fatal collision between a van you're watching cbs 5 eyewitness news on the cw. freeway still shut down following a gruesome incident. why a fatal collision between a van and a motorcycle is being called no accident. it's over. that standoff with a suspected hell's angel member. the ending that has police baffled. tragedy for a good samaritan who stopped after witnessing a car crash. how she was killed as she tried to help others. >> actually, she had 38 pieces in her body. >> a puppy that had been shot repeatedly found on an east bay street and television and it's not the only one. all lanes on eastbound are closed right now following a deadly incident. the chp says a van hit and dragged a motorcyclist for more

than a mile west of 150th avenue. don knapp on what investigators are calling a homicide. don. >> reporter: just by coincidence, we were in that traffic jam. at the time we had information from the chp that it did involve a van and a motorcyclist and the motorcyclist was lying face down on the freeway and probably dead. we later learned that police say it was an apparent road rage incident. now the chp is saying that the van driver and by the way, there were no people in the van. just the van driver. the van driver and the motorcyclist riding with others were involved in some kind of road rage altercation. st patrol says the van driver may have intentionally ran the motorcyclist. overrunning the bike and dragging it several miles of the eastbound lanes of this usually heavily traveled freeway, east of 150th have been closed since the 4:00 p.m. crash. what police are calling a

homicide investigation. >> it looks like there's a primary area of impact that we can see on the freeway now that we have all the cars moved. it looks like a primary point and then the motorcycle got place underneath the van and dragged for one mile before it stopped. >> reporter: now we were in that traffic jam ourselves for about half hour before we joined other frustrated motorists and turned around on the freeway and went the wrong direction to the last ramp, drove off into the over crowded streets of san leandro where people were trying to find their way back to 580. it was intense all evening. the traffic, the freeway is still shut down and people are still, as you can see, coming by me here on this frontage road. so, really rough day for traffic and a very bad day for a couple of people who may or may not have been involved in a road rage incident.

>> thank you very much. well u.s. marine from the stockton area has been killed by a hunter in oregon. apparently mistaken for a bear. 20-year-old christopher was hiking with a friend near silver creek falls park. police say he was wearing dark colored clothing when a hunter saw something moving in the brush and opened fire. so far, the hunter has not been charged. the case is being turned over to the local district attorney. it's an unusual sight on bay area streets. gun owners bearing arms in public. a new state law bans people from openly carrying handguns. protesters are fighting back. today in san leandro, people brought out their unloaded rifles and shotguns. >> main concern i have is protecting my family. i had an armed robbery inside my door. i wasn't the victim, but just knowing that it happened, i tried to help the guy out, you know, i decided to open carry.

>> these gun owners hope these rallies will inspire legislators to repeal the new law. a horrific case of animal cruelty. someone fired 38bb gun pellets into a puppy. that's not all. ann shows us this isn't the first puppy that has been abused in that area. daphne is stronger and sweeter than she may appear. this one-year-old pit bull came to the berkeley animal care services shelter last month. >> skiddish, frightened of people with lots of small marks on her body. >> the vet found out why. >> actually she had 38 pieces of buck shot in her body. >> shot with a bb gun dozens of times, her ears cut almost in half. a job not done by a professional. >> just flat out cruel. >> this parking lot about a block away from the shelter is

where taff daphne was found. they looked exactly like her. this is a very distinctive looking dog. >> the same markings, the same crop job on the ears. >> we are now x-raying them so they don't have the same problem. >> one of them had a few pellets removed. a shelter says her sisters were already successfully adopted. >> unbelievable. these dogs forgive people everything. they have clearly had terrible and traumatic lives. all it takes is the smallest act of kindness to win them over. >> daphne showed that to a woman who came to the shelter looking for a dog today. >> she's beautiful. i mean, dogs are just like humans. they are fearful. they have been abused in any way. >> berkeley animal care services is accepting donations. it could cost thousands of dollars to remove all the pellets and police are hoping for tips on who her previous owners may have been. >> this is not an isolated

case. there's lots of animal abuse that goes on and we really need the public's help. >> in berkeley, cbs 5. in another incident involving a hell's angels member, police have cleared the scene of a 12 hour standoff without an arrest. officers thought they found steve ruiz who is accused of shooting and killing a hell's angels member at a cemetery in san jose last week. they thought he was held up on a house in stockton. then the search that turned up empty. >> for nearly 12 hours, the police surrounded this stockton home waiting for steve ruiz to come out. but finally they went in and came out with nothing. >> what do you think about shutting down a street for 12 hours and coming out with nothing? >> embarrassing. you know, i don't know. >> there were plenty of inconvenienced and unhappy neighbors forced to remain inside their homes all day while the san jose police s.w.a.t. team rolled in with their armored truck.

