life to go on the record. thanks for being with us. we'll see you back here tomorrow night. tonight, new information. it is spreading, mounting evidence the irs and the fec, up to no good, colluding to target conservative groups. tonight, he will hear from the american future fund founder. only on the record. nick ryan, nice to see you. >> thank you, greta. >> before we get into the react of being investigated by the fec and the irs. what's the american future funds? >> a grass root organizations that i started in 2007. we are based in des moines, iowa. we were formed to give americans that have a conservative and free market point of view, a group to belong to and organize and air their voice. >> are you a 501 c-4. >> yes. >> how long have you been a 501 c-4? >> we were approved in october of 2008. >> you have learned recently

that your organization came up in a series of response between the fec and the irs? >> we learned that from the house ways and means committee. chairman dave camp. we found up that they turned up an e-mail that had an e-mail from an fec lawyer that went to the irs and lois learner that is a character in the irs saga that continues to come up. >> do you know why your name surfaced with the fec? >> when we started our group, the very first ad we ran was in march of 2008 and it mentioned senator norm coleman and senator amy cole bashar, both in a positive light and talked about how they worked together and worked well together. following that, the minnesota dfl, their equivalent to the democratic party, filed a complaint against us which then the irs began to investigate. >> what is your thought about this? you feel singled out and targeted? or do you think politics is a

rough business and the irs is now beginning to check you out and the fed does too? >> i think it is very unfortunate. when you saw all the other tea party groups that initially got targeted, pro life groups, very small groups. the common thread was that most were conservative. you could tell they were conservative. they were so small. i couldn't really understand why would you mass target very small groups. people focused on their own community wanting to advocate for issues in their own community. i was shocked i didn't think we were targeted, because we have grown to be fairly large. lo and behold, it does come out, we actually were targeted and we were targeted when we also were a very small start-up group. i think what that says to me, there is actually a culture within the bureaucracy of the irs that they do seek out and target conservative groups. by all accounts, it looked like they attempt to target them in their infancy when they are small. >> this was going on sort of behind your back. i take it you were not aware of what was going on? >> correct.

>> who tipped you off that the irs and the fec were talking about you? >> we wouldn't know about any of this if it wasn't for the investigation of the ways and means and oversight committee. >> is there anything wrong for the fec and irs to talk to each other? these are both government agencies. any problem with that? >> two things that are concerning. first, you had don mcgan on here, commissioner at the fec. the fec, if they are going to seek out in an investigatory way and talk to other agencies about pending investigations, they are supposed to seek approval from their commissioners. they didn't do that. the second thing is, if you look at the entire e-mail string, the last instance was in february of 2009, references conversations that took place between lois lerner and the individual at the fec. some of that was take place before we were an approved group. the question remains with lois lerner, what was she communicating with the fec about?

unless she was communicating something that wasn't publicly available, why would the fec call. she doesn't divulge anything that wasn't publicly available. >> when you first got 501 c-4 status, did you think then that you were targeted? >> no, i didn't think so. >> looking back, do you think so? >> looking back, i don't think so. where the red flag seemed to come up is in february of 2000 the. >> that's the e-mail from the fec to lois lerner at that point? >> correct. >> why do you think -- lois lerner is the common thread. is that her job or do you suspect something more sinister involved? >> i think it would be very helpful if she would testify. it doesn't appear that will happen. one thing that is true, she is

the common thread. you have what appears to be a very rogue actor within the bureaucracy of the irs that has targeted a number of different groups. until we can hear from her or get more information from the fec and the irs with this mountain of e-mails that actually do exist, that they have yet to turn over to the committees that are investigating them. >> are you satisfied you have all the information about your organization between the fec and the irs? or do you think there is more? >> i think there is more. when this entire thing started with the other small groups, i would never have thought it would have turned into this and included us. it seems every day or every week that goes by as those investigations continues, more comes out. i wouldn't be surprised with anything that comes out. >> the disturbing thing is, it is taking so long to get information. the volley of letters that go back and forth between capitol hill and the administration, it is like pulling teeth to get the information to find out what happened. >> it is very frustrating from

our perspective as a group the one thing that's left out of this entire conversation as well as a criminal investigation. if there are individuals in the irs that disclose confidential tax information, it is a criminal matter. the justice department says they are investigating it. i don't have a whole lot of confidence they are going to bring any charges in that particular case. i actually believe it should be removed from the justice department and they should appoint a special prosecutor with subpoena power and do an investigation with integrity. >> nick, thank you very much. thanks for joining us. >> thank you, greta. a former fec chairman calling the irs targeting scandal part of a long-term assault on first amendment rights. bradley smith, former chairman of the election committee joins us. good evening, sir. >> nice to be with you. >> nice to have you. >> explain to me why it is a part of a long-term assault on the first amendment, this scandal. >> for many years, people in the name of campaign finance reform have essentially tried to shut up political speech that they don't agree with. sometimes they don't agree with it because it is funded by what they call big money. more often, they just don't agree with it.

