tv Nancy Grace HLN February 2, 2010 10:00pm-11:00pm EST
10:00 pm
breaking news tonight. satsuma, florida. a 5-year-old girl tucked into bed and five hours later she's gone. daddy comes home to find not a trace of little haleigh. last person to find her alive, new stepmother, mystery cross lynn, who takes to the air waves to claim that she's innocent. but even in one brief interview croslin cannot keep her story straight.
10:01 pm
bombshell tonight. after haleigh's father and misty croslin both handcuffed, arrested, booked. cummings talks first and tonight we learned that stepmother mystery croslin does the same. as we go to air, we discover jailhouse tapes, video and audio hours and hours of misty croslin, jack, jack, yacking away. including an hour-long visit with mommy and daddy all caught on video. croslin already cracking behind bars ratting out her brother on a felony. police convinced that croslin is the key in haleigh's disappearance. and after 12 days of isolation,
10:02 pm
haleigh's dad is moved. where is haleigh? >> jailhouse recording, up to five hours of tapes set to be released. what clues do they contain? >> what's your relationship with misty? >> there really isn't a relationship. i guess ex-wife/friends. >> reporter: misty could be looking at a 150-year prison sentence lawyers say if she knows anything that happened to haleigh. now would be the good time to talk. >> they just need to move on and look for the right person.
10:03 pm
>> if i find whoever has my daughter before ya'll do, i don't care if i spend the rest of my life in prison. i don't care. >> that's all i know. when i woke up she was gone. >> even though croslin squeals, telling cops he stole items, including a 12-gauge shotgun and five mini bottles of jim bean, two bottles of dawn dish liquid and harry potter dvds. he could be facing life in prison on charges of burglary and grand theft. >> good evening. i'm nancy grace.
10:04 pm
thank you for being with us. bombshell tonight. misty croslin both handcuffed, arrested, booked. cummings talks first. and, tonight, we learn stepmother misty croslin does the same. as we go to air, we discover jailhouse tapes. video and audio hours of misty croslin yacking away, including an hour-long visit with mommy and daddy all caught on video. >> reporter: law enforcement expected to release recordings of misty behind bars. the tapes said to include extensive conversations between misty croslin and her parents. did she know that law enforcement was rolling? >> of course i want to know if she knows anything and what she doesn't know. >> it's well over $2,000 in pills that misty croslin and her
10:05 pm
crew were selling. she told the investigator that she was freaked out because it's a lot of pills and she didn't want to get into trouble. >> but she did. >> reporter: she's sitting in jail. investigators have her on drug charges. could they use this case as leverage with the hope of getting information about the disappearance of 6-year-old haleigh? ? police say that misty was the last person to see the 6-year-old and have always accused her of not telling them everything of that happened that night. >> if i knew where she was, we wouldn't be sitting here today. we'd have her. >> tommy croslin facing
10:06 pm
additional charges including grand theft that could put him behind bars for life. why? because misty croslin skeeled behind bars on her own brother. why will she not tell cops what she allegedly knows about the night that hail lee disappeared? >> art, you've just gotten off the phone with croslin's father and sister-in-law. what can you tell me? >> i can tell you that misty is behind bars, nancy, and she is scared. her father told me that she doesn't know what to do. she's been getting squeezed by detectives in the haleigh, not the drug case and they want to know what she knows. they have been dangling names in front of her wanting her to identify certain unnamed people and she has not given up anything yet. >> wait. wait. wait.
10:07 pm
don't lose me. art harris, police are dangling names in front of her. okay. her storely story all along has been she was there at the home alone. >> asleep. >> with the 5-year-old little girl haleigh and ronald cummings junior. that they were asleep. her story got twisted up as to which bed they were in and so forlt and the next thing she knows she wakes up to go to the bathroom and then the babe girl is gone. she didn't hear a thing, see a thing, she doesn't know a thing. so what other names are there to dangle in front of her? >> nancy, that is the $64,000 question in satsuma. who are these that police are dangling? we don't know. could they have been in her dream that night? she woke up and remembered those four shadowy figures in that trailer. we don't know that. she has heard some names and she's not talking. >> to you, marlena, what can you
10:08 pm
tell me? >> i can tell you, nancy, she's not saying anything about the night that haleigh went missing but she has no problem telling police that her brother stole dvds from their neighbor. was she really at home the night of this case or this goes back to was she possibly passed out the night that haleigh went missing and she doesn't even know what to tell police at this point. >> we are taking your calls tonight as we go to commercial, secret jailhouse audio and video of former stepmother, misty croslin, hours and hours of her. art, she is talking for hours on end to who? who is visiting her and who is she talking to? >> welling, the last visit, nancy, was with her parents, an hour visit. they split it up into 30 minutes
10:09 pm
each. her mother and father and her brother tommy got a visit from his wife lindsey. so that's the other -- >> don't care about tommy croslin unless you can tell me something that she has blurted out during one of her drug-fueled nights on the town. so all of these people are visiting. is it one on one? are they across the table? how does it work? >> i believe it's through a telephone and then at a different location than the actual inmate, nancy. that's how they have it set up there. >> so what you are telling me is, the visitors are at, for instance, a visitor center and a different building can they see each other? >> i think they can. so there is video or there is video much each person talking but i'm told that they can see each other.
