if romney might be guilty of a felony by misrepresenting his leadership at bain. but supporters say romney did nothing wrong. >> he actually retired retroactively at that point. he ended up not going back after his time in salt lake city. he was retired from bain. bain is a good company. it has been successful and helped create a lot of jobs. the fact that he has private sector experience is a beneficial thing. >> another republican says the president is clearly misrepresenting the facts about romney. >> if you look at the fact checkers or look at the washington post-it says obama is blowing smoke. they give him three paw knock yows. he is fibbing. he is misrepresenting the facts about bain capital. >> we are likely to hear more about this as we go around and around. >> steve, great, thanks. as steve reported the romney camp says the president's campaign is wrong,
11:01 am
but oat bough ma team -- but the obama team continues to try to tar the presumptive republican nominee, and it shows no sign of stoping for now. as the president said, no apology. how will this affect the campaign? we have the author of "the backlash" and president of" mow men mum analysis." the president is standing firm. no apology while the romney folk says he is full of it. >> obama should be apologizing to all-americans. first he lied about the stimulus and unemployment is above 8%. he lied about obama care that it would not be a tax. well why are they hiring 1600irs agents if it is not a tax? this is a grand distraction. obama does not want to talk about his failed leadership, his failed policies with high taxes and regulations that are not growing the economy and certainly not creating be joes.
11:02 am
>> -- creating jobs. >> mar gee -- margie, do they not want to talk about the economy? >> mitt romney brings up the record at bain. he points to that as his main credential. he doesn't talk about his time when he is governor because he was 47th in job creation. it is not just about bain. it is a huge list of things that i think was well captured in the latest obama ad. it is his tax havens and not being forthcoming and not releasing tax returns. he was the most withholding president since richard nixon. you can see reports of what he says. it is taking credit for things after he left bain and not wanting to take credit for other things that happened while at bain. it is his history on out sourcing, corporations are people. it is all of those things that have come from the romney campaign. and that is before you get to his actual policy and how he is going to really protect the wealthiest among us at the
11:03 am
expense of everybody else. >> margie, you said, quote, his history on out sourcing. romney folks say that's not true at all. it is completely not true. he was not involved at the time anything -- anything that allegedly, potentially happened. >> i guess that's what i mentioned earlier. there are some things he said, well, i was responsible for a job that came to companies after i left bain. and he said he was not responsible for jobs lost. we don't know when he left bain. we now heard he retired retroactively. that's the kind of language that puts distance between mitt romney and everybody else. it is that sort of language that makes it hard for people to understand where he is coming from. and he wants to get out of -- >> it is the distraction. >> do you think this will get distraction? >> it is something that
11:04 am
happened 20 years ago to shift the debate away from obama's failed policies and failed leadership, high unemployment, 8.2%, unemployment in the black community over 14%. among black youth it is 40%. that's one of the reasons obama did not go to the naacp convention this week. he didn't want to face that public and try to explain why unemployment is so high. so it is a great distraction to try to distract the public and the media for something that may have happened 20 years ago. the focus should be on what is happening now today and what has happened over the last four years under president obama. >> do you think their plan will work for them? >> it is not going to work. look at the numbers on the papers today with unemployment. obama as a war on coal and fossil fuels. he is sending coal miners to the unemployment line. this is utterly ridiculous. the plan is not going to, would. it is a grand distraction.
