13 states of are approving the president obama's job performance. here they are: the other 37 states do not think the president is doing a good job. so how can he win re-election? joining us now from washington fox news analyst and radio talk show star laura ingraham. what are the odds in your opinion that president obama gets reelected in november? well, bill, if you look at the real clear politics average of all the polls, obama is up slightly like 2.8%. something like that today. if you look at where the money is going. couple of things that you are going on here. polls sighting big time home states. these are not going to go for romney.

interesting plays are always in the states like nevada up over obama virginia where it is fairly dead even. down in florida average. romney, i believe his strength you are seeing in an odd way play out in the previous segment which is chick-fil-a controversy. romney wasn't at chick-fil-a yesterday coming forward and saying, you know, this has gotten out of hand the demonization of people. and we want to stand for something for something that is constitutionally based some of them there for marriage not entirely political has some political meaning. and i think you are going to election day with a huge turnout against kind of this redefining of marriage american institutions. >> bill: you are the vegas

now, interestingly enough, in this gallup rundown here, the states that matter the most, florida, 46% he approval of president obama. virginia 46. nevada 45. and ohio crucial, 44%. with numbers like that it's almost impossible for the president to win. yet in the cbs poll yesterday, cbs, quinnipiac, "new york times," had the swing states gone. so it's a confusing morass right now. >> it is confusing. you were tackling the wisconsin governor recall, right, a lot of polls showing he was in trouble up to the very end. i really believe that a lot of these pollsters are trying to do their best. oversamples democrats. >> bill: that's what they did yesterday in the quinnipiac poll. >> they did again. 7%, something like that. >> over sampled. i think romney needs to do. he needs to do a better job of

>> bill: kelly file segment tonight on jury trial 26th, president obama issued executive order very quietly giving african-american students greater access to, quote: a complete and competitive education, unquote. what exactly does that mean? here now to explain attorney and fox news anchor megyn kelly. i am mystified by this executive order. you explain it to me please. >> there is a crisis for african-americans in many of our schools in terms of the discipline they face and the lack of graduation and the fact that they are two years behind whites in terms of what the level of education that he they are attaining even though they are in the same grade. so they are trying to look at this. now, it does come right after the president received a report from the same group to which he announced this policy that if he didn't do something for the african-american community is he in danger of losing significant portions of the african-american vote in

some critical swing states. but the president comes out and says okay, da i want to create a commission that's going to look into this problem in our schools? and then i also want to work with communities to try to. >> bill: he doesn't have to do an executive order to create a commission to look into how to better serve those children. >> the commission is doing more than just looking into it. >> bill: what is it doing. >> the most controversial part of what it is doing is it wants to eliminate methods that lead to the desperate use of disciplinary tools. >> what does that mean. >> black students are getting expelled and suspended more than white students are. >> bill: unfairly. >> that begs the question. is it because they're creating more of a disciplinary problem than the white students? or is it just that five white whites do the black dos and blacks get punished more harshly. >> bill: i don't think that's the case though. now you are opening this up to chaos.

if you are going to have expulsion for white kids different from, you pelings for black kids. that will be lawsuits all day. >> the already saying maryland school district just implemented a similar policy can't have the number of blacks that we get expelled and suspended that we have. work out your numbers to make them even. the critics came out and said that's going to result in white students getting expelled or suspended for lesser offenses. >> bill: they can't have that. >> just to even out the numbers. >> bill: is that what president obama wants? >> i doubt that but i think he is trying to address a problem that government is not necessarily well-suited to address. >> bill: but it seems to me, and this is when w. all due respect to mr. obama. he doesn't know what he wants to do. he uses his power, executive order which should be only used sparingly to create a situation where he doesn't know what to do. what do you do? >> one other thing is he doing is he is encouraging the community to come together to look at this problem and ask why.

>> bill: you don't need an executive order to do that. >> it's not really the issue. shouldn't would he be doing something? seriously there is a crisis among minority groups in particular african-americans. >> bill: do you know why. >> i know that many people believe it's because seven out of 10 black children now are born to parents with only one parent household. >> bill: you just lit it. that's -- hit it that's the problem that the home life of the students in certain areas, and i don't know if it's a black-white thing a lot of white kids with the same problem raised by a mother. >> three out of ten. seven out of ten babies born out of wedlock. that's what's going on by the time they get to school they don't know anything. there is not a book in the house. >> they are not set up. >> no supervision. >> that's why i say there is only so much president obama can do about that. >> bill: that's right it's a bogus issue. >> community outreach part of the program get leaders to come together in the community and say what are we going to do about the underlying problem that makes a lot of sense. >> bill: what you can do about out of marriage births?

what you can do? that's the problem. >> much more fund mental change. >> bill: executive order saying you can't do that? >> yeah. not going to happen. >> bill: that's right. so, to me this is a phony issue. >> i know you and bernie have been covering. this the first step is calling attention to the problem. admitting there is a problem and then addressing t in a way that, you know, you are not accused of being down on african-americans. it's a real issue in the african-american community needs to understand it and come out in front of it. >> bill: i will tell you what, if they set up different disciplinary standards based on skin color, you are going -- there will be riots. there will be riots in this country. you can't do that. >> you can't start suspending the white students for throwing spit balls just so that the suspension numbers the same. >> bill: it's a racist action. >> that is the worst case scenario. that's not what president obama is trying to do. criticism of the program. >> bill: that disturbs me. i want the president of the united states to have a clue and then he use his power and
