understanding that father joe jackson and the brothers are insisting that he be buried at neverland, a place that he hated it after the police raid of child molestation charges. we don't know where the body is. it's in a secure area under lock and key. why? what can you tell me about the underground tunnels at the staples center arena and who is trying to stop the burial of michael jackson's remains at neverland? >> nancy, there are a bunch of reports out there about how the body could have been taken out without a trail of media around it. it was built with numerous underground tunnels, across to the nokia and to hotels so the

theory is that it went out with these tunnels looking like any kind of an agreement truck and maybe the media didn't notice it. >> so for all we know, his body was not in the casket but was at that moment being smuggled through the kitchen of the hilton hotel? >> or another theory out there is that the body never left forest lawn. this could have been an empty casket and the body stayed at forest lawn. we just don't know right now which of these theories is

jackson's family is worried that he had a drug problem and they even attempted an intervention two years ago. it apparently started with janet. she visited his vegas home in early 2007 and was shocked when she said that the house had almost no furniture, looked a bit creepy, and michael appeared disheveled at that time. she asked her brothers to go to michael's house with her to try to convince her to get him help but michael reportedly ordered

security not to let them in. >> ian, specifically with where the body is going to be buried, there are a lot of legal hurdles that you have to go through. there are statutes against that. it's not getting rid of a dead body. we're starting a cemetery in the backyard. now, i understand father joe eight brothers are behind this. >> yeah, absolutely. and what was said earlier was correct, what you said, nancy. michael did not want to be buried there. after he left, he planned never to go back. he felt violated after the home was raided by the police during the second child molestation case. he only stayed because it was close to the trial and the day that he was set free, he left. he never went back. he never wanted anything more to do with it? >> to make a modern day graceland, is that what they

want, like elvis' home? >> absolutely. because they want to make money. this is the best way that they can pay down that debt. it would be a constant revenue stream for both the family and the children. >> can't you just imagine all of the tourists abroad flooding neverland to pay respects to jackson's grave? it's all about making money. bethany marshal, will it ever end, making money off of michael jackson's dead body? >> money has such a strange role in michael jackson's life because so many people wanted to make money off of him and, in this case, by building up a graceland of sorts for him. but also michael jackson dangled money in front of people and used it in different ways to bring people to him who supplied things that were very dangerous for them. >> to a jackson family confidant and former family attorney, the

host of klaa news radio, thank you for being with us. brian, what can you tell me about an alleged intervention attempt by janet jackson to save his life, an attempt that clearly failed? >> all of the family members were very concerned about michael and they expressed their conce concern. as to their attempts, they kept that very private and i know that they made a great effort to try and take care of what they thought was an important aspect of their life. they just always were there to say that they were going to help and they kept their private business to themselves. >> to natisha lance, our producer there on the scene, what can you tell me about janet jackson trying to stage the intervention to try and save jackson's life and him refusing, having a fleet of bodyguards turning them away from the front door and even not taking his 79-year-old mother's telephone calls? >> you're absolutely right,

nancy. this is february 2007. after a visit with michael jackson, janet became very concerned about his health. she wanted to stage this intervention and tried to get the help of her brothers to get on board with it. there our rumors about this intervention that was going to happen and the jackson family ended up releasing the statements to "people" magazine and certain family members signed the statement but janet jackson's name was not included in that statement. >> thank you for being with us, a former jackson rabbi and author. rabbi, thank you for being with us. were you familiar with jackson's drug use? >> we're not children here. the whole world was familiar. anyone who saw him in the 2005 trial saw that he was out to lunch.

seattle and from new york. we understand that tonight five doctors have been identified under suspicion of giving michael jackson, enabling an addict, who happens to a music icon. what are the possible charges against him? >> they could be looking at manslaughter i or manslaughter 2. based on now r knowing that he's an addict or especially with the anesthesia, using that to help him sleep on its face would be enough for a manslaughter. but we've heard from the police chief right now, william bratton, that there's not a certainty of charges yet. >> i've heard from the police chief, bratton, he says that he doesn't know one way or the other. >> right. >> but can you imagine the scene of anesthesiologist in a mobile

i.v. unit and in a van and he's got to stay hooked up to this all night to sleep. >> they could be charged with narcotics dealing which is of course outside the medical practice.

it's a mystery. michael jackson's sudden death at age 50. the singer's arms riddled with marks and veins had collapsed, found in people who use i.v. drugs. >> our source cautioned investigators cannot say whether a diprivan iv mark caused the marks on jackson's arms. >> it can be pumped through an i.v. line like this or you can regulate it with your hand like

that's not unusual for a drug addict. but, brad, my question, to use this drug as if you're in the o.r., that means the doctor has got to be there the whole time you're hooked in and we know the personal chef that we just saw said that he sees oxygen tanks coming in and out and that a doctor would come at night and leave in the morning. in fact, he's quoted assaying he thought jackson was having an affair with a male doctor. the doctor would come at night and leave in the morning. >> it's like pealing the bark off the trees. as we here reports about them trying to step in, they did a few things that could have been better. one, showing up in mass and not taking no for an answer. an intervention is a conversation starter.

