as i say to my daughter, good morning, sweetness. i'm christi paul. relax a little bit. let's tackle this morning together. here we go. a lot of people are still digging out from this week's wintry storms. there's another blast that could be on the way to warn you about. could it be heading in your direction? we'll pass that on to you. also, there may be a new risk for survivors of breast cancer, some scientists are making a link between drinking alcohol and recurrence of that disease. and take a look at this, it's not one of santa's reindeer. this is what a family keeps as a pet. how they nursed it back to health. beautiful animal there, isn't it? okay, severe weather we need to talk with you about today.

a deadly storm left much of the country freezing cold and bitterly windy. blizzard conditions hammered the midwest and northeast. more snow is expected today. in fact, at least 17 people have died here. strong winds today will make it feel like 20 below for all of you in the plains and the midwest. some of you are trying to make the best of it. >> it's not my favorite time of year, but i don't mind it. just got to dress for it. >> i've seen it a lot worse. we'll get through it. >> i love a white christmas. you need a white christmas. you need it for the kids. absolutely. but then it can go away. >> you know, those folks are just used to it. this isn't anything new to them. they can handle it. there's another big storm in the works as well. bonnie schneider is in for bob van dillen. this is going to be a big lake effect snow event for some locations like northern michigan to the west we're going to be

measuring the snow totals by the foot and that is also the case for parts of upstate new york back up to buffalo. i think more south of buffalo and further inland but here along the great lakes heavy snow, be blustery winds creating whiteout situations and also brutally cold temperatures. i'll talk more about the bitter windchill that will affect bigger cities like chicago and cleveland and also some big changes for south florida after record high temperatures. there's a lot more coming up. >> and they're talking 20 below in one place and record high temperatures in another. boy, thank you, bonnie, so much. one in six americans has had the swine flu. this is a new estimate from the cdc that says about 50 million people got sick from the h1n1 virus and about 10,000 died from it between april and mid-november. most of those deaths were between 18 and 64. the cdc's director says the majority of americans have not had swine flu so it's still important to get that vaccine. five americans arrested in pakistan as suspected terrorists

have been trying to contact militant groups on youtube and other sites from police in pakistan who arrested the father of one of those spents. u.s. intelligence officials have been worried about home grown terrorists who might be recruited by radical groups. one expert says the biggest mistake is to underestimate the terrorists as unsophisticated. >> they communicate regularly through the web. they even adopt american names and even enter through chatrooms, one of them playing a male, one playing a female, and you think they're just connecting whereas in reality they're passing information to each other. >> in norway to accept the nobel peace prize president obama said we have to be constantly mindful that some these twisted ideologies are available over the internet and can affect our young people. that's a quote there.

casey anthony's attorneys are hoping to get the death penalty off the table. she's due in court. remember anthony is accused of killing her 2-year-old daughter caylee. caylee's remains were found in the woods near her home exactly one year ago today. she disappeared about six months prior to that. we're going to bring you live coverage of the casey anthony court appearance, in fact, here on hln startin at 9:30 a.m. eastern. stick with us here. women who had breast cancer may put themselves at risk when they drink alcohol. a new study finds those women have a 30% chance of breast cancer recurrence, and that's just with moderate alcohol consumption of three to four drinks a week. post menopausal and overweight women may have the greatest risk here. a cia official denies a report that black water security guards took part in secret cia missions. former blackwater employees and intelligence officials told "the

new york times" the company regularly helped with snatch and grab raids in iraq and afghanistan from 2004 to 2006. now a u.s. official tells the associated press blackwater provided security but did not perform cia missions. the man accused of secretly making nude videos of espn reporter erin andrews is expected to plead guilty. rafer weigel, what do you know about this today? erin andrews has been the victim of a nightmare scenario when a stalker videotaped her in the nude through a peephole in her hotel room. well, andrews' nightmare may be close to end iing. this guy, 48-year-old michael barrett, will plead guilty to a federal stalking college. california's u.s. attorney says he will enter the plea on tuesday. andrews told oprah winfrey she felt violated by the videos when she became aware of it, understandably so. >> no doubt.

thank you so much, rafer. we'll be talking to you again in a bit. a grand jury says two missouri cops were justified in the shooting death of a suspect. kansas city police, in fact, released this dash cam video of the september shooting. you see the suspect start shooting at a call. look at that officer order him to drop the gun. he wouldn't. one cop appears to be hit but cops back up and again start shooting. my goodness, do you have a lot in store for this weekend -- depending on where you live, but the weather is not going to be kind to everybody here. bonnie schneider? that's right, christi. get the shovels out if you live in buffalo or in the vicinity, even cleveland, snow there today and tonight. a lot of lake-effect snow and this is challenging because it not only comes in fast but it comes in heavy and hard, so we have advisories, warnings posted upperstate new york for areas to pennsylvania and ohio and then for southern sections of areas

north of michigan. here's the snow, the way it's shaping up right now coming in off the great lakes f. you're wondering why it's snowing here and not here, there's a good reason. the phenomenon is called lake-effect snow and the way it breaks down is that the temperatures of the great lakes or any body of water right now still a little bit warmer than the temperature of the land just in advance of it. so when you have the very cold air coming over the great lakes, tapped into that warmer, moist air that's just on top of the lake but then the air rushes onshore where it's colder and the air can't hold the moisture as much so immediately it dumps the heavy snow right here along the shoreline of the lake. if you live right there, you're probably used to it in erie, pennsylvania, so we'll see snowfall rates one to two inches per hour. you'll see widespread snow to the north of cleveland, erie, pennsylvania, and heavy snow for syracuse and grand rapids as well and up to marquette in northern michigan. so a lot of snow to talk about, bitterly cold temperatures right now in green bay. it is negative 2 in marquette.

the windchill factor will be a big story not just for today but for tomorrow. by tomorrow evening we'll see the windchill factor drop down to about 25 in chicago and 22 in sioux falls and then getting colder so the windchill factor, the way your body interprets the weather, a big story there. another big story is south florida. now we're getting cloud coverage and cooler temperatures, but, christi, yesterday the temperature climbed to 89 degrees in miami, florida, making it the warmest december day ever. >> wow. >> we're talking extreme cold and then extreme heat down south. >> i don't know about you, i can handle the snow, it's the frigid temperatures that get me every time. >> the windchill. >> not a fan. bonnie, thank you so much. and just because you saw her foreca forecast, take good care out there when you're getting to school or work or wherever you're going today. be careful. we want you to be safe. do you want a great paying job? and who doesn't? find out where you'll find some of the biggest paychecks, plus

