help. no question about it. but what president obama does not want to articulate is that there is a shift in how many americans see themselves. it used to be self-reliance ruled. my parents would never under any circumstances take government welfare payments. my worked in a fast food place before did he that come to think of it that's what his son, me did moo n. my early adulthood. many feel they were entitled to free stuff because it's not really our fault if we are not prospering. it's the country's fault. the country has to make it up to us. sending us money. that's what's going on. tremendous sense of entitlement among some younger americans and some older citizens who simply have not succeeded. president obama is encouraging that mind set by putting out a narrative that says wealthy americans and business people are not paying their fair share to the feds. all the stats show affluent americans pay the vast

majority of federal taxes and half the population pay no income tax at all. in france, the new socialist president there wants to tax the affluent at a rate of 75%. three quarters of their stuff he wants. he wants to do that so he can dole the money out to french citizens who don't have very much thereby ensuring their permanent support. do you see a difference between the french socialist strategy and what the democratic party wants in the u.s.a.? i don't. it's just a matter of percentage points. and that's the memo. now for the top story tonight, reaction from two democrats. joining us from los angeles, leslie marshall and from washington kirsten powers both are fox news analysts. we are becoming an entitlement state are we not. >> we are not becoming entitlement state we have been an entitlement state for a long time. the question is whether or not you think that's a good thing or bad thing. whether or not you think the government should be providing these services or not. i will say the one place i

really have to disagree with you on though is that obama anything to do with it according to the center for immigration studies, there has only been a three percentage point increase of year all use rate of welfare since obama came. in it doesn't really jive that he is somehow increasing the use of welfare. >> bill: the dollar numbers are astronomical. put up a chart so everyone can seat dollar numbers under president obama from 2008 onward. it's just a straight graph up. and the numbers are staggering. when you have, leslie, a third the population, a little bit over 300 million people in this country, a third the population receiving some kind of government assistance, do you think that's a god thing? do you think that makes a -- good thing? do you think that makes a strong country? >> absolutely not. i agree with christian. this is not the fault of the president. this is not something that's happened overnight or past three or four years.

>> bill: you say america has been a welfare state for some time. you are both putting that out there? because in the year 2000, i will use that graph line, 2000 to make my comparisons. it was much less of a percentage of americans on the dole. and i say on the dole. look, some people need the assistance. they get sick. they got stuff happen to them. they got children. whatever it may be, all right? we understand that. okay. withbut the percentage, the grah line is straight up. so, leslie, you say that the entitlement society is not a good thing. kirsten, you say you don't know if it's a good thing? >> no. i said it depends on where you are coming. >> bill: where are you coming from. >> where i'm coming from i think it's good that the government provides these services. >> bill: for anybody? it should be easy to get on there and they should be accessible? they have billboards go here if you want it? we will pick you up. we will drive you on our bike. you think all of that is good? that makes a stronger country? >> yeah. because most of the people who are getting it are people who are quite desperate.

>> bill: you think a third of the american public is desperate? >> i think that, yeah, for people who can't afford to feed their children who are using food stamps. using medicaid. >> bill: you say 1/3 of the american population is desperate. can't afford to do this stuff. >> i think they are in very dire straits right now a lot of people are really struggling. i think healthcare costs have been increasing so much. >> bill: unemployment rates -- bad but not astronomical. you think a third the population is in desperate straits? >> i think anybody who can't afford to feed their children, you know, and, you know, living at a poverty level is in a pretty bad situation. i mean, you forget -- if you compare to the past, bill, healthcare costs were nothing compared to what they are today. i mean, now, you have to. >> bill: that's why we have medicaid and medicare. >> that's an entitlement. but that's an entitlement. >> bill: it's an entitlement but i pay my own way. i'm not on medicaid, leslie. i mean, i'm paying my own way. most of the folks that i know are doing so as well.

whether they be teachers or cops. you know, guys that cut my lawn or whatever they do. he they are paying their own way. but you guys are basically painting. you are both painting for the audience a picture of a third of the country destitute and they will can't do anything about it. and they have to be rescued by the federal government. >> hold on, i have to say something. bill, just a second. the thing you have to understand. >> no. a lot of people -- that's not what i said. >> a lot of people are working. >> you are painting a picture of people sitting around eating bon bones all day. a lot of people receiving welfare have jobs. >> bill: defeating the system, the stats show that how about the rise in disabilities, kirsten, how about the dramatic rise in disabilities, is the work place that much more dangerous? is that what is happening? it's exploded. >> look, the idea that people are somehow defrauding the welfare system is not -- you cannot sustain that argument. >> bill: of course i can i can point to -- >> -- no, you cannot. >> bill: point to dramatic rise in every area of people

