the woman's death is tragic and everyone would agree with that. but she died several years after that man lost his job. is it a dirt track? >> it doesn't matter and quite frankly, they have backcheck, pinocchio, whenever these check places do. we should point out that the presence first attack ad on mitt romney was on the same income when they called him a vampire. this is the next part of the story from this super pac. it doesn't matter whether it's true, and quite simply they probably don't care if it's true. what they care about is getting in it on the air and right now they have not heard it yet. but what they have done is by running an ad that is so salacious and over-the-top, it promotes the character, it's a character attack. they know what's it's going to create controversy and is going to be seen even before they put a nickel behind it.

shannon: do you think anyone out there that has a job and a family or are looking for a job do you think they they're looking at those fact checks and those pinocchio test which have really call this one out, as you mentioned? you think the average american -- do you think it will matter and they will make the connection in their mind that mitt romney is a bad guy? >> juicier blog post from the "washington post" versus if they do back this up with some money, really, once you think about this. the attacks on mitt romney have been character attacks, vicious attacks on his character that he is a bad person. this is the ugliest reelection campaign in the media era. we can't think of a time where an incumbent president and his forces have done this intentionally negative about another human being. bill clinton used to talk about the politics of personal destruction and this is it.

they would try to destroy mitt romney. whether or not the fact checkers like it or not, it is here. they are putting the worst ads up in virginia, ohio, pennsylvania, wisconsin, trying to kill mitt romney before he can get their. shannon: we show pulling that mitt romney's unfavorable numbers have ticked upwards. it sounds like a brilliant strategy by the obama campaign. >> this is like general critics lemay in world war ii. this is carpet bombing is absolutely fiber content firebombing. this is not brilliant. it is brute force. the thing that the president knows his bed he is less likely than republicans because of the carpet for it. i can only imagine what would happen if mitt romney were running for his super pac was running a similarly rough nature ad, i don't think he she would be having a very good day today. shannon: 11:30 a.m. eastern time

everyday. thank you so much, chris. clearly, that ad is sparking a major quest for truth on the romney and obama trail. there are similar cries coming from democrats about a new mitt romney ad. that ad accuses the president of gutting the work requirements for welfare recipients. but the obama campaign and former president bill clinton, a key player in that reform movement, they have slammed the ad. so where do these questionable attacks go nuts? we will debate this and we will update you the minute the white house remarks on this latest super pac ad. we are getting new details about the shooting rampage at a sikh temple on sunday that left six people dead. the fbi saying just a couple of hours ago that they have not yet determined a motive for wade michael paige and his actions. today they reveal how he died. >> the evidence in the case that

the second responding officer who shot page in the stomach, thank goodness, subsequent to that, it appears that page died from a self-inflicted gunshot wound to the head. shannon: authorities say that page acted alone in the shooting. we are also seeing some stunning developments in a bizarre mystery that unfolded at san diego's historic coronado mansion last year. there is a new report that claims six year old max did not accidentally fall down the stairs as previously thought. he was the son of jonah shacknai. shacknai's girlfriend was found

hanging from the balcony several days later. her death was ruled a suicide. chris allbritton has been watching this story for months. >> to forensic pathologist have been hired to look into the death of her son. both of those doctors came to the same conclusion that the little boy could not have fallen over the balcony himself. let me show you here, this is the staircase in question. to give you context of what we are talking about. max shacknai was actually riding his scooter here, he went towards this corner of the balcony and then somehow, he grabbed his scooter and hit his back and went up and over the railing. here is a diagram of the san diego county's corners office of what they think happened. they went up over the balcony

comehither chandelier, and landed on his back. now, the two doctors say that it is physically impossible and here is why. they say that max at shacknai was 45 inches tall. the railing is only 32.25 inches tall. the center of gravity is right there where the blue dot is. and it is impossible for him to propel himself up and over that balcony because he simply is too short. one doctor takes it even further, saying that max shacknai was assaulted at the top of the staircase and pushed over. the mother believes that that makes sense. >> especially given all the multiple claims of injuries. over his head and his back over his right eye. it just didn't make any sense. >> we now know that the father's

