they care about the cash. they haras you into making a quick decision with all those calls and he felt males, and if they can't get you online, they show up on post. one of the worst examples of this is a college recruiter who had the nerve to visit a barracks at camp lejeune and enroll marines with brain injuries. just for the money. these marines had injuries so severe, some of them couldn't recall what courses the recruiter had signed them up for. that's appalling. that's disgraceful. it should never happen in america. i'm not talking about all schools. many of them, for-profit and non-profit, provide quality education to our service members and our veterans and their family, but there are some bad actors out there. they'll say you don't have
1:01 pm
to pay a dime for your degree but once you register they'll suddenly make you sign up for a high interest student loan, they'll say that if you transfer schools, you can transfer credits but when you actually try to do that you suddenly find out you can't. they'll say they've got a job placement program when, in fact, they don't. it's not right. they're trying to swindle and hoodwink you. and today, here at fort stewart, we're going to put an end to it. we're putting an end to it. the executive order i'm about to sign will make life a whole lot more secure for you an your families and our veterans, and a whole lot tougher for those who try to prey on you. here's what we're going to do. first, we're going to require colleges that want to enroll members of our military or veterans on your families to provide clear information about their qualifications and available

recruitment practices. we're going to strengthen the rules about who can come on post and talk to service members. >> and we're going to make it a lot easier for all of you to file complaints and for us to take action when somebody is not acting right this is about making sure you succeed, because when you succeed, our country succeeds. it's that simple. after all, at the end of world war ii, so many americans like my grandfather came home to new opportunities. because the original g.i. bill, by 1947, half of all of all americans who enrolled in college were veterans and you know what, they did pretty well. they rose to become presidents. and supreme court justices. and nobel prize winners. and they went on to become scientists and engineers and doctors and nurses. # million americans were educated under the original g.i. bill. and together, they forged the backbone of what would
1:04 pm
become the largest middle class that the world had ever seen. they built this country. they turned us into that economic superpower. and we can do it again. we faced tough times, gone through the worst recession since the great depression, two wars, but you know what, we have faced tough times before. and all of you know something that america should never forget: just as you rise or fall as one unit, we rise or fall as one nation. just as you have each other's backs, what's always made america great is that we have each others' backs. each of us is only here because somebody looked out for us. not just our parents, but our neighbors and our communities and our houses of worship and our vfw halls, each of us is here
1:05 pm
because we had a country that was willing to invest in things like community colleges and universities and scientific research and medicine and caring for our veterans. each of us is only here because somebody, somewhere, had our backs. this country exists because generations of americans worked together and looked out for one another. out of many, we are one. those are the values we've got to return to. if we do, there's nothing this country cannot achieve. there's no challenge that's too great for us. there's no destiny beyond our reach. as long as we're joined in common purpose and common resolve, better days will always lie ahead and we will remind everybody why the united states of america is the greatest country on earth, and as i look out at this sea of incredible men and women, it gives me

1:07 pm
who tend to be very tuned in to things politically for obvious reasons, and you can see the president, about to sign that order, down in georgia. if you'd like to see more of that, you can watch it live, streaming on foxnews.com. in the meantime we want to get to other news for you now, including this: >> an alert coming in on new signs about our economy and they are not good. suggesting things are slowing down and the new challenges that that would create for president obama's reelection effort. welcome here to "america live" everyone, i'm megyn kelly. the new data on the gross domestic product released just hours ago, the gdp as it's called is a measure of all the goods and services produced in an economy. sort of like the doctor feels your pulse to see how that's doing this, is sort of the pulse of our economy. in the final quarter of 2011 we saw 3 percent growth. but for the first quarter of 2012, it slowed to 2.2%. economists had expected and desired better numbers than
1:08 pm
