according to the chairman of the house committee, she may soon be required to return to capitol hill to testify. issa believes she waived her rights yesterday when she delivered an opening statements. thanks to that monumental legal misstep she may be forced to answer questions in the coming days. but lerner is the latest in a long line of officials who have attempted to avoid accountability recently. make no path, this begins with president obama. >> let me take an irs situation first. i first learned about it the same news reports that most people learned about this. i think it was on friday. >> eric: so the buck doesn't stop at his desk. he didn't know the irs was working behind the scenes to win the reelection. what about eric holder.

his agency has been caught spying on reporters and fox news. will he take the responsibility. >> i was not the person involved with the decision. i was recused in that matter. i don't know what happened with the interaction between the a.p. and justice department. i was recused from the case. i don't have a factual basis to answer the questions because i was recused. i don't know what has happened in this matter. >> eric: just like his boss. he can't be blamed. he was kept in the dark about his own department's actions, how convenient. when playing dumb isn't enough, you have to flee the scene of the crime. that is what secretary of state hillary clinton did about answering questions about benghazi. so it's time to find out what they are so afraid of. after all, what could be so dangerous about the truth? joining me is jay seculo and

juan williams. i have to go to you juan, boy, let's start with the irs. it seems to be with the ones with the legs. you can't excuse this. president obama said he saw it on tv and found out about it? >> you wouldn't want the president of the united states playing politics in irs. i'm pleased as to whether or not his counsel should have informed him earlier, given him some warning. when you stop to thing about it, you don't want these political people telling the irs what to do, what not to do and potentially using the irs as weapon against political opponents. >> eric: when he told us he found out about it on tv. jay carney agreed with him. /@ since that day, we've learned that chief of staff knew about it. we also learned that his white house counsel knew about what

was going on at the irs. do you believe president obama had no clue? >> no. i believe in fact the white house was well informed. we know a couple of things that are important to point out from what my friend juan said. we know the white house counsel was informed by the deputy secretary of the treasury. that is the president's lawyer. the president's lawyer didn't bother to tell the president of the united states? and chief of staff and deputy chief of staff met with lerner on how to get the information about the inspector general's report before the report was releas. let me say something else. this information today, 27 of the coervative cases, in 15 of those cases, letters from lerner to my clients including the letters asking for membership lists, donor information, inappropriate inquiry came out in march and april of last year which is nine months after

lerner said she put in an end to that part of the program and she was dismissed about four hours after those letters became public. her name is on those letters that went out. she was meeting with white house counsel. >> eric: i could do a whole show on each one of scandals. department of justice looking into phone records of both the a.p. and fox and could be as many as several hundred phone linings. you can't think this is okay, this is not okay. this is an overreach? >> yeah, gosh, in the case of james rosen, the idea that he is just asking for information. they cite him for trying to persuade a source at the state department to give him information. i would be in there and i think a whole bunch of people would be in jailing. a.p. story is a little different. i think a.p. made big mistakes

and the government was trying to protect a double agent saudi agent that was embedded. i think a.p. made mistakes. i understand what was happening there. i thought that the breadthth of the subpoena, new york, capitol hill, they went too far to get information. i've yet to hear their side of the story. >> eric: they used the eggs me entangling acted to get the records. is that an overreach? >> i think a complete overreach the i agree with juan. on the rosen case, it's one thing you have a leak within the state department. go after that leak within the state department but to target the reporter. freedom of the press is one of hallmarks of liberty. the idea they have targeted james rosen with a subpoena, access to his parents' emails and phone records, this is

absurd. a.p. case is different because national security implication is there but in both cases is an overreach. >> eric: president obama delivered an hour long speech on counter terror. timing kind of stinks to me. 300 million will be in backyard probably talking about the scandals. does president obama is going chase this down a hole and not talk about it this weekend? >> i don't know what he thinks. the polls indicate that most americans aren't following it especially not the benghazi story. irs story that jay and i are getting most attention. fox poll this week had about third of americans aware that concerned about it. the key issue there is both democrats and republicans don't like abuse of irs policy because no matter which side you are on,

honesty we didn't look at the white house. we didn't question anyone as to whether or not they received any direction from the white house. >> that is the question i asked? >> that's correct. >> eric: why not ask that question? >> of course it was an audit and not an investigation. inspector general's report is incomplete and certainly damaging to the irs but the fact never asked the white house anything. his statements about what the white house did know or not know is meaningless under law. >> eric: why do you think that question wasn't asked? was the appointment by the administration that specific inspector general? >> i think what they were looking for was exactly who was in charge. who made this decision. he wasn't looking at influence. they are trying to find out