10:10 pm
>> well, her attorney can sit with her and the only person that can sit with her in the prison where she is. the visitation, though, nancy, is a web cam. so she can only speak through a phone and a web cam. >> people, people, let the parents go in and visit. let them hold hands. let them hug. let them krichlt maybe she'll tell the truth. out to the lines, jesse in kentucky. hi, jesse. i think i've got jesse in kentucky. i certainly can hear you. okay. let's try melody in ohio. >> caller: hi, nancy. >> hi, dear. what's your question? >> caller: my question s. for god's sake, the money that they were using to spend on these drugs y. did not ronald cummings put that money towards the
10:11 pm
reward money? for god's sakes? >> you know, interesting question. how much money are we talking about, art harris? >> we're talking about $4,000 worth of drugs that they sold so this was cash in their hands supposedly, nancy. >> okay. art, very quickly, we only have less than a minute left. all of these hours of misty croslin talking on video, how are we getting our hands on it? how is it that we are getting it? >> the st. john's sheriff's department has been taking these recordings and they are now being reviewed by the case detectives in putnam county. they are redacting them tomorrow. we expect tomorrow to get a dvd of the misty tapes. >> yes, doi have a please age for whoever has taken haleigh. i would ask that you please, please bring my daughter home.
10:12 pm
10:15 pm
i wish they would have taken me instead of her. she's only 5. she can't really do anything. i don't know where she is. >> she was a 16-year-old child whose job was to look after somebody's two young children and i can only imagine that this girl would want to get out and have some kind of fun. >> i look at her like she's my own. i would do anything to get her back. >> of course i want to know if she knows anything. what she does know. >> we need to find my daughter. >> okay. do you think misty has information that could help do you that? >> i don't think she holds any information that is going to help find haleigh.
10:16 pm
>> reporter: misty's brother was taken by police to be questioned. that's what she told them. it looked like no one was home that night. >> he told police that he banged on the door and got no answer. he looked impb side the windows and saw no lights, no television, did not hear a sound. >> i would have woke up if i heard any noise. i didn't hear anything at all. >> >> if someone is whaling on the door, there's no way that she couldn't have heard that whatsoever. >> do you believe she left the home and left the children alone, ronald? >> absolutely not. i want to get to the bottom of what happened. one way or the other, i want my daughter to come home.
10:17 pm
10:18 pm
to see little haleigh alive. she jacks with visitors, including her mommy and daddy. let's remember, there is no mommy daddy privilege like priest, parishioner, husband-wife, attorney-client privilege. nothing they say will be kept out of court. let's unleash the lawyers. we're taking your calls live. family law attorney sue moss and raymond gudice and peter, also out of the atlantic jurisdiction. weigh in sue moss. >> we're going to get these tapes. each one of these people would fall quicker and quicker in order to get a deal so i don't expect much. >> here's what she knows. she know who is has sold her 340
10:19 pm
some odd oxycodone pills. the dealers know something about what happened to the child. that's what she's sitting on. >> well, peter, even if she claims she can't remember anything but going this late, i guess i'd go to sleep, too. even best case scenario, i want to know who is she with. who is she with in the hourses leading up to this. we know for three days before she came back to the home she had been out on a binge, awol, missing for three straight days and you know she was drugged out to the max by the time she washed up back at home. >> no question about it. the position she's in the police want her to implicate herself in a murder when she's only facing drug charges now and she'd be foolish to do that she's too
10:20 pm
sauf veto do that. >> we have and already we have some of them which are playing. hours on end of girlfriend, babe sitter turned stepmother, misty coslin says that she's the key to the case. >> i don't think she's sitting on anything or holding back anything, quite frankly. i think she's a poor, scared little girl who would knowingly turn over any information that she had if she thought it could bring home little haleigh at the time. the drugs have ruled her life and ruined her life and it's probably not much there to work with. if there is, it's going to take a long stay in prison and some rehabilitation to bring it out. >> b.s. i never said that to you, marc klaas. but this little girl had this
10:21 pm
10:24 pm
10:25 pm
