president obama called the benghazi attack a terrorist attack right away. >> the day after the attack governor i stood in the rose garden and i told the people in the world that we were going to find out what happened that this was an act of terror and i also said we are going to hunt down those who committed this crime. >> i think it's interesting the president just said something which is on the day after the attack he went in the rose garden and said this was an act of terror. you said in the rose garden the day after the attack it was an act of terror. it was not a spontaneous demonstration. >> please proceed, governor. >> i want to make sure we get that for the record. it took the president 14 days before he called the attack in benghazi an act of terror. >> he did in fact, sir.

let me call it an act of terror. he did call it an act of terror. it did as well take two weeks or so for the whole idea of there being a riot out there about this tape to come out. you are correct about that. >> the administration indicated that this was a reaction to a video and was a spontaneous reaction. it took them a long time to say this was a terrorist act by a terrorist group. to suggest -- am i incorrect in that regard? on sunday your secretary -- the ambassador of the united nations went on the shows and talked about a spontaneous -- >> i want to move you on. >> i want to do that, too. i just want to make sure we have a chance to get questions answered. >> definitely an intense moment there. how did the white house really

respond to the attack on our consulate. steve sen to is following this one. it can get complicated for those who are not following it closely. >> looking back at the comments made by the president and susan rice in the hours days and weeks after the attack the killing was referred to a number of different ways. as she pointed out during the debate he did appear in the rose garden the day after the attack and here's what he said. >> no act of terror will ever shake the result of this great nation. alter that character or eclipse the light of the values we stand for. today we mourn for more americans who represent the very best of the united states of america. we will not waiver in our commitment to see that justice is done for this terrible act and make no mistake, justice will be done. >> but just four-days lart

ambassador rice made the rounds in the sunday talk shows and told a different story. best assessment we have today is in fact this was not a preplanned pre-meditated attack. >> she said the latest intelligence said it was a spontaneous attack by a mob protesting the anti muslim video. the story was people grew outside of the consulate it grew very violent and those with extremist ties came with weapons which are quite common in post revolutionary libya and it all spun out of control. state department spokeswoman, white house press secretary and other administration officials did little to discredit that assessment until september 19th when matt olson director of the counter-terrorism center testified at a senate hearing and he said yes they were killed in the course of a terrorist attack on our embassy.

here is more from obama and others after that. >> what we have seen over the last week, week and a half is what we have seen in the past where there's an offensive video or cartoon directed at the prophet mohammed. this is obviously something that then is used as an excuse by some to carry out inexcusable violent acts. >> there are no words or excuse for killing innocent. there's no video that justifies an attack on an embassy. >> there's no doubt the kind of weapons that were used, the ongoing assault, that it wasn't just a mob action. >> matt olson has said it was a terrorist attack. the president was still talking about a response to the video.

it is a little bit confusing. >> you got all that? >> yes. >> this moment about libya a big talker this morning. >> will this be a big issue in the presidential race going forward. here's what charles krauthammer has to say about it. >> on explaining libya yet it will be a huge problem but it will be a huge problem in a few days. right now in the context of the debate he got away with it because there was no actual response that i think swung it in a way that was incorrect and unfair. >> now candy krau lee did speak after the debate and said that romney was in the right and i just think that he picked the wrong word. that's what she said. make sure you tune into fox and friends later this morning because they will be getting reaction to this controversy

>> welcome back to "fox & friends first". i am heather childers. >> i am heather nauert. round two of the presidential debate turn will into a real slum fest last night between president obama and mitt romney. the most talked about moment from the moderator. doug luzader is following this angle for us. he is live in washington can mo with more. i think we are talking about libya here. >> this image may say it all. most of the questions came to deal with domestic issues but it was an exchange over libya that is getting all of the tanks this morning. it started with the voter asked the president about security failures that led to the deadly attack on the u.s. consulate in libya last month. that raised questions about why the administration initially insisted the attack was about an

of terror. who was right and who was wrong last night. here is chris wallace's analysis. >> on the question of libya i think you have to say both the president and romney were wrong. the president was wrong because he seemed to imply that he had declared the attack in benghazi an act of terror the next day. he was clearly stunned romney saying well you went off to a fundraiser in las vegas. no i was in the rose garden and i declared it an act of terror. all he said was no acts of terror will shake the resolve of this great nation and didn't refer specifically to that at all. romney was wrong in that he tried to say look you have given up the game here because you declared it an act of terror on september 12th but susan rice went out and said it wasn't an act of terror. i am not sure either of those are true. >> fox and friends will be joined by robert gibbs at

