steve brown is live in chicago with the very latest on this story. good morning. >> good morning. it turns out the very latest on this story happened at a vigil last night for lira cook and elizabeth collins, the two missing cousins in iowa last season on friday. according to family members of the missing girls, f.b.i. dogs flown in from quantico, virginia yesterday hit on the scent of the two girls and followed it for a distance, we are told. or at least that is what is being reported. the f.b.i. has not confirmed that as of yet. but family members meanwhile, still cling to hope. >> i've run over everything in my mind 1,000 times and it's impossible. we try hold on to whatever kind of hope you have. >> it has been friday afternoon was the last time that we have any report of someone seeing lira cook, age ten, or elizabeth

now. >> gretchen: i understand the both of you grew up in this town, so this is near and dear to your heart. you'd like to stay in your community. but it's a little tough right now. tell me what the change in your salary has been since the mayor slashed all public workers to minimum wage. >> it's approximately 70% reduction for us. that's what we're seeing right now. >> gretchen: in the parks you were making $24 an hour as a firefighter. now you're making minimum wage, which is 7.25. how long has this been going on so far? >> we've actually received one pay at minimum wage thus far. >> gretchen: amy, i know that the two of you have two small babies at home and it was tough to make ends meet with the regular salary that bob was bringing home. i know you're working part-time as well. what is this going to do to the family budget?

>> well, i mean, we do live pretty frugal the way it is. we cook at home of the i do do a lot of couponing. we're still trying to make ends meet, but ultimately, it's going to come down to paying the mortgage and buying food and if this continues, the math doesn't add up. we'll have to choose what can get paid for. >> gretchen: i want to look at the city of scranton and the cash strapped situation. the city has $133,000 in cash, but the city owes $3.4 million in vendor bills. bob, i guess this is what started the situation, where the mayor had then gone to city council and asked them to approve a 78% tax increase over three years for members of this community and the city council, most of them also democrat, the mayor democrat, said no. is that correct? >> yeah, that's correct. what's happening is right now

the city employees are basically in the middle of a fierce political stalemate in both sides are having disagreements on how to implement certain changes to bring the city forward. so right now the employees are caught in the middle of that. >> gretchen: so here is the statement from that mayor of scranton. it's unfortunate that the employees have to bear the brunt of this because the city council won't budge, but i can't print money, i can't spend money i don't have. i guess the argument against that, though, has been that the mayor has been responsible for trying to keep the city in budget and many people say he has not done that and this tax increase is too much money. the bottom line is, you guys are paying the price. amy, what are you going to do? >> you know, we talk about it at great length on what we're going to do and if there are any areas we can cut back. as of right now, we have a lot of great family and friends who have reached out to us and we're just going to sit tight and be

businesses and i got to tell you, it shows a fundamental misunderstanding of the american economy. >> steve: no kidding. >> it's the strength of our economy. >> steve: pardon me. so when people say, you know, bill gates self-made man, warren buffet, self-made man. steve job, self made businessman. the fine print, according to the president, thanks to the tunnel, the teachers, the bridges. >> it's no wonder he says the private sector is doing fine and we just need to send more money to the states so they can hire more public employees. that's his answer to the economy. again, i think it shows that he doesn't get it. he doesn't understand how our economy works. with all due respect to steve jobs and all those other folks who made huge successes, there are millions of americans every day who work very hard in very small businesses just to kind of keep it afloat, to be able to meet payroll. and those folks feel like they've built it, believe me. that's my concern is that what this president is doing in terms

of policies and has done for 3 1/2 years, which is more regulations, higher taxes, more borrowing, more spending, policies that make it hard tore create a job through his health care policy, energy policies, this is the reason we're falling behind and the reason we have unemployment at levels we haven't seen since the great depression. examine the reason we're not seeing the kind of economic growth that was hoped for. we need a change. we need a president who first gets it, understands that the private sector is what creates jobs and not government. >> eric: you mentioned doing fine. that was a line from last month when president obama said we're doing fine in the midst of 41 months in a row of unemployment above 8%. where is he more tone deaf? we're doing fine or it's the government should be taking credit for all the success of small businesses in america? >> i think it's both. i think it's a sense he has that it's the private sector is doing okay. the problem is we need to add more to government because the second part of his statement, which hasn't gotten as much play is he said what we need to do is have washington send more money back to the states. remember, this is the

washington, d.c. that is going broke. we can talk about that, but we've got record debts and deficits. washington is now borrowing over 30 cents for every dollar it spends. this is not sustainable and the notion is that somehow you can tax small businesses to be able to solve this problem, it doesn't work that way. you got to give small businesses the ability to create jobs and that's creating an environment for success and for growth and that's what washington is not doing. he'd like it make it even worse. >> gretchen: one of the buzz words together that we've heard in the last year from the obama administration is fair share. people need to -- it falls into what we were talking about. now the second report that's come out from the congressional budget office and it gave startling statistics. in 2008, in both 2008 and 2009, the highest earning 20% of taxpayers paid 94% of the total income tax burden and i know you like to point this out because it had something to do with the bush tax cuts in maybe a

