anyway. kind of left that one open. what is going on here? why would he think he could have a say in the kids' lives? 1-877-tell-hln is the number. joining us to talk about it, russell wettenson, legal analyst and he was in the courtroom also with us jennifer smetders an attorney who specializes in family law and stacy kaiser psychotherapist. call in 1-877-tell-hln. all right, russell. we get the curveball, huh? lawyers for dr. klein show up. what happened here? >> yeah, this was definitely a bit of a curveball. there's been a lot of speculation about this for quite awhile. mark vincent kaplan hon represented kevin federline showed up to court and tells the judge that his client wants some role in the kids' lives. the reasoning he says is that he had a long-standing commitment to michael jackson as michael's request. the judge quickly chimed in and said what is your standing, and his lawyer said, he is not the

presumed parent and then asked for a sidebar. so this was definitely a bit of a dramatic moment. and the judge after the sidebar came back and said, listen, you don't have standing in this action. you may have to proceed in another way but today, you are not supposed to be here asking for this kind of action. >> so his claim in court is a commitment to michael jackson? is that what you're saying? >> that's right. he said he had a long-standing commitment to michael jackson. >> all right. jennifer, have you ever seen or heard of anything like this, someone who is a dermatologist doesn't know the kids from adam that we know of anyway wants in. what do you make of this? >> this is getting crazier and crazier every week it seems. for the judge to discern that he is not the presumed father, that means that he was not the father at the time the children were born. so he's not -- he wasn't married. he wasn't -- in order to be the presumed father you have to be

married at the time the children are born but this raises an interesting question. he states that he doesn't believe he's the father but in order for him to show up there and asking for a choice in education and medical, those are rights that normally go to a parent in a joint parenting agreement. so it's very suspect here. i think this doctor is more involved just his commitment to michael jackson. i think he truly thinks he may be the father of those children. >> let's, russ, you want in real quick? >> sure, i mean, that seems to be the only explanation here. i mean, if he's just a concerned friend, it doesn't make any sense. it's a hard legal battle for him to make. >> you concur with jennifer. listen to what he said, dr. klein was asked by larry king on "larry king live" within the month, flat out, larry asked him, are you the biological father of the kid and he hemmed and hawed his way around the answer. let's give that a lis. >> and that's not answering the question. >> no, because i'm not going to answer it the way you want to

answer it. >> you can say no. >> i can say no then. i'll say no if that's what you want to hear. >> i want to hear what you know. >> to the best of my knowledge i'm not the father. this discussion, however, is between michael, his children and this person. it's not to be discussed who the father is over national television. >> lets me add this, this is a quote to diane sawyer saying all i can tell you is to the best of my knowledge i'm not the father of these children but i'm telling you if push comes to shove, i can't say anything. stacy, what do you see in here? is this a guy being vague to draw attention or is he flatout being evasive or both. >> i think it's both. i think we're going to see a lot of people want to step up and get involved with the kids. there's a gold mine there a lot of drama and controversy and media attention. look, he's having it right now. >> in the midst of that interview, a fact i missed he admitted to larry he donated sperm to a sperm bank in the past. so he's capable of doing it.

he has no qualms about it. russell, you see this guy mounting some kind of legal battle to get in the kids' lives or by the judge saying you have no standing, it's done and klein's out? >> i don't know that it's done because he had the nerve to show up and say i want in this. you have to believe he's willing to take further steps. if he is going to take further steps this judge said this probate hearing is not the place to do it. it may be that this is something he'd have to raise in terms of a paternity suit in family court. i don't know that he has much legal ground to stand on but that would be the route he would have to follow. >> jennifer, you specialize in family law. how easy for a client to say i want a paternity suit here, let's go, or a test i guess. >> he needs to file a suit in order to find out whether or not there is a father and child relationship. the court would then order a paternity test. and then based upon that test,

then he could start to claim rights and have standing, but that's a little bit further down the road. for them to come into court today and want to evoke some sort of standing without even having the father/child relationship defined, he hasn't signed a vol untarily acknowledgement of paternity. he's been very evase i be over the question. i think i'm being evasive over the question kind of highlights that he knows more than he's alluding to and we're going to see more of this man. i don't think it's -- it's not a closed case. what this reminds me of is anna nicole smith. how many fathers of those children potential fathers came up. where the money goes. >> zsa zsa gabor's husband. remember that guy. >> where the money goes, so do the possible fathers. >> we'll hit on more developments in this story. we'll take your phone calls. 1-877-tell-hln. still going to hash out the final final on the custody of the kids. katherine jackson gets custody. any nuances to that?

welcome back to "prime news" on hln. continuing our conversation. a huge development in the michael jackson case today. let's go to the phones. tracey joining us from alberta, canada. tracey, your comment or question here? >> caller: i really don't think katherine jackson was maybe the right choice. with her age, who's to say in a few years those kids won't have to go through this again as well as the fact she had to have known michael was under the influence most of the time he was with those children.