we are taking your calls live to mark herald, joining us live from new york. thank you for being with us, mark. what is all the chitchat? is that to open up the individual to finally they've got something worth listening to? >> it's still a missing person case. they are not just collecting evidence to complete a crime that they want to get into court. they are doing whatever they can within the bounds of the law to dangle whatever they can and find a way to find out what she knows. i don't believe she's sauf vee at all but i believe she knows something and they are having to do this as a case that is not going to trial to package up. you're still trying to find this girl alive. >> i was kind of troubled about a statement that i had heard
10:26 pm
from the jailhouse interview with ronald. he mentioned something when they were talking about kidnapping and the people or whatever. he said, those two. and then he went on to something else. that kind of bothered me. >> to you juanita in oregon, we will comb the transcripts to find out what you're talking about. hi, dear. >> hi, nancy. hey, i have a question about the sinder block placed in the back
10:27 pm
door. do you know if they ever did touch dna to get the cells off the rough surface. >> what about it? didn't they test the cinder block? >> they did. they took it into evidence and never came back with anything after that. even the door they took. and they never came back with anything. >> and very quickly, mark herald, if you can explain touch dna. >> any time there is a transfer, if they can get dna off the skin cells, it can be incriminating. i know they took the cinder block.
10:30 pm
. ronald, even behind bars, faced a lifetime that he will only talk about haleigh. he said to this moment he has not changed his mind. if he finds the person that killed haleigh, he will kill that person. he doesn't care what kind of jail time or even if it offers the death penalty. it's worth it to him. >> they heard misty was dealing, that they could get drugs from her and they called and asked if
10:31 pm
they could deliver. >> how old are you? >> just turned 18. >> they have her behind bars and they do intend on questioning her again about haleigh's disappearance. >> when did you last see her? >> we knew all along that misty was the last one to see haleigh, allegedly the last one to see her alive. she knows more than what she's been telling. so hopefully, hopefully this will put a little bit more pressure on her to see her. what do you know? >> i'm trying to do everything to find her. answer the questions that i have to. i don't know where she is. >> what does ronald know? >> video and audiotape, misty
10:32 pm
croslin ratted out her own brother on felony charges. out to you art harris. as part of her talking to investigators, she ratted out her own brother? >> that goes to show that in satsuma, blood is thinner than water. and misty had no loyalty at all within a heartbeat of being incarcerated, she told him about tommy, that she did not recognize that tommy had stolen. they matched that up with a neighbor's theft report. they searched the house and asked his wife and wa-la, their towels, dvds of hear hair repotter. she's not loyal in the east. >> what could she gain for
10:33 pm
stealing captain morgan? who cares? >> you cannot describe the rational thought processes to the people in this case. if she thought perhaps she may get a decade or two lopped off of her drug trafficking sentence, perhaps that is racing through her mind. but she's very, very frightened about the drug case. >> i guess she should be. i know she's frightened. i understand that. i don't care. all i want to find out is where this girl is and what became of little haleigh. and why is stealing a bottle of captain morgan and some harry potter dvds, how does that get you life behind bars? >> well, he also was allegedly -- he allegedly stole a gun, nancy. so if you steal a gun in the process of another crime, that's a felony, and that can get you life in prison. >> we are taking your calls live. pauline, hi, dear. >> caller: hi, nancy.
10:34 pm
respect your show. admire you for keeping us alive. my question is, are these people perhaps in a drug deal and they have given away misty and they are now trying to recover that money? >> excellent question. you know, ray, i hear this ransom, sold for drug debt, sold the baby bee to get back at the father. that hardly ever happens. i don't know that it's ever happened. arizona is the kidnapping drug trade of the state. does it happen? the sean most likely not. i agree with you.
10:35 pm
>> what about it peter? >> i think it's more than likely that she was not there. >> sue moss, while the two defense attorneys are laughing it off as drug dealing, you know, it might have been 2000 here, 800 there, but somebody is supplying them. somebody with a lot of drugs. there's a distributor in the mix somewhere. there's a manufacturerer in the mix somewhere. somewhere there's a doctor or a dentist writing scripts out of the ying-yang. someone is looking at a lot of jail time. the likelihood to come down to satsuma, florida and steal the little girl out of the home, unlikely. >> that's true. but mark my words. drugs has something to do with this crime.
