sailors missing in afghanistan and kidnapped the other. a napa county soldier was laid to rest today after fighting in afghanistan. >> reporter: jim served four years in the army and 15 months in iraq before going to afghanistan. he was killed there 11 days ago at the age of 21. he died july 14th along with three fellow soldiers when an ied destroyed their vehicle. he went into the army and did service in iraq. >> he had everybody's back and he will definitely be missed. he was a great guy and we will always love him. >> reporter: 15 g.i.s have been killed in afghanistan just this past week. with at least 50 americans dead according to military times

online, meanwhile a hunt continues for two missing u.s. navy men. taliban claims one man is dead and they want to exchange his body for two insurgent prisoners. >> we focus on the return of these two individuals. >> reporter: the two servicemen were headed back to their base in kabul when they apparently ran into taliban fighters. they are searching for the navy men when they disappeared in kabul. >> it serves to remind the challenges we have and also the service and sacrifices that so many make. >> reporter: army specialist shay stanley is back home of a making the ultimate sacrifice. >> he did anything they told him to, he was just always willing to sacrifice for other people and he made sure the job

got done. >> reporter: as evidence of tough times ahead, documents printed in the new york times said, the taliban is stronger than at any time since 2001. they say the war is hand strung. they will not count this counterinsurgency as an out period. they are not contradicting anything that is known about the war but a lot of people say the administration has tried to be transparent and this information shows they were not. well an 8-year-old girl visiting has died in a san jose apartment fire. it broke out this morning on the 1600 block of hamilton avenue in willow grove.

the fire damaged 6 apartments. >> it is something that is hard to witness. >> reporter: but dozens who live in this apartment building witnessed a fire that killed an 8-year-old girl. >> i just started crying. >> reporter: the two had just moved in days ago, they woke to screams coming from an apartment across the pool. >> you can see an orange fire something you would see in a television show coming out the window. >> reporter: six minutes after 911 was called, they found most of the seven people staying in the apartment had made it out. one girl was trapped. she was in the back bedroom. the firemen pulled her out. >> reporter: that girl and other other people were taken to the hospital including one woman who appeared to have fainted in shock and there the little girl was pronounced dead, in a complex where most

people knew each other, the news hits hard. this man had just seen her. >> the little girls were going to some kind of an event and they all had little dresses on. >> reporter: on what turned out to be the 8-year-old's last day. six apartments are vac waited -- evacuated today and those who can get in are not sure they want to. >> it is hard to be here knowing that happened and knowing it happened across the way, i feel really bad for the family. >> reporter: at least one neighbor we spoke to criticized the fire department's response time and that could get worse, they are slated to close the end of this months. a seven-year-old oakland girl continues to recover after being bitten by a pit bull.

work. >> anything we can get, we will take it. >> reporter: people who live along the gulf coast hope to get their lives back. they used a plug to stop the gushing oil which has been in place for the past ten days and starting tonight they will remove the temporary cap, clean out the tunnel and put in a mile of new lining. they have to work quickly to avoid anymore weather delays. >> that pipe in the relief well is the most important item we are working on. >> bp says the completion of the relief well now looks possible by mid-august. they will plan for more delays. the agency is accusing drivers of staging a sick out but it's not true. neither appears to be bulging

after talking to both sides. >> reporter: caught in the middle of this labor dispute, 250 transit ders, last week some buses were late, others did not he who up at all. one thing they agree on, the service is just horrible. it is a daily scramble, they say they have been dancing all week. driving one week and then in a middle after shift to change and relief other operators. >> i am not used to driving 172, getting off another 72 and picking up another 72. that is three different schedules on the same line. >> reporter: they blamed the problem on the contract dispute. >> they are facing their worst budget deficit in history $56

unsafe. >> the union knows they are being dishonest when they say otherwise. the routes are the same, the service is the same and the drivers are participating in a sick out and the only thing it is hurting is the passengers. >> in the meantime, passengers are getting impatient. later this week the union is going to court in the hopes of forcing transit to rescind the contract after talks broke off but ac transit says if that happens a lot of weekend service could be eliminated and drivers could be laid off. >> all right, thank you so much. last minute negotiations have averted a strike by hollywood teamsters. they erected thousands of drivers. studios offered additional

members making $100,000 for that part-time job at city hall. >> it is outrageous. >> reporter: together she and her husband make 7 $5,000 a year and support a family of 6 on that. that is 2 $5,000 less than those part-timers at city hall. they joined the march, carrying scenes saying stop the fraud and two adults went to their homes. they urged the mayor and two city council members to resign. >> i want a job like that. >>reporter: it didn't appear any of the targeted council members were home. i knocked on doors who were accessible but neighbors say they left hours before they came here. a rally and march at city hall and tomorrow night, the showdown here. residents get to voice their

opinions at the city council meeting. residents will face them and talk more later. former san jose police chief is backing up the november ballot to legalize marijuana. he has now researched the institution for prop 19. he said legalizing pot could actually deter people from smoking it. >> if a young person is trying to get marijuana, they can get it easily because they are dealing with drug dealers, but if they try to something something that is regulated, they have to produce identification showing their age. >> reporter: he says marijuana

laws take valuable time away from more serious laws and turns people into criminals. a unique way to expose children to music. they held their 8th annual concert in the park. it includes a petting zoo where kids can have a hands-on experience with an instrument. this is a celebration of mexico's bicentennial. a graduate student returning his first marathon ever. 25-year-old keith becker posted two hours 23 minutes and 28 second and it was a new record for the race. marie carson won on the woman's side. 23,000 people took part in the 32nd annual event. they said keep running because it was chilly, right?