>> russell, help clarify because i think people wonder, katherine and we hope and pray she has a long life but she is 79. at today's hearing was anything talked about if she can't take care of the kids who, does? >> no it, that wasn't addressed at today's hearing. there were no objections to katherine jackson taking over as the guardian of these kids. even dr. klein's lawyer didn't on the to that. he said he wanted to be inserted in some way. as of now, there's been no discussion. we talked about that on the show before. i hope the parties are starting to discuss what will happen to those kids in the future because it is very possible these kids will see the death of another guardian during their childhood. >> yeah. let's clarify one thing again. the custody deal had been worked out between katherine jackson, debbie rowe, their attorneys. anything added to that or was that basically rubber stamped today? >> that was rubber stamped today and pretty much what everyone predicted would happen. >> let's move to the estate. that is a battleground.

clarify for everybody, katherine jackson claimed the current executors lawyer john branca, john mcclain, keeping her in the dark about things. basically, she needs to know more. are they fit and able to administer and make decisions for michael jackson's estate? russell, any headway on that? >> there was a lot of discussion during today's court hearing and the judge said he wanted to encourage a free flow of information and encouraging that all along. today he kept stressing that phrase. so today would make a lot of headway because they're going to continue the hearing on the probate issues regarding who has permanent control of the estate till monday. between now and then, we can expect fights whether depositions will be taken and documents exchanged. >> jennifer, how much can katherine jackson be contest that branca and mclain are the executors without her violating the no contest clause in michael's will and she's out of

her 40%? >> she can make waves. let's put it that way. what i think is interesting in this case is that there was talk today, my understanding from the reports is that if there's information that's going to be disseminated it has to have a confidentiality agreement clause placed on it. that actually does happen. it's more common than what you would think. the reason why that happens sometimes is because you have a party that may be receiving very sensitive information, and there's a fear that that party may disperse it is into hands that would misuse the information. >> okay. >> i question maybe joe jackson as one of the concerns here. i don't know. but obviously, somebody is worried about who gets the info and how they're going to use it. >> russell, the aeg contract, katherine had not seen that in the past. now they're going to let her look at it with that confidentiality clause in there, right. >> right, that was the subject of the discussions regarding

joining us to talk about it, pam bondi, florida state prosecutor, criminal defense attorney mark eiglarsh and good to have you back, marva. help clarify concerning george. we've had a couple of delays. do you know why the delays and when will he actually answer some questions here? >> i don't know why his giving a deposition has been postponed. we do expect it to take place sometime this week. >> okay, this week. what's your read on the delays? is it because cindy took two days and 13 hours? do you think the schedule is pushed back? >> usually i cancel depositions when i have a conflict. it could be george is just realizing, i've got to go through this again after the civil deposition. he's not looking forward to being grilled again. >> pam, talk about cindy. two days, 13 hours, brother lee nine hours questioned. take us inside.

what kind of questions are they being asked? obviously it's going pretty deep. logging those kinds of hours. >> it is, and prosecutors have a tremendous advantage-in this case because they have john morgan's civil deposition. they have cindy's initial statements to the police, then they have all her statements as they evolved in the civil case. all the other times she's basically changed her story, including in the civil deposition. i think they're going to have all those statements lined up, detailed and they were ready to go and impeach her. i think they went in great, great detail given all the inconsistencies with her. i think lee has remained fairly consistent. i don't think he's a crucial witness in the -- for the state but george is a crucial crucial witness. and one thing we know is they also took him before the grand jury. he has been very, very consistent. >> okay. mark, as pam talks about that there and we note cindy's

inconsistencies, that also helps jose bias. doesn't that hip him off where the prosecution might go and how questions are being answered? >> absolutely. both sides are learning a lot based on how the questions are being asked. i think what's key is both sides are focusing on if she didn't do it, if casey didn't do it, someone else did. casey told allegedly police that it was zany. everybody's focusing on does she exist who helps problem she exists? mom and dad claiming she mentioned for the year before caylee went missing, that it was zanny, they heard that. george actually said in his deposition once a week for the whole year. so potentially 52 weeks he heard the name. that helps prove her existence. >> but they never met her nor have a phone number for her. so that's going to hurt them, as well. nor did caylee ever mention her.

