we appreciate it. jon: "america live" starts right now. megyn: fox news alert on three big stories that we are following. dramatic developments in the development into the attack in libya. it took the lives of three americans. i'm sorry, poor americans. plus, a major speech from governor romney and forecasters sounding the alarm is a storm barrels towards the east coast. it is a busy afternoon. welcome to "america live", i am megyn kelly. going quickly to the radar. look at this. forecasters in washington saying we don't have many modern precedents for what the store models are suggesting. hurricane sandy, which has already lashed cuba and the bahamas is on a collision course with two other weather systems in the united states. we will have updated storm and transform information for human moments. we are also waiting to hear from governor romney and the critical that a ground state of iowa. take a look at games where we are expecting the governor to take the microphones now.

what he calls his major economic address. we will keep it live as soon as the governor starts speaking. but first, this is an exclusive information about the terror attacks in libya. just coming in to fox news. after weeks of denying our ambassador and others, the attack was underway and helpless tonight. during the deadly raid, cia operatives asked to times for permission to go and help the ambassador and his staff as they were under attack. both times, the requests were denied. then, a second firefight erupted at a second location. the annex. this is hours later. and the two former navy seals would wind up dead make a third request for help.

on a final request, they were told to stand down. with backup not provided. we learned new details about those two u.s. navy seals that were killed in gaza. tyrone woods, yanked from the cia annex. even though he was told not to twice, to help save lives. glen doherty moving from tripoli would not survive. national security correspondent jennifer griffin is alive. jennifer, what can you tell us? >> let me clarify two things. first, there were three separate requests to begin starting around 9:40 p.m. from the cia annex. first, there was a team of operators who are at the compound. they requested a clear chain of command to be sent over to help when they started hearing gunfire at the consulate. they knew that the consulate was

under fire and that the ambassador needed help. they were told to stand down twice. once around 9:40 p.m. they asked an hour later. at that point, he disregarded orders and they made their way from a small reaction rescue team from the cia annex, about a mile away, at that point, it was too late. he made some heroic efforts to rescue those and they brought them back to the annex and made it back to the cia annex at 12 midnight. at that point, another request for help. military help for some sort of coverage. but no help was sent. during that time, a quick reaction that included glen doherty and other team members as they made their way from the capital, tripoli.

they landed at the airport and benghazi at about 2:00 a.m. it took about 45 minutes to make their way. they were delayed at the airport because they couldn't get libyans among the ground. a delay them and getting to the compound. they got to the compound shortly before 4:00 a.m. four separate mortars. there was a machine gun position on the roof. those who are in benghazi the night of the attack, they had laser pointers on the mortar fire team. if they had been sent in, and some were on standby, a few hours away, but they could have prevented those mortars.

they felt that held was not sent when they requested it. >> jennifer, you reported that there was a white house meeting. there was a meeting in the oval office on the same night at 5:00 p.m. eastern eastern time. the president and vice president, and secretary of defense. has the administration offered any more detail on what went on? >> i can confirm that there were two separate surveillance drones that were up about benghazi. one was sent shortly after the attack. it was shortly after the attack began. video could have been accessed at any agency across washington. i am told some sources said anybody with special clearance can call up that live video feed from their classified computers and watch in real-time what is happening from the drone of the above. those drones were in the vicinity in eastern libya, already working.

they were replaced. in real-time, about an hour and 20 minutes after the attack on the consulate again, the secretary of defense, the vice president was meeting in the oval office. megyn: as jennifer just reported, the cia requested military backup three times. three times and was denied. tyrone woods, a u.s. navy seal, was killed in a terrorist attack. he ignored the orders to stand down. he went to the consulate to try to save those in peril. he fought to the bitter end. trying to keep the attackers at bay. his body was found slumped over his machine gun. he fired to the last moment. his father wants to know who indian administration made the call not to dispatch military assets, it that might have saved his son's life. instead, tyrone woods and the other americans had to fend for themselves. charlie joins us now by phone.