girlfriend was in charge of watching him at the time. she is the one that found him at the bottom of the stairs. she committed suicide three days later. but her hands were tied behind her back. her feet were bound and she was naked, hanging from a balcony in the very same mansion. her family does not believe that she killed herself. max's mother does not believe his death was an accident. the coronado police department say they are willing to reveal all the evidence, but have not gone as far as to say that they will reopen the case yet. a fascinating fascinating new information coming from these independent pathologist. shannon: it is very fascinating. thank you for keeping us up-to-date. and marc berman had a chance to look at these autopsies and the evidence in the case. he is going to join us in about 30 minutes with a new twist on what he discovered in his brand-new report. >> this is a fox news alert. we are awaiting a news

conference on a security system for new york city. it looks that the nypd has teamed up with microsoft to create new technology that will give police a possible new tool to help protect the city. david lee miller has the latest live in new york city. >> hello. we have this news news conference that we expected them to weigh in less than half an hour. we expect michael bloomberg and new york please commissioner ray kelly to attend. what they are going to unveil its latest tool for the new york city police department called the domain awareness system. what this essentially is is it allows the city to monitor various videos and examine the video with police databases. how can that be applied? here's an example that was given. it's a suspicious package is located on the street. the police will now have the ability to easily look at video of that specific location and go back a number of days and see who placed that package at the location. what is interesting about this system is that it uses not only cameras that are owned and

operated by the city and police department, but also cameras that are owned by private businesses, they can also voluntarily take part. just a few days ago, the police commissioner a little bit of a preview of how it works. >> what it does is aggregate a lot of the information that we have through cameras. we put it through databases that make it a one-stop shop for investigating. especially in regards to types of government services. >> not everyone thinks the system is a good idea. civil rights advocates say that there is a potential here for great abuse. the head of the new york city -- one of the american civil liberty union members says that there is some entity that should be looking over the shoulder of the nypd. >> one of the big concerns in the system, even if you think it is a perfectly legitimate law enforcement system, there is no oversight whatsoever. the only people who have control

charges leveled against governor romney by the most powerful man in the senate. majority leader harry reid continues to repeat claims that governor romney did not pay taxes for about a decade. >> his father, george romney, said the president that people running for president should file their tax returns. governor romney will won't do that because he has basically paid no taxes in the prior 12 years. shannon: they are refusing to reveal a source for that. the white house to denounce senator reid's claims. >> i think the dispute is between the romney campaign and harry reid and senator reid is, you know, doesn't take direction. he speaks for himself. shannon: he is addressing this issue on his website. the true and pathetic story of the president and the mainstream

a brand-new battle brewing over welfare reforms first signed into law by president clinton. they are accusing the obama administration of trying to drop welfare for certain recipients. this is growing into a big fight

on the campaign trail as well. >> reporter: republicans in both houses have now introduced legislation to prevent the obama administration from using waivers too reduce work requirements in the 96 welfare reform law. listen. >> for them to just unilaterally change the law, they can't do that. >> if the president wants to make changes or his administration has better ideas on how to administrate this area or this program they are welcome to come through congress. >> reporter: what started all this was a july 12th memo from the health and human services department in which it claimed it had the quote, authority to waive compliance and try other methods, including quote, definitions of work activities and engagement. many lawmakers saw that as a pow err grab because the original legislation did not authorize such waivers. the welfare law is two years overdue for reauthorization.

they say if the administration needs changes, ask for them. >> we are in the middle of a second decade undoubtedly we need some changes. let's work together to get them done >> reporter: the administration justified its action saying there was response to letters from utah and others asking for flexibility. listen. >> just last year states led by democrats and republicans, including nevada and utah called for these waivers. >> reporter: now utah's letter, though, complained only about the accounting requirements in the law and did not ask for a waiver of the work requirement. the governor also questioned whether hhs could act on its even saying, quote, utah understood that hss did not have waiver authority and our request was limited, and limited flexibility was made under that assumption. secretary sebelius sent a letter to congress saying she would not accept any changes that undercut the work requirement in the original law. skeptical lawmakers say if