10:36 pm
unfortunately it's going to take a lot more prison jerky to get her talking prison talk key. >> little general, let's talk about the dream because that has intrigued me from the moment i heard it. she is saying -- misty croslin is saying that i don't know anything and i pray to god she mentions this in the videotapes. i had this dream where four guys were in the home the night that haleigh goes missing. little general, how much of a dream is that? >> it's quite a reality. it's not a dream. >> remember o.j. simpson had a dream about somebody killing his wife? that somebody would be him. >> exactly. she knows so much. and i could tell this early on we saw her body language would w so many tales of deception, from the lick licking to the shoulder
10:37 pm
slugging to the monday toe tone voice to the defiance, repetition of words. we saw so many tales and we know that she had something to do with this. >> of course she did. but we don't know what. maybe it was a case of allowing these people in the home, maybe something to do with the drugs. but she was the last one with the girl. and we still don't know where 5-year-old haleigh is. out to professor of health, john hopkins. thank you for being with us. dr. marty, she's been behind bars now around 12 days. how long is it going to take a full fledged develop freak on oxycodone and oxycontin to dry out? >> she could be in the middle of that process right now. typically it takes two to three weeks. these heavy narcotics, these narcotics that people can forth a prescription for. but we may not see the effects of this wear off until about six
10:38 pm
weeks, after which they get severe depression, fatigue, and they get generalized malaise, and that lingers on for months afterwards. >> dr. marty, what about the lick licking and those are withdrawal symptoms. >> >> we know that there were hours and hours of videotape of misty croslin with haleigh. you talked to misty croslin's father and sister-in-law. what can you tell me again about those tapes? what do we expect to hear? >> if you get the tapes made today -- >> right. >> you will hear misty talking
10:39 pm
about things like what happened that night. 50i6 never known this from her sister-in-law before but she says she was so tired from those parties in the last three days in which she came home she did not want to baby sit. that she called ron ds mother and she offered to pay her to baby sit and misty told her sister-in-law she didn't know if she wanted him to baby sit. she said it was okay. that's the last we know, nancy. thas what you'll hear on tonight's tape. >> so you're telling me the night that she was there she didn't want to be there, she did not want to baby sit? >> that's what she told her sister-in-law who i talked to tonight suddenly one of them disappears. we're taking your calls live. as we go to break, happy
10:40 pm
birthday to one of our regulars. we know her, love and respect her. dr. leslie austin. she had a big birthday and i'm sure she celebrated not only with her humaned loved ones but all of her beloved pets. they get dressed up for every holiday, halloween, christmas, easter, you name it. dr. leslie, happy birthday.
10:43 pm
misty's brother reportly was arrested on a gun charge. tommy croslin says that he went to the trailer the night that haleigh disappeared. he pounded on the door but no one opened it. misty croslin says that she was home all night. >> i walked in the kitchen and the back door was opened. i didn't notice that about haleigh until i went in the room and she was gone. >> her story changes so the ring
10:44 pm
of truth is that somebody went there and she wasn't home when she knocked. >> i'm trying to do everything to find her. answer any questions that i have to. because i know i didn't do anything with with -- to that little girl. i would never hurt her. >> i thought all along that she had something to do with it and now this kind of just proves it. i mean, she's the last one to see our daughter and her stories just don't add up. >> they go out and look for the right person, maybe they would have the answer but they are trying to get all of the answers from me that i don't have.