that, about 2.6% growth, they were projecting. again, we are at 2.2. the obama administration now reacting, saying the economy is moving in the right direction, but saying more is needed. chris stierwalt is our fox news digital politics editor and host of "power play" on foxnews.com. chris, it's going in the wrong direction. and this plays into a theme that we've been seeing from the pundits lately, which is folks who support president obama saying, you know, sort of don't believe your lying eyes when you see you're unemployed and your neighbors are unemployed, we're coming out of the recession, the economy is growing, we're creating jobs, then the other side saying i don't feel it, i don't feel it, and these latest gdp numbers seem to suggest a lot of people don't feel it. >> well, a lot of people don't feel it, and certainly, what you saw, you could have a juxtaposition to what you just saw, the president giving a campaign-style speech in georgia, talking about scientific investment and echoing the stump point
1:09 pm
speeches, talking to military families. he wants to be talking about that, he doesn't want to talk about a slowing growth rate because that plays into mitt romney's hands because romney argues yeah, maybe things are getting a little better but president obama has made it worse, made the recovery weaker and made it take far too long. megyn: you need to have 3 percent, that's what they say, generally a 3 percent growth in gdp to sort of start the engine moving again towards recovery, towards what we're used to in this country. you know, we're at 2.2. it's lower than they projected and lower than we add all hoped it would be. the problem for the president politically, chris, if it stays at 2.2 or goes down, does the -- do the american people pay attention to those numbers or is it more, as i suggest in my first question, more of a feel? >> well, it's definitely about the feel. these numbers are how we measure what people are likely feeling out there. we take survey, overwhelming majority of respondents in the latest fox news poll
1:10 pm
said they thought the economy was still in the resession, but numbers like this not only tell what people are feeling but what they're likely to feel in the future. i point you to this, a recent financial times study they did of employment data in the swing states. in the swing states, job growth is even slower than in the rest of the country. they're having a much worse time in the states that will decide the election than they are at large. so when you see numbers like this and you see these problems, you get a sense of why the president wants to talk about anything but the economy, especially on a day like this. megyn: you know, that's fine, you know, seven months in advance, we have seven months to go until the big election. when do the people -- is there a point at which they stop and say this is the marker i take with me into november? >> so we're rolling with about a # percent undecided right now. that 8 percent is going to shrink and shrink and shrink. they will probably, if president obama is lucky, they'll split even lerks they'll probably go a shade to the challenger. the second quarter of the year, if the president sees a number like this in the second quarter of the year
1:11 pm
or, as you suggested, worse, if things get worse and people are really hurting and these problems are accelerating, what you'll see is those undecided voters who are generally moderate, and the persuadable voters here, they're going to break hard against the president. that could be big trouble for him by the time you get to the middle of the summer. megyn: they're looking for trends, you know, are we going up, down, are we stagnant. chris stierwalt, thank you sir. >> you bet. megyn: we got brand new fallout after a top administrator from the environmental protection agency attacks the oil and gas industry. remember this from yesterday? >> [inaudible] >>

1:46 pm
they do, in a huge percentage of marriages, and so what happened to john edwards, like many passionate people, it seems, he was moved in a passionate way by another highly successful person and they had a child together. i really object to this being the way we select leaders. we couldn't have gotten a civil rights movement off the ground if martin luther king were held to the same standard. he would have had his character assassinated because of his sex life. it's absurd. megyn: is it just his sex life? or is it the lies he was telling us in trying to be a man of family values, in cheating on a wife? i mean, cheating on a spouse is never good. cheating on your dying wife while she has cancer, really bad. >> very sad. but i can tell you, sadly, if you choose to call it sad, it is not that union common. and what do you do when you have an affair? well, unless you have an open marriage, you hide it. i'm talking about millions

2:05 pm
us. let's start with this report in the "l.a. times" that says house leaders, republican house leaders have drafted a proposed contempt of congress citation for the southern general of the united states. is that true? >> the working documents we believe the "l.a. times" have originated in our committee and are part of ouron going options in trying to get the truth in fast and furious. megyn: they speak of a 48-phage draft citation being drawn up by you and your office. >> by definition we made it clear repeatedly including when attorney general holder was before our committee that our patience is limited. though he agreed he was going to cooperate. he also caveated with a whole list of things he wouldn't do. the most notable thing is congress was lied to. the american people were lied to on february 4 of last year.