rise and shine. good to see you that morning. a shoot-out in new york's times square left a suspect dead. no holiday shoppers or tourists were hurt, thankfully. according to police, though, the shoot-out started after cops confronted two men they say were using aggressive tactics to sell cds. soon after one of the suspects fled, pulled a gun and started shooting. an officer returned fire and the 25-year-old was killed. >> after the police were there, clearly they had either taken off him or found by him a pretty significant weapon that he pulled off to the side. >> what did that look like? >> someone else said it was something like a mac-10 but a huge gun with a clip underneath. it did not look like anything

you'd want to get on the other side of. >> police say the suspect's gun was indeed a mac-10 pistol and it jammed during the shooting. a nativity scene in an l.a. clothing store raising some eyebrows today. some people who work across the street say the virgin mary is not wearing enough, people, and they want the window display changed but reactions are mixed. >> i don't care if it's supposed to be trendy. they've taken something and made it trashy. and i think that's what i object to. it looks trashy. >> i think it's perhaps a bit risque. i don't personally find it offensive. >> no, it doesn't really offend me. >> i think it's art. it's also advertisement. you have to look in the context, i believe, and i don't find it offensive at all. >> the store owners themselves, by the way, declined to comment. there's new information about what happened to adolf hitler's body. we are now learning about a top secret kgb operation and what soviet agents did with hitler's

remains new for you in about 30 minutes. i know so many of you are struggling just to make ends meet. government employees apparently, though, they're doing quite nicely. their salaries are booming apparently. our money expert jennifer westhoven, this is going to make some people a little ticked off, i think. i think so. nothing like a little anger with your morning cup of coffee. no, thanks for waking up with us, christi. >> we don't want to do that. >> isn't it supposed to be when you go into government, you're doing the right thing, you're helping people, but you don't make as much money. it's kind of a tradeoff. while the average american worker makes $40,000 a year, the average federal worker makes $71,000 a year. and you can't believe how many of them make six figures accord ing to "usa today." get this. two years ago the transportation department had one person making more than $170,000 a year. now that number is almost 1,700

people in just two years they're suddenly getting huge raises. there have been all kinds of new pay scales and they've eased the pay cap which means you and i are paying all those salaries. all right. there was a measure to try and prevent another financial collapse. it is going up for a vote today on capitol hill. now it was supposed to prevent that huge financial almost collapse last november. it was supposed to prevent that from happening again. remember, that was when the whole system was about to come flying off its axis. it wasn't just wall street companies, ordinary companies were getting in a lot of trouble, too, but that measure has been i'm saying turned into milk toast. they watered it down. they took all the teeth out of it. much of the reform in the bill has been gutted. there's a measure to keep banks from betting the farm by not letting them bet on derivatives. do you remember hearing about those? well, lawmakers are looking to kill that and they're looking to kill a measure that would create a watchdog agency to look out for you when it comes to

abandoned by their coach before their big bowl game. what? it happens in college football all the time. and college football itself needs to make a change. >> okay. >> to keep it from happening. now the cincinnati head coach brian kelly, to his credit, turned the cinderella bearcats in one of the great stories in football. they went from relative obscurity to a national championship contender. now he was hired by notre dame to take over their program and now he will not coach the bearcats in their first-ever sugar bowl appearance on january 1st. and players are livid. >> i heard everything i need to know. i left. everybody knew what was going on. and for him to last so long, i felt he did our team an injustice. >> one of the players said he was disgusted. now in pro football there is a rule that you can't talk to an active coach until the season is over. why can't college football implement the same rule? it would protect these kids. it would be better.

police in pakistan say five young americans arrested there tried to contact terrorist groups on the internet. the men are accused of plotting a terrorist attack. the father of one of those suspects was also taken into custody. pakistani police say the young men wanted to join militant groups and die as martyrs. roman polanski's attorneys are pushing to get his underaged sex case dismissed without polanski showing up for court. a california appeals panel is considering that request. now poe llanski is under house arrest in switzerland. the filmmaker, remember, pled guilty in 1977 to having unlawful sex with a 13 ye-year- girl. he fled the u.s. before sentencing. and defense secretary robert gates met this morning with the

iraqi prime minister. he expressed condolences after a wave of bombings killed more than 100 people there. u.s. officials are saying the attacks could be a sign that al qaeda's weakening. gates informs iraq to talk with u.s. troops and remind them their mission is critical. and casey anthony is due in court in just three hours. her attorneys are trying to get the death penalty taken off the table today. remember anthony is accused of killing a 2-year-old daughter caylee. she's pled not guilty. the thing is kcaylee anthony's remains were found one year ago today. those are some of the he headlines for you we're following this morning. happy friday to you. welcome back. i'm christi paul in today for robin meade. so good to see you. thanks for keeping us company. a big storm is falling in the west and it's expected to dump at least a foot of snow in the sierras. that region has already seen more than three feet of it and people around lake tahoe have been without power since sunday. >> it happens about every ten years but this is the worst one i've seen in 30 years.

>> in regards to? >> the amount of snow, the ice, the temperature drop. >> we've been playing a lot of games like 31 and solitaire, and the other thing that's fun is that we've been sleeping in the living room. >> i love listening to him. solitaire. there's more nasty weather, though, in store for people on the east coast. bonnie schneider will get us up to speed on that system. good to see people taking advantage of family time. the biggest investment fraud in u.s. history came crashing down one year ago today with the arrest of bernie madoff. his ponzi scheme cheated people out of billions of dollars. jennifer westhoven breaks down what was lost and what's been recovered at least so far, right? >> yeah. i mean, that is a lot of people, christi. 2,000 people directly but a lot more who say they were hit or were invested in other ways who woke up to find out that all of their savings, all of the money they were counting on was gone,

that they were ripped off and most are going to get back very little, maybe 10 cents on the dollar, some of the lawyers say. out of $21 billion that was lost, only about $1.5 billion has been recovered from trying to sell the mansions and the yachts and all of that. now some people actually got all their money back they invested because they withdrew it before anybody knew anything was wrong, but, get this, they think because they thought they had a lot more money in there, they somehow want back their fake profits, too. >> i felt as though we were cheated. i felt violated. >> i think that she's in that group, so she gets back the safe profits, other people don't get back theirs. there's actually all this fighting among the madoff victims. now madoff in jail, 150-year sentence, you may remember there were some people who thought he was going to be threatened.

people might want to take him out. apparently, from "the wall street journal," every con artist he is the godfather. >> wow. it's pretty bold for people who took their money out to be saying i want more. >> i understand they feel cheated. >> some people have nothing. they have nothing left. right, right. okay. jen, thank you. 14 connecticut firefighters got promoted after a five-year legal battle. the white firefighters sued city officials in new haven because they threw out the results of a promotional test. not enough minorities did well on that test, so the case went all the way to the supreme court, remember, and it ruled the white firefighters' civil rights were violated. >> through persistence and hard work it proves in america that individuals can make a difference and it was because 20 individuals stood up together. >> an attorney for some african-american firefighters is challenging the exam's validity.