and, two, this is really important and i think a lot of people can relate to this. if the kids are involved like in this case they are, you step in and you get the kids out of the situation and oftentimes that will be the thing that will help break through the denial of addiction. >> but it's just amazing to me that a doctor -- can you just imagine -- can you conjure up the image of a doctor there in a mobile unit in a van shooting jackson up and keeping the catheter in the arm overnight? >> i wouldn't. and if you were to step outside the studio here of cnn and walk two blocks, we could get these other blocks of cnn here. >> how? i've never in all my years of prosecuting drug use, drug trafficking, i've never heard of a diprivan addict, ever. >> well, i think if you can equate a drug dealer with a doctor that is misprescribing, you've got a pretty good

correlation there opiate users. >> overnight like this? >> no, i've never seen that. >> so few block ace way from cnn? >> no, but i'm sure we could get diprivan. >> how does a doctor get to it? >> you may have to get a d.a. license. it's not a common drug. you really have to get a license to prescribe than kind of drug. >> let's listen to one of the doctors allegedly named as one of the five under suspicion by the l.a. coroner's. here's jackson's dermatologist, allegedly, the biological father of the children. this is dr. arnold klein. take a listen. >> there was a report that you were the biological father of the children. >> all i can tell you is that to

my knowledge i am not the father of these children. i am telling you that if push comes to shove, i can't say anything about it but to the best of my knowledge, i am not the father of these children. >> i went to a sperm bank once but i don't think i can -- to the best of my knowledge i am not the father. this discussion, whatever, is between michael's children this person. he's not to be discussed over national television. >> what's he doing giving sperm to a sperm bank? all along, that dr. arnold klein, a long-time friend of jackson. he said no, no, no, i'm not the dad, to my knowledge. the whole time he's looking away from the camera, can't look at the interviewer and then he said, yeah, there was that time that i donated sperm. okay. alexis martin, a family

attorney, state attorney, thatth sounds like he's screaming, yes, i'm probably the father. >>. >> he very well could be saying that he probably got paid for it and like you say, he doesn't want to discuss it in the media. that would be something that he would discuss with the children at some point possibly. >> would that have any effect on the state if we find out who the dad is? >> no effect. >> no. >> no effect. out to dr. bethany marshal, did you observe his demeanor when he was saying no, no, no, to my knowledge i am not the -- wouldn't you know if you were the dad and suddenly do an about face and say, well, there was that time that i donated sperm. >> i think what is happening, if he wants to inject himself into the notoriety of the case, he wants the public to know that indeed he's possibly the dad.

but as alexis just said, he's under a confidentiality agreement. i think something about addiction that is important to clear up, michael jackson was not addicted to diprivan. i think he was addicted to open pea eighties and he took so many of those that he was having withdrawal effects, insomnia and agitation. and that the doctor instead of medicating the rebound anxiety and intomorrow yeah gave him diprivan to cover it autopsy and that's malpractice and it's agreej gous. >> back to rabbi shmuley, were you familiar with any of these doctors prescribing all of these medications or obtaining them for michael jackson? >> well, nancy, when i was with michael, what we were trying to do is rehabilitate his life. this is a man that had no purpose to live. it was the children that kept him alive.

michael could not celeb prettiness to a higher cause. it was a prison for him. we went to a university to give a lecture and michael came with a cast and he has a broken foot suddenly and he always had some ailment, some bodily ailment. some people will famously remember that he was bitten by a spider and that would mean that a doctor had to accompany him. that was always aud because we would be wondering, where are these doctors? where do they practice? they never gave good answers. and i used to say to michael, you know this is a poison, don't you? you know that it's going to kill you? and he knew after he second questions tered himself, he was light-headed and whoozie, after dinner michael decides to stand during dinner. i said, why are you standing? and said, i took your advice and i decided not to have the medication because it's bad for me. he always knew it was bad.

there are two michael jacksons, the outpouring love that you see, he was shy and he could be forthcoming and gentle and even exhibit an ability of spirit. then there was the king of pop and he was immune to any kind of criticism. and if you did try to intervene at all, he did shut you out. he loved his mother and called her a st. but he would not take her calls either and i'm certain that's true. when you tried to separate him from what he needed to live, he would try and separate himself from you. as we go to break, a very special happy 80th birthday to mrs. grace bryant from all of your loved ones. plz bryant, happy birthday.