11:05 am
people are unemployed and not going on food stamps like the administration is saying is so great. >> marjo ri e? >> even republicans say why doesn't mitt romney released his tax returns. his dad did 12 and he is doing fewer than any other fewer presidential candidate. we have had lots of wealthy presidential candidates. 24r* is a sense that mitt romney has -- it is not just he is wealthy, but she withholding and he is playing with a different 70 rules with the tax havens in bermuda and the caymen islands and the swiss bank accounts. it may be legal, but does that make him a sign -- does that show people that he is putting america first? he has their interest in him. he will fight to reduce and end those tax loopholes that allow the wealthy to not invest in america, but abroad. if he is benefiting from them, then we can ask legitimately, we should ask legitimately, will he fight to help continue
11:06 am
tax shelters that help america. >> the focus is on the economy. look at the spending and the debt our country has incurred. unemployment is ridiculously through the roof. the president was more focused on obama care and getting that ran through than focusing on growing the economy and keeping people employed instead of end ising them to the government plan. >> janeen, there is another interview with the cbs sunday morning the president gave over the weekend that has not got as much attention as the one in the local station in virginia in which the president says washington, quote, feels as broken as it did four years ago. so is that someway an implicit admission of failure of hope and change? >> he is going baying to blaming bush and then -- going back to blaming bush and then he will blame george washington because things are so bad. he could have done tax reform, regulation reform to turn the country around, and he didn't do that. that's what they don't want to talk about. >> does he -- when he says
11:07 am
washington feels it is as broken as it was four years ago, that's why america elected i'm -- elected him. >> i think you are absolutely right, and i think the president is right to say it feels broken. i think it is important to recognize in this whole show that people think the president is more interested in collaboration and corporation than republicans in congress, especially when folks like mitch mcconnell say our number one goal is to make sure obama is not re-elected. those are mitch mcconnell's words. republicans, that's their main message is we are against obama. whatever he is for, we are against. if he is for blue sky, we are for yellow sky. that's the way it is in washington right now. >> the american people are tired of the growth of government and spending. anytime government is too big our liberties are reduced. this is what the american people are focused on. not this nonsense or this distraction. >> they hate the bickering. it takes two to do that.
11:08 am
>> i think it is going to continue. thank you so much. >> thank you. that is a preview of what we can expect over the next few months. thank you. there is a desperate search underway right now for two girls from iowa. more than a hundred volunteers right now searching by land, sea and air to try to find 10-year-old lera cook and her eight-year-old cousin elizabeth collins. their bikes were found along a trail, but they haven't been spotted since friday. here is the latest from our new york city newsroom. anna? >> jaime, after holding a candlelight vigil last night hundreds of volunteers and emergency workers have resumed their search for two missing cousins in eastern iowa. the mother of one child fears the girls were abducted. misty cook said it was out of character for her daughter to wander to far from home. she often stays at the home of
11:09 am
her cousin in evans dale while she works. they were last seen shortly after noon on friday in downtown evans dale. their bikes were found along a trail on the southeast corner of meyers lake. investigators have found no other traces of the girls. police searched homes and swept the area via helicopter. they also used sonar equipment as they dragged the lake and plan to search other bodies of water today. the fbi and iowa division of criminal investigation has joined the search as the girls's families continue to hold out hope. >> who ever has them, lets them go. lyric can call me. she has my phone number. >> she is 4 feet 6 inches tall and weighs 80 pounds. she has brown hair. 11-year-old lyric cook is about 4 feet 10 inches tall and she has a stocky build and light brown hair. if you have seen them call authorities immediately.
11:10 am
authorities don't view this as a missing person's case, but he is not ruling out the possibility that the girls were indeed abducted. an amber alert can't be issued for these girls because they don't have a suspect or a vehicle. we will cross our fingers for them. >> call it in. thanks. now a north carolina coroner is trying to identify a body that was found near the search for a missing mom. the remains were found 20 to 30 miles from where lynn jakenheimer disappeared a week ago. the ohio mom was on vacation with her children, and her on again-off again boyfriend, gnaw than y'all summer field. she dropped her children off on july 8th and summer field has not been seen since. his brother reportedly told police he admitted to strangling her. and here is good news for law enforcement. one of america's most wanted behind bars today. he is waiting extradition from mexico at this hour caught in
11:11 am
cancun after 24 years on the run. he is accused of killing a woman in san diego during a meth deal gone wrong, and apparently he has been living and working under a fake name in mexico spending the last decade selling time shares to tourists and heading through the city's busy airport. he allegedly bragged he was on the run from the law. breaking news this morning, we were reporting that president obama says he will not apologize over the continuing attacks against governor romney and his time at bain capital. this is the type of rhetoric -- is this the type of rhetoric american voters are looking for? that's coming up. >> and it is hard to believe mortgage rates are at new record lows. why aren't they taking advantage of the opportunity to cash in? >> and a summer nightmare for every swimmer. the continuing search for a young surfer in australia who was attacked by a great white. >> we are searching by ourselves out here.