sonia sotomayor ruled against the white firefighters when she served on a federal appeals court. a louisiana man who bet against the new orleans saints lost his 60-inch tv when his friend shot it to pieces. rafer weigel, i have to tell you, this is pretty violent video. >> it is violent video and if you love your tv, you may want to look away. bottom line is, don't bet against the new orleans saints. he told his friends if they won and beat washington on sunday they could come to his house, shoot his tv. you may remember what happened after an overtime field goal lifted them in the come-from-behind win. he was forced to eat his words. here is that disturbing video. his phone started ringing. there you have it. about a dozen showed up at his home with firearms and a case of beer. >> now are those really friends? come on. >> and shot his tv in his backyard. and the video, which this guy took, there he is.

oh, poor guy, he put the video up on youtube. there have been about 150,000 hits. >> i'm not surprised. look at him go. >> i kind of feel bad for him but at the same time why would you do that? >> i don't -- well, you know, he didn't think, i'm sure, that his friends would take him at his word. i don't think i would. >> apparently they did. >> i'm not a new orleans saints junkie so i guess i would know better. >> it was a bad bet, let me tell you. >> it was a bad bet, and i'm thinking they had maybe a few drinks before he jammed his head into the tv like that, too. thank you. all right. i know that a lot of you are going to be heading out today into some pretty dicey weather so it's going to make for one awful commute. take your time out there. bonnie schneider in for bob van dillen. where do people need to be particularly careful here? >> i'd say chicago, cleveland,

buffalo, erie, pennsylvania, those places facing not only bitter windchill but many of them will see snow today or tonight, some heavy snow. as you can see the snow continues to push its way across parts of upstate new york. we're watching for that. we're seeing a lot of snow in western michigan and to the north as well, some of it's going to be so heavy as we go through the day. the cold air sweeping across the lakes. the lake water temperatures are warmer to allow the cold air to grab the moisture off the tops of the lakes, hold on to it and then it comes over the land. the land is colder. it gets dumped in the form of snow immediately and quickly we are looking at really snowfall rates that could be one to two inches per hour in the vicinity of buffalo, not necessarily the city itself. and as we kind of expand the map, we're looking at heavy snow in grand rapids, michigan, be and down through areas into northeastern ohio. this is the way it shapes up this morning. it's very cold out there across the great lakes and it's even colder as we go further to the

west. the current temperature is negative 10 so you factor in the windchill, feels like it's negative 26. on a day like this you may want to stay inside, wear lots of layers when you bundle up. now just the opposite of what's been happening in florida, heavy rain to the south of florida, cloud coverage and that's a good thing. people actually have been complaining that it's been too hot down there. they've been complaining about it. now the temperature in miami is 72 in west palm. it's about 70. both of those cities shattered records yesterday getting well above 85 degrees. 89 in miami. yesterday, christi, making it the warmest december day ever so now about 82. what extremes, right? >> my gosh, you have people in ohio and michigan probably saying florida is looking really good right about now. high temperatures and all. thank you, bonnie. you've been hearing all the drama, i know, surrounding tiger woods. everybody is talking about it. people have been taking shots at him but others say he's done a lot of good, too. for instance marlo thomas told

talk about fast food. how about a made-to-orr pizza at a drive-through? a restaurant in northern california is offering customers a fresh pizza cooked in just a couple of minutes and they say it's all thanks to a high-tech oven system. >> our ovens use about four different kind of heating technologies. we have a pizza stone that comes to heat in about two to five seconds so about 500 degrees. we have convection that shoots through the oven at about 60 miles an hour. >> the restaurant owner says his next goal is to win the international pizza box folding championship in las vegas. i didn't know there was such a thing. if you're looking for gift cards

and giveaways on the internet you might end up being steered to websites you did not expect. jennifer westhoven, of course, is looking out for you. jen? this is a strange story. and there's nothing illegal about it, i don't think, chr christi, but see if it passes your smell test. so you see an internet ad that says free stuff like maybe a gift card at a popular store, all you have to do is basically sign your name but you're signing your name electronically, lend your support and send in a form letter to congress about health care. you might end up taking it because you want to get some christmas presents. this is being done by both sides, groups that love or hate health care. so watch out for this in case you're not sure that you necessarily agree and, by the way,a lot of these offers, if you actually read the fine pr t print, you can usually get the freebies without sending any letters. okay. job hunters, this isn't going to necessarily help you right away but it could help in terms of

long-term planning, maybe if you're in school, what do you want to major in to make sure you can get a job when you graduate. well, health care, computers, and finance? yep, the government is predicting these are the field that will have the biggest in the next ten years. you can become a biomedical engineer, computer analyst, home health aide. and finance firms are going to need more people to check their math. that would be nice. they will need financial examiners and compliance officers. what to watch out for, though, making semiconductors or autoparts. the group predicts further losses there. >> sad to hear. >> christi? >> you mentioned to me, giving the smell test. i have a 3-month-old in diapers. my smell test is totally skewed right now, let me just tell you. i'm just going to take your word for it, whatever you say. thanks, jen. all right, you cannot look at the rubble of one man's home and believe that he was sitting inside when this happened and survived.

we're learning five americans arrested in pakistan of suspected terrorists had been trying to contact militant groups on youtube and other sites. this is from the police in pakistan who also arrested the father of one of those suspects. u.s. intelligence officials have been increasingly worried about homegrown terrorists who might be recruited by radical groups. one expert says the biggest mistake is to underestimate the terrorists as unsophisticated. >> they commute regularly through the web. they even adopt american names and sometimes even enter, through krat roo, one of them playing a male, one playing a female. and you think that they're just connecting, whereas in reality, they're passing information to each other. >> in norway to accept the nobel peace prize, president obama said, quote, we have to be constantly mindful that some of these twisted ideologies are available over the internet and can affect our young people, unquote.

big day for casey anthony today. her attorneys are hoping to get the death penalty taken off the table. she's due in court in about 2 1/2 hours now. now, remember, anthony's accused of killing her 2-year-old daughter, caylee. she has pleaded not guilty. caylee's remains were found in the woods near her home one year ago today. she had disappeared about six months earlier. we are going to bring you live coverage of the casey anthony court appearance right here on "hln." that starts at 9:30 eastern this morning so stay with us here. meanwhile, a deadly storm has left much of the country freezing cold and bitterly windy. blizzard conditions hammered parts of the midwest to the northeast where even more snow is expected today. and at least 17 people have died. today strong winds will make it feel like 20 below for all of you in the plains and the midwest. some of you are trying to make the best of it. >> it's not my favorite time of year, but i don't mind it. just got to dress for it. >> i've seen it a lot worse. we'll get through it. >> i love a white christmas. you need a white christmas.