charlie, what is your reaction to breaking news? >> thank you, i appreciate the introduction, and i do want to reiterate and really emphasize again that this is not about politics. if it were about politics, it would dishonor my son. this is about honesty and integrity and justice. >> you learn more about his final moments, how he was denied three times, and how he ignored the orders to stand down and he rushed to the scene to try to do his best and he did it down to the last. >> my son was an american hero. and he had the moral strength to do what was right. even if that would professionally cost him his job. even if it would cost him his

life. he was a hero who was willing to do whatever was necessary. to respond to the cries for help. if, in fact, those people from the white house were courageous and have the strength, within minutes of the first attack, -- he was not denied permission. i don't know much about weapons, but it's coming out right now. they actually had laser targets focused on the mortars and they refused to pull the trigger. to me, i'm an attorney. but to me, that is not right.

those people made the decision and who knew about this and lied about it -- they are murderers of my son. that is a very strong statement. but for their benefit, we need to stand up and they need to change the direction of their lives. i say, you know who you are. i hope years from now, you change the direction of your life. megyn: charlie, do you feel like you are getting straight answers? from the administration on this? >> this is all a pack of lies. that is one thing is the father whose son who has been killed, i do not appreciate lies. >> i'm a loving person. i love my son and i want to honor him.

him in high school. and i wanted you to show those for one reason. and that is so that people can be inspired and know that he was just a normal kid. we were an imperfect memory, but a normal family. i hope that his legacy goes on. and that we would raise a generation of american heroes. and that they would be inspired by his pictures and his life. those are strong morally and strong in every other aspect. we do not need another generation of liars who lack the moral strength. megyn: charlie, all the best you and your family. >> i really appreciate that. i really wish the best to those

we are waiting for governor romney to speak in the critical battleground state of iowa. taking a look at ames, iowa, where we are waiting to deliver a major economic speech. iowa was a blue state in 2008 with a lot of independent voters. at the same time, we are getting new research showing governor romney gaining significant ground with a critical voting bloc. just 11 days before the presidential election. look at this poll. governor romney has a 19-point lead among independent voters. this surge is happening just over the last few days. here is a breakdown for you. governor romney went from three points to an eye-opening 19 points. it could be the sharpest tilt among independents in a presidential election since 1984 with reagan's landslide win. chris stirewalt is our digital politics editor. before we get to the independence, i know you were listening to the interview with mr. charlie woods.

everyone is flabbergasted at what is happening on this program. what are your thoughts on our? >> well, the only thought you can have is that as a father, you hear that and it is heartbreaking. i think it is a heartbreaking story. the reason that is significant is because there are a lot of parents who have suffered losses of their children in iraq and afghanistan and other american heroes. in this case, it is a story that encapsulates what happened in benghazi and encapsulates everything about the people, especially the establishment that has been struggling to get a grasp on what happened. here you have in real-time, not just what the white house knew. not just that they were watching. but the calls for help to have three calls for help reviews -- it is going to lead to a lot of lead to a lot of consternation and a lot of frustration. then you think about how a

father has to go forward and carry that message. what a difficult job for him. he is certainly changing the direction of this discussion at a crucial moment in the country. megyn: mitt romney chose not to go there on the question of libya at the last debate. many believe that that was a smart move for him. the swing and independent voters. is it connected? >> i do think it is connected. certainly, the president and his way on foreign policy is attributable to this. suspect with this news, but the pleas for help and the refusals but that would worsen, i think the biggest reason that the independents are moving away from this at such a fast pace is that the president has opted to have a narrow reelection

strategy that he is focused on primarily attacking mitt romney. and the character attacks on mitt romney. but he has also focused on narrow satisfaction efforts where he has tried to find narrow slots of his own political base and appeal to them, rather than making a broader argument. remember, what independents have in common is that they think the status quo on both parties probably are not so great. and they are looking for more unifying message is. >> speaking of governor romney, we are going to listen to his remarks. we are told this is a major economic address by team romney. >> does that change the country's course. there were turning points of defining consequence. we, today, are at a turning point. national debt threatens to crush our future. our economy struggles under the weight of government and fails to create the essential growth