11:15 am
11:16 am
surfer. they say he was bitten in half by a massive great white shark. one beach goer who tried to help says he nearly became a victim himself. >> i was on the back of the jetski and in front of us saw a guy get attacked by a shark. took my mate to the shore and went straight out. there was blood everywhere. it was a massive, massive white shark circling the body, the half of the torso that was left. i raced to grab the body and the shark came at me on the jetski and tried to knock me off. >> the victim of the shark attack is the fifth person killed by a shark in that region in less than a year. this could be really good news for homeowners, home
11:17 am
buyers. mortgage rates drop toing credible new lows. a 30-year fixed rate loan is just over 3.5%. if you want a 15-year mortgage, 2.86. incredible. the rates present a great opportunity, and not just for people looking to buy, but also for anybody looking to refinance an existing loan. but in today's take charge consumer protection segment, we are going to look at how you can cash in on these low interest rates by refinancing or acquire a home. but the question is why aren't more of us doing it? joining us to talk about this, dominic tovella. good morning, dominic. let me ask you that question. i don't remember the last time we saw rates close to this, but more people aren't refinancing. is it because it is difficult to get the loans approved, or people have fatigue already over refinancing? >> a little bit of both. and let's emphasize. this could be a once in a lifetime, once in a generation opportunity. we have never seen loans like
11:18 am
this at this interest rate ever. 60 years. it is going to be not an easy thing to get done. people are tired of the process. it is long and frustrating, but you really have to grab this opportunity. you really have to knock on the bank's door and say i am entitled to this. let me have a lower interest rate. >> why aren't banks allowing modifications where you pay a one-time fee instead of pulling your tax returns. if you are already a customer with them, and they just reduce the rate for the remaining term of your loan? >> i personally had these kind of conversations with the banks, and they will sit here and argue that their regulators are forcing them to document things three times over and make sure every t is crossed. the truth of the matter is they don't want to lend money for the next 30 years at 3.5%. we want to barrow that money. as difficult as they make it, knock on the door, do what you have to do and get it done. >> what if you lost your job or you owe more on your home
11:19 am
than it is worth at the current time? how do you find a lender that has the creativity to help you get the loan approved even if you are not in the best shape right now? that's the take charge message we want to bring home. >> make sure your credit is as good a shape as possible. we aren entitled to a free credit report. clean it up. be dill jept about making -- diligent about making payments. contact your existing lender. they have your history. you are already a customer. they already have that risk on the books. third, go to other lenders, particularly credit unions, local regional banks. they didn't take the hit that the major banks did. fourth, go to a good, qualify mortgage broker. if you have a unique situation, maybe you switched jobs or maybe you are self-employed. try dealing with a professional who may know exactly where to place your loan and get this thing done. >> what about government programs? are they working for folks? >> great question. we have two programs out right
11:20 am
now. the five largest banks in the country, chase, wells fargo, bank america, citibank, they just settled with the federal government for $25 billion. if you are underwater on your loan, they may be in a position to help you refinance that loan. they are not going to give you the great rates we get today. they are not obligated by the government to give you these great rates, but they may be able to reduce your existing loan. if you have an fannie mae or freddy mac-backed loan, those up to 125% underwater, in other words the value of the home is 125% below your value, your debt, you can under the hart program you can refinance there. there are programs even if you are underwater on these loans. >> i am so glad you brought that up. harp, look it up on-line, even if you don't have perfect credit you may qualify. thanks so much. great to talk to you. >> have a great day.
11:21 am
>> and if you want more and the ability to take charge on a number of consumer issues, go to fox news.com and click on america's news headquarters. at the bottom ofhe main page you will see our show. and then when you click on that, you will see the take charge consumer protection segment. this one is included. we hope we helped out. >> always great information. and those mortgage rates, wow. a new battle may be shaping up on capitol hill. this time it is over the bush era tax cuts. coming up, what is at stake and how it can cost you. plus, new developments from the fox news voter fraud unit. the attorney general eric holder is taking on texas over voter id. voter fraud, and the lone star state coming up.
11:26 am
bottom of the hour. syria is now denying that its forces used heavy weapons during a mass killing in a village on thursday. opposition activists say tanks and helicopters killed at least 220 people. in mexico city thousands of demonstrators are taking to the streets there. they are protesting the results of the recent presidential election. candidates accuse the winning party of campaign fraud. and new york city firefighters put out a fire at a popular tourist spot downtown. several hundred folks are at the seaport when the fire broke out. thankfully no one was hurt. this is a hot button issue, and it is building in washington right now. senate democrats are pushing a one-year tax cut proposal for americans earning $200,000 or less. now, the move is likely setting the stage for a big showdown for republicans over extending the bush tax cuts which will expire at the end of the year.