discussion of drones. >> eric: we know about drones killing an men. anwar al-awlaki was a naturalized terrorist. that happened two years ago. "new york times" ran it two years ago. we knew he wanted to close guantanamo bay four years ago. what is the timing? a big weekend is coming up. if the discussion about drones or three pending scandals? >> we have all mcdonald's farm a scandal. we're not sure which scandal to even talk about. i don't think this will work because he is putting off really the ultimate reckoning. he says 30 days we'll do this and 90 days we'll do this. the irs scandal has been out for a year. i think they know who is responsible but he is not

getting anybody. nobody is willing to be fired or removed from office. i think it's a bit of misdirection. and important questions about american citizens overseas. even that issue he be on secures. of course, they should get due process but his idea of due process is flash cards and power point presentation. so that he doesn't come clean with. >> eric: we've learned that 18 suspects in benghazi terror attack were partly surveilled by the intel people in d.c., yet president obama himself has said he has a kill list. we know the kill list if, i want to do the list somebody will get droned. >> i'm not sure. within the state department going back to the benghazi thing fourt people he said he was going to fire are still there.

we called them this week. they is all have phones at the state department. really the question is will he fall fol through with this. he is in danger of using his leadership or ability to lead the nation because people distrust whether government is being used for political purposes. >> eric: president obama when he told us about the irs scandal two fridays ago, he said he learned about it on television. since then, jay carney backed him up on that. since then, general counsel was made aware of it and more recently his own chief of staff was aware what was going on at the irs. do you believe that president obama had no idea that the irs was targeting conservative groups? >> i think the only way we can find out is follow the paper trail. we will have to do an investigation. i think we need to know was

there a written directive from washington, did it involve the white house and how far up the food chain does it go? i think we only would know that by doing an investigation. so i don't want to conjecture, but i do have a feeling that the criteria of what they were looking for, tea party, patriot, people that have criticized the president, that sounds like somebody written by a political operative. you may find a cross over from civil servant to the political aspect of president obama's world. we won't know until we do an investigation. >> eric: john gotti was known in the mafia, a lot of things came from his office but he was never pinpointed because had a group that shielded around him. do you say he needs a written directive. what if it wasn't a written directive but a directive?

>> i think whether or not there is a culture of corruption that comes from either the white house or political people within the white house saying let's get our enemies, we don't care how you do it. that is sort of something3km[ unwritten. i suspect that government z in multiple irs offices weren't just doing this on verbal order. i suspect there were more to it. i think people a worried about criminal charges because the irs agent that has been mountain middle is being suspended. i think we have to get to the bottom of this. i'm concerned and i think whether you are republican or democrat or independent. nobody wants to see that and see a government used against people just because they disagree with you politically. >> i got that release from the office that called for removal of lerner. she has been pout temporary administrative leave with pay. is that okay?

>> it is a beginning. i would have suspended her without pay. we have to watch closely because what they tend to do is they transfer people around and change their titles. with benghazi, no one was punished for the fact that for six months they begged for security and it was denied by hillary clinton and the state department. she says i know nothing, i'm in charge but that decision wasn't made by me. the same with president, i no nothing but i don't know anything about that. attorney general holder has the same opinion. i'm in charge around here but i think i recused myself from the decision. we have all these people, nobody wants to take responsibility. when they say someone was reassigned or fired, we find out they are still in their position the state department. >> eric: senator rand paul, thank you. >> new developments regarding efforts to spy on fox news, we'll tell you why they are

what the administration does. they took it steps too far. i remember during bush years, state secrets were being splashed across the front pages on counter-terrorism, interrogation, black sites. the president of the united states commander in chief, george w. bush picked up himself and called "new york times" and pegged begged them not to release the story that would gravely endangering the united states. "new york times" published anyway. you go after the leaker, did bush go after "new york times"? absolutely not. >> they had to build a case to get a judge to authorize to get phone records. they needed that information in order to build the case. >> the case against rosen or the leaker? >> to build the case against him. >> they had plenty of information.

book, between one and hundred there is not a lot of skill wise but there is intangible, heart. what i loved, for example, my favorite hockey player, i was only friends to keep my teeth believe it or not. friends to ks bobby clark, the philadelphia flyers. you were bleeding on that court. there was not going to be anything left at the end of the match. >> didn't do good to take it home with me. i brought it to leave it all out there. to be able to walk off after every match and feel that i gave it everything i had that is really the only thing i could ask for. growing up and playing against such great competition you are not going to win all the time. you have to get the feeling that even though you do lose you take something out of that and if you win you can take something out of that, also. not everybody can win all the

time. >> why not? >> i tried. i tried to avoid that at all costs. it just doesn't happen. playing against too many great athletes and too many things can happen. it is the heart and the mind from my standpoint. the number 1 to number o100 it is a small group because they all play great tennis. it is what they bring that counts. >> you loved to play mcinrow more than anybody else. >> i don't think that will ever leave. i liked playing him because he brought out the absolute best in me and was a mirror image of myself outside the game. watching him play and knowing that i had to be better than i normally could be made me feel like going out there. if i could reach that and accomplish that then the things would take another step forward.