and appointment that we need. at the same time, emerging powers seek to shape the world. china with its model of authoritarianism in and just hottest with sharia and repression and terror for the world. this is an election of consequence. our campaign is about big things. because we happen to believe that america faces big challenges. we recognize that we have a big choice and the american people want to see big changes. together, we can bring that real change to our country. [cheers] [applause] >> four years ago, candidate obama spoke to the scale of the times. today, he shrinks from them, trying to distract our attention from the biggest issues to the smallest issues. from characters on sesame street and silly word games to

misdirected personal attacks that he knows are false. the president's campaign falls fall short of the magnitude of these times. and the presidency has fallen far short of the promises of his last campaign. four years ago, america voted for a post- partisan president. they have seen the most partisan political president, and washington is in gridlock because of this. president obama promised to bring us together. but every turn he sought to divide and demonize. he promised to cut the deficit in half. but he doubled it. how about his budget? it failed to win a single vote, even republican and democrat, in either the house or the congress. he said he would reform medicare and social security and save them from insolvency. but he shrunk from proposing any solution at all. president obama's promised the

stimulus would be created by now. in countries that have made themselves more attractive for entrepreneurs, it tries to minimize the small and shiny objects. this election matters more than that. it matters to your family. it matters to the senior needs to get an appointment with a medical specialist. people who talk about how medicare has been slashed to pay for obamacare. that is the demand from wisconsin. a gentleman from wisconsin, he used to have a job now has a job at $8 per hour. without benefits. it matters to the college student graduating this spring

with 10 to $20,000 in student debt. [cheers] [applause] >> she also learns that she will be paying $50,000 in government debt. it puts the american dream beyond the reach of so many. that is for the child in the failing school unable to go to the school of his parents choosing because the teachers union that funds the presidential campaign opposes school choice. the president's campaign slogan is this. foreword. but to 23 million americans struggling to find a good job these last four years, it feels a lot more backward. [cheers] [applause] we cannot afford four more years like the last four years. this election is about big things. like the education of our children. the value of our homes. the take-home pay from our jobs. the price of gasoline that we pay. and the choices that we have in our health care.

it is also about the big things that determine those things. like the growth of the economy. the strength of our military. our dependence on foreign oil. and america's leadership in the world. president obama frequently reminds us that he inherited a troubled economy. a troubled economy is not all that he inherited. he als inherited the greatest nation in the history of the earth. [cheers] [applause] he inherited the most productive and innovative nation in history. he inherited the largest economy in the world. and he inherited the people who have always risen to the occasion regardless of the challenges that they face. so long as they have been led by men and women who brought us together, called on our patriotism, indicted our nation with patriotism and conviction. despite all that he inherited,

president obama did not repair our economy or save medicare and social security. he did not reach across the aisle to bring us together, nor did he stand up to china's trade practices who deliver on the promises about the muslim world, where anti-american extremism is on the rise. what he inherited wasn't the only problem. what he did with what he inherited made the problem worse. [cheers] [applause] in just four short years, he borrowed its trillion dollars nearly, adding almost as much debt held by the public as all american presidents combined. he frightened of new business from hiring new employees and added an onslaught of new regulations come often to the delight of biggest banks and corporations, and the detriment

of the small growing businesses that create two thirds of our jobs. [applause] >> new business starts at 30 year low. weary from the president's staggering regulations and proposing massive tax increases. many families can't get mortgages or loans because of the doctrine regulations. the president invested taxpayer money, your money in green companies now failing, that were sometimes owned by his largest campaign contributors. he spent billions of taxpayer dollars on investments like solyndra and tesla and fisker. it only added to her dad. energy prices are up. he rejected the keystone pipeline from canada, and cut in half drilling permits and leases. even if gasoline prices soared to new highs. the problem with the obama

