>> if you think the casey anthony not guilty verdict was a shock, i have got news for you. it could happen again, this time in the drew peterson murder striel. drew peterson, you know the ex cop, the guy who made history with his dead and vanishing 3rd and 4th wives. tonight on "justice" i am going to tell you why that just might happen again. i was in chicago, joliet, to be exact, during week two of the trial. i watched in disbelief as the illinois state police declared that kathleen savio found dead in her bathtub was the victim of

an accident. a woman whose hair is soaked in blood lying face down in a bathtub with none of the little bottles on the side disturbed no soap ring no blood ring no towel, no clothes on the edge of the tub and within minutes of their arrival the state police from illinois say that it was an accident. the lead investigator directed that no one process the scene. what does that mean? that means don't take fingerprints, don't move the area for blood, don't process the can of rug cleaner found right near the bedroom that the csi guys didn't even see and don't check any room for any signs of forced entry, and even though there were 13 separate bruises, including a 3 inch bruise to the butt of kathleen savio which the csi investigator says he didn't see at the time,

he declared the bruises to be insignificant. well good old sherlock there didn't even bother to examine a 2 inch gash of kathleen's head but he knew there was a lot of bleeding after because when he took her out of the tub we got a lot of blood all over. he didn't even look to see where the combloblood was coming from. they were out of there in record time. it's as if they said enough about the dead, let's attend to the living. a spokesperson for the family of missing stacy peterson agrees. >> a coroner who was there and observed something that was really not right, you have also a state police officer who didn't really give a darn. >> and if that doesn't convince you that the illinois state police were so inep the so

system's at thtempt to make a defendant look as good as he can while making the victim's life an open book. judges spend their days deciding whether the jury can hear all of the truth and witnesses are told that they cannot say all of the truth. example, i can kill you and make it look like an accident, but only i can kill you is allowed in. why? let's go back to the courtroom. judge bernilo's courtroom. he won't allow the prosecution to present evidence that drew peterson on trial for the murder of his third wife killed her because he didn't want her to get his money in the financial settlement. remember she is found dead 6 days after a subpoena for drew's pension is served on him. peterson swore she would never get any of his pension. by the way, as an aside, the

year before drew's child support was doubled and within days he shows up in his swat uniform with a knife to kathleen's throat asking why don't you just die? take a listen to kathleen's sister and brother. >> she told me she would never make this divorce, she would never slive to see the end of te divorce. >> saying he would kill you and make yit look like an accident. that's not a coincidence. >> i told you how the judge allowed the defense to call the victim every name in the book from a mad woman, a woman possessed, very angry, bossy, a woman who was ballistic, bonkers, crazy. this week the subject of the defense's diversion were kathleen's friends, her sister, the people who reported drew would kill her and make it look like an accident. they were lamb basted by the defense for not intervening and for not stopping it. remember it's everyone's fault

but drew peterson's. take a look at this one. >> how could you believe anything she said then when she thought she was in trouble she started crying. >> you think that was made up? >> absolutely. >> if you can make others look bad maybe the criminal won't look so bad. finally the blue towel. did you know a towel has a right to remain silent. you heard me right. a towel has the right to remain silent in the judge's courtroom they do. the prosecution is not being allowed to show that drew peterson could have placed the towel by the body when none was there according to the first five or six witnesses who saw the body. the da says the scene was staged to look like an accident. they should be allowed to present testimony that a towel that wasn't there suddenly shows up when someone says why is there no towel here? why is the prosecution not being

allowed to pro their case. the burden of proof is on them. they need to prove it beyond a reasonable doubt. let them do their job. we don't need to sanitize the facts. to do so tips the scale against the person who has paid the dearest price, the person who never choose to be a victim in the first place. and now, at the center of this drama are the lawyers. peterson's lawyers, joel bronski steve greenburgh who like their client are cocky confident and brass. they pull no punches they are often politically incorrect and litigate both in and out of the courtroom. take a look at this one. >> what do you make of the safety factor in this trial. >> who? >> stacy factor. >> stacy who? >> she is on your witness list. >> oh, that stacy. >> maybe she will show up. >> if she got the sustain.