that's true then why did the department argue in the first place that it could waive work requirements? shannon. shannon: interesting question. jim, thank you. >> reporter: yes, imagine. shannon: again the romney campaign took this debate to a new level when it released this ad just yesterday. >> in 1996 president clinton and a bipartisan congress helped end welfare as we notice by requiring work for welfare. but on july 12th president obama quietly announced a plan to gut welfare reform by dropping work requirements. under obama's plan you wouldn't have to work and wouldn't have to train for a job, they just send you your welfare check. shannon: the white house is calling the charges categorically false and blatantly dishonest. we have two fox news contributors. good to see you both. it's important here that president clinton has weighed in. he said the obama administration

has taken important steps to insure that the work requirement is maintained and waivers will be granted only if a state can demonstrate that new people will be moved into work by this approach. false campaign ad? >> no. what he has done is give these waivers and there is some question about the legality of having the hss secretary do this. there is a question in the original law of whether or not these kinds of waivers with regard to the work requirement can even be waived. that might have to be settled in the courts. but what romney is saying, is look you have an executive who has once again gone around the congress and legislative process to give these waivers, again, questionable legality on the work requirement. what is important to recognize here is that you might now under this. if this is allowed to stand you might have state bureaucrats across the nation then counting things as work that should not be counted as work. so, for example, we have

examples of journaling, or bed rest, or meditative reading. >> that is work. >> counting as work requirements. if you allow the states this kind of flexibility in being able to decide what is work and what is not work you'll have this ma tphaouf srer maneuvering. >> usually we love state rights and we hate centralized government. apparently not today. that is not what the romney ad said. the romney ad said that obama would waive the work requirements. that is not true at all. everybody concedes its not true at all, including independent belief in people who watch us independent leave. the only way you make a waiver is if you make the work requirement stronger. why would the romney campaign bring up welfare reform. now we learn that when he was governor of massachusetts mitt romney allowed people on welfare to have free cars. the state would pay for the cars, the car insurance, it would even pay for aaa, this is something that is so tone deaf

because he's raised this issue now that the obama administration can come back and say, look what you did to massachusetts, look at the give aways you gave to people on welfare. i sometimes wonder who is running the romney campaign. did they not do research on their own candidate? >> governor romney has a very strong record in massachusetts as governor on the work requirements. every time legislation came up from democrats in his state legislature he vetoed legislation that would have weakened the work requirement. i'm not quite sure about that. i do think the ad is correct. when people say that governor romney in 2005 signed a letter saying that he wanted some state flexibility all of those republican governors who asked for that in 2005, and this gets sort of to the crux of this. they weren't asking for waivers of the work requirements, they were asking for flexibility in actually implementing a lot of some of the federal money that was coming into the state. >> quickly just a note this is from "the washington post," not a conservative baston by both people's accounts.

if we are going to look at them, they do these pa tphoeb pinnichios. they gave four to the romney ad, three pinnochios to the obama ad. julie it sounds like both side are in trouble on this. maybe it's not a good issue for either one. >> i don't know what they said about obama but i will say with mitt romney i don't know what monica would say to the fact that he gave away free cars and auto insurance to people on welfare. that to me is not somebody strong on welfare. all obama is trying to do is say look, california, ohio, whatever state you want to pick, if you have a better way to put people back to work that is demon strabl, you hav demonstrable, you have to prove it.

we will allow you flexibility to do that. >> i think both campaigns your engaging this issue. in that obama memo coming from hss they actually used a new, brand-new legal argument that apparently they pulled out of thin air that would actually gut the work requirement. so you have to look at this from all sides here. the other point about this is that governor romney is making this an issue because it gets to the bigger point about government dependency and that is a largest narrative about what president obama and the left have been doing over the last three and a half years, which is to expand the number of people dependent on government at all levels. >> i guess if i wanted to be dependent on government i would have lived in massachusetts in 1997, would have got even welfare, a free car and autoshaourpbs. i don't kno auto insurance. shannon: >> the best welfare is a steady job and that is something this administration has not