what you have here, for example, is a classic effort to put pressure on conservative groups. nobody suggested these groups are corrupting officeholders. they just don't like these groups so they put them under attack. they have harassed their donors and tied them up in legal proceedings and generally attempted to make them tough to speak out on politics. >> one of the most painful things about this whole irs scandal is not so much that the organizations were denied tax-exempt status or 501 c-4 status but that they were put into a holding pattern. while you are in a holding pattern and they keep asking for more information, you are denied the ability to even appeal an adverse decision. it would have been better off with a no, a denial, than to be put in this limbo. that's actually the more troubling aspect. they got put in this holding position and there was nothing they could do. >> that's right. it puts them in sort of a limbo.

if they are at least told no, then they can go about some other course of action to do what they want to do. what is going on here with this sort of holding action that's strange is that there is no tax benefit at all to the irs holding them up. that is to say, they don't -- tax-exempt groups, they want it to be 501 c-4s. they don't pay taxes. if they were not 501 c-4s, they would have to be qualified. 527s don't pay taxes either. 527s are regulated more heavily as political groups. they have to expose their donors. many people that have nothing to do with these ads, just their general membership list has to be made public. these people are often harassed and bullied. they fear official government retaliation and unofficial government retaliation. you don't have to get irs permission to be a c-4. the irs by harassing these groups is just making it more

likely in the future, the groups won't apply for irs status at all. they will just stop operating and then you don't know at all what they are doing. so the irs in a sense is shooting itself in the foot. why? because of a general hostility toward political activity by conservative groups and also i think by new groups and outside groups, groups that haven't been players in the field already. >> it is very difficult to prove things like discrimination. that's essentially what this is, discrimination. i suppose the most effective way would be if the irs would sort of open the door and let us have an accounting of how many liberal groups or progressive groups had this type of analysis or scrutiny compared to the number of conservative or tea party groups. that, it seems to me, would be a good start. do you agree or not? >> i do. it takes us back.

it would be really nice. everybody is talking about, is there a smoking gun, a direct trail leading back to the white house? i think that is kind of irrelevant. it would be big news if there was. the real story is creating this culture of harassment. this idea that participating in politics is somehow a bad thing, that these tea party groups were being bad. in 2010, at about the time the irs began this targeting, president obama on at least four occasions specifically suggested that these were front groups for foreign operations. david axlerod, his close consultant, made that allegation directly and so did numerous others. president obama called it a problem to democracy and then upped it to a threat to democracy. when you have your leaders putting that kind of thing out there, when you have senator baucus and senator schumer and senator merkley and senator shaheen and several other democratic senators writing to the irs saying, these groups are dangerous, you need to investigate them. what do you think the irs is going to do? they are people. they see this. they know these are powerful people saying these groups are a

threat to democracy. you need to get them. that's the real scandal. not a smoking gun. >> then, you have to take it to the next chapter. now that they have gotten caught with their pants down, now that they have been caught targeting, now, what's the explanation for the leader? what's the culture. the culture has evolved where the president says it is phoney. it is phoney for someone to feel wronged by having been unfairly scrutinized. to continue your narrative, it is now the president is saying it is phoney. it is like this is no big deal. that's the message he is sending. >> i think that's right. that adds to the idea as well. this isn't a scandal. it is one argument that some have been trying to make, that these groups deserved what they are getting. the problem is, the irs wasn't tough enough on them. this is a real problem. we should be encouraging this grassroots political participation. the tea party is not grassroots.

it is a spontaneous organic movement. we should be encouraging it, not saying this is a bad thing. the president and various senators should not be out there saying these people are a threat to or democracy, investigate them, check them, harass them, slow them up. >> i just wish some members of the media would talk to the tea party members and find out a lot of their teachers, their shop keepers, they're airline pilots, a little bit of everything. they have been demonized considerably, this grassroots organization. this is stunning. i don't think the media has spoken to them. i'm going to take the last word on that. thank you, sir. >> thank you, greta. time for tonight's hot button issue. do you think people at the fec and irs are colluding or is it just interagency communication? go to greta.com and vote in our poll. the continuing resolution set to expire, the obama care deadline approaching. sound like a good time for washington to go on vacation?