suspect to say the least. >> the guy we ar talking about lieutenant james coughlin, here's a guy who called esp and says look he doesn't remember the dates so it is quite possible that he could have been there at any time except it was within two weeks of passing. do you think it's damaging? >> it is damaging if it was true but it's not true. drew wasn't in there. the only court dates in february was the date that was on the order. so whatever he said in court you got with each of the documents the document shows drew wasn't there. he is also blaming the fbi all of these other witnesses any time something is going bad for them they can say well i told the state police they didn't write it down i told the fbi they didn't write it down. three or four witnesses saying that. >> it isn't it true the fact

that drew whether or not there on one day doesn't mean he wasn't there on another day. you are not taking down verbatim everything they say the cops police and fbi you don't get a chance to correct their reports, do you? >> i can't correct the report but they get it right these are important that are on there this svent something the fbi can make up. it is clear. it is clear there was only one court date in february and we have the order and it shows drew wasn't there kathy wasn't there and kathy's lawyer wasn't there. >> let me go back. if you think coughlin is lying you have the friend in the basement that rented from him

while she was buildings house. the nursing student friend and the sister. did all of these people get together and say let's conspire against drew peterson. they all say he said the same thing. we can't blame the report for inconsistency. they are all corroborating each other. >> she is broadcasting all of these bad things. >> what about the marks on her neck that the nursing student saw. she said she had two marks on the side one on the center. where is that from? >> we are not going to talk about that until close arguments. >> one final question. hasn't there been a finding in civil court where drew peterson said he killed kathleen savio by -- if the hearsay is being allowed by judge white he would had to have made a finding that

is being under allowed by forfeiture by wrong doing. don't you basically say we are going to let it in because we think by a preponderance of evidence drew peterson tried to center lines kathleen frto prevt her from testifying in the divorce. >> that decision that ruling by judge white is under seal. we cannot tell you what the signings were. we accept what was discussed in open court and that was i think 8 out of the -- 8 out of the 12 segments he found to be unreliab unreliable. we already have a judicial finding all of the evidence for example parks were unlreliablun. >> he did find 8 of them reliable. in order for him to do that he would have to believe that kathleen was silenced to not testify in a divorce settlement and stacy was silent in order to not testify in the murder trial. she is the one when the cop when

there were five hearsay statements the most important hearsay statement is by lieutenant conklin from bowling. why do you say that? >> because he heard drew. it wasn't hearsay upon hearsay. the other four were hearsay upon hearsay and he broke the code of professional courtesy. >> by coming out of the cops saying i -- >> absolutely. >> good point. when you hear anderson she was the one who lived with fabio lived in the basement when you have her saying there was a knife under the mattress. and the nursing student i had to walk her to her car because she was so fearful. and you have the sister. it's a cumulative effect. it depends how the sjury evaluates it. >> when you were out there you spoke with reverend showery. what can be added to the hearsay? >> it is huge you are talking

there is one thing judge that investigators know the suspect always knows where he was at the time the victim died and that is with the victim so the most concentrated part of their alibi is the time of death. >> there's no question. let's talk about this statement judge white the hearsay. wasn't the judge already made a finding by the preponderance of evidence that drew killed kathleen by allowing the hearsay and sending it down. glass could you litigated two or three years with the appellate court i am going to let this in subject to the trial level. he forfeited his right of cross examination because he killed someone. >> there was a statute at that time where judge white was doing that.

i am not sure how much of that is relevant today. i will say this you are absolutely right in a court of law in joliet, illinois a judge said by preponderance of the evidence drew peterson killed kathleen savio. >> that is a preponderance of the evidence. that's a different standard. >> no question. >> the other issue is a jury here has to make a determination. right? they are not going to rely upon the judge. >> i am not suggesting it's proof beyond a reasonable doubt. i am saying a judge has said wait a minute i am going to let this in because they are secured by wrong doing. you can't benefit from the fact that you killed someone therefore i am going to let the hearsay come in. the hearsay comes in because they say drew peert son made it impossible for someone to be there therefore he has to listen to the statements as evidence. >> absolutely right. the bottom line here is it goes back to the judge.

railing and accident explain how that happened. >> hold on. what we are looking at is a full scene of max's height next to the railing when he -- when he was on a skate board and the other is when he is on his feet. either way it doesn't appear that the center of gravity is above the pop railing. am i accurate in my description? >> yes, you are correct. >> all right. >> this is a report done by our independent expert, so he actually shows that even with a scooter there is no way max could have gone over that banister as dr. gomez illustrated or tried to illustrate in his report. >> what i found disconcerting is that not only would max not have been over the center of gravity even on the scooter but there are different things like the pattern of injury on max's back

injuries are consistent with the experts decided after nine month a thorough investigation. >> i have read the report. it is compelling. how do you get an injury fron t top of your head. assuming that it was. rebecca the baby-sitter hung herself or so it was determined she committed suicide. do you think she was responsible? >> i think -- i have asked that the police department reopen this investigation and amend the disposition of his face. they are the experts and they have the ability to do the work to do the expert work to find out what happened that day to max. >> to the attorney. can i ask you what the next step is here? >> we are waiting for the police department to respond to our meeting with them. we met with them for three hours. we had the expert present