>> we now have co confirmation from the fishery officials in massachusetts today that it was a great white shark that attacked a swimmer off a cape cod beach last month. christopher myers was swimming with his son when he was pulled under. he managed to get ashore and was streeted at a hospital in boston. authorities confirm it was a great white after examining the bite marks on both of his legs. there's been an increase in shark sightings because of the growing seal population off massachusetts beaches. now back to the death of a 6-year-old boy at the famed coronado mansion in san diego last year. independent pathologists hired by max shacknai's mother said the child was murdered and did not accidentally fall down the stairs as investigators had previously determined. this mystery last year sparked a number of theories, especially

after the girlfriend of max's father, pharmaceutical tycoon's girlfriend was found hanging by the neck a few days later. mark fuhrman has looked into the evidence. this comes from independent outsiders. what do you make of the reports? >> well, first we have to understand that the coronado police department has not reclassified the child's death from accidental to homicide, so that being said, these are renowned experts, and of course this was a pathologist that did the original autopsy, and i'm sure that they are going to take these reports under consideration and maybe a different view, or a view that the original pathologist and the detective didn't quite consider in the initial autopsy, and then if there is evidence they will

reclassify the case as a homicide, and then the suicide of the girlfriend, rebecca starts to make more sense now than it did then. >> the mother who hired these independent outside consultants said she was very disturbed, obviously, having lost her son she's already suffered a tragedy, then to find by what she determined from the report that there had been some other injuries inconsistent with what would have been an accident, she mentioned injuries on his eyes, the top of his head, did anything stand out to you as something that would raise concerns as a detective that maybe this wasn't an accident? >> not seeing the autopsy, not being at the autopsy, not seeing the photographs, and not knowing the condition of the child before the accident, it's very hard to say. when you have injuries thathe supervisory adults are saying were not there before the accident, then you can conclude that if they didn't happen during the accident, then the

accident didn't occur as described. the injuries around the eyes, depending on how the child fell and where the impact was with objects from the bana sister t bannister to the floor, if you can imagine a half so manier salt where the victim landed on their back you would not have injuries to the faces specially abrasions and contusions. if you did they would leave skin cells or blood on the objects on the way down. >> what level of persuasion would a police department have to be convinced of in order to look at the outside report and say we already had the coroner's report, now we get to outside report, there is enough there that suggests maybe it is worth opening? >> well, they have no axe to grind on this. it's one thing, another pathologist looking at a case, but a biomechanics

professor-doctor, somebody that studies the movements of the body and how things are possible, and the way the body would fall, i think this is something that a police department would welcome, because if you establish that the child was the victim of a homicide, but still alive for four days, the girlfriend, rebecca commits suicide, which was always in question, was she murdered or was it a suicide, it starts to make sense that the grief and the fear that the child would awake from the coma and then they would be found out starts to make sense. so if i was a detective i think i would welcome the new information, and i would weigh it with what we questioned and what we didn't know and perhaps that biomechanics doctor actually came in and solved some of the problems that we were struggling with initially. shannon: and of course her family continues to contest the finding that she committed suicide, as many families do. they find the way they knew her and the days that they were talking to her around that it

doesn't seem consistent to them. i know they are also challenging that particular finding. if this were to be reopened as a homicide case, how tough is it for the police that somebody who would have been the only adult in the house at the time, the number one witness to what happened is no longer here? >> really, i think it comes down to paperwork. you have a suspect in a homicide that commits suicide, and i've read her autopsy, and clearly the evidence that leads up to the suicide, and the location of her successful suicide, she did that alone. it was not a homicide. i mean there is conclusive, absolute evidence on the balcony, and before, and evidence where she painted on the door, and that paint transferred to her hand where she put it back into the rope that she had behind her back. so i mean that is co conclusive it was a suicide, but why? if it's a homicide now you know

travis. this is his new mugshot taken after his arrest last night for allegedly driving drunk in suburban dallas. police say he crashed his pontiac transam and we are learning a short while ago when police arrived at the scene they say the country star was found naked, and threatening to shoot the police officers. a lot more on this story in the next hour. also a developing story in las vegas about a controversial and disturbing billboard. it shows what looks like a person hanging from the sign with the words, dying for work, that is painted on the sign. trace gallagher has details from the west coast newsroom, very bizarre, trace. >> reporter: you can imagine driving to work down i-15 in vegas which is the main interstate looking up and seeing that billboard and seeing what appears to be someone hanging from it. this was right off the fle freeway of interstate 15. it was part of an impromptu campaign with multiple