11:27 am
wendy long who is a republican candidate in new york, and it is great to meet you. you probably won't brag, so let me just on this one note. first of all you went to both northwestern law school and harvard law school. i am an attorney and that's tops. you also clerk for justice clarence thomas for the u.s. supreme court which is amazing. not everybody gets that opportunity, and that will help us when we talk about health care. i want to talk about the tax cuts first. you decided to run for senate, and my question is why did you feel that new yorkers need an alternative? >> she seem blem mat particular of big government, big taxes, high spending, increasing the national debt and just killing the middle class and doing all of the things that are keeping our economy in a rut and preventing us from creating jobs. just completely unresponsive to what the economy needs and what we need to grow jobs. i need to replace her. this whole issue about these tax cuts is a distraction of
11:28 am
the terrible job she has been doing the last three years in the senate. >> overall in washington these tax cuts that the president wants comes with tax increases. the one that caught my eye are the estate taxes. if you think about it, it could be as high as 45% on your earnings which you already paid taxes on when you earned it. and then you leave it to your family member and you get taxed again at 45%. >> well, there are taxes across the board. estate tax is one of them. we have the highest corporate tax rate in the world, and we are talking now about increasing taxes on individuals. we are sitting here in new york city where i guess kirsten thinks a fire department captain and a married teacher who are earning $250,000 are the rich, and we have to soak them and increase taxes on them. it is ridiculous. we are talking about increasing taxes on people who are middle class, and we are talking about increasing taxes on job creators.
11:29 am
that's what kirsten and these other democrats in the senate want to do. >> senator gillabrand is not the only one that wants to push this forward. i want to tell you, i researched this and senators james web who is a democrat and joe lieberman who is an independent but caucuses as a democrat, they are against this. they say they will not support these tax increases or as the president is saying tax cuts. >> if we keep the tax cuts for everyone, it is an increase. it is just less of an increase of the and senator gillebrand is at the center of the pack. she doesn't agree with senator schumer who in my fire fight or teacher from new york city he would want to include them. but even he is in favor of tax relief on-the-job creators. she would soak the middle class to boot. >> so both new york senators you are saying are moving in a direction that could be dangerous? >> they are both in favor of tax increases. schumer is not as bad as
11:30 am
gillebrand is. >> that comes at a cost, and you say it would be a jobs killer. what do you base that on? >> you do not raise taxes in a recession. or when you have a slow economy whether the economists call it a recession or not, barack obama himself said that in 2010 when he approved keeping the current tax cuts in place. he said last thing we want to do is raise taxes because it is such a drag on the economy. we have to get the money moving and we have to get people investing and having some confidence in hiring people. that's the only way out of this economic drag we are in right now. >> this race you have put yourself into, the ability to represent new yorkers, new yorkers -- new york is always called a melting pot. it represents everybody. the rich, the poor, minorities , all industry. do you think your thoughts about what you would do should be taken a look at by other states? look how many are teetering or have filed for bankruptcy.
11:31 am
>> i think new york is a perfect microcosm for what is happening in the country. we have the financial industry and the agriculture. we have had great manufacturing, and what our current representation in washington is doing is just ignoring what we need to have a vibrant, growing economy. new york is a perfect example of that. our representation in washington is not doing what we need to get this economy going and to get more jobs. >> why do you want to be -- why do you want to put yourself in that position? it is a big job. it is a critical time, and you are presenting a different position than what is in place now that you would say is not working. why? >> it is a very different position. what we have in place now has obviously failed so badly. i mean, i have traveled around and around this state. i sit down around the table like this with mothers with tears in their eyes saying new york's greatest export is its children. they have kids who have come home with massive college debt and can't find jobs.
