. you're watching cbs 5 eyewitness news on the cw. he just started yelling shark. >> a surfer bitten and brought to a bay area hospital. the great white attack off the coast. tense moments tonight in the occupy movement in portland. protesters confronting lines of police officers. their message tonight. it is the deadliest attack since the war began. 12 americans killed in a suicide attack. good evening. hundreds of people on the move tonight in oakland in the latest march through the streets of downtown. protesters marched down carrying a banner. once at 7th and clay to confront police officers lining side streets. they appeared to make their statement and they moved on.

so far no problems. dawn. >> reporter: that's right, ann, many occupy oakland protesters left the en campment tonight and joined the march. obviously they did not get through but this march followed a long evening of discussion of police brutality that goes back to not just tuesday but to oscar grant. >> after dark the rally would come to rest. primarily the actions earlier this week, that chased protesters from the tent city they had maintained for two weeks. but first police formed a solid blue line. and when marchers turned and went to another street they were met by more police

officers. everyone no doubt had in mind the. >> a tent city has sprung up again on the front lawn and oakland's citizens are. >> missteps by mayor's administration has helped launch to -- as police moved of to clear an encampment with tear gas canisters. actions that appear to be responsible for injuring former marine scott ole sen. -- olsen. >> it appears to me that there may have been mistakes made by my people who are involved on this. >> reporter: but the mayor's apologies have not helped ease

tensions. national commentary and comedian john start have helped pump up protests. occupy oakland protesters planned strategy. yesterday defended police actions. >> i'm responsible for those officers actions. i fully support their ability to defend themselves against the life and prompt of citizen -- property of citizens that are trying to have a peaceful assembly. >> we are watching the protesters heading back here to city hall. so far we don't believe there have been a lot of dangerous confrontations. the marchers don't seem to have a direct plan. they are moving from place to place avoiding the police. >> so don, to the best of your knowledge they are or they are

not planning a rally at city hall when they end up there tonight. >> well, they begin with a rally rally. i think what they have been trying to do is make a statement at the police headquarters building. the big news is there were no confrontations. so so far it's relatively peaceful. >> thank you much. well, the iraq war veteran severely injured tuesday night remains in fair condition tonight. was transferred from high land hospital to another facility but where olsen went is not being released. he was hit in the head with a project i'll. halloween fever seems to be taking over the movement in san san francisco. several protesters got into did

halloween spirit today. told protesters to dress up as what scares them the most. protester also marched down market street downtown. police are letting the protesters in camp at least for now. a change of heart after occupy pro protesters took up -- after originally promising a crack down the city manager today instructed police not to break up the encampment for the time being. organizers already have plans to extend their stay. >> at the council meeting on november 1st we're all going to show up and -- >> reporter: officials say they

decided against police intervention. and in the south bay occupy san jose remains small but determined. sean oh kelly remanies atop a 36-foot tall ledge. san jose police made 15 arrests. hundreds laid out on ocean beach in san francisco today to send out the message, tax the one percent. this is the 9th year people have gathered at the beach to lay out a human banner. they hope the message will get through to the world. >> i keep hoping that this is the deb aid that we will get that -- decade that we will get that we are in this together. one of the things we need to do is make it more economically for everyone and letting the

rich pay their fair share is just the start. >> reporter: the human formed letters were 100 feet at all. a rough day today for occupy protesters in denver. first demonstrateors were removed after 2000 people marched through downtown. denver police say pushed an officer and his motorcycle down. hours later officers moved into a downtown park. officers cracked down on demonstrateors who refused to leave. all told, about 20 protesters railroad arrested in -- were arrested in denver today. bitten by a great white shark. more on the terrifying encounter. >> reporter: it was supposed to be like any other day of surfing at marinea state beach. >> i wave came and i piled up

over the top and he just started yelling shark. >> reporter: mccan i be en said they tried to paddle back to shore but it was too late. >> he just said, call 911 and i looked over and could see that his arm was bleeding pretty badly. >> skip was also getting ready to hit the water this morning when he saw the attack. >> he was able to paddle in on his own and he ran up the beach and stopped right at the bottom of the sand do you know. then four of -- >> he was bit on the arm and neck by a great white shark. you can see the 19-inch bite mark left behind. officials think the shark could be up to 20 feet long. >> you can see they have placed signs at the top of the beach

and they are warning people to stay out of the water. >> out likely possible that he isn't anywhere in the area any more. but for safety sakes we will be posting all these beaching. >> said he's still shocked by what he saw this morning. >> it was upsetting because this is really a popular spot and this has been the 2nd attack in 4 years. so it definitely makes you leary leary. >> reporter: the man is listed in stable condition and is expected to be okay. they are asking people to stay out of the water. an attack by a suicide bomber today in afghanistan has killed 17 people including a dozen americans. randall pinkston reports, it comes as they ask for more.