billboards around las vegas. the first one here was spotted over interstate 15. a lot of commuters called the police, called in talk radio shows. the dying for work slogan. the other one was across town, this one another dummy hanging, another sign, except this sign said, hope you're happy, wall street. the billboard company is one of the biggest billboard companies in that area. we called them, they have not responded yet. we don't know if they sold or rented the space or if the space was simply hijacked. either way the billboards have now been taken down by the nevada department of transportation. and in case you're wondering, nevada has the highest unemployment rate in the country by a mile, 11.6% in nevada. the next closes is rhode island at 10.9%, and we can tell you from first-hand experience there are a number of people, in fact tens of thousands very frustrated at nevada's handling of the unemployment situation in

controversy as she charged republicans wanted to take away women's reproductive rights and were against cheaper access to birth control. while the president wants the focus to be about that it's being overshadowed by another woman, the late wife of that steel worker you mentioned. a lot of controversy over this ad by the democratic super pack. some of the facts don't add up here. if you look at the time line of when the steel worker lost his job. the fact is his wife at the time when she was still alive had her own job and had health inn through her own company so they didn't necessarily lose the insurance because bain capital shut down that steel plant. the other issue was she got sick and died five years after the company went bankrupt. so when robert gibbs was pressed about all of this he would not run away from the ad.

they see this as a huge opportunity for themselves. a lot of them are coming out of a rock and they have logistical infrastructure where they can support their operations in syria. shannon: how worried are you that the syrian government has some times of chemical weapons? how worried are you al qaeda or another group could get their hands on those weapons? >> our government is concerned about it as is the israeli government. it occupied our intelligence agencies for some time. we wanted to make sure we know those locations and also work with the rebels because the regime is eventually going to collapse. and work those rebels now so those weapons will be safeguarded when that regime collapsed. i wouldn't be surprised if we didn't put some people on the ground to safeguard the weapons as we did in libya. shannon: i want to talk about

the rebels. we just got the sound in from counter terrorism adviser john brennan talking about the history of al qaeda. >> the history of al qaeda is they try to take advantage of areas that are lawless or going through political change or chaos. they grew in iraq. they they have taken advantage of the situation in somalia and yemen because of the problems there. syria is no different. shannon: for me that begs the question and for others as well. if we know al qaeda may be involved in syria what do we know about the others we broadly term as rebels. who should we be helping. what do we know about the rebels and what different groups may be taking part and identifying themselves that way. >> i think they are in two large groups as radicals as we would define them loosely. al qaeda and also the muslim brotherhood. they are on the far right of

that movement. most of the rebels have fall on a category of being moderate. a lot of those are former military officers and nilt non-commissions officers helping to lead that movement. i'm making the assumption that we are working with some of those more moderate groups. not only to assist them now, with the movement that they conducted against the regime but equally important to have a relationship that we forge now so we can influence those moderates in a post-assad regime and they will -- they will vie for power and influence. and we are going to play a role i believe in attempting to get a more moderate regime in syria post assad. shannon: do you think that will be possible? from what we understand iran is standing with syria. the latest television appearance on state tv by assad was with a senior iranian official.

what are we to interpret about what role they will play as he tries to hang on to control and if he loses it afterwards? >> this is critical for the iranians. this is their number one ally in the region. yet the iranians have been trying to form a coalition a from lebanon to syria to iraq and what they are interested in is regional hegemony. the iranians have been trying to prop up the regime. they provided resources, supplies, ammunition. they brought in the quds force. and the head of the quds force has been in syria for weeks and months at a time and leaves and comes back again. hundreds of quds force members are in syria assisting the syrian army. as you know, the "wall street journal" reported the 48 hostages seized by the rebels are quds force members.

shannon: country star randy travis is in major trouble.

police busted him in north texas after they say he crashed his car and we are hearing he was naked when officers arrived on the scene and threatened the officers during his arrest. doesn't sound good for mr. travis. >> reporter: someone called police and said they saw somebody flying the road naked and that turned out to be country star randy travis. police say he had a strong odor of alcohol on him. his 1998 trans am was off the side of the road and had crashed into construction debris. police say he refused to take a breathalyzer. as you can see from the mugshot, he had scratches and cuts on his eyes. he also had a black eye. police say when they tried to put him in the patrol car he
