could be set free tomorrow if a gun found in a complex isn't his. it was found hidden in a laundry basket during the arrest. >> the state has to show that ramirez had knowledge there was a gun in the household. he did not. >> there will be witnesses that say he doesn't live there. >> reporter: the parole revokation hearing isn't is trial which means l.a.p.d. detectives won't have to prove very much to keep him locked up for a parole violation for a conviction not related to the beating case. >> if the state can show that it is just possible that it is possible it happened the way it did the parole board will sustain the parole. >> reporter: he could be sentenced to a year in prison

and would allow the l.a.p.d. to line up its case to them without shows its cards. >> the parole board even though they are supposed to be objective and look at it independently under the investigation he may be under knows full well he is the prime suspect in a brutal high profile attempted murder. >> reporter: the lawyers for ramirez have offered witnesses and alibis for their client. but sources tell us investigators may not believe some of those alibis. and may ask the defense to submit poligraph tests. >> i personally don't see a problem with it i just don't like it. >> that was jeff wynn reporter. bryan stow remains at san francisco general hospital in the a coma. volunteers in the east bay today wrapped up three days of searching for a missing nursing student michelle lai.

she disappeared three weeks ago. her disappearance was classified from a missing persons case to a homicide but michele's family believes she is still alive. this weekend searches were focused on the niles canyon area. his father says he only wants one thing for father's day. >> i want nothing. just for her to be here right now. here with me. that's my biggest father's day present i would ever have. >> organizers say volunteer searches will continue next weekend and for as long as nest. some scary moments along a county highway today. take a look at these flames. the fire broke out near interstate 780 and east 5th street on ramp around 3 p.m. this afternoon. >> there was a fire that most likely came from the freeway up. burned in behind these houses. got into the trees. torched the trees and threatened six houses. >> firefighters knocked down

the flames quickly and in the end only a few fences burned. no injuries were reported and no homes were damaged. other bay area headlines new swan troubles as san francisco's palace of fine arts. the baby of the swan family disappeared from the lagoon thursday. the keeper believes a hawk killed the three week old. the older brother attacked her. bella had just returned to the lagoon after a month away being treated for her injuries. cabs could be in short supply in san francisco tuesday. drivers are planning a strike to protest several policy changes. among them allowing cab companies to charge the drivers 5% for credit card transactions. the cabbies will also have to wait for fare increases that were supposed to take effect august 1st. nata confirms a strike killed civilians including two children. republicans say it violates the

war powers act with u.s. involvement. susan mcginnes on the action to halt the project. >> reporter: a nato bomb deliberately killed nine civilians including two children they say. >> this is another night of murder and terror and horror in tripoli caused by nato. >> reporter: they admit one of the weapons missed its intended targets and may have caused a number of civilian casualties. u.s. involvement in libya has reached a milestone. it has been just more than 90 days since the first air strike. possibly putting the administration in violation of the war powers act which requires the president to get permission from congress for continued military action. >> we are spending $10 million a day. part of an effort to drop bombs on gadaffi's compounds. >> reporter: but the white house insists it is complying with the war powers act because there are no u.s. troops on the

ground. >> and i believe that president obama has complied with the law consistent in a manner with virtually all of his predecessors. >> reporter: the united nations is pressing the rebels for details on how they would run libya if gadaffi stood down or was ousted. an outcome many lawmakers feel is necessary. >> our standing in the world goes down. >> reporter: the debate over the mission in libya is expected to intensify this week as some lawmakers have sued the white house and others bring legislation to end u.s. involvement. susan mcginnes for cb c cbs5. as of this weekend there were 27 homicides in the city this year. the highest in 20 years. police believe at least half of

those murders are gang related. and it is not easy growing up in east oakland where violence and death are everyday occurrences and it is even harder for some kids to get an education. this weekend as don knapp shows us east oakland high school students met to look for solutions. >> reporter: her poetry is personal. lots of east oakland kids can relate. >> what should i do? what could i do? i don't know. just know that i will be listening. >> reporter: the students tell their stories and with poetry, multimedia and theater tell what their research says needs to be done. >> if wealthy children were suffering in the way these children were suffering that we would see it as a national crisis. >> reporter: san francisco state professor and a teacher on friday. >> oakland is considered one of the most violent cities in the country. i have been teaching in the city for 18 years and pretty much every year i bury at least one student. we lost a student this year to gun violence. >> reporter: the step to

college program keeps kids engaged with the same english teachers in four years. >> you can't be out late because it is closed down already. it is just so dangerous. you really don't see much kids in school any more. basically a shooting you see every time. >> people always have expectations of us that we do not have of ourselves and they are not going to live that long. and all kids are outside always selling drugs. it is hard because you've got other things on your hands like you've got to work. you've got to worry about violence and you've always got to watch your back and look over your shoulders. >> but in the classroom they are made to feel safe. >> it is a family. you just get inside there and once inside there it is more calm. >> reporter: duncan doesn't just want kids to get out of oakland he wants them to get an education and come back. that's pretty much what he has done himself. >> i'll tell you the thing that makes me the most hopeful is despite all the things these kids are going through they

still come to school every day and if we can match that level of hope and optimism then i think we have a shot to turn things around. >> reporter: east oakland, donovan mcnabb, cbs5. sunday service brought parishonners to a place of worship. the change at a bay area church creating a divide in the congregation. trash. some of the hazards they face at work. the bay area effort to ensure rights for a certain group of workers. for me to know their heart beat, to know how the center of their hand feels. i think my dream is coming true. >> a dream that once seemed like an overachievement. a single father's painful past and how he used his fear to be the best dad he can be. well, we are less than 48 hours away from the official start to the summer season and it sure does feel like it. i've got your pinpoint forecast with the details next. ♪

loss of former pastor george crestpan who retired in 2005 but remained part of the parish. recently he was asked to leave the rectory where he had lived. >> it is always at the discretion of the pastor. i know father john wouldn't make a decision like that arbitraryly. >> we find his leadership style and his ability to communicate have been lacking. >> reporter: many of the protestors don't like the direction he is taking the church. >> the church was the star and light of the community. it is slowly becoming prey of the most obscure trends of conservativism in the catholic church. >> reporter: they say the church has cut back on so- called social justice campaigns like protestor nuclear testing and the death penalty. >> we tried to speak with father john, the current pastor. he didn't want to speak and didn't have a statement to give. but the bishop of oakland is taking it all under consideration.