evidence in the case indicating he may have been hurt or worse, the victim of a tragic event. i believe we have breaking news out of that area now. joining us to talk about it we have jennifer smeters is family law attorney and reporter for the idaho statesman patrick orr. patrick, what can you tell us right now. >> right now i'm standing by a canal. about two hours ago, police canceled a press conference for the robert manwill case because there is reports of a boy found with a blue shirt in a canal. morning. the conference. and that's about all we know boise police that they canceled their 2:00. now we're kind of waiting to see what happens. >> that's a sad development. refresh our memory, patrick. was little robert wearing a blue

shirt when he was last seen? >> he was. some of the reports are a little bit sketchy but it was a blue shirt with superman logo. nobody really got close enough to see, you know, just how close that -- the boy who was in the water matched the description or if it indeed was a boy. i do know they just removed the person from the water and left. right now, it's kind of hard to say. but based on the reaction we've gotten from the police department, i think they have some ideas this could be robert. but at this point, nobody really knows. >> were family nearby? >> they weren't. we checked out two places on both sides of the canal where we could get the closest. i didn't see family on either side. they've been working pretty closely with the boyce i police department. i would imagine that's who they're with right now. >> you mentioned this is close where a body was found in a canal. this is close where a rental home was searched over the

weekend. what do we know about this rental home? >> the people, what we found out is the people who live there know the manwills but that's about it. there's also some reports that a car was stolen from that home and returned sometime last week. but these are all kinds of weird disconnected facts and the police haven't put that stuff together and i think they've been searching for the child really. but the people who did visit the home did know robert manwill's family, melissa sue jenkins and her boyfriend, danny ehrlich. that's the deal there. as far as the evidence they got from that house, police haven't said but they finished up on saturday. they haven't been back there since. >> here's a report i have, and patrick cheb me if i go astray. evan wallace owns the rental home, right? >> i don't think he owns the home. i think he lives there. >> he's a renter there. his suburban bloodhounds hit on something concerning his suburban? >> it's possible.

that's what we've been hearing too, but police haven't connected the dots to a lot of this stuff yet citing the ongoing investigation. that's what we've been hear too long. >> evan wallace, that's who -- in the center of all this at least concerning that rental home. he spoke and i believe he's been in contact with sheriffs. listen to what he had to say over the weekend. >> pretty devastated that my truck is being, you know, considered part of this. whatever lead helps. i have complete cooperation with this because it's a little boy that needs to be found. >> there you have it. authorities saying anything else about this case? it sounds like not really, patrick. >> not yet, but there could be some kind of update today, especially if they identify the boy. but right now we're just kind of waiting. that's probably going to take at least a few hours. based on the proximity, it's definitely concern for the boyce i police department. >> patrick, let's talk about

robert's mom, melissa jenkins, live-in boyfriend daniel ehrlich. have they been going to these press conferences and updates. we know other family members have. >> the other family members have been there, but melissa jenkins and daniel ehrlich junior haven't been to the last three days. police say they know of their whereabouts. that's about all they'll say about it. >> is that raising some eyebrows in the area? >> it's raising some eyebrows in the community but the police haven't identified them as suspects or even people of interest. so why they're not there, we're not really sure. the family's not taking questions. just lots of speculation right now. a lot of speculation. >> yeah, and obviously our thoughts and prayers as we hear that a body was found. it's certainly not looking good. jennifer, help us understand this now. we've got melissa jenkins, the mom of robert manwill. she pleads guilty to a

9-month-old. danger. father. >> yes. us, how would he be day of to go to an unsupervised visit with his mom with all these facts out there? >> it's mind boggling sometimes. the question is to what extent the court put some sort of parameters on her visitation with this child. i am so concerned about -- first of all, it's heart breaking to hear that a body has been found, but to say that eyebrows are being raised by the parents not being present at least the last couple of days at these press conferences definitely raises some questions. i'm not going to tell a parent how to dreev but with the history of the violence within this family and to know that dogs may have scent -- picked up on a scent that this child was injured, i really feel that

heeter on june 29th, reunited after 59 years apart. after the wedding, his new bride went to her home in missouri to pack her things and when she returned to california, her husband was gone. left his car, sunglasses, wallet, keys are missing. police say they're not certain he was not abducted. but his wife isn't so sure. let's give it a listen. >> he was in very good spirits. >> 59 years, and he gave me this in 1950 when he went to the korean war. and we were just getting started again. he would not have the left on his own. >> you can hear the emotions. fontelle heeter joins us by phone and colleen loomis with the police department. fon tell, what do you think happened to your husband? >> i really have no idea what happened. i know i made the comment that i don't think he would leave on his own and i really don't, but i don't know that there was any

foul play or anything involved. i just can't imagine that he would leave. he was very anxious for me to be here and he loved me and i loved him. >> yeah. when was the last time you saw him, fontelle or who was the last person to see him? >> i think the last person to see him was his son-in-law. >> when you saw him last, he was in good spirits, everything was fine? >> yes, he was. i talked to him every day i was gone, sometimes twice a day. we'd talk as long as maybe two hours a night. >> is there -- fontelle is there a favorite place he might go? i mean -- tahoe. there. robert in good health? he's 81.