>> reporter: members of congress are already on their five-week recess and the president heads for martha's vineyard this weekend. do the american people think that either of them deserve that vacation. >> no. he's been on vacation his whole tenure. >> i don't believe anybody has worked hard enough to take vacations. >> you work hard enough and you get your own money, you get your own vacation. i would say he needs to work a little bit harder and deserve to get his vacation. >> if he spends his own money on his own vacation, it would be better. >> i think everybody deserves to go on vacation but it seems like he is always on vacation. >> should congress be gone from washington for the next five weeks? >> absolutely not. they do not deserve a vacation at all, nope. >> how about you? >> when you think about it, we are probably better off. the more days they are not working, the better off we are. >> i think they maybe should have a week break but five weeks at a time is a lot. >> whether they are on vacation or not, i don't think they get time away from their jobs even

if it is a five-week recess. i suspect much of the work of congress is done while they are on recess. >> i would like a five-week vacation. we get a week or two. >> do they deserve a five-week break right now? >> we know absolutely not. there is so much that needs to be done. it is unfinished. we are so behind. it is unfortunate enough that this is the same-old, same-old. i am here in washington to see maybe the last of what this country is going to look like. prosperity. there are still people traveling. in the near future, things are going to be entirely different with obama care coming into play. the finances just aren't going to allow people to have vacation. >> five weeks off, great if you can get it. congress has given themselves this giant five-week break and president obama is taking a vacation as well. the tea party, they are not taking a break.

one tea party leader saying, they are working harder than ever. executive director, larry nordvig joins us. nice to have you back. >> thanks for having me back. >> a few thoughts about the vacation going on here in the city. some members of congress will say they are talking to constituents. nonetheless, there is a lot. if you are going to prioritize your job, there are a lot of important things that are being left undone. do you have a thought about it? >> yes, i do. this is kind of a good news bad news situation with congress on vacation and the president vacationing. the president seems like he is always on vacation. his approval rating is down to 40, 42%. congress is in single digit approval rating. on the one hand, they are not around which means they are not going to damage the country any further in the next five weeks which is good. the bad news is, there are a lot of important issues and many have time limits. amnesty is slipping through the hour glass. that problem gets worse every day. obama care, october 1st, is kind of a gate that we need to do something before the exchanges

begin to open. we need to get to work on these issues and restore this country back to what it should be. >> what is your group doing, your tea party group doing? are you just sort of sitting on the sidelines this five weeks frustrated? are you writing letters or organizing? are you doing anything? >> this city is at a dead stall. i am curious what you are doing. >> it is a great time to vacation up to d.c. that's no what our plan is. i can speak for the richmond tea party. we are working extremely hard. i am doing about 18-hour days. i just came over. i couldn't be in studio in d.c., because i had a two-hour meeting with our board and i came straight from there to this program. he with have a lot of things lined up during the august recess. we would like to speak to our congressman. there are many things we have planned to do and we are definitely not on vacation. we are working extremely hard right now. >> are you networking with other

tea party groups across the country or is yours just localized to richmond? >> no, we are. the events we have coming up within the next week, we are working with a tea party group from maryland. we are working with the national tea party patriots this next week and three other conservative organizations. we are coalition building with other tea party groups here in virginia. the following week, we are with another conservative group to try to oppose obama care, which is a train wreck no american wants. believe me. we are going to touch on the amnesty issue and set up a town hall and include every tea party in congressman cantor's district to come to that. right now, he has not communicated that he is going to have a town hall. if he doesn't want to come, we might have one with an empty chair anyway. >> larry, give us a handful. you don't have to name them. give me five or six people in

your tea party group, occupations and backgrounds are? >> tea party groups, our own board, we have two women, three men on the board. one gentleman is black. he is the head of our very active minority outreach. the jobs description. we have one county supervisor that's in government. we have two people that work for an organization. one is in i.t. we have one semi retired bids man. i'm an airline pilot. it is everything under the sun. we are average americans, very patriotic, passionate and force pull full. we want this country to return to constitution and limited government and some fiscal sanity and we want to hold our representatives accountable. we are not going to stop doing the work until we see that come to fruition. >> larry, thanks for joining us. >> thanks for having me, greta. >> we know who he is and where he is. so why isn't the militia commander charged in the benghazi attack under arrest.

the u.s. government knows who he is, where he is. why hasn't the libyan militia commander charged in the benghazi attack been arrested. we are not the only ones who want to know. senator kelly ayotte tweeting, why is this guy roaming free?