the tree's up. you need it for the kids. absolutely. but then it can go away. we have another big storm to tell you about. bonnie schneider is in for bob van dillen. she'll tell us what's on tap for the rest of the country as well. about one in six americans has had the swine flu. this is a new estimate from the cdc that says about 50 million people got sick from the virus and about 10,000 died from it between april and mid-november. most of those deaths were people between 18 and 64 years old. now, the cdc's director says a majority of americans have not had swine flu, obviously, but it's still important because of that to go get vaccinated. the biggest investment fraud in u.s. history came crashing down a year ago today with the arrest of bernie madoff. his ponzi scheme cheated people out of billions of dollars. our money expert, jennifer westhov westhoven, breaks down now what was lost and what was recovered as well or has been recovered up to this point, jen. >> so many stories about people

who woke up that morning rich and then found out on the news that they were poor, you know. they couldn't send their kids to school, had to sell their homes. more than 2,000 people were directly hit. they were invested directly in his rip-off scheme, and most of them will get back very little. just about 10 cents for every dollar they put in. out of $21 billion that was lost, only $1.5 billion has been recovered. now, some lucky people, very few of them, actually got all the money that they invested back called their principal, right? just for example's sake, say you put in 20 bucks, i'm making it really simple, and they said, my gosh, your money has grown to $100. you didn't get the 100 back but at least you got the 20 back. they had withdrawn it. they didn't know anything was wrong. it was before the arrest. but some people think they should get back those fake profits, too, the $100 i was just talking about. >> i felt as though we were cheated.

i felt violated. >> and, of course, that is understandable, but they have a limited amount of money they're splitting up between all these people. madoff himself in jail, 150 years in there. but maybe you won't believe what the other inmates think about him. a fellow inmate quoted in "the wall street journal" says, to every con artist, he's the godfather. like they respect him. >> wow. well, i don't know that that's the kind of reputation you want to have at the end of the day. but i don't know, maybe that means he's safe in jail. who knows? hey, thank you so much, jen. we appreciate it. defense secretary robert gates met this morning with the iraqi prime minister, and he's expressed condolences over a wave of bombings that have killed more than 100 people there. u.s. officials are saying the attacks could be a sign that al qaeda is weakening. gates was in iraq to talk with u.s. troops and remind them their mission there is critical. listen to this. women who have had breast cancer may put themselves at risk when they drink alcohol. a new study finds those women

have a 30% chance of breast cancer recurrence, and that's with just moderate alcohol consumption of three to four drinks a week. the study says post-menopausal and overweight women may have the greatest risk. this was done, by the way, by kaiser permanente. i know you know about the couple who crashed the white house dinner last month. they're accused of trying to pay a debt with fake jewelry now. salahi gave a swiss watch to a landscaper to pay $2,000 that he owed apparently. but a jeweler said it's a fake and only worth about 100 bucks. turns out the watch wasn't needed anyway. a check was delivered to cover the bill. let's talk about the weather. that's going to affect so many of you today. bonnie schneider, who needs to be on the lookout first and foremost? >> the great lakes and areas into northern new england will see snow today. and then further off into the northern plains, bitter windchill will really rip everybody over there. take a look at some of the snowfall totals we've seen across new york.

this is in the upstate area near where we have the lake-effect snow machine happening. and i'll tell you, when you start measuring snow by the foot, you're in trouble. you've got to really start getting the shovels out. and we're expecting more of that. that was just yesterday. some more of that is in the forecast for today. we are anticipating quite a bit of snow. check out some of the images from across the midwest after the storm rolled through there. we have some pictures to show you of what it looked like across minnesota, iowa, nebraska, just to name a few. boy, that is some heavy snow working its way across iowa. now, in des moines, this was just your typical prewinter snowstorm. what's happening in the great lakes is a little bit different. lake-effect snow happens when you have cold air coming over the warmer waters of the great lakes. tapping into that warm air and then as it comes over the colder land mass quickly, fast and furious, the snow just plummets from the sky at snowfall rates two to three inches per hour sometimes. plus you have the wicked wind. so it's a whiteout situation. that's why the blizzard warnings are in effect.

i mentioned the windchill, just to show you, right now the current temperature in marquette, michigan, is negative six. then as you head further westward, it's colder with a brutal windchill, christi. all the way down to negative 17 right now early in the morning in minneapolis, minnesota. >> ouch! i can't take the cold. i can take the snow, but not the cold. >> i agree. >> thank you, bonnie. do you want a great paying job? who doesn't? where you're going to find some of the biggest paychecks. also, south carolina's governor admits having an ongoing affair. now he wants to make up with his wife. well, she has something to say about that.

this september shooting, kansas city police just released it. the suspect started shooting. the officers ordered him to drop the gun. he would not. and at one point an officer appears to be hit but pops back up and starts shooting again. well, south carolina governor mark sanford wants to reconcile with his wife. remember sanford disappeared this summer and then admitted he was having an affair with his argentine mistress. jenny sanford told abc news she will not stand by her husband's side while he deals with the repercussions of his affair. a state legislative panel rejected an impeachment resolution against the governor. he faces an ethics hearing next month. infinite supply of appalachian trail jokes. >> oh. i know the appalachian trail jokes, they're here to stay. we have to admit it. nice, jen. that's jen's voice you're hearing. we're going to her next. there's so many of you, we have to be serious here for a second.

okay. so many of you are struggling to make ends meet, we know. government employees, though, their salaries are booming? really? >> and particularly at the high end. like the highly paid government employees. i mean, you kind of think the idea is, if you work for uncle sam, you probably won't get rich, but you are doing something really noble and you'll you'll get benefits and longevity. but a report says that federal salaries have exploded. when the recession started, there was just one person at the transportation making more than $170,000 a year. $170,000 a year. now that number is almost 1700. and also at the defense department, a lot of highly paid workers there are pretty much raking it in. "usa" today cites federal data that says a lot of the pay caps were repealed and different basically pay schedules were put in. in washington, a measure that would try to prevent another financial collapse goes to a vote today on capitol hill. now, you know what it was supposed to do. it was supposed to prevent what happened last november when we

thought the financial system was going to freeze up and fly off its axis. well, that bill has been sharply weakened. and, you know, i think we're showing you pictures of wall street, but you may remember back then, we were talking about companies like ge that might not be able to pay their workers. mcdonald's, all kinds of companies, couldn't get access to normal money. much of the reform, though, in this bill has been gutted even though the vote is coming today. there was a measure to keep banks from betting the farm by limiting exposure to derivatives. that's dead. and also what could be killed is a measure to have an agency that looks out for you for financial products, a consumer agency. christi, back to you. if it passes, we may not get much in it. if you're traveling this morning, there's a lot of wicked weather out there. here's bonnie. >> we're looking at snow, wind, rain, all kinds of delays popping up later on today. as you can see on flight explorer, there's well over 1500 planes in the sky. still early out west. you'll see delays in the west

obscurity to a national championship contender. he was hired by notre dame to take over their program, but now he's not going to coach the bearcats in their first sugar bowl appearance on january 1st. cincy players, though, are livid. >> i heard everything i needed to know, and that is he accepted the notre dame job so i left. everybody knew what was going on. for it to last so long, i feel he did our team an injustice. >> gillyard was one of the ones who said he was disgusted. in pro football there's a rule you cannot talk to an active coach until the season is over. why doesn't college football implement the same rule? for the kids? the super bowl champion pittsburgh steelers are having one of the biggest collapses in the nfl, losing their fifth straight game to their bitter rival, the lowly cleveland browns, 13-6. steelers' quarterback ben roethlisberger was sacked eight times. he was on his back so much the browns are one of the worst teams in football, and the steelers last year were the best.