was he forgetful at all, anything like that? >> no, he's in excellent health. the police talked to his doctor not very long ago and they said for his age, nervous excellent health. he had no dementia, no alzheimers. and i found him just crisp as a dollar bill, i'll tell you. >> your story, you fell in love, what, in the late '40s? >> yes. >> he gave you the ring in 1950, he goes off to the korean war. >> right. >> you lost touch. you each led your separate lives. how did you guys reconnect? >> well, i knew who bob was all along. i knew he had lived in monrovia, but i also knew he was married and never contacted him in any way whatsoever. then on may 3rd, i was at my daughter's home in shawnee, kansas, and she was working with her computer on the coffee table and i asked her to google him to see if she col find him.

and she found the robert harrod at this address. i said i don't think that's him and about that time, she put the phone to my ear, she had already dialed it and he said hello and, of course, i had no choice but to say hello back. >> you were back in. >> yeah. >> did you pick up right where you left off? >> we certainly did, the minute i got off the mane and looked at him, he was older but he still had those beautiful eyes and he -- i could tell by looking into his eyes that he was really a good person. >> well, fontelle, our thoughts and prayers are with you for bob's safe return and you can be reunited once again. i want to bring in detective coreen loomis. what are you guys going on here? >> right now, we are calling all of the family, doing interviews them.

contacted some family member or a friend just to let them know that he's okay because at least obviously, at this point, this really has become now a national story and i'm sure that he wouldn't want that to be if he were in a safe place. that has either happened or he did leave on his own and ultimately met with foul play. or that he was the victim of foul play on the date that he disappeared. which was two days before fontelle was due back in california. >> keep us posted, detective loomis. it's nice to talk to fon tell heat ter, as well. coming up this story, want it hear from you. call in on this one. college graduate, just got her diploma in april and now suing her school. she claims they have not done enough to get her a job.

trial attorney, back with us as well defense attorney jennifer smetters. here's a couple much hkoucouple statements. the office of career advancement counselor did not make sure their recruiting clients call their graduates that recently finish school to get job placement. they have not tried hard enough to help me and saying they favor students who got a 4.0, they help them out more with job placement, her gpa, 2.7. look at our economy. a lot of people are out of work. is there any way this is legit? >> desperate times call for desperate measures. >> that's what we have here it sure seems. >> what's going on in this world? >> good question. >> realistically here, i want to know what kind of contract this woman entered into with her college. was there a gpa component here? was it a bait and switch? what were the promises that were

made? what did they do to induce her and to lure her into paying $70,000 tuition or is this just simply buyer's remorse? >> i want to know more information. i wish she would have yeah, me . chip, as you see what we know so far, is this thing going anywhere? >> well, this lawsuit certainly brings a new meaning to the term class action lawsuit, mike. >> nice. >> i think it's going to be a very, very difficult lawsuit. unless there are specific guarantees by the school that can be sued upon that were not met that lured her into a situation which was almost a fraud transaction going on, the courts have not recognized these types of lawsuits, especially in new york, where it would require the jury or judge to actually determine whether or not the education was deficient and did not then give her a job when she got back out. >> yeah. let me read the school statement here. this is monroe college. "while it is clear that no college, especially in this economy, can guarantee employment, monroe college remains committed to working with all of its students,

anyway. kind of left that one open. what is going on here? why did he think he can have a say in their kids' lives? we'll take your calls. 1-877-tell-hln is the number. joining us to talk about it, russell wetanson, an attorney, entertainment reporter, legal analyst for popsquire.com. he was in the courtroom. we'll get to russell in a second. also with us, jennifer smetters, an attorney who specializes in family law. and also joining us stacy kaiser, a psychotherapist. again, call in. 1-877-tell-hln. all right, russell. we get the curveball, huh? lawyers for dr. klein show up. what happened here? >> yeah, this was definitely a bit of a curveball. but there's been a lot of speculation about this for quite awhile. so mark vincent kaplan, who also represented britney spears's ex-husband, kevin federline, shoepd up to court and tells the judge his client wants some role in the kids' lives. the reasoning he says is that he had a long-standing commitment to michael jackson at michael's request. the judge quickly chimed in and said what is your standing, and his lawyer said, he is not the

