>> steve: when mitt romney selected upon paul ryan as vice-president nominee the health care plan became a front issue. last week we were talking about what seemed like tanigencial issue and now we

are talking about medicare. so let's look at the two plans. not the ryan plan, because romney is not running on ryan's plan. look at the obama plan and romney plan. >> they make the same reductions in medicare. romney a little bit more because obama hasn't submitted a 10 year plann going forward except for obama care. the approach is different how they achieve the cuts. that's the key difference. the obama program sets up a panel with burrcrats that take your blood pressure and your surgical history and what medications and doctor office and forget privacy. that is all now in a computer and when you are 85 years old and you want a bypass surgery or hip replacement. it goes in the computer.

he's 85 and high blood pressure and used to smoke and on anti-cholesteral meds and has six more years to live and four of that quality. operation costs $4000. that is a $100 per quality year denied. or it says you have colon cancer but you only have three more quality years and a vast and most expensive drug is too costly. denied. we'll use the second best drug. that is a very difficult system. it abroigates authority to the state that is god's and anti-prolife. but the romney plan is totally different. what that says, you can keep current medicare and no changes as long as you like but we will offer you a better deal. you will get $15,000 in the

beginning of the year and you buy whatever insurance plan you want and you pay the deductible and if there is money left in the end of the year you keep it and i will not tax. that empowers you as a consumer. for $15,000. you can buy in the medicare plan or something knew. but the point is, you buy it tailored to your needs. right now, the government doesn't care about your health and you don't care about the costs. you make a great care. but now the person buying it pays for it just lick a car. and this exact system working with prescription drug meds and the price this year has not increased. >> steve: dick, i saw a mitt romney adtalking about how, and it is addressing seniors out there. you paid into medicare your whole life and when you need it, we discover that the president of the united states

one ahead. but under 50 . i believe romney will win. but let's put the ryan designation in the political context. i think what happened here. when romney choice ryan. he ended the primary nomination process. it ended that day. all of the people who backed santorum and ron paul and bachmann two-thirds of the voters looking to someone other than romney because they are concerned about whether he was conservative or not. that is over. it is a real mitt romney and a solid fiscal conservative and opens up a medicare debate that we better win. everybody said you mess with medicare you are going to lose . 15 years ago, you did. i ran the campaign against the

republicans over medicare. it was a totally different environment and no body understood that medicare was facing bankruptcy. >> gretchen: florida is so important with seniors. you were an opponent of romney picking rubio. you believed that would help him deliver florida. how do you feel name. >> naming romney than rubio make its more difficult to carry nevada and new mexico. but i don't think it going to make it harder to carry florida. what is going to determine whether he carries it. can he win the medicare debate. that i think it is central and that is terribly important and romney is off to a good start in doing that. in taking the tack he eliminated personal questions

about is he conservative? and moderates about bain capital. everyone is focusing on the economy and fiscaluation. the other thing to point is ryan is the single brightest person currently in american politics and i think that he is one of the most articulate and capable and the idea of having a paul ryan debate speaking in the convention and speaking out as he tours the country is absolutely wonderful. if you just wanted to script who you want by your side fighting it would be paul ryan. i think it is a very good choice. >> gretchen: a lot of people don't know who he is, dick. >> everybody in florida knows who rubio is, he would have helped in an extent. but in a few weeks, it will be

part of our country and the same issues that affect gay merrence affect everyone else . we are look for example jobs we are trying to figure out how to educate our children and prepare for retirement. retirement security is an issue in the gay community. when you look at all of those thingings, we came down to the decision to be the only gay organization to endorse romney and ryan looking at their vision. >> gretchen: i think people think it is a foregone conclusion hacertain group in society. gays or people who are into green energy that they would automatically vote on the democratic side. >> that's the thing. we are no different than anybody else. there are gay conservatives and in the last election and in the tea party election 31 percent of the gay vote went to the republican member or the republican candidate for congress, because they are

concerned about the size and scope of government. we are on the brink of fiscal disaster in our country and everybody is concerned about that. >> gretchen: so when the president changed his mind about gay marriage and saying he was in favor of it how did they? >> that is my opinion and dick cheney's and john bolton a lot of conservative in support of same-sex marriage. but the election is coming down to more than one issue. but the president has to talk about things like gay marriage or birth control or you know, chicken sandwiches because he can't defend his record on jobs in the economy. >> gretchen: it is down in the economy for both proud. >> we'll be in the republican convention homocon for gay conservatives and celebrating the ticket and rallying the