>> i think we should be able to work things out. afterall we are christians. >> reporter: though united isn't how many would describe this. >> i don't like it. because that's not going to accomplish anything. especially a church. you know. to me this is not respect. >> reporter: in berkeley, anne makovec, cbs5. some bay area churches are calling on the members to help their congregation. a senate committee will take it up in the coming week. the bill extends basic labor rights. this workering told her experience of cleaning one home. >> there were rats. the dogs lived inside of the house. there was trash everywhere. >> reporter: lopez says she is asking for the same protections other workers have like safe working conditions, breaks and overtime pay. labor laws passed in the 1930st

excluded domestic workers. business is better only marginally for san jose's downtown hotels. very poor occupancyt 14 downtown businesses. it was up only 3% last year. overall revenue also rose slightly from 11 million to 11.5 million. even the hotels closest to san jose's biggest attractions like the convention center, civic auditorium and center for performing arts saw slight increases in business. as we just heard, summer is right around the corner. headed for a heat wave? >> definitely warmer conditions. as we take a look outside we are seeing mostly clear skies all around and temperatures warming up. high 60s for the coastal regions. high 70s for the bay. and 90s, mid-90s. high pressure ridge here. we can see the building nicely over the area. that low pressure system is a thing of the past. we do have a new low pressure system working its way from the

north there but not going to affect us until late wednesday into thursday. tomorrow you can definitely expect nice conditions all around. we have got high 60s or mid to high 60s for the coastal regions. 60s to 70s. 60s. basically into the 90s range you will see tomorrow. sunny skies inland. sunny to warm conditions for the coastal area. and let's take a look at what you can expect for tonight. mostly clear skies. santa barbara rose 51. napa and fairfield. oakland 58 for you. as we look ahead and take a look at the highs for tomorrow we are seeing warm conditions all around. fremont 89. i was a little bit conservative. we could get warmer. antioch 95 with brent and livermore. richmond 78. berkeley 80 for you. temperatures are definitely climbing all due to this high pressure ridge and all due to a northerly flow that is keeping temperatures just a bit warmer. santa rosa 91. sonoma 90. lots of 80s. high 70s and 90s in the

forecast. in addition your pollen report high for grasses. as we take a look at your air quality index for the next week we can see moderate for the east bay, santa clara valley seeing moderate conditions. south central bay, north bay and central bay seeing good conditions all around. better conditions. go ahead and enjoy this week but understand conditions will be a little testy as far as the quality index as far as air quality index goes and uv index will be very high. here is a look at your exten extended forecast. first day of summer. then a cool down by late wednesday into thursday. we are finally going to see some cooler temperatures. some high 50s into high 80s. saturday and sunday. cooler temperatures. then partly cloudy sky conditions. a warm up and then a bit of a cool down. >> that's good. >> thank you very much. a picture perfect day for crowds to gather in cesar

chavez plaza this weekend. ♪[ music ] >> the special celebrating the ends of slavery in the u.s. people began observing june 19th as the african-american emancipation day in galveston, texas, in 1865. the date people there learned the civil war was over. this particular gathering has taken place for more than 25 years. well, city of vallejo has had its share of problems and this weekend it was taken over by pirates. clearly this is a good thing. the annual pirate festival along the vallejo waterfront is a treasure trove for the cash strapped city and businesses. >> it is usually doctors and lawyers and everybody who actually dress up to be pirates because they are good guys in real life and they want to have a little bit of that edge. >> the pirate festival attracts about 30,000 tourists each year for the two day events.

his dad walked out when he was a toddler leaving his mother to raise him and seven brothers alone. in east l.a. in the projects in gang territory. >> you are pretty much raised by the streets. most of the single moms that are out there are working long hours. it was really tough to see all that stuff. to see brothers coming home drunk and high. and then me being the youngest it was like wow. where is the man in this house? >> reporter: a question he vowed his children would never have to ask. today is he a single father raising simon and 2-year-old sebatian. he split with the mother but still takes care of his sons. >> mom and dad together is super, super great. but if it doesn't happen, doesn't mean it is the end of the world. you keep going forward to be the best father, the best person you can be. >> reporter: and in a neighborhood where too young men grow up without fathers. raul fills that role for as many as he can as a counselor

with an inner city program dedicated saving youngsters from gangs and crimes. he fills a hole in their lives today. this 19-year-old wants to go to college to be a counselor like raul. >> he is a person that would really be there for me. and i never really had people like that. >> reporter: 24-year-old daniel r rosealis was arrested for carjacking. >> i think it takes a man to raise a man. thank god he put him in my life. >> reporter: raul says he is grateful for the young men at home boy and especially the young boys at home. >> my fear was to be a father the way my father was to me. and my dream was to be the best father ever. for me to know their heart beat, how the center of their hand feels. i think my dream is coming true. >> reporter: to be a winner as a father he say to just step up to the plate.