presumed parent and then asked for a sidebar. so this was definitely a bit of a dramatic moment. and the judge after the sidebar came back and said, listen, you don't have standing in this action. you may have to proceed in another way but today you are not supposed to be here asking for this kind of action. >> so his claim in court is a commitment to michael jackson? is that what you're saying? >> that's right. he said he had a longstanding commitment to michael jackson. >> all right. jennifer, have you ever seen or heard of anything like this, someone who is a dermatologist, doesn't know the kids from adam that we know of anyway, wants in? what do you make of this? >> this is getting crazier and crazier every week, it seems. for the judge to discern that he is not the presumed father, that means that he was not the father at the time the children were born. so he's not -- he wasn't married. he wasn't -- in order to be the presumed father you have to be married at the time the children

are born, but this raises an interesting question. he states that he doesn't believe he's the father, but in order for him to show up there and asking for a choice in education and medical, those are rights that normally go to a parent in a joint parenting agreement. so it's very suspect here. i think this doctor is more involved than just his commitment to michael jackson. i think he truly thinks he may be the father of those children. >> let's, russ, you want in real quick? >> sure, i mean, that seems to be the only explanation here. i mean, if he's just a concerned friend, it doesn't make any sense. but he has -- it's a hard legal battle for him to make. >> you concur with jennifer. let's listen to what he said. dr. klein was asked by larry king on "larry king live" within the month, flat out, larry asked him, are you the biological father of the kids? and he hemmed and hawed his way around the answer. let's give that a listen. >> larry: that's not answering the question. >> no, because i'm not going to answer it the way you want to answer it. >> larry: well, you can say no. >> i can say no then.

i'll say no if that's what you want to hear. >> larry: no, i want to hear what you know. >> to the best of my knowledge i'm not the father. but i want to tell you that this discussion, however, is between michael, his children, and this person. it's not to be discussed who the father is over national television. >> all right. let me add this. this is a quote to diane sawyer. succinctly saying "all i can tell you, to the best of my knowledge i am not the father of these children, but i'm telling you if push comes to shove i can't say anything." stacy kaiser, what do you see in here? is this a guy being vague to draw attention or is he flat out being evasive? or both? >> i think it's both. i think we're going to see a lot of people want to step up and get involved with the kids. there's a gold mine there, a lot of drama and controversy and media attention. i mean, look, he's having it right now. >> in the midst of that interview, by the way, a fact i had missed. but he admitted to larry that he had donated sperm to a sperm bank in the past. so he's capable of doing it.

he has no qualms about it. but russell, you see this guy mounting some kind of legal battle to get in the kids' lives or you think by the judge saying he has no standing it's done and klein's out? >> i don't know that it's done because he had the nerve to show up and say i want in this. you have to believe he's willing to take further steps. if he is going to take further steps this judge said this probate hearing is not the way to do it. he threw around words that trigger family law proceedings. this may be something he has to raise in terms of a paternity suit in family court. i don't know that he has much legal ground to stand on but that would be the route he would have to follow. >> jennifer, you specialize in family law. how easy for a client to say i want a paternity suit here, let's go? or a paternity test, i guess. >> he needs to file a suit in order to find out whether or not there is a father and child relationship. the court would then order a paternity test. and then based upon that test,

then he could start to claim rights and have standing, but that's a little bit further down the road. for them to come into court today and want to evoke some sort of standing without even having the father/child relationship defined, he hasn't signed a voluntary acknowledgement of paternity. he's been very evasive over the question. but i think him being evasive over the question it kind of highlights that he knows more than he's alluding to, and we're going to see more of this man. i don't think it's -- i don't think it's a closed case. what this reminds me of is anna nicole smith. how many fathers of those children, potential fathers came up. where the money goes. >> zsa zsa gabor's husband. remember that guy? >> where the money goes, so do the possible fathers. >> okay. we'll hit on more of the developments in this story. hang tight. we'll take your phone calls. 1-877-tell-hln. still going to hash out the final final on the custody of the kids. katherine jackson gets custody. any nuances to that? what about the battle over the estate? worth an estimate of anywhere

i think people wonder, katherine and we hope and pray she has a long life, but she is 79. at today's hearing was anything talked about if she can't take care of the kids who's next, who does? >> no, that wasn't addressed at today's hearing. there were no objections to katherine jackson taking over as the guardian of these kids. even dr. klein's lawyer didn't ofrnl to that. he said he wanted to be inserted in some way. as of now, there's been no discussion. we talked about that on the show before. i hope the parties are starting to discuss what will happen to those kids in the future because it is very possible these kids will see the death of another guardian during their childhood. >> yeah. let's clarify one thing again. the custody deal had been worked out between katherine jackson, debbie rowe, their attorneys. anything added to that or was that basically rubber-stamped today, russell? >> that was rubber-stamped today and that was pretty much what everyone predicted would happen. >> let's move to the estate. that is a battleground. clarify for everybody, katherine jackson claimed the current