economy is the misguided recovery and causing millions of people to endure lengthy unemployment and poverty. [cheers] [applause] that is why 50 million more of our fellow citizens are on food stamps and president obama took office. that is why 3 million more women are now living in poverty. that is why nearly one in six americans today is stagnant. we receive the latest round of discouraging economic news. last quarter, our economy grew at 2%. after the stimulus was passed, the white house said we would be growing at 4.3%. slow economic growth means slow job growth and declining take-home pay. that is what four years of obama policies have produced. americans are ready for change.

pro-growth, for jobs, for more take-home pay. we will bring that to them. [cheers] [applause] now, we have had four presidential and vice presidential debates. there is nothing with what the president proposed were defended that has any prospect of meeting the challenges of the times. rising taxes will not grow jobs or ignite the economy. in fact, his tax plan has been calculated to destroy 700,000 jobs. a new stimulus, three years after the recession officially ended, that may spare government, but it won't emulate the private sector than it did the stimulus of four years ago. cutting $1 trillion from the military would kill jobs and devastate our national defense. this is not the time to double down and trickle-down. this is time for new bold changes to measure up to the moment and they can bring america to certainties of the future will be better than the

[cheers] [applause] >> and paul ryan and i are elected this year as president and vice president, we will endeavor with our hearts and all her energy to restore america. instead of more spending, more borrowing from china and higher taxes from washington, we will renew our faith in the power of three people, pursuing their dreams, we will start our plan for a stronger middle class that has five elements. by shrinking the bureaucracy in washington. number two, we will produce more the energy that we need to heat our homes, fill our cars, and make our economy grow. we will stop the obama war on coal. in the effort to crimp natural gas by the very technology that

encourage growth by lowering tax rates and lowering deductions and closing loopholes in making it clear from day one that unlike the current administration, we actually like business. and the jobs that business create. their kids and parents cannot be put above the interests. this economy will come roaring back. 12 million jobs will see rising take-home pay. we are finally going to see the

middle-class and it is about time. paul ryan and i are going to stop there. when we take office, we will save medicare and social security, both for current retirees and the generations to come. we will restore the $716 billion president obama has taken from medicare to pay for his obamacare. we will reform health care. the cost that has been skyrocketing to provide for those with pre-existing conditions as well.

we are going to look for common ground and we will put the interest of the american people about the economy. in business in the olympics and in my state, i brought people together to achieve real change. as you know, i was elected as the republican governor in a state that had a legislature that was 85% democrat. well, when i came into office we were looking at a multibillion dollar budget gap. instead of fighting with each other, we came together to solve the problems. we actually cut government spending. we reduced it. we lowered taxes 19 times. we defended school choice. we work to make our state business friendly. our state moved out. twenty places in job growth.

schools were ranked number one in the nation. we turn to the 3 billion-dollar budget deficit, which had turned into a rainy day fund. in history combined. criticizing obama-care. talking about the stimulus, what he believes are the green energy failures and saying a americans are ready for a change and pivoting to his point and five-point plan, talking about 12 million jobs saying he will grow this economy at 4% a year rather than the number we saw today which is 2% which governor romney termed a false recovery. we'll be joined by lou dobbs who will react to the governor and talk about another story that's getting a lot of attention today. that's the number i just mentioned. the gross domestic product numbers came out and they showed 2% growth last quarter. they had been projecting 1.8%. so it's better than they assumed it would be. during the reagan economy it was 7%. lou said there was a number

behind that 2% number and it concerns how much government spending went into that 2% number. back now to our top story. sources telling fox news during the consulate attack in libya two former navy seals and a cia operative in the area called for help repeatedly. they called three times. asking for military backup during the attack on our u.s. consulate while around ambassador was still alive, we believe. all three requests were denied. we are learning after they were told help was not coming and they should stand down, mr. woods ignored those orders and left of the ciaannex and drove to the consulate to try to personally save the ambassador. doherty came in from tripoli and he would be killed later. i spoke with tyrone woods'

