesting megyn there are a lot of people hot about this and the pressure on the white house continues. megyn: the religious

of america poster for the 08 campaign. jim lasser and another executive are also strong obama supporters worked on this ad. obama supporters created and shaped this ad. ph-g megyn: if you picked any ad in the country you would probably find someone in ooh port of obama or any of the other candidates. what does that tell us. >> reporter: it looked to me like it was an endorsement of president obama's second term. megyn: you think in essence it was a slight of hand. >> reporter: no i think it was intentional that i and other viewers would have that impression. i think it was slight of hand to convince clint eastwood, an iconic american and a known conservative to put his face and voice on that ad, which looked very much like it was supporting a second term for president obama. i think it's one of the great slight of hand political

operations of the last generation. how else can a group of people who support president obama convince clint eastwood, a conservative guy who says he doesn't want to take sides in this election. megyn: and he doesn't like bail out, even of the car industry he said. >> reporter: they got him into this commercial. a hundred million americans now think that clint eastwood endorsess a second term for president obama. megyn: you sound like rush limbaugh. he was making a similar point yesterday. >> this ad obviously that eastwood did. i'm going to give him the benefit of the doubt and suggest he got suck erred into this. all this talk of working together, and that's always what people say when the democrats are about to get shellacked. when the democrats are about to get creamed or on the rope. time out, time out we have to stop the criticism and all the

partisanship. time out, time out we've got to all start working together. that means republicans need to shut up. megyn: he has come out eastwood and said i didn't mean to be political in the ad and i'm not enforcing any candidate. he seemed to be supporting america. he said it was a proamerican mess and. >> reporter: i think he was duped to some degree. megyn: it's a two minute ad and we hear the name chrysler one time. >> reporter: there is a financial angle to this. chrysler still owes the u.s. taxpayer 1.2 i think it is, $1.2 billion. what are they doing making an ad which looks like anticipate endorsement of president obama for a second term and which cost $14 million? they owe us money. why didn't they pay us off first? remember, chrysler was bailed out by the taxpayer, the company was gussied up, the union was fixed, and then they gave it to an italian company. when was the last time that an iconic american company was given to a foreign corporation.

the hands of their father, josh powell. a man long i'd in the disappearance of his wife, susan powell. police releasing the chilling 911 calls revealing a social worker's frantic attempts to get police to the powell home before the home ignited in a fiery inferno. trace gallagher has more. >> reporter: it really is, megyn. the social worker who covers the best perspective on how horrifying this was, she calls 911 and she tells them that josh powell opened the door, and the boys were a step ahead of her. they walked in the house, he then quickly slammed the door in her face, she began pounding on the door. now listen. >> nothing like this has ever happened before. these visitations, i'm really shocked and i could hear one of the kids crying, but he still wouldn't let me in. but i think i need help right away. he is on a very short leash.

the president's healthcare law and one particular aspect of it. as things stand right now, religious institutions, catholics hospitals and institutions could soon be forced to pay for benefits like birth control or sterilization with no copay to the employees even though those benefits in the case of catholicism conflict with church teachings. now a group of senators say it is not about faith, it's a republican war on women's health. >> we voted to give women great access to affordable healthcare services including contraception. these are important historic advance thes for women's health and they should not fall victim to ideological policies. >> republicans have been waging

a war on women's health since they came into power. the first three bills they introduced were direct attacks on women's health in america. >> my republican colleagues almost shut down the government over family planning. now if they have their way, millions of women could lose their contraceptive coverage which could expose them to declining health outcomes and their babies to declining health outcomes and could cost them about $600 a year. megyn: monica crowley is a talk show host and sally colmes. the we are talking about whether the white house is back off. they said they are not going to compromise on this. they have the place they are happy with, and those democratic

senators seem to be agreeing. where is this going to go? >> the white house never had any intention of compromise on this. obama-care was passed a year and a half ago. this is their policy. this is a direct assault on religious freedom this country. megyn: do you think they expected as big of a backlash from not just cloth licks. we had a jewish rabbi who says it infringes on religious freedom. >> it's not just catholics. we have people of all faiths outraged over this. if you can go over catholics today you can go over the jewish community or the muslim community another day. we are talking about compulsion by the government of private institutions who do take taxpayer money. but to compel them to go up against church doctrine and accept by writ of the government

to accept things that go against the core of their religious beliefs. megyn: sally, can you explain why the senators we just heard, why is it so important -- why are the groups lobbying the white house saying this is so critical for the president not to back down on. >> there are a couple of things we should parse out. from a liberal perspective, he's had a history of backing down to any whiff of controversy. but what the senators are saying is generally right. these trumped up charges against planned parentshood. megyn: this is not planned parenthood. >> this is an ongoing controversy. megyn: if the president doesn't implement this, what's going to happen to the female employees at catholic universities and

catholic hospitals. >> they are being left without a choice. these aren't private institutions. these are institutions that take tax benefits for the public services they provide. the conservatives are always interested in individual choice until it comes to individual choices they don't seem to like. 98% of american women including 98% of catholic women have used contraception. that's their choice. megyn: it seems like that's what the white house is saying, virtually every single american this favor of birth control even thought it, against church doctrine. but it morphed from a contraception issue into a religious liberty issue. >> if you as a catholic want to seek out birth control that's

twin and your doctor, you and your church. but to tell religious organizations they have to do x, y and z in direct violation of their beliefs. that's tyranny. this gets to the core philosophical problems, most americans, 65% have with obama-care. we fear this kind of government overreach. we knew obama-care would get into every nook and krannive our bodies and our lives. and this is the direct points we were so afraid of. megyn: i want to ask you about the point of them taking government money. but you seem to be suggesting if they don't take it money, then they can't be regulated by the government. >> not necessarily. megyn: do you want to see catholic universities and hospitals going out of business, either closing down or having to