executors, lawyer john branca, former music executive john mcclain, keeping her in the dark about things. she doesn't -- basically, she needs to know more. are they fit and able to administer and make decisions for michael jackson's estate? russell, any headway on that? >> there was a lot of discussion about that today during today's court hearing, and the judge was very clear. he said he wanted to encourage a free flow of information. he's been encouraging that all along. today he kept stressing that phrase. so today they didn't make a lot of headway because they're going to continue the hearing on the probate issues regarding who's going to have permanent control of the estate until monday. between now and then, we can expect fights over whether depositions will be taken and documents will be exchanged. >> jennifer, how much can katherine jackson contest that branca and mcclain are the executors without her violating the no contest clause in michael jackson's will and she's out of her 40%? >> she can make waves.

let's put it that way. what i think is interesting in this case is that there was talk today, my understanding from the reports is that if there's information that's going to be disseminated it has to have a confidentiality agreement clause placed on it. that actually does happen. it's more common than what you would think. the reason why that happens sometimes is because you have a party that may be receiving very sensitive information, and there's a fear that that party may disperse it into hands that would misuse the information. >> okay. >> i question maybe joe jackson is one of the concerns here. i don't know. but obviously, somebody is worried about who gets the info and how they're going to use it. >> russell, we've got about 20 seconds. but the aeg contract, katherine had not seen that in the past. now they're going to let her look at it with that confidentiality clause in there, right? >> right, that was the subject of the discussions regarding confidentiality. the judge said they have to

also with us criminal defense attorney mark eiglarsh, and marva hinton rejoins us, reporter wbdo radio in orlando. welcome back, marva. i know you've been on this since day one. help clarify concerning george. we've had a couple of delays. do you know why the delays and when will he actually answer some questions here? >> no, mike, i actually don't know why his giving a deposition has been postponed. we do expect it to take place sometime this week. >> okay, this week. what's your read on the delays? is it because cindy took two days and 13 hours? do you think the schedule is just pushed back? or you read -- >> that's one possibility. but usually i cancel depositions when i have a conflict. so it could be the attorney. it could also be george is just realizing oh, gosh, i've got to go through this again, after the civil deposition. he's not looking forward to being grilled again. >> no, i'm sure. hey, pam, let's talk about cindy, someone who has been questioned. two days, 13 hours. brother lee nine hours. take us inside. what kind of questions are they

being asked? obviously it's going pretty deep. logging those kinds of hours. >> it is, and prosecutors have a tremendous advantage in this case because they have john morgan's civil depositions. they have cindy's initial statements to the police, then they have all her statements as they evolved in the civil case. all the other times she's basically changed her story, including in the civil deposition. so i think they're going to have all those statements lined up, detailed and they were ready to go and impeach her. i think they went in great, great detail given all the inconsistencies with her. i think lee has remained fairly consistent. i don't think he's a crucial witness in the -- for the state but george is a crucial, crucial witness. and one thing we know is they also took him before the grand jury. he has been very, very consistent. >> okay. mark, as pam talks about that there and we note cindy's inconsistencies, that also helps

jose baez, doesn't it? he doesn't that tip him off where the prosecution might go and how questions are being answered? >> absolutely. both sides are learning a lot based on how the questions are being asked. i think what's key is both sides are focusing on zanny. if she didn't do it -- let's step back for a second. if casey didn't do it, someone else did. casey told allegedly police that it was zanny. so everybody's focusing on does she exist? who helps prove that she exists? mom and dad, who are claiming that she mentioned for the year before casey -- caylee went missing that it was zanny. zanny, zanny. they heard that. george actually said in his deposition once a week for the whole year. so potentially 52 weeks he heard this name, zanny. that helps prove her existence. >> but they never met her nor did they have a phone number for her. so that's going to hurt them as well. nor did caylee ever mention her. that's probably hearsay and not admissible at trial. >> and how did she pay for her? >> exactly.

welcome back to "prime news" on hln. this story's baffling. an 81-year-old groom is missing. robert harrod married his childhood sweetheart june 29th. they had been reunited after being apart for nearly 60 years. yet now he is missing. what happened to him? we'll try to get to the bottom of that case coming up. call in with your thoughts, 1-877-tell-hln. this hour tips pouring in on a missing 8-year-old boy from boise, idaho, little robert manwill. we continue to follow this one for you. reportedly disappeared from his mom's apartment july 24th. over the weekend, cops searched a rental home, part of a landfill. it does not sound good. police have said there's new evidence in the case indicating