many, many of those jobless college grads are also staring at tens of thousands of dollars of debt. these are the chief topics of focus for congressman ryan as he returns somewhat like welcome back kotter, to the university of ohio today. last night the gop candidate was in las vegas. the emphasis is the middle class. the attack by the obama campaign and his policies. the campaigns clashed over ryan's budget plan and specifically his vision to how to rein in federal spending for entitlement programs like medicare. he gave his first sit down interview yesterday since joining the gop ticket to fox news senior political analyst, brit hume. in that session conducted in colorado yesterday, ryan made clear the gop ticket welcomes this debate over medicare, in part because romney and ryan intend to link medicare to

obamacare. >> only president obama raids $716 billion from the medicare program to pay for obamacare. we don't do that. what mitt romney is proposing to do is repeal all of obamacare. i have voted repeatedly in congress to repeal awful obamacare, including this cut of $716 billion to pay for obamacare. so what's very important here, a lot of seniors don't know this, is that they turned medicare into a piggy bank to pay for obamacare. we want to point that out and restore those cuts to prevent that raid of medicare. >> obama-biden campaign spokesman said yesterday that that's false, saying. >> quote, congressman ryan's budget incorporates the $700 billion achieved in obamacare, which come from eliminating subsidies to insurance companies, cutting waste and fraud, and reforming delivery systems that will keep

basically turned away from that report and never adopted any of the measures to try and get our debt under control. here is what erskine bowles had to say about paul ryan and his budget. >> have any of you all met paul ryan? we should get him to come to the university. i'm telling you, this guy is amazing. he is honest. he is straightforward. he is sincere. and the budget he came forward with is just like paul ryan. it is a sensible, straightforward, honest, serious budget and it cut the budget deficit like we did by 4 trillion of the the president as you remember came out with a budget and i don't think anybody took that budget very seriously. the senate voted against it 97- 97-0. >> eric: he's a democrat. it's also important to note that the bowles simpson debt commission that was going to do something about debt talked about tooking entitlements, including medicare. no question, not surprising he would be on board, favorably.

also senator ron widen, dick durbin. the president and vice president themselves have said positive things, but the one that really sticks out in my mind is when bill clinton -- i don't know -- remember that open mike where they caught him saying hey i hope this win in new york is important, but i hope they don't use that to do nothing. clearly there is a growing consensus has to be done. thank goodness paul ryan is out here saying, we have to tackle it. it's been the third rail for so long. it's about time someone stepped up and said we have to do this. >> gretchen: they did that with the debt commission and then it was completely ignored. so maybe the attention should go back to what those recommendations were for the debt commission because paul ryan's budget has a lot of the same things in it. let's talk about vice president joe biden because that is who paul ryan is going to go up against on october 11 during the presidential debate. maybe joe biden needs to go through a few more practice sessions because he has three gaffes yesterday alone. here is one of the biggest ones

was trying to become president. you argue that he will do that even more if he's elected to a second term. in what way? >> gretchen, the trick is that even though president obama has said i'm going to spread the wealth, he hasn't told you whose wealth he's going after. it isn't the 1%. it's middle class suburbia. he wants to undercut the economic independence of america's suburbs because he wants to grab hold of suburban tax money and send it over to the cities. >> gretchen: you talk about this concept of renallallism, which -- regionalism, which you say you believe president obama believes in this. what is it? >> regionalism is the idea that government ought to be larger than suburbs or cities. it ought to incom pass an entire region. that's a kind of excuse for grabbing hold of suburban tax money and redistributing it to the city. what i've discovered in researching this book is that this is what president obama has been devoted to for almost two decades. this is what the community organizers who trained obama

wanted. he bought that line and although no one knows it, he's working to this day, in the white house, with the same organizers who trained him on a plan to redistribute the wealth of america suburbs to the city. >> gretchen: what are you arguing, in his first term he wasn't able to do some of these things because of it all about being reelected and now, for instance, when we heard him speaking to the russian president and he thought he was off camera and he said that he would have more flexibility in a second term, are we to equate that to domestic things back home as well? >> absolutely. he's going to go after the suburbs in a second term because it was too politically explosively to do it in the first term. the truth is, he has already built the groundwork for all of these policies. it's all in place. he's going to pull the trigger in the second term. >> gretchen: many people at home are saying, but, there is congress. if congress goes republican or even stays split, can the president still enact these policies? >> yes. he can make a run around congress in calm of ways.