10:45 pm
>> we learned tonight, hours upon hours that stepmother, misty croslin on video and audio. what did she say to her mother and father and others that came to visit her behind bars? let's take a look at where this bunch is shacked up. they are in a couple of different locations. a couple of different jails. and we're also learning about jailhouse amenities. recreation time outside of jail, we are learning about library rees, tv, recreation yard, g.e.d. classes, programs. we learn about a menu tonight, chicken, rice with gravy, peas,
10:46 pm
and fruit juice. i had a couple of chicken nuggets in the car. they are eating better than i did. >> she's only in protective custody. so she can watch tv. and she can pretty much have visitors through the week depending on the schedule. for ronald, he's in isolation in putnam county. he can only have 20 minutes twice a week for visitation and supervised recreation. >> so while they are having chicken and rice, pudding, fruit jis, a 5-year-old's body is likely somewhere decomposing or else she's been kidnapping during one of misty croslin's drug hazes and god only knows where she is tonight. and also we learned that ronald cummings has been moved to where
10:47 pm
and why marlena schiavo? >> he's been moved to putnam county. he was originally separated by the defendants while they were still investigating but now he's back where he belongs. >> out to the lines, ann in iowa. hi, ann. >> caller: yes. i firmly believe that misty sold haleigh for drugs. not the money owed, nothing, but just sold her to get more drugs. >> in iowa there was a time that i would have scothed at that theory. but now in the magnitude of her drug needs and dependency, i think that may be entirely possible. the only thing, she hasn't been popped up anywhere. there's been no legitimate sitings of her. is that correct? >> that's correct. the put name county sheriff's
10:48 pm
department has a whole files, books of quote sitings that they have followed up on and no haleigh. i can tell you that theory is a little more than a theory in the mind of misty's father who told me that ron claimed he knew where he could get misty back for $35,000. he tells me he's told that to the police. that probably went right into one of those tip sheets and, you know, no one has been able to verify that at all. >> back to marc klaas. the more we hear, the more tangled up it gets for this little girl. what is your suggestion now to police that you've been here? >> i would say now that the police should do is focus on that group of drug sharing individuals that congregate in and around misty. who are the people that she was with? who could have been there that night? perhaps the little girl took a
10:49 pm
pill and died and someone disposed of her and misty may not even be disappear aware of that. but i would suggest it's probably with that group of individuals with whom they socialize and do drugs. that's probably where the answer is to this mystery. >> even if that were the scenario, it's still negligent homicide. sue moss, ray, peter odum, another issue about misty croslin talking behind bars. a lot of people think what you say to your parents, raymond, is somehow protected. that's not true. >> absolutely not. there's no privilege, as you pointed out. the attorney-client, maybe a tear tal privilege in some states but not in florida under these circumstances. >> if you're thinking back on the o.j. simpson trial, do you remember when rosie greer visited him in the capacity of a
10:50 pm
minister and simpson made some incriminating statement, akin to a confession, even though a sheriff apparently overheard it, it still was disallowed in court. in. >> in that case, because the sheriff accidentally overheard it. if the sheriff had been there then there would not have been any legal privilege whatsoever. >> sue moss, weigh in. >> i'm not sure about that. rosy greer apparently is a member of the clergy and i believe at that time he was claiming that there was the clergy privilege.
10:54 pm
brand new "jersey shore" outrage. why some people are furious that mtvs hit show got renew yood and the nasty fight over the secret j. lo tapes. that's your showbiz news tonight news break. we start, top of the hour right here on hln. >> that's ronald couplings talking to the "florida times union. on the line, dawn. >> caller: hi, nancy. i love your show. i think its great. >> thank you. >> caller: my question is, in all of this, where is misty's
10:55 pm
brother and has he been questioned about anything? >> what about it r. harris? >> misty's brother will be questioned and he'll be questioned again but he says he knows nothing. i was told tonight by his parents he's willing to take a lie detector test and pay for it themselves. they had their own private i that would do it for $750. >> remember him saying a guy dressed in black with squeaky shoes was in the home the night his sister went miss something. >> that was junior's quote -- comments. >> what about it, lillian glass? how would you handle a child witness like that? >> oh, nancy. it's so complicated because you can see that they're lying through their teeth. they change their stories. all of their tales when they speak, it's complete lies and it's very difficult to get a handle on this. >> art, what more can you tell us? >> i can tell you as far as the child goes they had experts question junior from the
10:56 pm
university of florida, who were specialized in child psychology and this kind of traumatic kind of case and that's what they told the expert. however the child is too young for irrelevant to hold up. >> right. >> in court. >> art, what can you tell us? you have have alluded to mind games with cops. what do you think in. >> that is the term that the parents used with me tonight. that's misty's freezing of what has been going on over the last few days that they've been playing, quote, mind games with her. >> oh, please, her mind is so fried she wouldn't know a mind game if it bit her in the neck, art harris. everybody, let's top and remember navy first class brian ouellette, a navy seal awarded the bronze star and purple heart. lost his life before walking in his graduation. his mother, accepting his bachelor of science degree in
10:57 pm
his honor. a black belt in karate. fluent in spanish, loves sports and the red sox. leaves behind grieving parents, six brothers, one sister. brian ouellette, american hero. thanks to our guests but our biggest thank you is to you for being with us tonight. and a special happy birthday to one of our stars andrea. she loves sting and the police but her number one love is her beautiful little girl, lilly. she bakes cupcakes for our show. happy birthday, andrea. and remember, the tipline in the hally case, 1888-277-tips. i'll see you tomorrow night 8:00 sharp eastern. until then, good night, friend.