all been accounted for now. authorities got 22 calls from worried families and some of the hunters themselves. groups had tried to dig themselves out of the snow, but they weren't able to pass through roads. and there's more nasty weather in store for people on the east coast. bonnie schneider's going to get us up to speed on that system in just a couple minutes. meanwhile, a cia official denies a report that blackwater security guards took part in secret cia missions. former blackwater employees and intelligence officials told "the new york times" the company regularly helped with snatch and grab raids in iraq and afghanistan from 2004 to 2006. now a u.s. official tells the associated press blackwater provided security but did not perform cia missions. 14 connecticut firefighters got promoted after a five-year legal battle. the white firefighters sued city officials in new haven because they threw out the results of a promotional test. city officials said not enough minorities did well on that test. now, the case went all the way to the supreme court.

and it ruled the white firefighters' civil rights were violated. >> through persistence and hard work, it proves in america that individuals can make a difference. and it was because 20 individuals stood up together. >> an attorney for some african-american firefighters, though, is challenging the exam's validity. the case was brought up at confirmation hearings for supreme court justice sonia sotomayor. she ruled against the white firefighters when she served on a federal appeals court. new for you this morning, drugs women use to build strong bones may help prevent breast cancer. a study found that women using medicines like fosamax were less likely to develop breast cancer than women not taking them. researchers say the study isn't enough to prove that the drugs prevent cancer and more definitive studies are need. the man accused of secretly making nude videos of espn reporter erin andrews is expected to plead guilty. rafer, what's going to happen

today? >> well, nothing will happen today, christi, but it will happen next week. but what's happening today right now for erin andrews, this woman has been the victim of a nightmare scenario. and that nightmare could be coming to an end when a stalker recorded her in her hotel room. michael david barret will plead guilty to a federal stalking charge. a california attorney says he'll enter that plea on tuesday. andrews is a sideline reporter for espn. she told oprah winfrey she felt violated by the videos when she became aware of them, understandably so. >> well, sure. who wouldn't? rafer, thanks for the update. a woman who's nine months pregnant helped save a police officer. angela gutierrez was driving with her husband and child when she saw teenagers attacking this officer. look at this video. at one point the teens reportedly tried to grab the officer's gun. and the pregnant woman kept pushing them away. >> something felt like i had to

it feel like it is one degree outside. so bundle up. wear the layers and cover all the extremities. it's going to be a tough one out there. not too far away in upstate new york, we're tracking very heavy snow. this is lake-effect snow on the ground already, well over two feet of snow in some locations. and then more is expected in the forecast because the lake-effect snow machine is working its way across the region with cold air over the warmer waters of the great lakes. then it dumps the snow fast and furious over the land because the land temperature is so cold. grand rapids, we're expecting snow today, 16 degrees. and then back out west where the windchill factor is even colder, well into the negative numbers. we're expecting the windchill factor to plummet later on today and tonight. but the temperature dropping slightly in south florida. and that's kind of good news. a lot of people on my facebook page were complaining they had to turn on the air conditioner. sorry, but i don't feel so bad. record high temperatures in south florida yesterday. it's going to be much cooler today. 73 right now in miami. i'll tell you, yesterday, christi, it climbed up to 89.

a texas prison guard has been fired over that escape by a convicted sex offender who pretended to need a wheelchair. joseph cuomo pulled a gun on the guards and escaped while being transferred to another prison. well, in this surveillance video obtained by khou, here it is, you can see him turn out a light in his cell before he gets up and moves around. the guard who was fired was supposed to search him before he was transferred. now, the state is investigating who smuggled a gun into him and whether any guards actually helped with his escape. casual sex may not be emotionally damaging. a new study finds having friends with benefits doesn't really mess with your head. about 20% of young people surveyed said their most recent partner was casual. mouf however, the researchers say the findings don't minimize the possible physical threats associated with casual sex. researchers at the university of minnesota, by the way, did that study. so if we head into the

holidays, if you're looking for gift cards and giveaways even on the internet, you might end up being steered to websites that you didn't expect. jennifer westhoven is looking out for you. so we search and what are we going to find? >> yeah. i think the key is you might see these internet ads that say "free stuff." we'll give you a free gift card to a store or something. all you have to do is basically sign your name. you've got to send a form letter to congress about health care that agrees with whatever group is making the offer. and by the way, both sides are playing this game, groups that like or hate the health care reform bill. but, you know, it seems kind of funny. like does it pass your smell test somebody might do that just because they want help getting christmas presents or something like that. so watch out. if you do read these, you know, if you're not necessarily in agreement, usually if you read the fine print, you can probably get that offer without sending any letter. you can get the freebie. coke will soon be back on the shelves at costco. you might remember we told you how costco had stopped selling coke. i think they couldn't get the

kinds of low prices that they want. there was a dispute. but the two companies have resolved it. and if you're job hunting, this isn't going to be something that will help you in the next few weeks, but what about the next decade? a new government survey is talking about the kinds of jobs that will be growing in the next ten years. where if you can do this job, you're going to be fine. one is computer finance. also home health care experts. and biomedical engineers. and believe it or not, finance experts, too. apparently, christi, knock wood on this one, more of the big firms are going to need people to check their math. financial examiners and compliance officers. >> that doesn't sound good. >> i don't know. i wish somebody had been checking their math. >> exactly. that's what i mean. jen, thank you. by the way, a guy who told his buddies that he was sure the redskins would beat the saints, so sure, he bet his tv screen, well, he bet his big tv screen, i should say, on it. oh, did he lose in a big way.

