and the supreme court said that provision was cops substitution natural and not preempted by legislation. and the provisions declared unconstitutional were the minor issues. that was employment, documentation for employment and reporting. minor provisions overall. clearly i agree with the justice, i wish the entire law was upheld at constitutional. i believe that arizona has the right to defend their citizens. they have the right under section 2b and that's what the supreme court said is constitutional. >> let me go to two things. first of all the person had to have already been stopped on something else. it's not like they can pick somebody up -- >> right. >> it's not ammeter i see a yellow person or brown person, let's stop them. that's not the law. >> and also the language mirrored federal law. this is what scalia was pointing out in his dissent today. >> everybody has to read that. he said the founding fathers would have taken for the doors

and not taken up with the united states if they believed the pre had the ability not to enforce the law as written. now we've seen it in reaction to the supreme court decision that the federal government is continuing in its ways today, sean. they suspended the partnership between states and local law enforcement and the federal government on many immigration enforcement activities. suspended it because of this decision in the united states supreme court. >> this is the whole crux, what peter is describing is homeland security suspend the immigration agreements with arizona in particular here. now when you couple this with the president's actions a week ago friday and he basically said forget about the laws that congress passed, forget about the laws that past presidents have signed, i'm not going to enforce the law. so it seems to me there's a bit of a constitution until crisis, one after another, that's being precipitated by the president.

is that your take? >> yeah. self-inflicted. here's what you've got. look at the situation. peter is exactly correct. now the provision that's declared constitutional that all nine justices agreed, including the most liberal members of the supreme court of the united states said when you stop someone lawfully and you have reason to suspect that person's immigration status needs to be checked, make that call to i. c. e.. now the federal government is saying arizona uv the right to make that call, there's only one problem, we aren't accepting that call. now you have a situation where they talk about judicial activists. this is a presidential activism in an unprecedented scale. the president is issuing decreases as if he's the king. you have legislation on the books and they are ignoring it. the supreme court said it's constitutional and the white house said they will us spend our enforcement relationships with arizona which has the most difficult border control issue of any state in our union but that's the one the obama

administration decided to suspend. it's politics, secure simple. >> what he did a week ago friday was by passing congress, by passing laws that were already on the books. it seems like he doesn't respect the constitution in this sings, separation of powers, k checks and balances, and these actions today seems like he's basically thumbing his nose at the judiciary branch. >> i think it's an absolute thumb at the nose but it goes even a step further, and i agree what jay has said. now, in essence, the federal government has put out a wanted poster. a wanted poster in effect for law enforcement in the state of arizona. they have now published a hot line phone number so that people in the state of arizona can report police officers on these kinds of stops. now the only reason they would want to report police officers is to indict those police officers for civil rights offenses. >> let me ask you, what does it mean that -- the only reason

that arizona came up with this law and scalia goes into this, is because they, in arizona, are bearing the brunt ever the fact that the federal government is not enforcing the laws of the land. so they said okay we will use the exact language and the exact law and we will do the job you failed do. we are on the front lines of this. what does it mean the president would not enforce it and then by pass. >> it means the president is not interested in enforcing those laws. >> but he's sworn to uphold the constitution. >> he is sworn to uphole the constitution but it means he has no interest, especially in an election year in enforcing those laws, and he's taken two steps today, two concrete steps that say i'm going to make it as difficult as possible to enforce immigration laws. stay out, arizona. we don't want your help. >> jay, so arizona -- >> go ahead. >> arizona has a 1-800 number to report police officers doing

their lawful job. at the same time that's what the federal government has done here. at the same time under eric holder as attorney general the united states department of justice was running guns into mexico and said they -- what do they do? they sue arizona on the immigration case, that's where they are spending the resources and now they are saying sorry, arizona, if you find somebody illegally here, too bad. we around going to follow-up at all. >> am i talking to too brilliant lawyers, both of you here, and you are basically saying the president of the united states is saying a jackhammer to the concept of checks and balances in the separation of powers in an oath he was sworn to uphold or is that a stretch? >> i don't think it's a stretch. i don't think separation of powers means very much for this particular president. i think he wants to get the case across that do not medal at all, do not troy to enforce the laws that are on the books of the united states because we are going to get in your way and there will be a hot line. if you try to enforce those

laws, and we think you you are g it wrong, you will go to jail. >> let me quote to you johnathan turly, he said in many ways president obama has fulfilled the dream of an imperial presidency that richard nixon strived for. we've seen this now -- >> go ahead. no, charlie is right. the reality of the situation is when you look at not just this case but look at a whole series of things that happened in the last few months, whether it's fast and furious, waiving the immigration between 16 and 30. and you have to ask yourself this. president of the united states had a democratic controlled house and senate the first two years. his term d he put together one comprehensive immigration bill? no. did he put forward any immigration bill? no. so what does he do five months before a general election? politics. that's what this is all about. and that's the danger here, the politics of this because the people in arizona are suffering. >> he said in his own words he