but how do you know you really owe them money? some debt collectors are flat out frauds. dave ramsey joins us from nashville to help you look out for your own money. thanks, dave. before we got to the e-mails, i want to know, i've had people send me e-mails saying you owe the money. i paid the money, but i still continue to get them. what's up with that? >> well, you've got a whole arm of the debt collection world that has gone completely rogue. they're trying to collect on bankrupted debt, which means the debt is not owed anymore. they try to collect the debt from people who don't owe it at all. never owed it. just the same name. so you've got to really ascertain if this is a real situation. if it's really your debt before you even begin to talk about negotiating on the debt or paying the debt. >> eric: let's read a couple e-mails. janet says my credit card company agreed to settle with me for much less than i owe. this sounds too good to be true. how do i know it's for real? by the way, once you do settle for less than you owe, can someone else come after you for the balance?

>> they can come after you for the balance if you don't get written proof that you've done the settlement properly. two rules when you're settling with a credit card company. remember that the credit card -- if a credit card collector's lips are moving, they're probably lying. so you really have to get it in writing. this is a scummy, scummy industry. so get it in writing and allow no electronic access to your checking account ever. they will freaking clean out your account. so do not allow them electronic access to your account examine get it in writing. then you know it's real. >> eric: number two, aaron in arizona says i have around $20,000 in credit card debt from five to six years ago. i was going to file for bankruptcy, but then i never did. now i've been told not to pay them unless they get a judgment against me because they can't collect on debt that is older than seven years. is that correct? >> well, statute of limitations is in place in some states. honestly, there are ways around those in a lot of cases. yes, they can collect.

it may or may not show up on your credit bureau after seven years, but what i would do is tell you a, you owe the money. so from a moral stance, you ought to address this. b, clean up your credit. c, you just don't want this hassle at the least opportune times one of these guys decides to go after you. i would sells with them in writing. >> eric: what do i tell discover when they keep calling me? i don't have any money to pay them and it's making me nervous. they might sue. what do you think of that one? >> eventually they will sue. they usually don't sue in the first six months to a year. sometimes even longer with the major credit card companies. the federal fair debt collection practices act protects you. they're not supposed to call you pep between 8:00 a.m. and 9 p.m they shouldn't call you at work if you asked them not to. ask them in writing so you can prove it. so you can cut some of the hassle down, abusive things like

really talking about was something the republicans already put on the table, was sort of this unshackling of regulations. that's what the republicans want, get rid of regulations and they used the word, unshackled. so that's why he was responding with his put the chains back on comment. do you really think there was that much thought going into the whole thing or was it just simply a gaffe? >> eric: my problem with this is that like you said, the obama campaign saying no, no. you don't understand. he was talking about the republicans. but doesn't make any sense. doesn't add up when you say, when joe biden is saying, they want to put you back in chains, he was referring to regulation. he was referring to wall street and banks and regulation. the republicans don't want to add more regulation to wall street. they want to reduce the burdensome regulations. so to say he was referring to republicans, it's disingenuous and again, it's not what you say. everyone slip, but it's how you handle it afterward and for me, it seems like this is a complete failure breakdown. >> steve: plus the way he was saying it. he picked up a twang.

he was in front of a large african-american audience when he said that. it's over the line. so many of you have e-mailed already this morning. meanwhile, if you look back, we told you a couple months ago that the approach that the obama administration was going to have is they've got to kill mitt romney. first it was bain is bad. then we heard about mitt romney is a felon. then we saw the ad last week about how mitt romney killed a guy's wife. and then this comment right there. mitt romney in columbus, ohio this morning on cbs saying, mr. president, this is a run for the presidency of the united states. clean up the tone. here is mitt romney. >> i think if you look at the ads that have been described and the divisiveness based upon income, age, ethnicity and so forth, it's designed to bring a sense of enmity and jealousy and anger and this is not in my view, what the american people want to see. i know what i'm running for. i'm running to get america working again. to get good jobs for people with