negative way for those top earners, right? >> it does. look, the president loves to criticize the tax relief from 2001 and 2003 and that report also said something else interesting. two reports last week, it also said when you take into account the effect of the tax relief on the deficit in terms of those higher earners the president wants to tax, making over two greatnd a year. it was 4% of the deficit, not taking into account anything to do with the growth that occurred because of that tax relief for a lot of small businesses. so yeah, he is somehow trying to get the american people to believe if you just tax small businesses more, we can solve this deficit and debt problem. you're right, under the bush tax cuts, the tax code became more progressive. before the bush tax cuts, of it 81% for that same group. then 86% right after the tax cuts and then as you say, in 2008, 2009 that, they had got over 90%. there has been a lot of unless done recently about the president's proposal to raise taxes on small businesses and

bottom line, it's about a million small businesses that get hit, 53% of their income gets hit. and by the way, even if do you that, it runs government for about a week. so it's not the answer to our deficit problems and it's part of this concern i have about the direction of the economy under this president. we continue eucrite size business. we continue to play class warfare and this is what's driving investment and jobs and opportunity offshore. we need to get back to making our economy more competitive and the good news is we got a candidate, mitt romney, who wants to do that and knows how to do that and has the policies to do that. >> steve: senator, have you heard from mitt romney lately? >> i have not. i've been watching him on fox, though. >> gretchen: we know you're on the short list for vice president. so we'll keep everyone posted the minute that we hear if your name happens to come up. >> great being with you. >> steve: straight ahead, shots fired from a u.s. naval ship. now one person is dead in the strait of hormuz. some say the u.s. committed an

>> steve: shots fired yesterday on the high seas from a u.s. naval ship in the persian gulf. here is how it apparently went down. a small boat, fishing vessel perhaps, initially turned away from the u.s. ship, but then abruptly headed back despite being given warnings to turn around. when the warnings were ignored, shots were fired from the naval ship and one person on the small boat was killed. the others were injured. is this action protected under maritime law? we called in the lawyer, fox news legal analyst, peter johnson, jr. what do you think? >> this is interesting. i believe that not only is it protected, it's legal and it's appropriate given what happened

with the uss cole where 2,000, 17 sailors were killed in this horrific terrorististic attack by a small boat that crushed the 40-foot hole in that vessel. so i think for the people in the navy is remember the cole. this is all based on daniel webster's 19th century discussion of what is appropriate in terms of self-defense. two words. necessity and proportionality, meaning if it's necessary to defend yourself, then you have to react in a proportional way. here the boat kept on coming. 30-footer or 50-foot boat manned with three outboard motors, which are similar to some of the iranian crafts we've seen in the past. and they fired warning shots and they kept coming and they killed one and injured three as a result. >> steve: the thing about the

ship over your shoulder, it's an oiler. like a gigantic bomb. all it takes is a bomb to blow it to kingdom come. what are the rules of engagement? >> the rules of engagement say give a warning. the rules of engagement say, you should warn the threatening entity in order to give it an opportunity to withdraw and then you can use force in self-defense if there are no nonforceful alternatives. what other alternatives was there? they weren't gog have a duplication of the cole. was this a test? the other thing to remember is that we've got 100 of these ships deployed around the world. this is actually a civilian arm of the federal government. there are not naval officers or sailors aboard, but for certain security forces that the navy put on to arm it and to maintain

markets, free enterprise and free people. perhaps it's time for business in general to begin to make the moral and ethical case for free enterprise itself. for the beginning of our country, people from all over the world have come here seeking the american dream, which is business ownership, or perhaps more importantly, the american promise, which is the promise that you can come into a free market and freely pursue the dream of business ownership and achieving all the goals and dreams that you would have in your heart. >> eric: but jim, tell me, where do you think the president sees the government's involvement in making tasty delight a successful yogurt company? >> you would think that the president himself had his first job in hawaii in an iconic brand like baskin robins would

understand that the kind of business franchising is. it's hard to understand those type of comments, but perhaps what it really reflects is the clear choice that he continues to talk about. that choice is becoming more and more polarized because of the kind of shrill rhetoric and finger pointing that we're talking about this morning. if you believe government is the solution to the economic problems, you beauty things one way. if you believe private enterprise and small business is the solution, you intuit things different. >> eric: another one of your concerns is the impending obamacare law that will affect small businesses like yourself. tell us what are you looking for? what do you expect and what are you concerned about? >> well, i think the concern is that even though the supreme court has decided as a tax that obamacare is constitutional, that doesn't make it workable or right in the field of battle

where we live every day. as an example, the employer mandate requires that if you reach the threshold of 50 employees, that you have to make a choice between increased costs or paying the penalties that is a greater burden to business. the hudson institute came out with a report that showed that in franchising, that's going to put 3.2 million jobs at risk and add about $6.4 billion in additional burden or cost to small business. i think that's significant. and it certainly is not a net growth expander or extender. it's a disincentive. >> eric: we need to point out the reason is because franchiseees are small businesses and as they approach 50, they may move people from permanent to part-time just so that they fall underneath that 50 threshold limit. we'll have to leave it there. thank you for joining us this