couldn't do this, but now he is literally negating parts of, you know, i guess the laws that he doesn't agree with. >> this is very serious. we have a new nullification crisis in the united states whereby the president decides by words and deeds and executive orders and hot lines and decision to revoke immigration agreements with states and localities, i can nullify laws in this country. and they may be on the books, and there may be laws that say you need to enforce the boarders and we need to have limits, but states, if that doesn't comport with what i want to do, you are not going to -- >> remember what he said, because it's the right thing to do. >> six months before that he said he could not do it, then he decide today do it. that's politics. except you are playing politics with an immigration issue that's very syria. very serious. >> we have a lot more to get to. thanks for being with us.

>> arizona did not ask for this fight. we cannot forget we are here today because the federal government has failed the american people regarding immigration policy. has failed to protect its citizens, has failed to preserve the rule of law, and has failed to secure our borders. >> that was gov. jan brewer earlier today reacting to the supreme court's arizona immigration law ruling. now the court struck down much of the law but upheld a key provision that allows police officers to check the immigration status of those who they suspect may be in the country illegally. now outrage is growing over reports that the obama administration has suspended agreements with arizona police and an anonymous official reports they will now ignore

calls from local law enforcement who report illegals. joining me is the county sheriff, and robert gilbert is with us, former department of homeland security and border patrol official. thank you for being with us. sheriff, let's get started with you and ask you, you know, what does this mean if the depapartmt of homeland security, if you guys do your job and this has now been upheld by the court, and you seek information from the government and they aren't going to cooperate, what does that mean? ostensibly, in reality doesn't that mean you have to release the people that they are talking about? >> well, sean, four things have happened over a brief period of time. fast and furious, which is a huge travesty, then you have the obama administration announcing they are no longer going to deport a certain category of illegal aliens that they haven't been deporting anything. that's the joke on you and the american public. then the supreme court ruling where they are claiming the arizona law was gut thed.

and today suspending and pulling away the 287g agreement and stating they aren't going to respond to lawful requests, requests that they are required to respond to under the law, is not just a slap in the face to the american public and to law enforcement in general, specifically in arizona, but the supreme court as well. >> let me go through this. governor brewer was very clear here. the only reason this came about is because the federal government failed the people of arizona and failed the people of this country, and especially people in border states. it's impacting our criminal justice, our healthcare system, and you are on the front lines of all of this. now as a result of this, the president's executive order, he's not going to enforce the law, and now he's saying our federal agencies are not going to cooperate with local law

enforcement. in all practical terms, what does that mean? >> sean, it looks like a huge opportunity being missed here. if you look for the first time in history the law enforcement community, whether federal, state, local or tribal, was going to be able to coordinate and actually work together in a cohesive manner in working toward securing the board he. it starts in arizona but it impacts the entire united states and if we don't secure the border here we will continue to have the trickle through that's going on in other states. the public expects us to work together. we work together in everything except this one issue. >> all right. >> why is that? >> sheriff, let me go back to october of 2010. this is president obama talking about how hispanic americans were being harassed under the arizona immigration law. and i want to k you if this is true or not. here's what the president said. >> if you are a hispanic american in arizona, your great-grandparents may have been

there before arizona was even a state, but now suddenly if you don't have your papers and you took your kid out to get ice cream, you are going to be harassed. that's something that could potentially happen. that's not the right way to go. >> now the president totally misrepresented the law. because law enforcement was not allowed under the law to ask people for, quote, their papers. they would have had to have had some contact with law enforcement ahead of time. what do you make what the president said and is any of that what he said true? >> well, sean, that's just an absolute insult to the professionalism of the men and women that work in this industry day in and day out. 36 years i've been in law enforcement and cochise county. we had one racial profiling complaint in that period of time and it was unfounded. to suggest for a second that this law would change that culture in law enforcement for a second is, again, just a huge insult. >> what about this justice

department hot line that has been set up for arizona immigration enforcement concerns? what does that mean for you and those that work in your agency? >> well, that's expected. the aclu lawsuit is still sitting in district court in arizona and that was the first lawsuit filed. that has yet to be heard. that's where they sued each sheriff, myself and every other share any of arizona and county attorney individually to enjoin us from enforcing the law should the supreme court rule as it did today. so we are going to be back here and going through this all over again. and they are -- they have lined up and they are waiting for the right case to come along to try to bring us back. so the battle is still to be waged, and that's why we started this border sheriff's project some time ago and you can go to bordersheriffs.com and get the info because we anticipated that this battle would be waged beyond the supreme court ruling. >> i'm not so sure if the president decides he's not going