>> a bus carrying american soldiers burst into flames after a suicide bomber ran into a bus. thick black smoke poured out of the wreckage. minutes after the blast coalition forces surrounded the scene, carrying victims to safety. this man was not far from the explosion. >> he says it was a huge blast. i went closer to the convoy and saw several americans on fire. a nato spokesman says at least 12 americans died in the attack. officials say the blast also killed several afghans. the taliban took responsibility saying the bomb -- taliban fighters say they will continue to attack until all foreign

forces leave afghanistan. the attack happened while officials met to talk about shifting more control to afghan forces. >> we are at a moment in time where it is time to think about integration. >> reporter: announced the violence is at its worse since the war began ten years ago. we're now going to take you back to show you some pictures from chopper 5. there has been an oscar grant protest that has split off from the occupy oakland group. they march down to police headquarters. police along the way had stopped them, however it looks as now the police and protesters are confronting one another. we also have another cbs 5

crew. i'm hearing this is east 14th street and this is where we have a road protesters as well as police. these are protesters marching under the headline of oscar grant. of course, he is the bart passenger who was killed by a police officer about two years ago, so this is a march against what they allege is police brutality. we have two crews on the scene. we'll have the latest for you right here on cbs. we'll be right back.

killed there. that death happened 2-weeks ago during the hell's angels were back to bury a fellow member that was shot there. at today's burial the only gunfire was the salute from the u.s. military. but as mark shows us police kept a close eye. >> the procession heading to oak hill memorial park stretched as far as the eye could see and it also could be heard from great distances as well. the body of steve cow son a santa cruz member of the hell's angels was carried in a hearse. >> he was a very nice gentleman, very good, good father. good provider, good man. >> reporter: earlier police say about a thousand people

gathered at the jubilee christian center for a private memorial service. the only visible sign of police were a few squad cars but police were stationed on the rooftops of nearby buildings and teams of officers were nearby but out of sight just in case they were needed. san jose police say there were no problems. >> this time we were still focusing on the fact there were outside groups coming in and we also believed that it wasn't beyond possibility that there might be frictiontion between the same group. from the air you could see the flag draped casket taken out and carried to its burial site. he was killed at this cemetery two weeks ago when he was attending the funeral of -- some kind of internal conflict

among the hell's angels led to the shooting and the suspect is still on the run. >> the way it went down is not a good thing. it's kind of sad it had to go that way. steve was a well known person and very well respected and he was a good family man. and i hate to see it do anything to damage the name of the hell's angels. >> reporter: as for steve are you is, police are still looking for him. they believe he is on the run with a current or exgirlfriend. police believe his life is also in danger. i'm mark sayre, cbs 5. we are looking at chopper 5 pictures. on east 14th street. it looks as though the crowd is breaking away. it has been a little unclear. this again is an oscar grant

protest, protesting what they claim is police brutality. it started at city hall and have kind of spread out. police have been lining the intersections. we have no clear direction on where these folks are going but it looks as if the stand off is over and it looks as if the protesters -- one thing they have had a beautiful night. and perhaps that is working to the police officer's. >> it has been warm out there. woman and clear -- warm and clear for the most part. this is what most of us are looking at this evening. while on the east coast the snow is flying for much of the eastern sea board as we will continue to languish some of this lovely fall pattern here. continued dry and mild with

some patchy fog on monday. cooling down a bit with a chance of showers come friday with much cooler weather expected into next weekend. but for the short term it is looking pretty nice out there. again a lovely fall pattern. throughout the north bay east and south bay as well and back at the water we're looking at upper 70s today, even the beach quite nice. we will expect a repeat performance for tomorrow. overnight temperatures chilling out in the north bay. mid to low 50s closer to the water and we will again look for a bit of an off shore breeze to hold on to tomorrow to continue this mild and dry weather pattern, at least into the beginning of the week when we will see a little patchy fog. but as you can see, even tomorrow it's just basically playing touch and go with the shoreline here not making its

way into the bay. so the cooling will be minimized to this shore itself while the rest of us enjoy mid- 70s around the bay. could see a low 80 as well. as we take a look at the expectations for next week, we'll look for a fire weather watch once again as winds gusty at times and low humidities prevail. the chance of showers creeping over the horizon late thursday into friday. along with cooler air here as we see a cool down in time for next weekend. we will see a change in this pattern and it will hold long enough to take us into candle stick tomorrow. we can expect to see temperatures into the low 70s. kim is going to love it for a change. no fog down at candle stick. you can't beat that.

thanks so much. we're going the take you back out to an overhead look at downtown oakland where the oscar grant protesters are again moving through the city. we should make this clear the unclear whether they are with the occupy movement. tonight at 8:00 the occupy movement had a protest and they have been kind of wandering the streets con fronting police when they can. it looks as if in some areas these protests are letting vehicles through. we'll be right back.

immigrants, lady liberty, who turned 125. in her honor 125 immigrants from 46 countries were sworn in as americans in a ceremony just under the statute. military service members included. >> i am part of that name now, america. >> give me your tired, your poor, your huddled masses yes or noing to breathe free. >> reporter: and in another ceremony actress signature organy weaver, a gift from the french lady liberty was shipped in parts. web cameras are now set up inside the statute to give viewers around the world a life look. >> the anniversary also celebrates a new beginning for lady liberty. >> she's supposed to be good