2:06 pm
10 months later when they admitted it was an outright lie. we included in the subpoena the necessary request, tell us how that lie came to be and tell was happened during the intervening 10 months. the attorney general has flatly refused to give us any documentation after february 4 and he refused to give us the kind of information necessary for us to understand who works at justice today, particularly here in washington, who was part of this failed program, part of the decision, made decisions and wanted this program, and is still working there and the president should not have confidence by any means in those people. megyn: we appreciate you coming on being here. i want to just ask if you are comfortable answering that, if there is a 48-page draft citation of contempt you or your office have prepared. >> there is a document. of course, we have gone through and made the case for the various reasons that we have no
2:07 pm
choice left unless the justice changes their position and changes it quickly so we can get legitimate discovery. 12 secret service agents made a terrible lance in judgment in cartagena. nine of them today are gone. in many ways a worse lapse in judgment that led to the death of brian terry and countless others in mexico. those people still have their jobs and we don't even have their names for sure. megyn: the "l.a. times" further reports there was a meeting in house speaker john boehner's office and the republicans on your committee were given the green light to proceed towards a contempt citation. that would be a step further earlier when you were upset with mr. holder. you have been just set with him for a while. he says it's political and he
2:08 pm
says he has given you what you are entitled to. but if speaker boehner gave you the green light to go ahead with the contempt citation -- has that happened? >> the speak letter have to confirm some things. all the members of my leadership agree that the american people are ebb titled to documents in discovery that we haven't been given. he has the view that he gives us what he thinks we need. for those of us old enough to remember. richard nixon thought there were a lot of things we weren't entitled to that ultimately the american people are glad congress got. this is the same situation. it's about what happened after brian terry died, after these weapons had long since been denied and congress says the american people have to know and hold people responsible. megyn: what is the time frame on this? in your estimation, the attorney
2:09 pm
general has been delinquent on his responses for months now. what is the time frame that you still see as available for the justice department to comply before they actually do get hit with a contempt citation? >> though we have a few other options for additional discovery, we are to a great extent stalled because of the coverup and stonewalling from the justice department. we have thoughts on who might be responsible and we aired some of those names. but the president knowing the truth and taking quick, decisive action, that will take the kind of discovery we are not getting and the justice is holding. these are legitimate documents that not only we have the right to know, but the american people have a right to know who decided and who covered up. megyn: president obama visiting the troops today and thanking

2:15 pm
also with me fox news military analyst retired general tom mcinerney. the president appeal together troops. last time around he lost overall the veteran's vote but he won veterans who are younger than 65. the younger ones went for him. how do you think that will turn this time around? >> that depends on whether governor romney and the republican leadership can get serious about the military vote and military families. obama isn't much of a president. but he's a brilliant, ruthless, shameless campaigner. an and his advisors realize as commander-in-chief he can take air force one and give a campaign speech at every u.s. base in the world as long as he doesn't call it a campaign speech. while governor romney who hasn't
2:16 pm
shown much interest in the military, can't hold a campaign event on a military base. they haven't figured out the extent of the military vote is up for grabs. if governor romney listens to the washington generals and talks about doubling down in afghanistan on the assumption that civilians make that soldiers make more war because the military people have had it. the people who have to actually fight have had it with afghanistan. megyn: last time around senator obama was campaigning on getting us out of these wars and he won the younger veterans. this time around he increased the troops in afghanistan but has set a deadline for withdrawal. we are all but out of iraq. he's not running against a decorated war veteran this time around. what do you glean from that?
2:17 pm
>> i'm delighted that he's interested in the military vote and the family vote. i think that's a plus. now in direct contrast to that is:he doesn't get the absentee ballots out in the states he's not going to get that vote. if he's trying to get the votes and he doesn't get the states to get the ballots out on time that will be a problem. the strategy we have in afghanistan is not a successful strategy. we can still win with a smaller number of troops. we need to go to a counter-terrorism strategy. and ralph alluding to governor romney. if romney listens to the gins they will want to double down. that not going to win. the sergeants, the airmen, the soldiers, mat reens, the sailors, they understand we are not going to win hearts and minds in afghanistan and we need
2:18 pm
to shift to a counter terrorism strategy. so governor romney is going to have to be able to articulate that in a proper way. on a day in and day out basis, these troops see this administration has taken our military apart. our aircraft, our helicopters, our vehicles, tanks, ships, they are all obsolete now. and the fact is we need more investment in the military. he has taken out over a billion dollars. megyn: ralph, what drives the vote among military men and women? is it all military? >> there is the veterans' vote, the older guys and gals who lean strongly conservative. there are the active duty people who lean conservative but can be suede either way. and they are smart and they listen to the policy statement. the third is the family vote. the spouses. they are a prime target for
2:19 pm
obama as he has figured out because they are tired of seeing their spouse go away time and again, then listen together spouses when they come home complain about the hopelessness of afghanistan. obama is clever. he's a guy that doubled down in afghanistan, now he's taking credit for undoing his own policy. i see governor romney god bless him is absent without leave. he's not standing up on foreign policy issues in an intelligent way and he doesn't seem to know our military with any way. megyn: how do you think those folks will likely assess the choice that they have? >> the jury is still out. they are going to assess it -- they are very bright, they are very smart. they will see through any veneer of placating them and trying to play to them and give them certain benefits because they know what's going on day in and day out.
