p.m. that's all the information we have at this time. no word yet if anyone has been arrested. for nearly a decade wayne sanchez was haunted by the disappearance of his sister and the charges were eventually dropped against a man arrested for her murder. it looks like sanchez took his revenge. police are investigating a murder and suicide. >> reporter: it all unfolded here last night at this pete's coffee. certainly a tragic development in the case involving a missing woman. it was a fatal meeting between two men connected to the unsolved disappearance of the woman. police believe it was her brother, 52-year-old wayne sanchez, who shot and killed a man who was once arrested and charged with the murder of his sister. they spotted each other at a restaurant last night. >> the suspect approached the victim and they had a conversation in the restaurant. it is believed that during that conversation the suspect

accused the victim of being responsible for his sister's murder. >> reporter: sanchez left the restaurant but returned a short time later and followed the victim to pete's coffee. >> fatally shot the victim. the suspect then exited pete's coffee, went out into the parking lot and as the officers arrived to the scene they heard what they believe was a single gunshot so they went over to investigate that gunshot and they found a suspect deceased in a parking lot from one self-inflected gunshot wound. >> reporter: he they met in a bar in 2001 and had drinks and went back to harms' home that night. investigators believe he killed her there and used a rug to carry her body out. harms' body was never found. but the persian rug turned up on a street a few miles away. fibers found some found in the jeep but the evidence was thrown out on a technicality.

charges against the man was dropped. he finally snapped. police are trying to find answers. >> we are trying to determine if this was something that was planned out or if the suspect ran into the victim and then everything unfolded as it did. >> i can't speak as to whether this was coincidental that they met or that the suspect was stalking him or following or preplanned this. >> so certainly there are more mysteries tonight and police say they will be working with police who had this original case and hopefully they can come up with some answers. >> linda yee, thank you very much. well, the family of the two families are not speaking. don knapp talked to some neighbors who new them. >> reporter: long before her 2001 disappearance and presumed

murdered. >> it surprised me it went this long and they never found any trace of her. you would think over a long period of time that the authorities would find something. >> reporter: when police arrested the man for the murder of harms the family said they hoped the ordeal would be soon over. >> we have been waiting for this for so long. now we look with some trepidation what will happen next. >> maybe we will find out terrible things too much. >> the sanchez family would never have expected this. >> what the guy was blamed for doing with his sister must have played on his mind quite a bit and just got to the point where i guess he couldn't take it any more, you know. >> reporter: many in the neighborhood know the sanchez' story. >> ten years or so. it is a long time to be carrying that around and just to act on it like a moment like

that is just crazy and shocking it happened rights here. >> reporter: this neighbor did not want to appear on camera. >> sad that they can't find her body and put it to rest. so i think this is going to be a little bit harder to do now. you know what i mean? definitely harder. >> reporter: another person saying the neighborhood is in shock. >> it is just a tragedy all around. it is hard to say what happened. there is really no evidence either way. but my heart just goes out for the family because they have lost now a daughter and a son and there is another man that is dead and it is just really shocking and horrible tragedy. >> reporter: the murder/suicide does not end the sad story. the body has never been found and nobody can say that maurice killed her. don knapp, cbs5. well, another remarkable milestone in her recovery. congresswoman gabrielle giffords has improved from critical to serious condition a week after being shot in the head. we are also hearing the last

message the accused arizona gunman left before the shooting spree. karen brown has that recording. >> reporter: 60 minutes has obtained the last voice mail left by jared lee loughner for a friend before he allegedly opened fire at a tucson supermarket last weekend. >> it is jared. i just want to tell you good times. peace out. later. >> all in past tense. it sort of bothered me how he said we are had good times. >> the shooter was right there. >> for the first time the doctor returned to the grocery store where he witnessed the shooting. >> he had such energy doing it. he did it almost enthusiastically which was really awful to see. >> reporter: as the suspect fired in the area right behind me, he was saved by that post which he hid behind during the shooting.

he then helped hold the suspect down preventing even more loss of life. >> he was straining very hard. he was tensed very hard against the people. we had a good hold on him. the two men that tackled him weren't about to let him go. >> reporter: congresswoman gabrielle giffords was the intended target of the attack. her friend was with her in the hospital when she first opened her eyes and says she similar proving every day. >> she can move both sides of her body. she can breathe. she is showing people she can communicate well by holdlinging our hands. >> reporter: family and friends said good-bye to two more of the six victims sunday. 30-year-old gabe zimmerman, a congressional aide to gifford giffords and dorwin stoddard who died shielding his wife from the bullets. one of the shooting victims is still undergoing a psychiatric evaluation after being arrested yesterday eric fuller shouted you're dead at a

town hall meeting. this came after someone suggested toss of gun control should wait until after everyone in the tucson shooting is buried. gabrielle giffords colleagues head back to work and first on the agenda repeeling president obama's health care law. but as it is reported, both sides promise a calmer congress. >> reporter: lawmakers are making promises. >> more productsive civil discourse. >> more civil tone. >> reporter: we need to start watching what we say. >> reporter: and they are taking action. >> my colleague senator mark yudall called for democrats and republicans to sit together at the state of the union. i called up tom after he did that and he graciously agreed we are going to sit together. >> reporter: at least some politicians will literally reach across the political aisle during next week's state of the union address. but this week house republicans plan to debate a devicive measure. repealing president obama's health care bill. >> we have gone in the wrong direction to solve the real problems in health care. the real problems in health care is it costs too much and

what we have done is expanded the coverage but haven't worked on the cost. >> reporter: the effort is largely symbolic since any repeal will likely not pass the democratic controlled senate. still, some welcome the debate. >> it gives us a second chance to make a first impression. there are so many good things in the bill. >> reporter: the debate over health care was sidelined last week as lawmakers honored the victims and survivors of the shooting in arizona. now the work resumes with health care and the still rebounding economy once again taking priority. cbc news. four family members found dead apparently killed by carbon monoxide poisoning. two girls ages 8 and 10 years old as well as a 60-year-old woman and 35-year-old man north of fresno. sheriffs blame a gas-powered generator. the family was using it after electricity was shut off to the home. when he will, checking