senator ayotte joins us. nice to see you. >> nice to see you greta. >> why isn't this guy in custody if he has been charged? >> i have no idea. right before we left for august to come home, we wrote the new fbi director and said, give us an update on this investigation. subsequently, we learned that abu khattala, part of an islamist group in eastern libya has been charged. he is giving interviews to the media. he has claimed that neither the libyan or american authorities have spoken to him. if we have charged him, why is he roaming loose in libya. apparently, we know where he is, because the media like cnn have been able to interview him. yet, we have not taken him into custody. i don't understand it. he should be interrogated obviously. the others that have been charged, alleged to have been charged recently should be

interrogated so we can get to the bottom of this. >> fox also spoke to him. i think fox spoke to him many months ago, last fall and reuters spoke to him on october 18th, a little over a month. everyone has been talking to this guy. so i tend to be a little bit of a hothead. i don't understand. you are in the senate so you are not in the majority. the house should be back in session and issue a subpoena to the fbi director, haul him up there and get the answer and get it immediately. the way these things drag on is like insane. >> greta, i have to agree with you. in the sense that we have not also heard from the people that were actually there on the ground at the attack, the survivors. yet, as far as i know, i know that the house has been doing -- trying to investigate this very thoroughly, chairman issa. i don't think we have heard from the survivors. that's very important.

in terms of public safety, here we have people that are charged with a terrorist attack, where an ambassador and three americans have been murdered. he is roaming around libya. we haven't picked him up. the libyan authorities haven't picked him up. why isn't he being interrogated or in custody? if it is important enough to charge him. and we allege that he's been involved. the charges haven't been made public yet. why is he not in custody? it doesn't make any sense. >> you are a former a.g. in new hampshire. i have been in the criminal justice system on the other side of the aisle. their are mechanisms to make this happen if you really want to. whether it is subpoenas to get people to testify or getting diplomatic permission to go over and pick somebody up like libya. god knows we have given them enough money. they're going to let us do something, i would hope. there is a reason somebody just doesn't give a damn, because

this could happen. it is not that difficult. >> i agree with you, greta. you think about it. why haven't we asked the libyan authorities to pick him up, demanded, frankly, with all the assistance we have given them. let's not forget, the libyan president came out right after this and basically said before we even did that he thought that this was an act of, terrorist act and the act of militias. we need to make sure this guy is taken into custody. all the others that are included in this secret indictment should be taken into custody. if we can't make that happen in libya, how are we going to make that happen in other areas of the world. we should have a lot of leverage given what we did in overthrowing gadhafi. >> one of the first pieces of chatter is that ansar al sharar. this guy is the leader of the libyan militia faction.

something is just not right. if we knew it then and if fox could talk to him last fall, reuters could talk to him, cnn can and we have him charged, something is really wrong with this. >> something is really wrong. think about it. ansar al shara claimed responsibility after the terrorist attack. so this is a key group in all of this. he, himself, has admitted to being at the consulate but claiming that he only came to help libyans that were in distress. that explanation doesn't make any sense. it is something he said to the new york times as well. he has given so many interviews at this point. according to him, the libyan authorities nor the fbi have interviewed him. it just doesn't add up with our background in criminal justice, greta. this isn't a situation where he already has been tipped off he has been charged. yet, we still haven't picked him up. >> senator, we have so much video from the consulate. the cia does.

corey. who is spending time and money on nonmandated obama care implementation. just a short time ago, they debated his proposal. supervisor, brad hopp joins us. >> nice to see you. >> you too. thanks for having me. >> what happened with your proposal? >> we debated for a little over two hours. at the end of the debate, the committee did forward on a proposal to the full county board. in essence, a portion of what i'm trying to accomplish went through. we've decided we will not partake in any navigator functions for the affordable care act. we will not partake in any propagandizing or advertising and actively going out and seeking out people to sign up and things like that. >> were you expected to? had the federal government contacted you and said, we want you to do this?

>> that's what started this whole thing. back in june, the american library association had their national convention in chicago. at that time, president obama made a pitch to them via video conference and asked them in essence to go forth and spread his message for him in regards to the affordable care act. now, members of the american library association that worked for our public library came back and had every intention to kind of start doing some of those things. that's what got the ball rolling for this communication. >> are you doing this because you are opposed to obama care or are you doing this because the county doesn't have the extra money to be doing that and if they have the extra money, you might want them to do something else. >> absolutely. both reasons. i am an opponent of own kr. care. i don't agree with it one bit. there is not a whole lot we can do at the local level as our local representatives. when we have the opportunity and it presents itself, for us to take action and protect our

taxpayers in regards to the affordable care act, we need to take that opportunity. this was one of those instances when we could step up and say, we are not going to spend local money doing a job that the federal government should be doing themselves. >> i assume you know your board pretty well. what do you expect happens when the whole board meets? >> i can be in politics long enough that anything can happen. i believe the proposal put forth tonight and forwarded on to the full board will hear debate. i believe our board will go ahead with what the action of the committee was tonight and approve it. >> supervisor, thank you very much for joining us, specially from green bay. >> thank you. >> more news tonight about obama care. under obama care, your family may be in danger of losing insurance coverage. why are some businesses now considering dropping health care for dependents of employees? anthony mongoluzo is the president of pro computer service. >> good evening, sir.

