for a 32-year-old man who was swept out to sea. that happened near orange beach, alabama. back to you, ladies. >> ainsley earhardt, thank you. for the next move let's turn to maria molina. >> how long is debbie going to hoover over the florida panhand panhandle. >> good morning everyone. we are continuing to feel the impact from tropical storm debbie. the lathes update at 5:00 a.m. from the national hurricane sent ever. it is still maintaining the hurricane strength with maximum sustained winds at 45 miles per hour moving slowly at 3 miles per hour. it will continue to hoover and produce more heavy rainfall. we can see another foot of rain across portions of northern florida. also looking at the ridge of more storms. some of the rain bands as we move over land and interact with the friction of the land.

that is why you have severe weather. it could produce damage over the state of florida. debbie will be a tropical storm as we make land fall over northern parts of florida and continue to move inland while it's over land. it will exit over the open waters of the atlantic and intensifying as it interacts with water. you can have maximum sustained winds it could be open water at that point. a lot of rain over a foot of it. flash flooding ongoing right now. flash flooding emergency open homes in franklin, liberty basically choppy river. it has already begun to flood. we have seen water overflowing the river and we will continue to monitor the situation here. it is a life threatening one as

suspected illegal immigrants without a warrant. jan brewer signed it into law a year ago. she says it's a victory of the state of arizona. brewer says she knows the fight over the law is far from over. arizona did not ask for this fight. nor did it seek the task of having to confront illegal immigration. we cannot forget we are here today because the federal government has failed the american people regarding immigration policy. has failed pro protect citizens the rule of law and failed to secure our borders. president obama is pleased the supreme court struck down what he considers to be the most egregious parts of arizona law. the president saying in a written statement what this decision makes unmistakably clear is congress has to act on

reform and it is not a broken immigration system it's part of the problem. republican challenger to president obama governor mitt romney responded to the supreme court decision while speaking at a fundraiser in arizona. he would have preferred to see the supreme court give more latitude to the state immigration laws. it is important to note the supreme court sent the immigration law back to the 9th circuit court of appeals for consideration. but the law will remain in effect during that period. >> kelly write live from dc for us. the prup cream cou-- suprem court ruling john mccain talking on the record. he is saying he is frustrated with the riling and federal government's enability to secure his state's borders. >> we are frustrated pass the laws now the supreme court says they can't enforce the borders

obviously the federal government won't. there have been improvements but arizona is still the place where coyotes spring people across. drugs come across our border there are guides on mountain tops in arizona driving the drug cartels up to phoenix where they are coming to the country. wildlife refuges are being destroyed. we have concrete evidence some of the fires have been started by illegal immigrants across our border. the damage to our desert has been horrendous. and of course a lot of people died in the desert because they have been deserted by the coyotes. they got lost or something. none of those seem to be bothering this administration. for them to not help us secure our borders in my view is worse

time for the top 5@5:30. the top stories making news at this hour. a 20-year-old man is under rays in connection with a deadly shooting of a police officer. holland oliver was the only person involved in the murder. the victim now identified as 32-year-old single mom sol lena hollis. hollis is veteran of the police force was trying to break up a fight at a jazz concert when she was shot. she leaves behind a 12-year-old daughter. dole is recalling 25 pounds of bagged salads because of possible listeria. >> they were distributed in georgia, kentucky, north carolina, tennessee and virginia. postal workers union activists and supporters kicking off a hunger strike. they protest what they claim are efforts to privatize to break up the postal service.

state could do about it. they struck down additional efforts make it a crime for illegals to seek work or give the police additional power to arrest without a warrant. president obama who fought the law claims his own victory. no americans should ever live under a cloud of suspicion because of what they look like. going forward we must ensure arizona law enforcement officials do not enforce americans and the court's decision recognizes. the white house didn't stop there. deciding to now end the federal partnership with arizona to crack down on illegal immigration. i would think the american people would think long about what the federal government is doing and why aren't they abiding by the rule of law. it is unconscionable.

nonhispanic americans i think standing up on this issue requiring administration administering the law and carrying it out will upset hispanics. >> tropical storm debbie continues to wash the florida panhandle. maria flooding still the biggest concern? >> yes, patty ann flooding is a big story with the storm system. we are not looking at strong winds. it is sustained winds of 45 miles per hour. it has weakened for several days we have dry air make its way into the center of the storm system. the center is 85 miles to the west of florida. drier air making its way into the center of the storm system. that is helping to break enit. we still have a lot of heavy rain on the eastern part of the storm system drenching the state of florida some of the outer

rain bands spawning tornadoes as they come on shore and interact with the friction and we get the tornado touchdowns. right now land fall is anticipated in northern florida west of the gainesville area as we head into the next 36 hours. later in the day wednesday until early thursday moaning. it is a very slow mover. moving east at 3 miles per hour. that's why we are seeing such heavy rain with debbie. the storm system is sitting there sitting in the tropical moistu in the state of florida. we have a number of flood warnings stretching from tampa on northward into the jacksonville area even further off to the west to the east of tallahassee, florida. 3-12 inches of rain. another fit of rain is possible as we head into the next 48-hours as the storm system tracks to the east. you have beening see that shading e -- it is in excess of inches easily.

they went to bed thought they would be okay through out the night. they broke up around 2:00 a.m. and realized they were in big trouble. they began to pass out their things including the family dog. after five years of living here this is the first time they have ever had to evacuate. luckily they have family in the area. they are not the first ones to have to leave the area which is 30 homes along the road where we are right now that have had to evacuate last night. we have a local shelter in middle burg where they are sending people. mo much had to be closed off the traffic they are going to be coming back through out the day to bring some of the belongings to higher ground as they continue to evacuate this area. they tell me black creek could be as high as today that's 16 feet above flood level. it could get as high as 25 feet that's the record that was set here back in the 1990s. live in middleburg florida