pay for or violate their belief. >> of course not. necessity provide a valuable public service. we are trying to layer religion onto this in order to pass the healthcare reform law. but really we have all kinds of quote-unquote compulsion in the interest of public health and public safety. we compel people to stop at stop signs. but in this case 98% of catholic women are already using contraception. we have people saying they are concerned about uninternedded presenting man is and the life of the children. catholic women should be able to and want to be able to have access to contraception. the government preserving and protecting their choice to do so. megyn: they gets on their own dime. >> this races the bigger question about the proper role

megyn: concerns about the bloodshed in syria after the government launches new attacks against pro-democracy demonstrators. but the united nations so far has failed to act. the u.s. ambassador to the u.n., susan rice is slamming china and russia for their veto of a proposed resolution this past weekend. take a listen. >> today we saw clearly which countries are prepared to support the people of syria and indeed the people of the entire region as they struggle to attain a future of peace and democracy. and we saw which countries for their narrow interests do not. megyn: my next guest says

ambassador rice shares some of the blame for that resolution's failure, among other things and he believes she should resign or be fired. he spent eight years at the united nations. he's a former spokesman for the ambassadors to the united nations. thank you for being here. why do you think ambassador rice should be forced to resign? >> i don't come to this decision lightly. i know that the united nations is a very tough place for americans especially. but after serving there eight years and watching and participating with four u.s. ambassadors, i feel compelled to speak out and to say we are not being represented, americans are not being represent and i think it's a national security issue. consistently susan rice has either not shown up for some important meetings, not spoken out when israel and other allies

need our support. but when she does show up she has failed. let's take two issues that are of significant importance to americans and our national security. one is iran and one is syria. this weekend we saw a miserable failure of diplomacy. she waited too long. she tboash yatesed too quickly and the russians smelled weakness. they could see our interests were not being represented by the best person. then you take iran and susan rice has failed to come up with a u.n. resolution in 22 months. we have had nothing from her team and yet it's suppose to be a national security issue. we are now going around the u.n. and we are asking europeans 20 to couple with sanctions and we are unable to have any type of leadership at the u.n. in spite of the fact that susan rice in 2008 was very aggressive during

the campaign saying she would restore leadership. meg require want to speak to you about syria in particular. you say she waited too long and when she acted she negotiated too quickly. people listening to this will say how is susan rice going to control russia and china. >> there is no question russia and china are difficult. they always say they are against resolution. but next month is the one-year anniversary of the syrian uprising. why didn't she start immediately to call for meetings. why didn't she start pressuring. when the russians and chinese see you waiting so long before you put forward a resolution, they sight as weakness. the russians would constantly stand up against us. but we put forward a draft resolution. we demanded a vote.

voter i.d. law. that law says if you want to vote you need to present photo identification. but the justice department blocked that law saying it discourages certain people from voting. the state leaders respond yesterday by filing lawsuit against the d.o.j., basically telling the federal government within mind your own business. joining me now, lis weihl and jonna spilbor. south carolina is fighting back saying butt out, feds. first and foremost, lirks s, what right does the federal government have to go into south carolina and say we don't like that voter i.d. law and you are not going to be able to enforce it. >> they have every right. south carolina is one of 16 states covered under the voters rights acts of 1965 that gave the justice department oversight. the department of justice on these 16 states, mostly southern states where there have been

issues of disenfranchisement of minorities. the department can say yay or nay. and that's what happened here. megyn: therein lies the response to people who say this is an issue of federalism. south carolina -- they had to submit laws like this to approval about it feds given a history in that state that is problematic when it comes to certain racial minorities. that's hot feds from worried this law will disenfranchise. the south carolina attorney general does not think in this instance eric holder got it right. he thinks there is no evidence this law will disenfranchise anybody. >> the reason for laws like what south carolina wants to pass is to avoid voter fraud. this will avoid plea from going in to register as my dog or dead

grandma. there might be 10% of non-white registered voters who don't have a picture i.d. we'll remedy that by giving them a free one. case closed. how can the d.o.j. argue with south carolina on that. megyn: tom perez who a lot of our viewers may know, he was vocal in defending the decision to drop the case against the new black panthers. he comes out i believe in this case and said, looking, we don't necessarily buy that that will rectify the problem. >> it puts another requirement on, you have to go to the department of motor vehicles, get that photo i.d. south carolina already requires a state-issues i.d. like a registration card. this adds a photo i.d., the department is saying that's adding something that's more onerous. there are only 15 states that require a photo i.d. megyn: it's been upheld by the

supreme court, has it not? >> it has. and if we bottom line it again, how hard is it? why is it own --ies it onerous to go to a dmv and geat free photo identification? megyn: you need it to buy a bought of wine. >> in south carolina they have a history with the department of motor vehicles of having dead people registered with the department of motor vehicles. i think the department of justice probably rightly or wrongly says we are not so sure about the history of south carolina here and their department of motor vehicles. megyn: they are saying there is so much fraud we can't be concerned. >> the bottom line is that under

the rights acts of 1965, the department has the right to do this. megyn: clearly they don't have the right in all circumstances to say, yay or nay in all decisions. they can't be arbitrary. they have to be able to back up why they don't think it's okay. the a.g. is saying i'm going to take you to court on it. what is the standard? does the a.g. have to show this was arbitrary? eric holder has stats he will use to prove this. >> how can the southern general prove a negative. how is he going to be able to say you don't have a voter fraud problem? >> holder will go back to the department of motor vehicles and say you have got fraud in the department that's suppose to be issuing these identifications. megyn: if the d.o.j. did not