father. >> it many coming out that they had laser targets focused on the mortars that were being set to kill my son and they refused to pull the trigger, they refused to send help. i'm an attorney, this may not meet the legal test of murder but to me that is not only cowardous, but those people who made the decision and lied about it ought murderers of my son. megyn: it was an emotional interview. i want to bring in chuck nash, a former navy captain and general onmci person iny. i have to start with you. you were on this program yesterday saying more could have been done. and they could have sent in this aircraft to help these guys.

now we learn the guys on the ground felt as you did and were requesting the aircraft you said could have been sent in and it was denied. >> megyn, this is still breaking news. it is absolutely shocking. first all, that three times the cia people called back so i think general petraeus and secretary clinton have to say why this help was denied. in addition when it went into the defense, the dod chain to panetta and general dempsey and ham, they have to answer. what i said yesterday and i believe it even more now, that if they would have launched f-16s they could have gone the them down within two hours. aviano is in italy. they could have gotten them down there in two hours. they didn't have to be armed. they just had to be overhead.

let me read something that the taliban said. tanks and armor are not a big deal. the planes are the killers. i can handle everything but the jet fighters. i believe two f-16s over benghazi over the safe house would have made a significant difference and that glenn doherty and tyrone woods would not have been killed. not for sure, but i believe that that presence would have had a difference. in addition i believe if tyrone woods would have been give up the go-ahead to go back over to the embassy that perhaps they could have gotten ambassador stevens out alive. i'm not happy to say that, but i'm very dissatisfied with what happened in washington, the top leadership of this country. our military and our agents and our people out there deserve better. megyn: captain nash, you have to look at this in the greater context. these guys in libya, they knew they didn't have adequate

security and they were requesting more from washington. they were requesting just to keep what they had and they were told no. the security was being reduced steadily. the british ambassador had an attempt made on his life. the brits shut down that their consulate. the red cross pulled out of libya. our ambassador in his diary was documenting his fears, he believed he was upon an al qaeda hit list. while the navy seals are begging for permission to save him, the permission was denied. how does that happen? >> that scenario i just laid out, megyn, just screams malfeasance. we spend a tremendous amount of money on our intelligence community and military. we have all the tools, we just need smart people putting those tools in place. why that embassy and that consulate were not better protected in something that we

call now. ♪ megyn: captain nash, by apologies. continue. >> i was trying to make it point it's not that we lack the tools of the trade, by you have to be willing to use them. the military as good as it is, as great as it is. the military gets tasked, they plan, and they execute the plan. if you don't give them the requirement to have something in place, an alert condition for example where you could have had an alert 30 aircraft on the deck at sigonella, or an alert 30 package out of aviano. all of those things are available. we used to have an aircraft carrier in the mediterranean now the threat has moved from

northern europe down into nagreb in africa. megyn: john mccain said we were not on alert despite the factors we talked about before the break. i want to ask you, these guys were denied to help the ambassador at the annex and like true navy seals they said screw that we are going. and they got out everyone they could who was alive and and they went back to the annex and that's where he died. several hours later after a meeting in the oval office our information is when they got back to the annex they again requested military support and again the request was denied. we are being told that request would have gone to the cia station chief in tripoli. it would have gone to langley and it may have gown into the

situation room. is that what you believe would have happened? >> absolutely. it went up into the situation room and into the oval office. let's not kid ourselves. when you lose or have an american ambassador being attacked it goes right to the president. if he doesn't get, you need a new commander-in-chief. everybody my this. it's now becoming evident that everybody knew this. because they didn't prepare in advance, that's a huge problem. they should have had a global hawk sitting over that and reapers offshore and, airborne. and the fact is they didn't even prepare which almost moves towards the criminal negligence that we didn't prepare ourselves for 9/11. we know it's so important to the radical islamists. so all these things put together is one huge error after another. our war fighters deserve much, much more and better leadership than they are getting right now.