with election day coming up, this is going to be an important week for the obama presidency. the supreme court will rule on obamacare, expected to be handed down this thursday, and we are expected the congress vote against the attorney general,

eric holder, will likely be held on thursday as well. they have been dealing with scandal and controversy and an economy that simply will not recover. joining me in the studio to breakdown how the healthcare and holder show downs later this week could impact november's election the author of the book "screwed" dick morris, and i can't think of a good week obama has had. >> he's had a horrible month of june. >> and may. >> and may. >> and april. >> and the polling reflects it. throughout most of 2011 he was at about 44, 43, 42% approval, once he actually went down to 39. then over november and december and into 20 is it 11 he recovered and moved up to 49, 50. now he's back down to 43 and 44 again. the rasmussen poll of likely voters has obama five points

behind. all of the other polls show, almost all the other polls that are good show romney ahead. there's one bloomberg poll, but if you drill down to the likely voters, it too shows romney ahead. i think there's been a fundamental change in this case. six months ago when i predict add landslide victory for romney, people laughed. about two months ago they chuckled and now they just kind of grimace. >> i don't like to go down that road and i'll tell you why. you know what? is 1133 days, dick, is an eternity in politics. i can see a scenario where that would unfold. >> but the economy is headed toward a recession, headed toward negative growth. the projected numbers for the jobs, which is going to come up july 6th, are less than 100,000 new jobs again for the third months in a row. and i just think that the policy -- well, to quote reverend wright, the chickens are coming home to roost. >> the chickens are bad

policies. the reality is unfortunately the president had a lot of hype and a lot of words on the teleprompter, but he wasn't able to deliver. as he said, this is going to be a one-term proposition if he can't turn this around. what do you make of the democrats? we have the latest one now, congressman mike mcintyre, in the 7th congressional district, now refusing to endorse obama. you look what happened in the primaries, arkansas, and west virginia, and a convicted felon in that case. >> and kentucky. >> pretty amazing. but you see more and more democrats saying they don't want my part of him. >> joe mansion, virginia. you will see that more and more as they distance themselves from obama. and it's going to be part of feeding will landslide that i think is coming. there's been a fundamental change, though, in obama's image on the left. not the right, the left, which

is that he's becoming like jimmy carter. the left is seeing him as too weak, in effective, uncommitted, aloof, incapable of delivering, hypocritical in -- >> but they will go back to him. >> no, they around going to vote. >> you think there will be a big enough majority will stay home? >> obama was only elected because of an extraordinary turnout that broke all the models of black and latinos and young people turnouts. unless he reply indicates that turnout model he can't win again and i don't believe he can. i think what is emerging here is a democratic discontent with him. 90% of the people who gave him 200 bucks or more have yet to contribute to his campaign this year. >> that's a big number. what impact eric holder, fast and furious, assuming the mandate at a minimum is struck down on thursday of this week with the supreme court, what effect do these have on the election.

>> he looks like a failure, looks like an incompetent. a constitutional law professor and runs the whole country to havoc in a year and a half passing a law that's illegal. he could have made it legal easily, base it in the power of the tax, but he didn't want the tax. i believe what is happening is we are watching the eclipse of the critique of obama. >> what is amazing to me, it takes a long time. everything we saw about him, the narrative has taken almost three years, three and a half years to sink in. and to me we are headed toward the most predictable economic crisis in history that could be -- that we can stop. the question is do the american people see it in these dire terms? >> you've got to hope they do, in other words, so we can reverse it. >> but we know the conserve ditch republicans and patriots

are going to vote against this guy, and we know committed democratic liberals are going to for the most part stand by him but what about the apathetic, alienated democratic voter who may or may not show up. he doesn't pay attention to this stuff until election day, and throwing out obamacare will get his attention. >> 15 million more americans on food stamps and all of the underemployed and chronically unemployed. and he hasn't been doing well in polls for independents. >> i want to note something we predicted in our book screwed came to pass last year. hillary went to the rio conference, the conference on climate change and gave away $2 billion of our money to a fund to be turned over to the third world dictators allegedly to help them deal with climate change. >> how much? >> two billion. and that's the down payment on a $100 billion fun we are negotiating with them.

>> $100 billion of u.s. tax dollars? >> well, it is happening right before our noses and there's not a speech about it. nobody in congress spoke about it. >> last question, what about the vp or romney? >> i think this has to be rubio. he's risking of losing the latinos unless he takes a counter step which is to nominate rubio. i think it's a done deal and i don't think it's another scenario. >> i can imagine another scenario but that's my first choice. and a busy night tonight. he says the israelis are killers and now he's going to become the next president of egypt. and why the white house is reportedly relieved that the muslim brotherhood candidate won in egypt. what happened to that democracy in egypt? we will check in with liz cheney.