11:32 am
they have husbands and they themselves can't find work. they are worried about paying their bills. they are worried about going to the grocery store and buying groceries. paying for gas, paying for home heating oil. they just need some help and some relief. it is not going to be by the government taking things over and squeezing people more and trying to take more money. you know, the top 10% of income earners pay 39% of the taxes in this country. the top 10% pay 70%. we can't squeeze these people anymore. if that's their idea at some point you are going to run out of people's money to give to the government. >> let me jump on that point and show you this chart and show our viewers too. the rising cost of obama care. there is now a mandate. you worked for one of those coveted positions that young lawyers like me would have liked to have had and couldn't get. what is your take on this? the sky rock qeting costs -- the sky rocketing costs and
11:33 am
the government budget office keeps telling us what obama care costs us, and it is going up, up, up and away. that means taxes for people who are now sometimes out of work, under employed. what is your take on the supreme court's decision and what you would do in your position as a u.s. senator about obama care? >> well, it is terrible. i mean basically senator gillebrand and president obama and others chose to spend the last three years instead of getting the economy back on track, instead of creating jobs, they chose to spend their time essentially nationalizing health care and creating as you say this huge price tag that we are all going to have to foot the bill. not only the tax of this individual mandate that the supreme court has ruled is a tax, but there are tons of other taxes embedded in obama care, and i have been hitting senator gillebrand on the medical device tax that will kill an important industry. there are loads of taxes. that's what they have done. the first thing we need to do to get rid of obama care is to elect senators and president
11:34 am
and house of representatives that will appeal it. senator gillenbrand was putting owe by ma care in -- obama care in place, and i was the deciding vote to repeal obama care and replace it with systems that will give american health care consumers some affordable, good choices for health care. >> you are for americans having health care, you want to do it a different way. i know you support governor romney. do republicans have a plan to get people in this country what they need, not only back on track economically, but also get health care which you feel they deserve? >> absolutely. the first thing we should do is have tort reform. a lot of the cost of health care that is so astronomical is driven bay these ridiculous frivolous lawsuits. and doctors have to practice defensive medicine that drives up costs incredibly. we need to reform the litigation that is all of these medical malpractice
11:35 am
suits. the next thing we need to do is to let competition flourish. let the state create solutions. let them come up with products that a variety of products. i think american consumers for example should have the choices in health care that senator gillenbrand has. she gets a wonderful home menu of what her health care plan should be. average americans need to have those same choices she has. and we do that by letting the states come up with different solutions and different products and allow insurance to be sold across state lines so the consumers have a choice. and that will bring down the prices and make it affordable. >> i appreciate the specifics. you have chosen to challenge democratic senator kirsten-gillebrand and wendy long. very, very nice to mee you. attorney general eric holder, you know he took on south carolina first and now he is taking on texas on the voter id law.
11:36 am
11:40 am
the department found this law would be harmful to minority voters, and we reject its i'm plaw men -- implementation. >> in our effort to protect voting fraud we will be vigilant and we will be strong. but let me be clear. let me be very clear. we will not allow political pretext to disenfranchise american citizens of their most precious rights. >> well that was attorney general eric holder defending the administration for suing texas over his voter id law. supporters say it is ensuring the right to vote, but the administration is pursuing these lawsuits for partisan.
11:41 am
joining us right now from houston, texas is the republican state senator who sponsored the voter id law. senator tommy williams. senator williams, thank you for joining us this morning. jay good morning. i was one of 19 co authors on this bill. >> you just heard the attorney general say the law is harmful to minority voters. how would you respond? >> after hundreds of hours of deposition in a week long trial eric holder has not been able to produce one texas voter who would be unable to get their id under this law. his own expert admitted that in his peer reviewed research voting is not affected by voter id laws, and he couldn't bring any evidence of discriminatory intent or affect before the court. it is shocking. >> you know, some of the critics say that in some parts of texas it is a big state. you know you are 200 miles away from a dmv office, like
11:42 am
one-40 of the con -- one-four of the county says it is hard and it is potentially discriminatory. >> west of i-35 we have a part of our state that is sparsely populated. i don't know of anyone who would have to travel 200 miles, but it is not unusual to have to travel 30, 40, 50 miles just to shop for groceries in far west texas of the. >> so your sense is that it wouldn't be hard to get a photo id? >> well, no. in fact, the survey showed that the very people eric holder says don't have those id's that he tried to identified over 93% of the african-americans and over 92% of the hispanics admitted they had an id and they would be able to vote under this law. it would be incredible they say they don't have an id. they are driving now.