saying give me stuff. all right. leslie hasn't said too much. >> give me food. >> bill: am i being unrealistic here? you see an explosion in disabilities in the workplace. i have been working here 16 years. i didn't know i was in such jeopardy in just eight years? what happened? things are falling down. >> tripped down the hall many times unsuccessfully. >> bill: wrap it up, leslie, go ahead and say what you want, leslie. >> here's the deal. the honest truth is there are some people that are bulking the system, that there are some illegals that do and this a come to the united states for that that is not the majority. there are a number. i would say the majority of people who need such assistance. the problem comes with what it was originally designed to do. which was to be a temporary helping hand out of a bad situation. it's become not an entitlement system in my opinion. >> bill: become a way of life. you are actually agreeing with me, leslie. >> i agree with you for part of this. you know i'm going to pay dearly for that later. >> bill: you be careful going down the streets of los angeles tonight. >> i'm in trouble.

right. and the fact of the matter is, the question is, in my opinion, why are they in such desperate need. >> bill: do you really feel those numbers aren't gamed up. beginned up by people who are just taking advantage of this. >> without question. >> bill: you have to break it into two categories. >> absolutely. >> bill: the people who really need it. and we all agree in a civilized society we should have safety nets for those. the people who are gaming the system, under the encouragement of a liberal democratic party, which is telling me you are a sap if you don't get. this come on, go get that. >> it is a big game being played. one is that we are bringing in approximately 15 million people into the country that we didn't invite. number two. most of them don't have high school educations. we know by, you know, years of sociological study that they will be people who will be dependent on welfare for many years to come. we also have a failing education system. we have 25 million people

a new fox news poll just out a couple hours ago. registered voters. not likely voters registered. 49% obama. 40% romney. a 9 point gap. all right? >> big deal. >> bill: included in that 49%, has to be almost everybody getting welfare payments because romney is saying is he going to do away with all of that. >> this is not a great position to be in you are governor romney. a couple of reasons. one is we know that half the country isn't paying taxes. we know that we have got 100 million people receiving in some form welfare from the government. then we have people who are receiving entitlements, that is social security, medicare, we are an expansively dependent society right now. >> bill: when -- the ladies allege that this has been going on for a long time. that it isn't just suddenly under president obama that we have changed. what's your opinion? because you are very old and you have seen a lot of things. >> bill: in america. >> as i recall back to f.d.r. are. you are making t much too open. the idea that we would see this occur started in 1965 with the so-called war on poverty. and then to telescope ahead to the present. we have a president who has presided over the greatest expansion in food stamps in the country's history. it was never even imagined, social security disability unemployment benefits move out people are being moved in wholesale numbers. >> bill: you say it started in 1965. the chart we have shows a much bigger escalation in the last five or six years. >> no question about it it much of that is because of the policies that obama put in place. >> bill: you are blaming it on him. the ladies are saying is he not the entitlement president. he inherited this culture, the mind set changed a long time ago from self-reliance from my parents to give me, give me, give me. >> gingrich had it wrong. obama is not the food stamp president. he is the food stamp president

>> bill: and in the impact segment tonight, as you may know, former penn state football coach jerry sandusky convicted of 45 counts of child sexual abuse. is he expected to get life in prison when is he sentenced in september. however, his attorneys say they will appeal and are also asking for a new trial. that despite what one of sandusky's lawyers said right after the jury verdict. >> the judge in this case was marvelous. judge klee land was the ultimate jurist, he was fair. he was firm. he was reasonable with everything we asked for, i believe the jury acted on the evidence that was presented to t. and i don't dispute or have any problem with the jury's verdict. >> bill: that was sandusky's co-counsel joe amendola. joining us is carl, the other counsel and partner to amendola in this case. it seems to me that you are appealing or going to appeal but your guy or your partner is saying, look, everybody did

the right thing. so, what are you basing your appeal on? >> well, if you listen carefully he said based on the evidence they had in front of them. partly we weren't able to present everything we wanted to. secondly, we weren't given enough time to prepare which was a major issue. >> bill: seven months wasn't enough time? >> no, it wasn't. we were given most of the documents days before trial. cross-reference. even though you had seven months to prepare for the trial. the prosecution, which is required to handle her documents to you did how long before the actual trial began? when did you get the final stuff. >> final belt of documents days before. >> bill: a week? two weeks? >> within two weeks. >> bill: within two weeks. >> within two weeks of trial we received thousands of pages. >> you say that wasn't enough time for you to go over these,