more take home pay. and the president seems to be running to hang on to power. i think he'll do anything in his power to try examine get reelected. i want to get this country going again. that's what brought me into the race and hopefully we can have a debate about issues and our differences on issues and contrast in that area, but these personal attacks, i think are demeaning to the office of the white house. >> gretchen: here is the problem with politics in general right now. can you really run a race only on the issues? i think the american public basically would like that, i know that i would personally like that, but have politics gotten to such a point where it just is this amazing and perpetual negative ads? i think this is what we're going to be seeing for the next couple of months. >> steve: four years -- >> gretchen: some of the issues in the debates. but we'll see this because it appears to be the strategy. >> steve: four years ago, john mccain would not attack barak obama personally. and yet, fast forward four years and you see this. this is extraordinary. >> eric: then you look at the polls and it says -- some poll,

gallup had 68 or 69% of the american public is not happy with the direction of the country, yet barak obama seems to be polling evenly with mitt romney in a lot of the other polls. so the negative attack ads that the obama campaign is using seems to be working. so you're going to see a lot more of it. mitt romney mentioned the campaigning, the president's campaign has become what he calls unhinged. he says it stirs jealousy and anger and points out the joe biden comment. he mentioned this today. he says it sinks the white house lower. it's divisive and avoiding the issues. that is important. romney wants to get back on the issues. >> gretchen: i think you need to be consistent in talk being negative ads. if you don't like them, then you don't like them for both sides of the fence. you don't like them for democrats or republicans. i remember during the republican primaries, a lot of people said, negateds work -- negative ads work. >> steve: it came out of his work. >> gretchen: i'm talking about in general the negative tone.

>> eric: welcome back. mitt romney says the president has gutted medicare to the tune of $716 billion to fund obamacare. but that his plan would save it. his plan being romney's plan would save it. meanwhile, president obama claims the romney plan hurts americans. who has the better plan for seniors? here to break it down is fox news legal analyst, mr. peter johnson, jr. >> good morning. i looked at this in the same way we looked at obamacare for a couple of years and said what is the mitt romney plan? we've seen all these negative commercials and a lot of kind of

scurilus talk. nothing changes under the plan for current seniors for those nearing retirement. also, medicare is reformed in the premium support system, whereby all americans on medicare would get a fixed amount of money, if it was done today, it would be about $15,000. they would have an opportunity to purchase a policy, or, eric, go and stay on medicare as it exists now. traditional fee for service medicare would be offered under the romney plan. now, lower income seniors would receive more, what's called premium support, than wealthier americans. but there would be the same opportunities to receive the same care. finally, the point is that competition among plans and people's interest in assuring costs are kept down would reduce costs. now, the really interesting thing about it is that the plan that mitt romney is talking about is a half democratic plan.

senator ron widen, i don't know if we have his picture -- he's one of the authors of the plan with congressman ryan. and mitt romney has said, i'm going to adopt it. and i think it's important to understand that congressman ryan, his mother lives in florida, she's a senior on medicare. i think you talked about that before. he said on "60 minutes," my mom is a medicare senior in florida. our point is, we need to preserve their benefits because government made promises to them that they've organized their retirements around. and so that appears to be what the romney plan is about. unfortunately, a lot of the stuff they're saying is not true. >> eric: that's the ryan plan. but romney will adopt major portions. >> that is the romney plan we just talked about. mitt romney has made it clear that what he has adopted is the ryan-widen plan. a bipartisan plan with republican and democrat --

oatmeal. my job as an executive chef is make sure that menu reflects that and gives people the choices. >> gretchen: about 80% of mcdonald's options are under 400 calories. what's the best choice to eat? here with more is dr. mark siegle. fast food is going healthy? >> we heard from the chef. he was talking about changing the whole menu around to respond to healthy choices because mcdonald's, a smart business, has realized that people out there want healthier choices. this is the first step in that direction. and they're talking about 400 calories or less. of course, calories are only one thing. i would say there is also other issues, fat, salt has to be looked at. cindy goody, their head nutritionist, told me basically they're moving towards that next salt and fat. we also spoke to mimi roth, the president against obesity, she says, maybe this is just a magic wand they're waving over this. we heard from her as well.