>> egypt's presidential run off has ended. mohammed morsi is about to become the first islamist president of egypt. what does the obama administration think of this new development? well, they are reportedly relieved. this according to the new york times story. they said president obama, quote, the crisis in egypt has put him in an awkward position, champion of america's long time go and critic of america's long time ally. but who is this administration relieved to have as the egypt's next leader? well, in the past morsi has called israelis vampires and killers. and he is quoted he intends to reconsider the camp david accord. yet despite these outrageous comments, the white house is relieved? joining me now with reaction is fox news contributor liz cheney.

relieved to have the muslim brotherhood? let's see, they refer to the israelis at killers, vampires, a known killer. and i want to get your take. >> you are exactly right. they said they were relieved, they have welcomed it. and, in fact, even more troubling i have heard from a number of liberals in egypt, people who should be with the united states asking why is it that the united states is now backing the muslim brotherhood. the muslim brotherhood is anti-freedom, they are anti-women, they are anti-christian, they are anti-israel, they are anti-american, they are anti-democratic. they are very closely alied with, in fact the same organization as hamas. they are the organization that spawned al-qaeda. and the leader of al-qaeda began in the egyptian muslim brotherhood. so you've got a situation now where you have got this organization in charge potentially in egypt, which is

the most populous arab nation. you know, setting us up here for a real conflict it looks like between the muslim brotherhood and the military, while at the same time the united states in what is really incomprehensible seems to be welcoming this turn of events. >> why is this, it's never been a surprised, you mentioned they are anti-jew, anti-israel, and we know what happened to the christians in egypt, et cetera. you say all this, and yet president obama and through his secretary of state actually seem to come out in support of the win of the muslim brotherhood even before it was announced on sunday. >> right. and you know, we heard reports, for example, that you had christian villages where people were told by representatives of the brotherhood don't go vote, don't go to the polling places, stay home. and at the same time you had that kind of pressure going on, the administration here seemed to be assuming that the only pressure that might be put on the electoral process would come from the ruling military. i think that you've got now a

situation where this president's foreign policy, whether you are talking about leaving iraq, leaving afghanistan, allowing the iranian mullas to continue to attempt to produce a nuclear weapon and having the muslim brotherhood come to power in egypt, people have to begin to ask who is benefiting from barack obama's foreign policy? and time and time again sadly it's american's enemies who are benefiting. >> we saw this early on when all that was going on, the so-called arab spring that was supported by the president in the promises of democracy, and now we have a known terrorist organization with a known terrorist sympathizer now. it seems that radical islamists, the middle east, we look to syria, we look to north africa and take it all the way to iran, it seems like we are living in the age of the rise of radical

islamists, and it seems like there is a growing alliance against israel and the united states. where can this possibly end? because it doesn't seem like it can end in any way that's going to be good. >> i think there are a couple things people need to watch closely here. one is to understand that democracy means more than an election, and that the united states needs to stand for the values of freedom, the values of equality, the values of liberalism, none of which is represented by the muslim brotherhood and we need to not be confuse bad that. secondly, you will have a lot of people, a lot of commentators say the muslim brotherhood is moderate. they are moderate muslims. they aren't. there are millions and millions of moderate muslims, including 12 million in egypt alone, nearly half the people who voted saying we don't want to be ruled by these people. morsi lost his own home, that has long been a stronghold for the brotherhood. but they are not moderate, they are in fact an extremist

organization. you had an important speech just tonight actually in london by the director general, the british mi-5,, their domestic intelligence service, saying the arab spring is creating a more welcoming circumstance for al-qaeda notice short term across the middle east and i think there's no question about that. >> morsi's, he led them in a chant the koran is our constitution, sharia or guide. why do i see this as what happened in 1979 with the ayatollah coming out of exile? >> i think that's the real fear here and the real potential concern for us. you had one of morsi's campaign rallies, you had one of his surrogates while he was there on stage in front of hundreds of thousands of people talk about how we are going to use gee laud to make jerusalem our capital. while you have this surge of extremism happening across the arab world, simultaneously you

have the united states pulling back and we have a president who i believe for the first time, at least in modern history, has had as his objective leaving america weaker than when he took office. and you only have to listen to his own words to understand how true that is. but the combination there, you know, is potentially explosive. it's bad for israel, it's bad for us. and the iranians in the meantime are working away day in and day out to develop the nuclear weapon while the white house leaks secrets about some of the programs we were allegedly working on to stop it. >> the president couldn't have been more wrong about the arab spring. we predicted from day one that this -- what happened yesterday would probably happen, and this may go down in history as the biggest foreign policy blunder as obama's presidency but we will watch it closely. it's always good to see you. thank you, liz. >> absolutely. thank, sean. >> time to check in with greta. where are you tonight? >> i'm in washington d.c.