off the table today. she's due in court in about 0 minutes. remember, anthony's accused of killing her 2-year-old daughter kalee. she's pleaded not guilty. kayly's remains were found near her home one year ago today. she had disappeared months earlier. jean casares is near the courthouse in orlando. i know the big issue seems to be the death penalty. is it possible the judge will rule on that today? >> reporter: the defense sure hopes so. this is the motion to preclude the death penalty. what the defense is saying is that the facts just aren't here for a death penalty case. you don't have a cause of death, you didn't even have an actual body that was found. it was remain, and it was bones that were found and you don't have the fact to show that it was premeditated, atrocious or cruel or that there was aggravated child abuse so they're asking the judge to disallow the state by bringing this as a death case. >> we're seeing her today, but

we'll see her next month, too or later next month? >> big day next month. it's the fraud trial. there are two cases going on at the very same time here, they're both criminal cases and both in the courthouse right behind me in orlando. this is the check fraud case. prosecution are saying that casey anthony wrote out four different checks to target, wynn dicksy and even a bank to bank of america from her good friend's checkbook and those are felonies. >> well, the other thing that i know is being brought up today by jose baez, he's seeking a protective order because he says he wants privacy with his client. he hasn't had that up to this point? >> reporter: we need to listen to this motion really carefully because what jose baez is saying is that when he is at the jail talking with casey anthony that the cameras are on, people are watching, maybe they're reading lips and he doesn't have that privacy. so we really need to see. there is a motion in opposition to this by the jail, the county, they're saying these are security cameras. we have to have security cameras

accept the nobel peace prize president obama said, quote, we have to be constantly mindful that some of these twisted ideologies are available over the internet and can affect our young people. about one in six americans has had the swine flu, that's a new estimate from the cdc that says 50 million people got sick from the h1n1 virus and about 10,000 died from it between april and mid-november. most of those deaths were people between 18 and 64. the cdc's director says a majority of americans have not had swine flu, so it is still important to get vaccinated. the man accused of secretly making nude videos of espn reporter erin andrews is expected to plead guilty. what do we know? >> we know miss andrews is probably breathing a sigh of relief. she has been the victim of an absolute nightmare scenario when she was v videotaped nude by a stalker through a peephole in her hotel room. well, the nightmare may be ending. according to court documents

this guy, 48-year-old michael david bear set going to plead guilty to a federal stalking charge. california's u.s. attorney says barrett's going to plea on tuesday. andrews, as you know, is a side line reporter on espn. she told oprah winfrey she felt violated by the videos when she was made aware of them. no excuse for those videos. >> a shootout in times square left the suspect dead. no holiday shoppers and tourists were hurt, thankfully. the shootout started after two cops confronted two men they say were using aggressive tactics to sell cds. soon after one of the suspects fled, pulled a gun and started shooting. an officer returned fire and the 25-year-old was killed. >> after the police were there, clearly they had either taken off him or found by him a pretty significant weapon that he pulled off to the side. >> what did the gun look like? >> someone else said it was something like a mac-10, a small

gun with a huge clip underneath. it did not look like anything you want to get on the other side of. >> police say the suspect's gun was a mac-10 pistol and it jammed during the shooting. good thing it jammed because who knows what could have happened. all righty. i know it is a bitterly cold day for a lot of you out there. let's go to bonnie schneider and find out how it's going to shape up. is it going to get any warmer for these people? >> not in the immediate future. we are looking at very cold temperatures, crist i and lake-effect snow and blizzard warnings in effect for parts of michigan and upstate new york. blinding snow, we can see one to two feet of snow. rochester, new york, got pounded off lake ontario, check out these white conditions and we have pictures what to show you what it looked like out there and that's heavy snow certainly across rochester, new york. we're looking at that and the whiteout situation. the wind, boy this brings back memories. i didn't live through rochester and i've lived through the

storms and it's very challenging. i give everyone the best of luck that has the lake-effect snow today. we have heavy snowfall totals and measuring it by the foot in some places and we're expecting parts of ohio and the reason we're getting so much snow is the lake-effect snow machine and that's what we call it, the cold wind from the northwest coming over the warmer waters of the lakes taps into the warm moisture off the lakes, grabs a hold of it and then the air rushes on to land and once it's over the colder land temperature because the land is colder than the water it can't hold the moisture anymore so it dumps it in the form of heavy snow, possibly two to three inches of snow an hour. combine that with the wind and you have a white out situation, crist i. it is not just cold and windy in the great lakes. wash wish, d.c., we'll have a live picture of the capital. 25 degrees there and gusts up to 22 miles per hour and look at the steam coming up and the

a grand jury says two missouri cops were justified in the shooting death of a suspect. kansas city police received this dash cam video. take a look here of the september shooting. there's the suspect that starts shooting at a cop car. the officers order him to drop the car. you see the cop that went down there.

he appears to be hit and he pops back up and again, starts shooting. women who have had breast cancer may put themselves at risk when they drink alcohol. a new study finds those women have a 30% of breast cancer recurrence and that's with moderate alcohol consumption of three to four drinks a week. post-menopausal and overweight women may have the greatest risk. this study, by the way, was done by kaiser permanente. while so many of you are struggling to make ends meet, government employee salaries, they may leave your eyes popping. let's put it that way. our money expert jennifer westhoven has been crunching some numbers. you look a little perplexed, too. >> maybe now you know they don't want to limit wall street salaries. they want huge ones for themselves. i thought if you go to work for the government and you are doing something noble and you may not get rich. not necessarily anymore. federal salaries have exploded and i'm especially talking about way up at the top.

when the recession started there was one person at transportation making more than $170,000 a year, look at the latest count. almost 1700 people making more than $170,000 a year? a high-paid defense department workers have also been raking it in, just really differently compared to just two years ago. "usa today" cites federal data for the statist beings and says many of the pay caps were repealed. the queen of personal finance, kind of my personal finance heroine, suzy orman and here's what she had for you for the holidays. >> the greatest gift we can all give each other this holiday season is the gift of honesty. if you have the money out there, if you don't have credit card debt and you have an eight-month emergency fund, go out there and buy anything you want, spend your money, but if you have credit card debt. if you're not saving and you don't have an emergency fund can you just not spend what you don't have?

casey anthony's due in court in about an hour now. her attorneys are trying to get the death penalty taken off the table. remember anthony's accused of killing her 2-year-old daughter caylee. she's pleaded not guilty, but watch live coverage of the hearing right here at hln starting at 9:30 eastern. defense secretary robert gates met this morning with the iraqi prime minister, he expressed condolences after a wave of bombings killed more than 100 people there. u.s. officials are saying the attacks could be a sign that al qaeda is weakening. gates was in iraq to talk with u.s. troops and remind them their mission is critical. roman polanski's attorneys are pushing to get his under age sex case dismissed without polanski showing up for court. a california appeals panel is considering the request.