2:20 pm
so both sides either -- obama or the romney side. the jury is still out, both sides can still win it. megyn: gentlemen, thank you. you heard congressman issa talking about potentially charging attorney general eric holder with contempt of congress in connection with the "operation fast & furious." scandal. is that something they can win? new developments today on a wildly popular story of a new jersey couple, the house they rented and the ghosts they say are living there. oversight committee confirming to fox news that the committee has drafted a document that would hold the attorney general of the united states in contempt of congress for stonewalling, they believe, their efforts to uncover the facts behind the fast and furious operation. if this happens it would be the most aggressive challenges to a cabinet official. can they do it? and what are the implications. joining me julian epstein and presence piecey. there was a report in the "l.a. times" that got detailed about the advance steps this committee has taken. issa confirmed they do have a document, wouldn't deny the report about speaker boehner authorizing with a green light. let me start with you on this, fred. is it time?
2:35 pm
there seems to be an impasse. they want a bunch of document, attorney general holder says they are not entitled to it. what is the next move if not this? >> that's the only move. the attorney general says they are not entitled to the document. we don't let -- it's the attorney general and the doj don't get to say what they are turning over it's predicated on the subpoena. megyn: mr. holder says this is political. he says he's holding what is not responsive and that's the end of it. if issa and the republicans in dong go forward with this, how would they do it? >> first of all the first analogy to a normal case where there is a subpoena is a
2:36 pm
terrible analogy and it's wrong legally. the attorney general has provided 7,000 documents to the committee. he testified about 7 times. he provided numerous witnesses. some of the witnesses they made available the committee hasn't interviewed yet. the reform committee is asking for things they are probably not entitled to, things like grand jury material. megyn: we know all that. >> no we don't know all that. megyn: we discussed it's times. today's discussion is not what they are arguing over. it's about how it would move forward if they need to move forward. we understand issa thinks he's entitled to a bunch of stuff and holder says he isn't. >> if you have a good case it's difficult to enforce. if you have a bad case it's difficult to enforce. the way you do it is the committee would vote to enforce
2:37 pm
the contempt citation. if the floor votes to actually hold the attorney general in contempt there are two procedures the house would follow. one would be to go to the u.s. attorney and ask for a criminal contempt procedure. that's unlikely to happen given the u.s. attorney general is in charge of the u.s. attorney. the other way would be to go to the courts to seek a writ of mandamus. if you have a piece of information that's relevant to the investigation that the justice department is holding back. when you go off grand jury materials and ongoing investigation you will never win that fight. they won't win this fight. >> i disagree. 302 materials get turned over all the time. i stand by my analogy. the doj does not get to tell
2:38 pm
what the scope of the subpoena will be. congress has the inherent power to -- though they wouldn't done it since 1934, to haul holder out and ask him to answer for his conduct and it's punishable by one year in prison. >> you are incorrect. megyn: as a practical matter the republicans control the house. this vote originates in the house. i don't want to say it's all political and they will vote along political lines. but let's assume that does happen. they decide to hold the attorney general in contempt. you say they go to the u.s. attorney whose boss is eric holder or oh go to a federal judge. does the judge exercise independent discretion in deciding wet there is probable cause? >> no, there would be two procedures if necessity dough a civil suit.
2:39 pm
a writ of mandamus, you could get a declare torry judgment that the materials in question are not privileged. megyn: i'll let you get in, fred. >> grand jury materials which the congress would not normally get. or you could essentially ask the court even join the department of justice to refer the material to the justice department, to the committee. but i'm telling you given the broad nature of this request, i can guarantee this will not be successful. megyn: once they get past this point. >> here is the problem. historically when there is an issue between the executive branch and legislative branch the courts have been loathe to get involved in these things. i'm not so sure i agree. holder is not --
2:40 pm