megyn: fox news alert. a followup on our exclusive information about the terror attack on the u.s. consulate in libya. fox news confirming requests for military help were made as the attack unfold but were repeatedly denied. welcome to "america live." i'm megyn kelly. sources on the ground in benghazi tell fox news as our compound came under attack by terrorists, cia operatives at an annex asked for permission to go to the consulate to try to help our u.s. ambassador chris stevens. repeatedly they were told to stand down, at least three times. former navy seal tyrone woods and two others went anyway. they were later joined back at the annex by glenn doherty who

megyn: we have been following breaking news developments for the last couple hours on the deadly terror attack in lib what that left four americans dead. fox news learning from sources on the ground in benghazi that as the terrorists stormed our consulate two former navy seals requested permission to come to the consulate and save the life of ambassador stevens. they were told to stand down. three different times. here is what we know. tyrone woods and glenn doherty, the two former navy seals were part of a small team at the cia annex a mile from the consulate. as the consulate came under attack at 9:40 p.m. and these two heard the shots they reported the fighting to

headquarters. they were told twice to stand down. they called an hour later and requested permission and again they are told stand down. that's twice told stand down. meantime ambassador stevens is inside a room filling with smoke because the terrorists set the consulate on fire and he will ultimately dive asphyxiation. woods and doherty and two others ignore orders and head to the consulate anyway. the place on fire. they are taking fire and they call again for backup. again the request is denies. four hours later they have returned with the body of sean smith, they were unable to find ambassador stevens or his remains and they returned to the annex under heavy fire. four hours later the fire has died down and woods and doherty are found dead from mortar fire we believe that they were fighting back at annex. back in washington, d.c. at 5:00 p.m. eastern time. 90 minutes after the fighting

first began at consulate, the president, the vice president and the secretary of defense leon panetta gather for a meeting in the oval office. we are told they knew about the attack and had intelligence from the ground. let's pick up that story from andy card. welcome back to the program. now we know ... >> this is very troubling. megyn: now we know the president was having a meeting with the defense secretary at 5:00 p.m. eastern time. we are six hours behind benghazi. at 5:00 p.m. eastern time it's 1:00 a.m. benghazi time. at 1:00 a.m. the ambassador we believe was dead but the fighting was continuing at annex and doherty and woods were still alive and begging for backup that was never sent. put it in perspective. >> having worked at the white house during times of crisis i'm aghast we would have had these officials meeting in the oval office and not being counseled

to offer guidance and direction. i don't know what the conversations would have been in the oval office. but my experience tells me the national security adviser, the cia director and probably the chief of staff would have been involved in these meetings and there would have been a healthy tee bait over what to do. but you dent debate forever. you have to make decisions. when american lives are at stake and american national interests are at stake you have to act and lead. i'm troubled by this information. it also -- i'm going to complicate the challenge of trying to address why they didn't tell the american people about the nature of this attack after they knew what it was. so i think there are many troubling concerns to this latest information. and i don't think it's credible to say that the president or others were waiting to learn more about the nature of everything before they commented about it. they they knew about it almost realtime. megyn: doherty and woods wanted to get to the consulate to save the life of the ambassador they

knew was there. they were told twice not to do it. they went anyway. they weren't able to save him but they were able to get a security guard into the car and get whack to the annex. they radios, send us backup. they were denied. no backup was sent to the annex. that's where four hours later from the time they called for backup, those two were murdered. they had a gun on the person responsible for the mortar fire that would ultimately gun them. they had a gun trained on them and were asking for the special forces that could take advantage of that situation, and they were denied. now, that was after the oval office meeting. so the president was already aware, we presume. was aware of the situation there, andy. we are also told one other complicating thing. not one but two predator drones were over the area watching this and jennifer griffin reports that would have been fed back --