7:00 a.m. eastern this morning with more reaction for you. now to other highlights. in the debate they were both very aggressive and tins hitting each other hard on the issues. listen. >> think about what the governor just said. he said when i took office the price of gasoline auz 1.80, 1.86. why is that? because the economy was on the verge of collapse. we were about to go through the worst recession since the great depression. as a consequence some of the same policies governor romney is promoting. >> why am i raising taxes on the middle class? under the four years they have been buried. i want to help the middle class. ly not reduce the share that is being paid by the highest income taxpayers. i will not under any circumstances increase taxes on the middle class. >> i will believer what he said behind closed doors that 47 percent of the country considered themselves victims,

who refuse personal responsibility. think about who he was talking about. folks on social security who worked all their lives. veterans who sacrificed for this country. students who were out there trying to hopefully advance their own dreams. >> in the nature of the campaign some campaigns are focused on attacking a person rather than prescribing their own future and the things they like to do. in the course of that i think the president's campaign has tried to characterize me as someone who is very different than who i am. i care about 100 percent of the american people. i want 100 percent of the american people to have a bright and prosperous future. >> who won the debate? we have republican strategist bill fadia and consultant. how would you grade mitt romney both on style and substance last night? >> i think governor romney did an outstanding job on substance

for sure. if you give the president his due the president scored a lot of points on style last night mainly because the bar was set so low because of his terrible performance a couple weeks ago. as far as the substance of it mitt romney came out swinging on energy and i think that's going to help him in the swing state in pennsylvania. >> i feel like republicans are going to agree with you on that. democrats are going to say the president won. marjorie what about the independents? those are the ones each candidate really needed to win last night. >> this is the first time we saw the president turnout in these debates. we saw two potential presidential candidates standing there duking it out. who they might have lost are the women. there was a level of aggression we have not seen from either candidate and truly them sparring on stage and some of the comments about binders and how they were offhandedly referring to women a lot of people feeling sour on both

candidates to be quite on nest. >> you think women care so much about the over all tone or they care more about the issues? >> there have been independent polls for the last few months seems like there's a poll every day. in recent polling half of women voters say the number one issue for them is the economy. so it's not about style. i think we are doing women a disservice and discrediting them saying they are going to focus on the stale of this debate. for women and membn and voert ts is about bringing the economy back having a strong economic policy. >> issues that got a lot of tanks. that is benghazi. candy went on to say mitt romney said the right thing but used the wrong words. what do you both think will be the headline coming out of this? a pro romney the administration didn't come out with the facts soon enough or against romney.

marjorie, start with you. >> we are losing this point on the whole discussion. who is losing and nit-picking about libya is the american people. the focus is trying to figure out what really happened. >> we know what happened. finally the administration admitted it it was a terror attack and it was planned. >> i am not sure what nit-picking does to serve the debate. mitt romney made the wrong point he got called out by the moderator. what he was eluding to was wrong his choice of words. >> nit-picking on details. we are talking about american lives in a consulate overseas that was over run because this president has failed to have a sound foreign policy that reinvigorates american strength. he let it out and he got called on it. >> who do you think wins on the headline on that very issue. >> mitt romney for sure. >> i think obama had it on

libya. >> thank you so much, bill and marjorie. talk to you again soon. >> time now for your 5@5:30. top five stories making news at this hour. the up preem court handing the obama campaign a victory in the critical swing state of ohio. denying the request to end early voting except for military voters the friday before the election. voters say that it would reduce voter fraud and he's the burden on election officials. 15 states also filed a brief supporting ohio arguing that it did not impact the ability to vote. the obama campaign challenged the law saying it would prevent voters from casting early ballots. polls show early voters tend to vote democratic. >> food stamps hitting an all-time high this year. enrollment in the government program hit a record in the month of july with more than 36 -- 46 million americans on food stamps.

10 years ago about 19 million people collected food stamps. currently more than 1 in 7 americans is on this program. the former driver of osama bin laden off the hook. a u.s. federal appeals court through out the conviction for supporting terrorism in a 3-0 ruling. now the court says providing material support for terrorism is not a crime under international law when he worked for al qaeda. prosecutors argued he transported weapons and helped bin laden escape following the september 11th attack. there's an arak war veteran being denied instate tuition price at a university even though she lives in that state. haley perez is her name. she says the university of north carolina told her she didn't qualify because she didn't pay state income taxes while she was serving our country in iraq. when the army transferred her to