polanski is under house arrest in switzerland. the filmmaker pleaded guilty in 1977 to having unlawful sex with a 13-year-old girl and fled the u.s. before sentencing. police in pakistan said five young americans arrested there tried to contact terrorist groups on the internet. the men are accused of plotting a terrorist attack. the father of one of those suspects was also taken into custody. pakistani police say the young men wanted to join militant groups and die as martyrs. there are some of the headlines we're watching for you today. i'm christi paul. so glad to have your company with us. robin meade is off today. a storm is forming in the west and expected to dump a foot of snow in the sierras, a region that's seen three feet of snow and people in lake tahoe have been without power since sunday. >> it happens about every ten years, but this is the worst one i've seen in 30 years. >> in regards to? >> in the amount of snow, the

his ponzi scheme cheated people out of billions of dollars. our money expert jennifer westhoven breaks down what was lost and what's been recovered at least so far. hi, jen. >> hi, thank you, christi. this is the morns that so many people went to bed feeling secure and feeling they'd done well and woke up to find out they'd lost it all and they'd been cheated by bernie madoff's ripoff scheme. more than a thousand people directly hit and most will get very little back. 10 cents for every dollar lost. $21 billion tallied at this point and only $1.5 billion recovered. you know the stories where they're selling off the mansions and the yachts and stuff like that. a very interesting article this morning in "the wall street journal." they really talk to a lot of the people who know bernie in jail now. he's in butner in south carolina serving out the 150-year sentence and maybe you can't believe this, he's recovered something that he lost on the

outside. respect. a fellow inmate who was quoted in the newspaper this morning says to every con artist, he is the godfather. can you believe that? >> we have to remember who that's coming from. a fellow inmate. >> to them he's a success story. >> wow! that is something. all right, jen, thank you so much. south carolina governor mark sanford wants to reconcile with his wife. remember sanford disappeared this summer and admitted he was having an affair with his argentine mistress. jenny, the wife, told abc news she will not be standing by her husband's side while he deals with the repper cushion of the affair. they rejected an impeachment resolution against the governor and faces an ethics hearing next month. a duck in washington state tried to fly away from a pond. here's the problem. it was stuck on the ice. emergency crews responded to a 911 call about this troubled duck and when it was found it was covered in icicles and its feathers were frozen.

an animal rescue crew was able to free the duck and it was a domestic, not a wild animal. peer little thing. at least it's better now. ice, that's something a lot of you will see today, huh, bonnie? >> watch out on bridges and overpasses because even when the snow stops we'll see the snow-covered roads freeze over and with the wind whipping around those bridges it will be tough to travel. we're currently outside right now and it's 14 degrees in toronto, canada. we have 18 in erie, pennsylvania, that snow is causing traffic problems and 6, that's it in milwaukee, wisconsin and you factor in the windchill it's each cold out there. temperaturesing for thor off to the west and minneapolis at negative 2. that's the temperature outside right now. the windchill is negative 12. so this is a good day to be in those indoor areas if you can be because it will be brutally cold out there. low clouds coming in from the gulf of mexico, working their way into miami. so we're getting some heavy rain there as well, and i mentioned

miami because the current temperature right now, 73 degrees and still very warm, but incredibly warm, when you're talking about december weather. yesterday miami shattered a record high temperature. it got up to 89 degrees and just to let you know, that record went back to the 1800s and that's how long it's been since it was this warm in miami. there were record highs nearby in west palm beach, fort lauderdale and vero beach and key west, normal it 10 degrees cooler, but it will take a while. yesterday was the warmest ever in december for miami, florida. enough of the warm, that's just a small piece of the pie. the rest of the country is bitterly cold with the cold air coming in from the northwest creating the lake-effect snow machine. we're looking at heavy amounts of snow for western michigan. areas just north of erie, pennsylvania and right here in upstate new york, maybe not necessarily buffalo itself, but nearby. possible ney this region here some of the counties just to the south will see one to two feet of snow on the ground. erie, pennsylvania already saw some heavy snow.

be sending. there's something that doesn't smell right because you might take a side that you don't necessarily believe in because you want presence. you can see a lot of people in that uncomfortable position. this is happening on both sides of the issue, groups that either love or hate government health care reform and their efforts to try and blanket washington, d.c. with postcards or e-mails, but watch out for this and something you should know is if you really do want the freebie. probably if you read the fine print you can get it without sending in an opinion that may not necessarily be your own. it may just be manufactured by some group. just in the past few minutes retail sales up 1.3% in november. part of that was because of a little hike in gas prices although they're mostly in control. if you took gas out of picture sales were still up almost a percent. job hunters, it may not help you in getting a job right away, but long-term, over the next decade, the government predicts if you're skilled in these, if

"in session" correspondent jean casarez will join and live coverage it starts at 9:30 this morning eastern. we're learning five americans arrested in pakistan of suspected terrorists are trying to contact militant groups on youtube and other websites. this is from police in pakistan who also arrested the father of one of those suspects. u.s. intelligence officials have been increasingly wordied about homegrown terrorists who might be recruited by radical groups. the biggest mistake is to underestimate the terrorists as unsophisticated.

>> they communicate regularly through the web. they even adopt american names and sometimes even enter through chat rooms. one of them playing a male and one playing a female and you think that they're just connecting where in reality, they're passing information to each other. >> in norway to accept the nobel peace prize president obama says "we have to be constantly mindful that some of these twisted ideologies are available over the internet and can affect our young people." defense secretary robert gates met this morning with the iraqi prime minister over a wave of bombings that have killed more than 100 people there. the attacks could be a sign that al qaeda was weakening. gates was in iraq to talk to u.s. troops and to remind them their mission is critical. >> the man accused of making nude videos of erin andrews is expected to plead guilty.

rafer weigel, now, this doesn't happen today. >> this does not happen today, but, today, authorities are saying they got the guy who did it. the stalker who videotaped andrews in the nude through a peep hole in her hotel room. according to court documents and will plead guilty to a federal stalking charge and that will happen this tuesday. now, andrews, as you know, is a sideline reporter for espn and a victim of violation of privacy and she told oprah winfrey she felt violated by these videos when she became aware of them. >> rafer, thank you. about one in six americans has had the swine flu, that's a new estimate from the cdc that says 50 million people got sick from the h1n1 virus and about 10,000 died from it between april and mid-november. most of those people were between 18 and 64 years old. the cdc says you should get

vaccinated because most people, obviously, have not had it. those vaccinations still very important. a cia official denies a report that blackwater security guards took part in secret cia missions. former blackwater employees and intelligence officials told "the new york times" the company regularly helped with snatch and grab raids in afghanistan from 2004 to 2006. a u.s. official tells the associated press blackwater provided security but did not perform cia missions. boy, a deadly storm has left so much of the country freezing cold and bitterly windy. blizzard conditions hammered parts of the midwest through the northeast where even more snow is expected today. at least 17 people have died. now, today, strong winds will make it feel like 20 below for some of you in the plains and midwest. at least some of you are trying to make the best of it. >> it's not my favorite time of year, but i don't mind it. you just have to dress for it.