little robert may have been hurt or worse, the victim of a tragic event. i believe we have some breaking news out of that area now. joining us to talk about it, we have jennifer smetters, family law attorney and reporter for the idaho statesman patrick orr. patrick, what can you tell us route now? >> right now i'm standing by a canal in the desert south of boise. about two hours ago, boise police canceled a press conference, the daily update for the robert manwill case because there was reports of a boy with a blue shirt found in a canal. now, this canal is relatively was searched on friday and so they suspended the press conference. the coroner has removed a body and that's about all we know but i know it was a significant enough concern for boise police that they canceled their 2:00. now we're kind of waiting to see what happens. >> oh, gosh, that's a sad development. refresh our memory, patrick. was little robert wearing a blue

shirt when he was last seen? >> he was. some of the reports are a little bit sketchy, but it was a blue shirt with superman logo. now, nobody really got close enough to see, you know, just how close that -- the boy who was in the water matched the description or if it indeed was a boy. we were pretty far away. i do know they just removed the person from the water and left. right now, it's kind of hard to say. but based on the reaction we've gotten from the police department, i think they have some ideas this could be robert. but at this point, nobody really knows. >> were family nearby? >> they weren't. we checked out two places on both sides of the canal where we could get the closest. i didn't see family on either side. they've been working pretty closely with the victim coordinators, the boise police department. i'd imagine that's who they were with right now. >> patrick, you mentioned this is close, where a body was found. let's say that. in a canal. this is close to where a rental

home was searched over the weekend. what do we know about this rental home? >> the people, what we found out is the people who live there know the manwills but that's about it. there's also some reports that a car was stolen from that home and returned sometime last week. but these are all kinds of weird disconnected facts and the police haven't put that stuff together and i think they've been searching for the child really. but the people who did visit the home did know robert manwill's family, melissa sue jenkins and her boyfriend, danny ehrlich. in fact, they know mr. ehrlich, apparently. so that's the deal there. but as far as the evidence they got from that house, boise police haven't said. but they finished up on saturday. they haven't been back there since. >> here's a report i have, and patrick, check me if i go astray here. that evan wallace, he's the guy who owns the rental home, right? >> i don't think he owns the rental home. i think he lives there. >> he's a renter there. okay. his suburban bloodhounds hit on something concerning his suburban? >> it's possible. that's what we've been hearing

too, but police haven't really connected the dots to a lot of this stuff yet citing the ongoing investigation. that's what we've been hearing too. >> evan wallace, that's who is in the center of all this at least concerning that rental home. he spoke and i believe he's been in contact with sheriffs. let's listen to what he had to say over the weekend. >> i was pretty devastated that my truck is being -- being, you know, considered part of this. whatever lead helps. i have complete cooperation with this because it's a little boy and he needs to be found. >> there you have it. authorities saying anything else about this case? it sounds like not really, patrick. >> not yet, but there could be some kind of update today, especially if they identify the boy. but right now we're just kind of waiting. that's probably going to take at least a few hours. based on the proximity and some of the physical description stuff, it's definitely a concern for the boise police department. >> patrick, let's talk about

robert's mom, melissa jenkins, live-in boyfriend daniel ehrlich. have they been going to these press conferences, these updates? we know other family members have. are they going? >> the other family members have been there, but melissa jenkins and daniel ehrlich jr., they haven't been to the last three days. police say they know of their whereabouts. and that's about all they'll say about it. >> is that raising some eyebrows, patrick, in the area? >> it's raising some eyebrows in the community, but the police haven't identified them as suspects or even people of interest. so why they're not there, we're not really sure. the family's not taking questions. just lots of speculation right now. a lot of speculation. >> yeah, and obviously our thoughts and prayers as we hear that a body was found. it's certainly not looking good. jennifer, when we look at this care, help us understand this. we've got melissa jenkins, the mother of robert manwill. she pleads guilty to a felony.

for fracturing the skull of her custody because "he robert is in the custody of his unsupervised visit with his mom with all these facts out there? >> it's mind-boggling sometimes. the question is to what extent the court put some sort of parameters on her visitation with this child. i am so concerned about -- first of all, it's heartbreaking to hear that a body has been found, but to say that eyebrows are being raised by the parents not being present at least the last couple of days at these press conferences definitely raises some questions. i'm not going to tell a parent how to grieve, but with the history of the violence within this family and to know that dogs may have scent -- picked up on a scent that this child was injured, i really feel that