>> first of all, give me a little bit of an idea of how big your company is. how many employees do you have? . >> we are right on the air. >> what i'm hearing from a couple small business owners, those who provide health care to employees, they may curtail it to enter families. is that something you have thought about or are considering? >> it is something we have to consider. an average family plan is about $1500 a month. if you are looking at a 20% or 30% increase, times that by 40 families, that's quite a hit for any small business to take, even one doing well, such as ours. >> is that why you expect the insurance price is going to go up 20%, 30%? >> that's what i'm budgeting

for. i have heard some other colleagues tell me in the community that already did their renewals that they went up north of 20%. typically, the last two years, 7% to 11%. it will be a nice little hike. >> so the difference if it is 7% to 9%, you are talking about anywhere from a 10% to 20% increase, is that right? >> absolutely. >> my math. >> your math is dead on. >> so tell me, what are your employees saying? >> do they know about this? >> we're all taking a very active team approach to it. no one wants to hear the truth. do we cut family plans? do we raise prices? do we potentially lose customers over that? it is a lot of choices for a small business. you have enough outside challenges, let alone health care, one of the biggest ticket items in our payroll. >> staying at under the 50 mark and 41 employees, how does that have an impact? >> realistically, my job is to service my clients.

i can't worry about playing games to stay under the 50 mark. that would give me leverage, because, at that point, i would not have to provide benefits. look at the other side, who is going to want to work for a company that doesn't provide health care and care about their employees? it is something we have done from day one. we've just got to go forward. any good business owner is going to continue to find ways to be successful? >> have you been opposed? are you opposed to obama care? i should ask you that. there may be portions that you like. are you opposed to it? >> i'm not for it or against it right now. i am trying to do what a lot of people aren't doing. i am trying to wait and see what happens. i will be opposed to anything that causes our benefits to increase 20%. we'll know when our renewal comes up in november. >> at that time, of course, you figure out expansion and everything else. other businesses saying about the same thing that you are, a wait and see to see what the impact is? >> one thing that's really interesting. i am the president of the entrepreneurs forum in

nice to see you, henry. >> nice seeing you, greta. >> henry, what happened? >> what do you know about this woman and when was she last seen? >> she was last seen, greta, sunday evening. she had told her daughters she had agreed to go to a drugstore to get something for her daughter, half an hour later when she was expected back, she did not show up. she has not been seen since. hours ago, sources confirmed to me that a registered sex offender who has dated this woman in the past, sandra coke, is in custody on a parole violation. they are questioning him in connection with her disappearance. >> he knew her or she knew him from about 20 years ago when they dated apparently. but, also, there was some discussion about a missing dog. how does that factor into this? >> back in may, greta, someone broke into sandra coke's house and stole her dog, 9-year-old jenny, a cocker spaniel mix. in the months afterwards, for weeks and many, many days, sandra would put up fliers with the dog's picture, promises of a $1,000 reward. she would get a lot of tips that

would turn out to be false. some people would say, we have your dog or know where your dog is. at one point, she did pay $1,000 or some amount of money to get the dog but the dog never materialized. for the past week, some of her friends are wondering whether someone with evil intent, in fact, led sandra to believe that they had her dog. now, this is a completely new direction with a former boyfriend being focused on in this case. >> the home where the boyfriend, the parole violator lives, is that anywhere close to where she lives? i know her car was found. was her car found in between the two? >> what is interesting is that the ex-boyfriend has been in and out of jail for a while. the car, the location where sandra coke's car was found is in an area known for drug activity. whether these two recently connected.

she may have been trying to help him regain his footing. these two may have reconnected. if he, in fact, knew about where she lived and her whereabouts and, if, in fact, he had anything to do with her disappearance, that is a very unfortunate update, indeed. >> what about a cell phone? >> two of her cell phones were found on the street. one in oakland. another in richmond. it is possible that someone may have tossed one of her phones from the freeway overpass. the fact that she still has not been found despite these different pieces of evidence is very, very concerning to her friends and family. they have now put out a $100,000 reward and they are insisting that anyone with information, including this suspect, this potential person of interest, come forward and please let police know where sandra might be. henry, thank you. it has been a long time. haven't seen you in a long time. nice to see you, henry. >> good seeing you greta.