police say they had a tip that 38-year-old steve ruiz, the man accused of killing a hell's angels member at a funeral last week was inside the home. >> i have been here 20 years, i don't see any problems out here. >> police broke windows and shot in tear gas as they tried to get ruiz out of the house. you can see the damage. even the tear gas canisters were left behind. 12 hours later they went inside and came out empty handed. police took down their police tape and they were gone while ruiz remains at large. >> my wife was scared, but it has nothing to do with us. >> all that is left here in the stockton neighborhood is broken glass and a whole lot of curious neighbors. for cbs 5, i'm ben. >> well a good samaritan has been killed trying to help people after a car crash early this morning. 20-year-old maliga got out of her car to help when a car slammed into her. this was at 2:00 this morning

on 880 in heyward near the interchange with highway 92. cad was thrown to the other side of the freeway and killed. >> it was general in nature to help one another. we want people to help each other. but on the freeway this time of night, it is dark, people are intoxicated. people texting, a lot of things going on in the driver's mind these days. in the end, it's probably not a good idea to stop. >> four other people were critically injured. several lanes were closed for a couple of hours. they reopened by 5:00 a.m. they were told to pack up and move out, but the occupy oakland protesters are not going away. today they marched through downtown. aided by police who stopped traffic for them. the city threatened protests with arrests. they didn't clear out by city hall by 10:00 last night, but police never moved in. the protesters say they are

staying put. >> not just fighting for us over here. we're fighting for everybody that is out there in that community, you know, that is dealing with foreclosures, losing everything. healthcare. for closing down or schools and gang injunctions. police brutality. all those things are being addressed here. racism, all those issues are being addressed. >> some nurses from the california nurse's association have set up first aid stations at the oakland and san francisco protest. and two people have been arrested at the occupy san jose tent city. there were only three people camped out overnight when police moved in at 4:00 this morning. besides the arrest, one person was sited and released. the city says the camp site was creating health hazards. garbage piling up. the majority of the tent city was cleared out thursday. the occupy wall street movement is now in its second month. while the protest is against corporate greed, it is unclear who the heeders of the movement

are and what exactly they are asking for. goes to the heart of the protest in new york city to find out if the protesters have an agenda. >> five weeks after it began, there's still no single list of demands by the occupy movement. but protesters say right now, that's not the point. >> really what's going on, this is a place where people can get together and the conversation can be had where we can start to work toward what this is about. >> kendrick is 27 years old. he didn't want to give his last name, but says after he lost his teaching job, he was forced to move back in with his father. >> occupy wall street need a list? >> absolutely and there is. there's a million lists all over on every sign that you see. >> the movement continues to attract new people. like charlene spalding and her husband, bob. >> we came down from maine. we are here because we feel the middle class is -- >> the protests have spread across the country and appear to be striking a cord.

according to a new associated press poll, more than a third support the wall street protests and 58% say they are angry about the nation's politics. marsha spencer has never taken part in a protest before. she put her issues on a handwritten sign. >> i have heard some very lively political discussions here in the last few days and i think it gets people thinking about things more. >> you don't have a clear set of tangible, concrete steps that you would like to see taken. it's hard for people to figure it out. >> yup, that's their problem. i don't have an answer for that. the movement is awareness and it's outrage. that's what the movement is to me. >> for now, protesters say the lack of a single focus gives them a kind of freedom to attract more of their fellow citizens whatever the grievance. elaine, cbs news, new york. >> well don't eat the spinage.