prepare the defense that your client is entitled to? >> correct. >> what else? is there anything else you want a new trial? why would you want a new trial? the governor signed a bill here in pennsylvania which will allow for the use of psychological testimony in sexual cases. we believe that we could have presented a psychologist who would have been able to explain certain aspects of the case but couldn't because pennsylvania law doesn't allow that but will allow it in a few days. had the trial not been rushed -- >> bill: i don't know where you are going here because there is so much testimony against your client. so many people have stepped forward and then you have the witnesses and the shower and you have all of this stuff, i understand a robust defense is part of the constitution and we all get that but i'm not sure it looks to me and correct me if i am wrong, you are trying to use technicalities to get a guy off who is guilty yard. it looks like you are trying

to use the system somehow we could have had this expert say. look. the overwhelming evidence says the guy did it. the guy did it. the answer there is anybody can argue that anybody has try to quote use the system. the government used the system to exclude certain evidence. the government used the rules of discovery -- >> bill: the bottom line on any appeal is this: did the guy do it? and i think that your co-counsel was pretty clear in his statements after the trial that he didn't have any beef with what was presented and the way it was presented and he just thought the judge and everybody else did the job that they are required to do? >> and we have appellate courts because one out of five times judges make the wrong decisions in the course of their employment. it's a wrong judgment call at the wrong moment. that's what we're going to explore on appeal. >> bill: you sound like a stand-up guy, that's a compliment. you are coming on in here. >> thank you.

>> bill: you are earning the questions straightforwardly and that's what we like here. would you really feel comfortable if you get this guy sandusky off on a technicality? would you really want him walking around? would you feel personally comfortable with that? >> you know, years ago i got a guy off on a techni cattle and the district attorney came up to me and said i hope you are happy. the i looked at the district attorney if you had done a, b, and c done evidence. >> bill: you are dodging the question now you might be perfectly right would you feel comfortable having this guy walk around the streets of america? >> if he is guilty, the answer is no, of course not. my problem with that bill is that i'm sworn to zealous advocacy. i can't second guess a person's guilt or innocence. only the jury decides it. my job is to safeguard the process. it's unfair to put me in that position to say how would you feel? i only feel well if i do my job to my best ability. >> bill: all right, counselor.

atheist would act on his or her beliefs and then in god we trust on a dollar bill. on the supreme court, i mean, do you then start tearing down the institution? do you feel that an atheist would not reflect your core values as a person? >> yes, i will tell you why. because -- i mean, when you talk about issues that are some of the most extreme issues in terms of emotions in our culture today, it would be abortion, euthanasia, you know, stem cell, all of that stuff. >> bill: they wouldn't see life the way you see it because you believe in a higher power that's created life and they don't. >> absolutely. >> bill: that's interesting. and you say. >> i would not either. i would not vote for someone who is an atheist. primarily because who doesn't believe in god tends to believe in big government. you would link it to big government policies than moral issue. >> founding fathers believe in the declaration of independence god gave us -- our creator gave us.

they did 20 years ago? >> i believe this is happening because there is a lack of civics being taught in school. if you look at that sta tisz particular, 18 to 29, 70% of those demographics would vote for someone who is an atheist. i think that's because there is no education in our schools. the founding principles. >> bill: walking away from religion. >> founding principles being taught in school. >> big issue in these numbers is the fact that everybody prefers any kind of religion, muslim religion, mormon religion, hispanic, catholic to someone of no religion. and i think that's a powerful number. but i also think that these numbers of people believing in the atheist and possibly voting for them are increasing because people are starting to think we're more liberal. >> bill: we're more secular. it's not a matter of liberal and conservative. we are a more secular society now that it used to be that organized religion had a huge place in this country. no longer. it does not have that power any longer. >> understand the basic principle though. god gives us our rights

last week it was harry reid and romney never paid any taxes. then we will move on to how romney doesn't like latinos. then we will move on to he is trying to stop you from taking birth control pills. all of these are created little controversies that mick if such that he does not have to talk about something that's a little inconvenient let's just say the g.d.p. to debt ratio. >> bill: you think the president will prevail because of this strategy, will in the end he win the election because is he doing this? he is ginning up -- look, is he behind in colorado. according to the latest policy behind by a points in colorado. the only chance he has to win in colorado if the women turn his way the men aren't going to turn his way. he goes out with sandra fluke and run around the state. look, where were you? we are going to give you everything you want. and romney is going to not do. >>it let me tell you how i think this is going to go down. is he doing it now because to some extent it's working, right? he has that gender gap.