people. these incidents dated back to 2009 and they're sexual in nature, so we're not really going to describe what they are other than to say that if they happened, somebody could be in trouble. >> steve: yeah. this is the same woman who was accused of creating an atmosphere on par with a frat house or sorority house. also there was a fellow who came out i think about a week ago, james hayes, junior, the head of ice in new york, he filed a discrimination and retaliation suit against her and the agency, saying look, i was qualified for this job and janet napolitano wound up giving somebody who did not have the same qualifications the particular job. he says that apparently the person who got the job had a long-standing relationship with napolitano and he was pushed aside because, quote, because of this relationship she had with napolitano and because he was not female. >> eric: i guess you have to wait and find out the details. i think the department said the

allegations are unfounded. so wait and find out if they happen to be founded, then clearly miss barr is in some trouble, maybe janet napolitano needs to be addressed as well. >> gretchen: business news out of the drew peterson trial. word the judge could declare another mistrial. that would be the third one. >> eric: judge jeanine has been in court since the beginning and joins us now. judge, three times? is it possible we're hearing this again? >> three times in less than ten days. this is a biggy. the judge adjourned the proceedings yesterday to decide whether or not he wants to grant the defendants' request for a mistrial. why? because the prosecutor asked a question relative to kathleen savio, the victim in this case, seeking an order of protection while a police officer was on the stand. it was damaging testimony to the defense. the police officer was saying

that kathleen described drew peterson coming into her house dressed in swat, held a knife to her throat, said he could kill her, asked her where she wanted it. she said in the head. she turned her head and then the prosecutor asked about an order of protection which the judge has said is not allowed. the courtroom went ballistic at that point. the defense asked for a mistrial. the judge adjourns and the prosecutor in 30 minutes came back. the assistant state's attorney, she apologized. she said, i was wrong, judge. i really wrote it down, but it didn't register. it's highway mistake. sanction me. don't punish the prosecution. i sat next to the defense table. drew peterson at that point turned around and said to his lawyer, i don't want a mistrial. why? because he wants to continue going forward. he thinks he can win this case. but the judge right now is deciding whether or not he's going to grant it and it is a

black eye for the prosecution. but, guys, i don't think that it is fatal. i think the trial will go forward. i think that this was, if you want to parce it, not a complete error because the judge said you can't talk about an order that has to do with drew peterson losing his job. a lot of back and forth. >> gretchen: if the trial continues and drew peterson is convicted, could this be the number within point of appeal? >> sure. all of the requests for mistrials will be. the defense said, and there was a humorous point when the defense attorney stood and said, hey, judge, we're supposed to be the slime balls and we haven't done any of this stuff. but it can be an order for an appeal. but it certainly is not something that's fatal. the judge can give a curative instruction. he can sanction this prosecutor for defying a court order. i don't think that it was something that in the jury's

it looked like he had enough and he had to say something about it this morning. >> yeah. we got a lot of october rhetoric in august. no question about it. i thought vice president biden was particularly outrageous yesterday. he wasn't in virginia, as you know, he said he was in north carolina. so please don't lay that on us in virginia. but look, as far as what mitt romney said, you can understand his frustration. i think it's better to abide by the old saying, don't let them see you sweat. let surrogates do that. th makes more sense to me. everybody can understand the frustration on both sides with the highly negative rhetoric. >> steve: larry, were you just quoting a deodorant ad? >> well, you know, i've been known to do worse. it wouldn't surprise me. >> steve: well, what do you think mitt romney has been trying to do? do you think -- the conventional political wisdom is people, during the summer, they're paying attention to their own lives. it's not until the conventions that they start to wake up and

pay attention and then the debates. they see people on tv and that's when they make a decision? >> well, the research really doesn't show that, steve. people actually make their decisions on a rolling basis. some were decided last january. that is because there are strong partisans on both sides. it's actually a rolling process. that's why anymore, what happens every day matters at least to the point that some voters make a decision about their choice. as we said many times here, the country is already divided. 95% have already made a decision. >> steve: indeed. meanwhile, as soon as his name was released. paul ryan, you know, people on the left were saying, look, he's not a guy who will be popular with women. yet, when you look at some of the polling data, larry, he's actually got more people in favor of him -- women, that is -- than don't like him. what does that say to you?

>> it says to me that the paul ryan choice, first of all, i don't think will determine the election. but second of all, remember, half the public didn't know who paul ryan was when he was picked. i think it was actually closer to two-thirds or three quarters. i found respondents tonight like to admit they haven't heard of somebody and there are a lot of ryans in politics. this is all about the battle that's ongoing right now to define paul ryan on both sides. i'll bet you $100 million is spent on each side to define not just paul ryan, but his budget plan. so the real battle is now. it's not the announcement. it's now. >> steve: sure. and what the romney camp is doing is they've come out with a medicaid -- rather medicare ad today because so many people say, if paul ryan is trying to cut entitlements and stuff like that. they're not running on the paul ryan plan. they're running on the mitt romney plan. so what they're tying to do is take -- get the initiative, the are romney camp is on the