they're being -- the fact that they're staying away is almost bringing to attention that they may have maybe not the cleanest hands here. i don't know, but there's a lot of questions and a lot of suspicion going on. >> we're asking those questions. patrick, clear something up for us. we have robert manwill's father, i believe his name is charles. he's been to the press conferences, but the mom and her live-in boyfriend have not the last couple anyway, right? >> yeah, chuck manwill has been to every press conference. he spoke once. usually, one of the aunts, trish burrell, she's been the family spokesperson. but chuck has been to every press conference. >> okay. all right. we'll leave it there. patrick, thanks. >> thank you. >> for the insight. we hope the update is better than it appears at least at this point. jennifer, thank you as well. coming up, a touching story, really turns to heartache here as we see the situation right now. 81-year-old man who rediscovered his sweetheart from long ago

june 29th, reunited after 59 years apart. after the wedding, his new bride went to her home in missouri to pack her things and when she returned to california, her husband was gone. left his car, sunglasses, wallet, keys are missing. police say they're not certain he was not abducted. but his wife isn't so sure. let's give it a listen. >> he was in very good spirits. >> 59 years, and he gave me this in 1950 when he went to the korean war. and we were just getting started again. he would not have left on his own. >> you can hear the emotions. fontelle harrod joins us by phone. also with us colleen loomis with the police department. fontelle, you have to be heartbroken. what do you think happened to your husband? >> i really have no idea what happened. i know i made the comment that i don't think he would leave on his own and i really don't, but

i don't know that there was any foul play or anything involved. i just can't imagine that he would leave. he was very anxious for me to be here and he loved me and i loved him. >> yeah. when was the last time you saw him, fontelle or who was the last person to see him? >> i think the last person to see him was his son-in-law. >> when you saw him last, he was in good spirits, as you said there? everything was fine? >> yes, he was. i talked to him every day i was gone, sometimes twice a day. we'd talk as long as maybe two hours a night. >> is there -- fontelle, is there anyplace he -- a favorite place he might go? i mean -- >> not that i would know of. i know he liked to go to lake tahoe. he but the place where he had stayed with friends had been destroyed by bears. so i don't suppose he'd go there. >> is robert in good health? he's 81. was he forgetful at all, anything like that?

>> no, he's in excellent health. the police talked to his doctor not very long ago and they said for his age that he was in excellent health. he had no dementia, no alzheimers. and i found him just crisp as a dollar bill, i'll tell you. >> your story, you fell in love, what, in the late '40s? >> yes. >> he gave you the ring in 1950. he goes off to the korean war. >> right. >> you lost touch. you each led your separate lives. how did you guys reconnect? >> well, i knew where bob was all along. i knew he had lived in monrovia, but i also knew he was married and i never contacted him in any way whatsoever. then on may 3rd i was at my daughter's home in shawnee, kansas, and she was working with her computer on the coffee table and and i asked her to google him to see if she could find him. and she found the robert harrod at this address.

i said i don't think that's him. and about that time, she put the phone to my ear, she had already dialed it and he said hello and, of course, i had no choice but to say hello back. >> you were back in. >> yeah. >> did you pick up right where you left off? >> we certainly did. the minute i got off the plane and looked ahim, he was older, but he still had those beautiful eyes and he -- i could tell by looking into his eyes that he was really a good person. >> well, fontelle, our thoughts and prayers are with you for ob's safe return and you guys can be reunited once again. thanks so much for taking time. i want to bring in detective carrine loomis. do you have any leads? what are you guys going on here? >> right now, we are calling all of the family, doing interviews with everybody, bringing everybody in and speaking with them. the theorys are ranging from that bob could have gotten cold feet after this whirlwind marriage and had second

welcome back to "prime news" on hln. want to get back to the michael jackson story and a couple of intriguing stories in the midst of that. want to bring in my colleague, jane velez-mitchell, host of "issues with jane velez-mitchell" coming your way top of the hour, about 12 minutes away. first off, i've got to start with the curveball in court today. dr. arnie klein, michael jackson's dermatologist, has a lawyer, or lawyers there, basically requesting that arnie klein be involved with the kids in education, medical decisions. jane, where is that coming from? >> it's so bizarre because he was interviewed on larry king and never said anything about hey, i want to be involved in the kids' education and i want

to weigh in on the children's medical care because he did such a great job with michael jackson's medical care. that would have been the perfect opportunity. and why? why he? he says, well, that's the way michael jackson wanted it. well, that wasn't in the will. we have no evidence of that. now, this is the very same person who has in published reports been speculated to possibly be the father of these children. he refused to answer that one way or another. sew said, you know, this isn't something that should be discussed in the media. but yet, this action is fueling the same speculation that wow, he's probably the dad because it's a father who would want to be involved in a child's education and medical care. >> exactly. and larry king asked him that question. he hemmed and hawed around that, gave a really succinct quote to diane sawyer. let me read that one for the viewers. saying, "all i can tell you is to the best of my knowledge i am not the father of these children, but i am telling you, if push comes to shove i can't say anything." not exactly a denial there.