-- checking around the bay area. a man arrested after a short chase that ended in a residential neighborhood. a second suspect was found dead in a backyard. even though gunfire was exchanged, police are still not saying if the second suspect died from police force or if he shot himself in the head. the gang rape case against several members of the dianza college baseball team will soon head back to court. and this time the alleged victim is bringing civil charges against the defendants. since the former santa clara county d.a. rejected the case the men failed to settle for. the new d.a. will be watching the case closely to see if new evidence comes to light. a muni site may become a freight yard. critics want to use the land to

expand technology. union pacific railroad bought 160 acres of land from muni. last year, 200 acres were bought after the muni auto plant closed. union pacific says freight trains would benefit the environment because they are much more efficient than trucks but many in fremont do not want a rail yard in their neighborhood. new theories on what may have caused that pipeline to explode in san bruno. what they are and why the pressure is on for pg&e to get a handle on its record keeping. licensed to kill in the east bay. wild turkkeys running amuck. i'm meteorologist lawrence karnow in the cbs5 weather center. high pressure keeping us high and dry. but dense fog will be the problem. we will have details on that coming up. spiking pressure on gas lines for years and that has someone wondering if it contributed to the san bruno pipeline explosion. now lawmakers and the public are asking question. the utility doesn't have answers. >> they are a bunch of thieves. >> reporter: he is one of many in san bruno still not happy with pg&e four months after the disaster. >> it is supposedly a public utility. they are not. they serve the public. what they want the public to have. >> reporter: and now reports that the pipeline in san bruno may have been weakened because pg&e occasionally spiked pressure to the maximum level. something they have been doing for seven years on at least 10 other pipes in california. quite surprised and actually afraid. >> reporter: state assemblyman jerry hill wants pg&e to release those pipes locations. >> they must know where the pipelines are and i think the quicker, sooner they are required to let us know where

those pipes are locate and if necessary reduce the gas pressure in those pipes. >> reporter: but pg&e says it doesn't know. >> we are currently working to verify where these pipes are. if they are just segments or complete pipelines. so whatever information is in our system we need to make sure that that is consistent. >> reporter: one of the major criticisms of pg&e is faulty recordkeeping. in fact, they didn't know what type of pipe they had underground here in san bruno. they said it was a seamless pipe and it turned out it had several themes. >> that leaves us vulnerable and leaves us unknowing of where those conditions can be the same. >> reporter: hill has been pressuring the state to crack down on pg&e which has stopped doing the spikes. the alternative, shutting down a pipeline for more than a week for a water pressure test which costs a half a million dollars per mile. >> we are taking a very hard look at all of our practices right now to ensure maximum safety. >> reporter: in san bruno, cbs5. in contra costa county a

license to kill is ruffling feathers. about 100 turkeys in danville. walking across the fairways. to control their population the country club's homeowners' association got a state permit. and it lets them shoot up to 75 wild turkeys by march 1st. the country club says the biggest problem the bird droppings. but some complained that killing the turkeys is inhumane. lawrence karnow is here to tell us if it will be nice enough to enjoy the day off tomorrow outside. >> fog an sunshine around the bay area today. that fog starting to thicken up now and and it is moving around. be very careful, folks. high pressure sitting overhead now and with that ridge overhead, guess what? we get very stagnant atmosphere. not much mixing outside. so we get some of that fog beginning to form. so tomorrow we are expecting that tule fog tomorrow morning. dense fog advisories in effect

midnight continuing to 11:00 a.m. tomorrow. heading towards the afternoon we will watch the fog beginning to mix out and see some hazy sunshine in many spots. temperatures a little tricky but planning on the 50s and 60s outside all around the bay area. highs today. places that stayed in the fog didn't get warm at all. a cool 49 degrees for a high in fairfield today. only 52 in concord. 54 in vallejo. other places got sunshine. 64 degrees in fremont. 61 in santa rosa. so, as we head around the state you'll notice that dense fog into the central valley as well. be careful if you're traveling in this area specially early in the morning. it will be very thick. temperatures in the 50s. very similar conditions i think over the next five to seven days. high pressure sticking around doesn't want to go anywhere. probably going to be fairly stable in this pattern. until just about the end of the month. the jet stream lifting well to the north of the bay area meaning the storm track is staying out of the north as well. so we will stay high and dry and the big concern the nex

five to seven days will be that dense fog and it will be very thick. visibility less than a quarter of a mile. tomorrow morning we are starting out with fog just about everywhere you go. early on that blanket of fog looking very thick but as we head through the morning that will start to wreck up then by the milling of the afternoon we are looking pretty good. some hazy sunshine around the bay area. cool in spots. warmer in the san jose area. temperatures moving easily into the 60s. about 64 degrees in san jose. should be about 64 morgan hill. 62 in palo alto and 61 in union city. east bay temperatures are the trickiest. you get the fog there and it doesn't break up. that will keep those temperatures cool. temperatures in the 50s. antioch. brentwood. 631 in berkeley. north bay you'll stay -- 61 in berkeley. north bay you'll stay cool. 66 degrees in santa rosa. probably going to watch those