snow in iowa. some place we don't get cold weather, how about memphis, tennessee. outside it's 28 degrees and it's been cold there and that's the midsouth and how about the southeast down in florida. well, i'll tell you something, it doesn't get this hot, 90 degrees in miami and now the low clouds are coming in and overcast conditions and wet weather and i believe we have some live pictures of miami we can show you some of the clouds rolling in and doesn't look sunny, but the rain will come. today's high about 82, 83 degrees on the high side but yesterday, wow, it reached 89 degrees. almost 90 degrees in december. that's the warmest day in december in miami ever on record and not just miami but vero beach. folks in minnesota and maybe erie, pennsylvania, are wondering where is my heat? it will come this summer. >> you have to wait for it. thank you so much, bonnie.

casey anthony's lawyers want to block the death penalty. we're tracking this morning's upcoming hearings of the mom accused of killing her daughter. in a few minutes we'll take you live to the courthouse. plus -- >> now, i can see that the lights are on. a blind woman is getting her vision back thanks to a bionic eye. how it's removing decades of darkness for her.

so many of you are struggling to make ends meet. government employees, that's a different story. their salaries are booming. our money expert jennifer westhoven has been checking this out for us. >> no wonder they don't want salary caps for wall street, they don't want salary caps for themselves. i'm not talking about the government working, necessarily, the people at the top. kind of the long held tradition has been if you work for uncle sam and you work for the

government, it's noble and you're performing a service and you won't get rich because you're working on the taxpayer dollar. not necessarily any more. federal salaries have exploded, especially at the top rung. this is the transportation department. couple years ago only one person made more than $170,000 a year and that's almost up to 1,700 and there are thousands of people at the defense department who are making numbers like that, like where we're talking about almost in the rich category by the federal government standards. "usa today" cites federal data and say many of the old pay structures were repealed. the queen of personal finance suze orman was on larry king last night and she was talking aa little bit about so many people who are struggling with what to do with the holidays here. >> the greatest gift we can all give ourselves this holiday season is the gift of honesty, if you have the money out there, you don't have credit card debt and you have an eight-month

emergency fund, go out there and buy anything you want, spend your money. but if you have credit card debt and not saving and if you don't have an emergency fund, can you just not spend what you don't have? >> i just think, really, if you have credit card debt, you know, maybe there is a lot of shopping days left, maybe you want to take it easy. be willing to be honest with people and say, you know, i really can't afford an expensive gift i'm making my financial security important to me in the coming year and i think it can be really hard and some people think that's hard on their pride but you end up closer with people that you talk to about that. >> bake them some cookies, fill up their tumies and they'll be happy. >> all those digital photos. there is all kind of things you can do these days. some are calling it a bionic eye. in this week's "fit nation" dr. sanjay gupta reports on this new device that is helping people get their sight back.

found the ring in the folds of a dog food bag. turns out it belongs to somebody that works at the dog food store. >> worst odds than winning the lottery finding something like that in your dog's food. >> the owner says he's really grateful auto's owner kept trying to find him. good people there. a grand jury says two missouri cops were justified in the shooting death of a suspect. kansas city police released this dash cam video of the shooting. see the suspect start shooting that cop car and the officers ordered him to drop the gun. you see that cop go down and he pops back up and, again, starts shooting. let's talk about fast food. how would you like a made to order pizza at a drive through. a restaurant in northern california is offering customers a fresh pizza cooked in just a couple minutes and all thanks to a high-tech oven system.

>> after the police were there, clearly, they had either taken off of him or found by him a pretty significant weapon that he pulled to the side. someone else had said it was something like a mac 10 but a small gun with a huge clip underneath and it did not look like anything you want to get on the other side of. >> now police say the suspect's gun was, indeed, a mac 10 pistol and it jammed during the shooting. we want to take you back to florida right now and casey anthony. there is judge stan strickland as he's hearing arguments, it looks like from the prosecution at this point. her attorneys are hoping to get the death penalty thrown out in this case. remember, anthony is accused of killing her 2-year-old daughter, caylee and that she has pleaded not guilty thus far. here's the striking thing about this today. caylee's remains were found one year ago today in some woods not far from the anthony home.

but, again, arguments being made right now and not only the defense trying to get the death penalty thrown out but her attorney trying to seek a protective order and he wants more privacy with his client as they are, as they are conferring. so, we'll continue to monitor this behind the scenes and we'll bring you appearances throughout the day, throughout the morning right here on hln. want to get some other news to you, a new senate plan on climate change would allow more nuclear power plants to expand oil drilling off the u.s. coastlines. senator john kerry says the compromise is a move to get more republican lawmakers onboard. the compromise bill would also ease proposed restrictions on greenhouse gas emissions. president obama plans to call for similar restrictions at the climate change in copenhagen. 14 connecticut firefighters got promoted after a five-year legal battle. the white firefighters sued city

officials in new haven because they threw out the results of a promotional test. city officials said not enough minorities did well on that test. the case went all the way to the supreme court and it ruled the white firefighters' civil rights were violated. >> through persistence and hard work it proves individuals can make a difference and was because 20 individuals stood up together. >> challenging the exami's validity. one other big story is what is happening with the weather and how badly is it affecting you. are you able to even get out of the house? interstate 90 around erie, pennsylvania, is closed. >> the lake-effect snow machine. a weather phenomenon when it sets up meaning the cold air is sweeping across the colder water of the great lakes and grabs a hold of it and when it goes over

colder land mass the cold air can't hold the moisture and it releases it quickly in the form of heavy, heavy snow. that plus blustery winds makes a big difference in visibility and this morning temperatures in the teens across the area and we're also looking for cold temperatures this morning in memphis, tennessee, but at least it's finally getting a little cooler in miamae no where near these numbers but yesterday the high was 86 degrees and the clouds are rolling in and there they are, big change since the last time we looked that tower cam from wsvn. overcast conditions will make a big difference in south florida and upper 80s near 90s and i don't feel bad, the record high was 89, the warmest december day ever for that city. >> i don't think people will sneeze at that when they know what people in the northeast are going through. thank you, bonnie. >> sure. on wall street the dow is riding a two-seat session winning streak and we're already in positive territory. can investors make it three for

three by the end of the day? felicia taylor, what do you portend? >> i think we're going to be okay today. some good numbers. the bulls are out in the first few minutes of trade. stocks rallied after a new report showed that china's exports improved last month and exports here in the u.s. also improved. are shoppers shopping? the answer is -- yes. retail sales rose 1.3% last month and that was more than double expectations. a big portion of the increase was due to higher gas prices and also sales rose in electronic and home department stores and stocks are trending higher by 2%, especially at macy's. finally, we are looking for discounts this holiday season. some are finding them in the five-finger form. experts say shoplifting is on the rise with the university of florida survey saying store increase for the first time since 2008 to $36 billion lost.