after killing dictator, muammar celebration tonight in the streets of libya. fighters returned to their hometowns after killing dictator moammar gadhafi. tomorrow is a big day in libya. the day of liberation. the country's new leaders will declare the country's free of gadhafi rule. the ruling national council says it will hold an election for a new government within eight months. many iraqis are wondering what's ahead for them as the american troops get ready to leave the country. all 40,000 u.s. troops will be out of iraq by december 31. u.s. and iraqi leaders failed to reach a deal to keep some troops in baghdad. iraq's prime minister says his country needs america's help. president obama says the u.s. will continue to support iraq and becoming a stabilized democracy. >> the city of oakland took the day to remember one of the worst fires in bay area history. the oakland fire storm was 20

years ago this week. survivors gathered at the bart station mural to reflect. that event was follow leed ed by the exhibit center. those who witnessed the fire talked about the experience. >> that was my career fire, you know, by far the largest incident i responded to. all the risks i took that day. gives you a feeling. >> that fire in 1991 killed 25 people and destroyed more than 3,000 homes. meteorologists is joining us now. saturday goes in the books as a lovely day. >> real testy. we saw 80 degrees all the way back to the beach. a good 10 or 15 degrees above normal and fire conditions are going to be getting a bit sketchy as we see an offshore breeze setting up. i'm not sure we're going to be as warm tomorrow as we were

today. as you see here, 80s prevailing throughout the bay from the interior all the way back to the beach. for tomorrow, temperatures to cool off slightly. tonight, clear and kind of sol tri soultry out there. gradually cooling into the 50s. 60s elsewhere. for tomorrow, continued clear and warm as san francisco will cool down. about 5 degrees out of the 80s and into the mid 70s. san jose mid 80s down there. winds light and variable and good air quality given this high pressure system. today we saw those warm temperatures from east to west across the area here. 85 in cann cord. 86 in levermore. 81 in san francisco. 82 out in pacifica. 86 for redd wood city. that's a warm day by any bay area standards and again we will cool slightly here tomorrow, but still be on the warm side as the offshore breeze keeps the fog well

offshore. upper 70s to mid 70s at the bay for tomorrow. the interior, mid to low 80s out there. as general cooling will continue into monday. but for tomorrow, an offshore flow will return. clear and warm across the region. then we'll look for a southerly surge late tomorrow night into monday which will cool to conditions dramatically at the coast. back into the 60s. but that's only going to last a day or so. we see mostly sunny tomorrow as we look at the model. a little bit of fog beginning to arrive late tomorrow. that will cool things down into monday. this as the southerly surge as i mentioned. temperatures again tomorrow in the mid to upper 70s for most locations in the east bay. mid to low 70s towards the city and the beach and mid to upper 80s across the interior. cooler than today, generally speaking. fire weather watch will be up by midweek as temperatures will warm once again. gusty winds and low relative humidity as the offshore breeze

returns. clearing out the fog and warming through the end of the week. maybe not through the weekend, but at least through the end of the week. we'll start to see the pattern shift again by friday into saturday with the potential for light showers. mainly to our north. i don't think it's going to be a big rainmaker for us, but it will cool temperatures off. tomorrow, we're going to stay warm for the raiders game as we'll see mostly clear skies mid to upper 70s at the ballpark. >> still waiting for the chill in the air, aren't we? >> it's not here. >> not yet. >> thank you. well, two funerals today for victims of the salon massacre two weeks ago. michelle fast was layed to rest at a funeral in mineral park and ann sterling was at the emotional service for a victim in southern california. >> hundreds felt first christian church huntington beach to remember cristie lee

because it could make you sick. neighborhood some bag spinage is being recalled because it could make you sick. recalling sne spinage that comes in a bag. the california company says one bag tested positive for listeria. bacteria that can cause serious and sometimes fatal infections. the recalled products have the enjoy by date of october 16, but the company believes some people could still have the bags in their fridge. if you have any, return the bag for a refund. they finally got him, that red tail hawk that had been shot through the face of a nail gun. they captured the hawk today.

they have been trying to catch it for a week. the hawk had been seen this week in the park eating its prey. the plan is to take out the nail, treat the wound, and release it. free parking is being offered at oakland international airport between the thanksgiving and december holidays. a coupon to park for free up to three days in the daily lot. you have to fly out on a tuesday, wednesday, or thursday. you can do that. normally parking for those three days would cost $66. airport officials hope to attract more travelers during the busy holiday travel season. country singer loretta lynn is in the hospital tonight. she was set to perform tonight at a performing arts center in kentucky, but the center issued a release saying the singer was in the hospital. a note on her website says doctors have diagnosed her with early stages of pneumonia and she will continue to rest.

doctors say the 79-year-old should be back on stage by november. well times may be tough for americans, but in china someone bought one of marilyn monroe's dresses for $504,000. it was sold at a celebrity memorabilia auction. the dress was worn by the actress in the film, river of no return. other items auctioned off including madonna's, whose that girl tour bustie. albert pujols is no longer hit less in the world series and how did stanford fair? the minute is next.
