wreck him. i speak of cnn's roland martin. yes, that roland martin, now suspended by the network after the gay and lesbian alliance against defamation complained that some of his tweets were homophobic. it started during the super bowl when faced with the under wear ad and soccer star david beckham, martin tweeted this -- ain't no real bros going to h and m buying some underwear hash tag super bowl. followed by this -- if a dude at your super bowl party is hyped by the h and m underwear ad smack the ish out of him. >> oh no. >> glad then tweeted to martin that advocates of gay bashing have no place at cnn. then he issued a statement demanding the removal from cnn citing that, quote, he once referred to it as sinful behavior. he said he was cracking on soccer and not gays, but no matter. cnn issued this statement on

frocs? a virginia school district is considering a ban on cross dressing. after hearing a report that several students who favor dresses and wigs had to use faculty bathrooms due to safety concerns. there is another picture of a school. there are some windows. >> is that the school in question? >> it would outlaw clothing not in keeping with the student's gender, that is a distraction in class or poses health concerns. the ban would violate students' first amendment rights and they don't care about dudes in dresses. it is one or two angry teachers, sad teachers. but they say, quote, freedom of expression is good, but there is no limitation. that's where you draw the line of freedom of expression. meanwhile, let's go back to japan for an update on the situation there.

i don't believe that was necessary. pab, here is the thing, the school is saying they are worried about threats to kids. isn't the school concerned that they would be held liable if these kids were beaten up and they knew they would be beaten up? do they have a legitimate concern to protect the kids? >> they are probably also legitimately concerned about these kids' safety. they say there have been threats. they are not very specific about what the threats are or whether they are afraid they might be threatened ssments -- threatened. they talk about how the clothes can cause a serious disruption. clothes don't cause a threat. people do. if people are threatening these kids, then you go after those other kids. you go after the threat. you don't go to the other side. you don't say you can't dress

should neighbors care if he gets fresh air? i think so. so the pennsylvania prosecutors are looking for tougher bail conditions for jerry sandusky after the accused sex fiend was seen watching children in a nearby schoolyard from the back porch of his house. yes he is under house arrest, adjacent -- if you can believe this, he lives near an elementary school. i don't know how. i don't understand this. the teacher and intern complained and now the state's attorney general's office argued that he should not be allowed outside except to seek medical treatment. you know he will have some kind of medical problem. sandusky's lawyer says the concerns are on the neighborhood -- the concerns around the neighborhood are, quote, totally unfounded. we must talk about this and more in the -- >> lightning roooooouuuunnnnddd. lightning round.

welcome back to "red eye." a company in california is renting out drug sniffing dogs who are worried their brats may be hiding some kind of a drug habit. the dogs search the house sniffing out cocaine to heroin and prescription drugs like