11:43 am
they are using the id's every day. >> this was the university of texas professor who says 93% of african-americans have photo id. 92% of hispanics and 90% of whites? so fewer whites have photo id's? >> that's according to his sample of eric holder's own data. >> and there is the doj had a list of 1.4 million voters who they claim are going to be affected negatively by a photo id, and guess who is on the list. former president george w. bush, k bailey hutchison, the former senator and former senator phil gramm. what are they talking about? >> well, it just shows how loosely constructed the doj's own expert said, i will read a direct quote from him in the trial, i was not asked to weigh in on the question of whether or not they would be able to vote. so this list was created to maximize the number of people that might be able to vote. it doesn't have a real basis
11:44 am
in reality at all. >> what will happen with this decision, and what do you think the fate of voter id will be in this state? >> well, it is in the hands of the three-judge panel now, eric. it will be up to them to decide. unfortunately the way the law is written, eric holder does president have to prove his case. we have to prove he is wrong. ultimately it may result in the repeal of section five of the voting rights act which would be a great thing. >> well senator tommy williams and the other co-sponsors will await that decision by that panel in washington. thank you for joining us this morning. >> thank you, eric. >> and of course if anyone suspects any problems at the polls or voter fraud there is the address, voterfraud at fox news.com. >> keeping eric very busy. police in one major city have a duty to add to their own to do list. the drought has gotten so bad they are out enforcing a
11:48 am
11:49 am
and police in indianapolis are handing out fines to anyone caught violating watering bans. we have the latest from the fox extreme weather center. is it that serious, rick? >> we have 80% of our country in some form of a drought, and 60% in a moderate drought at least. a significant drought across a large area. we have had worse droughts, more intense at least, but in smaller areas. to see it in a widespread area is the problem we are dealing with. there is rain to be had out there. it is a scattered summer-type garden variety thunderstorm popping up as the day heats up. and some of these at times could be a little severe, but the worst of the drought you will notice -- actually you won't notice, but it is here across areas of georgia. you notice the rain is off to the west and off to the east of it. we are not penetrating this area where that significant drought is. dry conditions at least across the northeast, and we have rain showers moving in there. that will continue to be the case today, scattered showers. the west obviously has been very, very dry for such a longtime.
11:50 am
we have been dealing with very dry conditions across especially arizona for much of this year. take a look at what happened over the last 24 hours. look at these storms that blew up yesterday. that's good news, but it did cause a little flooding across some of these areas. the heat though will continue to be the story. swree heat advisories post -- we have heat advisory usa cross -- across the plains. >> those people are suffering. thanks, rick. >> you bet. there is a new push for the chairman of the house judiciary committee to subpoena national security leagues. details coming up.
11:54 am
a crisis has been unfolding in chicago. there is a big spike in gang violence and a soaring murder rate. how is the city handling this? a fox news contributor joins us with commentary every sunday. hello. >> hi. >> we hear stories from people in chicago that it is getting bad. >> and it is about time that some of the media has awakened to it. what is interesting is if you look at the front page. new york times this morning there is a story called two classes divided by i do. basically it says single motherhood is seeping into the white class. before it was looked on as a racial matter.
11:55 am
now white mothers are a part of the number, and 40% of the births in the united states are i will legitimate. now, that is going to offend some people i will legitimate. even the associated press in the style books say please don't use i will legitimate. say they are children born of people who are not married. well, it kind of gives you an idea of where at least the media, the liberal media is looking at this culture. the times story has not one word about chicago. this is just some sort of compilation of studies. do you know that in chicago recently they had a museum dedicated to gangs, and of course they spotlighted white gangs going all the way back to al capone. that's interesting and fashionable to think about that. city journal has been -- and that is the publication of the
11:56 am
conservative manhattan institute has been very good on this. it is called the second rate city, nice illusion to the second city in which they talk about how bankrupt -- or how virtually bankrupt the state is and the city just as well might be in the same problem. it was interesting to see rom emmanuel who is the closest of all cronies to obama waxing forth on bain capital and romney. what about chicago, mr. mayor? there were no questions on abc about chicago. the city is virtually, large parts of it, very large parts of it, and now extending into the suburbs, in a war. there are at least 600 gangs with many, many more factions there. most of them are minorities, and the most prominent victims
11:57 am