drew to his article about jackson's death and the events leading up to it comes out tomorrow. debbie rowe, she's making a hour nl, horrible impression and how will she convince a court otherwise after all of her statements in the past about not wanting the children? >> it's going to be tough and what is going to be even tougher is what we saw at the memorial the other day. the kids are very clearly comfortable and very happy within the jackson family despite their criticism. so it's going to be a lot to convince a judge that we should pull them out of this family atmosphere, that they are very comfortable and happy in and that they seem very much in love with the other family members, particularly janet jackson and katherine jackson and then to go to this other strange woman's home that they don't even know is their mother, we have reported to you in the past that they only think of her as a friend. >> we know that dr. around nald

klein might be under suspicion by the coroners. who is the other? >> sources confirm that dr. klein is on that list and well as dr. conrad murray, the doctor that was with him when he collapsed. >> did he stay in the home and stay overnight quite the often? >> staff errors say that they were there five days a week. >> by the way, they were not lovers. so what was he doing there? >> apparently the concert promoters wanted to make sure that there was a physician there. i think it was part of the london tour, he was going to do 50 shows. that's such an intense schedule. >> you just said 24 hours a day. why come overnight and leave in the morning? >> wait a minute. he was going to be there around the clock. >> he would come at night and

leave in the morning but i'm impressed by your logic that it was part of the insurance, because that was part of the whole plan, was to keep him fit. somebody was shooting him up. somebody had to be there and attend him with oxygen, which we know was there, and he was only there overnight. >> yeah. >> so it looks bad. >> and he's not the only doctor, dr. murray. there are a number of physicians that attended to michael jackson all the time over and over again. >> you're right. >> and people made a great point. if you wouldn't give them what he wanted, he would just move on to the next one. >> steve, the homicide unit is investigating this. it is just not about only the probate matters. homicide is investigating. what does that say to you? >> nancy, i think that you are going to see a number of charges come out of this. diprivan is a very difficult medication to get and i think we'll be looking at a diversionary investigation where doctors were taking this, for example, they took it out and

they were going to use it on a victim that died. you're going to find that this medication was then diverted elsewhere for illegitimate purposes. >> i haven't heard that explained because to me that makes it much more serious, steve carney, and it already is. quickly shifting gears, a little girl taken on the lamb by her mom and a sex offender out of lockdown is not headed to the loving arms of her grandmother but to foster care? >> reporter: little haylee donathan was found with her sex offender mother boyfriend and her mother. >> they have turned up surveillance photos that show the missing girl. >> both of the women that work here at this wal-mart say that candace came into the store by herself. >> the mom is in the walmart so that means she leaves the 4-year-old baby girl alone?

this is senseless. straight out to the news director with wmaram. michael, i get why the little girl is not going with the mom because she's facing felony charges but why not the grandmother? >> right now, nancy, we can tell you that there will be a jurisdictional county that will send haylee back to ohio. they already have a foster home set up for her here and they have a visitation schedule set up for haylee's grandmother. as for the reasons why, we can only look at the situation that surrounds this and speculate. >> why? >> if you're specifically asking why she is continuing to be in foster care? >> why isn't she coming home to

the grandmother? >> i don't know what's taking so long to get her from san diego home. i know that there are some children service investigations going on and grandmother had certainly hopes haylee comes home soon. there is some bureaucracy going on. >> hold on. that's not my question. she's not going to the grandmother. she's going to foster care. >> that's correct. children's services took emergency custody based on the unknowns in the situation. what's happening is mrs. watson agreed to cooperate with children's services for a short period so we can get haylee back to ohio and so the juvenile court can determine what's in her best interests. >> explain to me why she's not going to the grandmother. >> what's interesting is she got emergency custody when haylee was taken by the mom and the sex offender boyfriend. cps has done an investigation at the house and unfortunately they revealed that they don't think it's a safe environment. they want haylee with a foster family.

>> ms. watson, what got into her to romance a convicted sex offender from behind bars? i mean, she knew he was in prison for a sex offense with a minor. >> no, she did not know. >> well, didn't she meet him behind bars? >> no. as far as i know she did not. he has manipulated her.

it's been a long journey, almost a month, you know, just every day. we're not losing hope but at the same time it definitely is scary. i'm just excited to hold her. >> straight back to matt. i'm still not getting the clear picture as to why the blood grandmother is not getting custody. now, the attorney is just saying, well, there's a slowdown in moving her back to ohio. no. she's not going to grandma. she's going into foster care. >> what's interesting is that mary watson a couple weeks ago told us that the mother candace

watson did not know that robbi potter was a sex offender. apparently when cops arrested her candace potter admitted she did know he was a sex offender, did know he was violating probation, dia probation, did know she was helping him escape and agreed to do it. the authorities want to make sure this child is going to be released into a safe environment. >> got it. >> given the fact that she has two children that are right now both alleged criminals it certainly is under scrutiny. >> you're right. the daughter helped the sex offender bust out and the son is a sex offender. doug, what do you make of that? >> i mean, to explain the difference between your analysis and what the lawyer said, i think there may be another court hearing in which they'll am go in front of the judge and social services will say look. we still have this under investigation and want her in our custody and then the lawyer for the grandmother may take the opposite position.
