you're watching cbs 5 eyewitness news on the cw. we want to have an experience. >> it said money can't buy happiness, but for tens and thousands of people today, it bought sweet revenge. he took matters into his own hands after he felt threatened. what he did that sent occupy protesters running away from his building. another bay area city at risk of losing its police department. who will serve and protect if that happens? >> i don't know anything offhand that mystifies americans more than the cotton they put in pill bottles. what do they do it? >> the legend has died. tonight we'll remember the life and words of andy rooney. today, quiet protest across the country against big banks, people putting their money where their mouth is. the event started on facebook and called on everyone to

transfer their money out of big banks. today, a south bay business opened its doors for people compelled to act. why some people are moving their money. >> we want to have a positive experience. >> they are opening an account at the san jose credit union after pulling their money from wells fargo. >> sick of being nickel and dimed. >> this credit union isn't normally open on saturday, but they open today to take advantage of the occupy movement encouraging people to move their money from the big banks. >> we felt we had to be open in response to our community and our members. that was an easy decision for us. >> i work full-time and i don't have any other means to help support the whole occupy wall street. 99% movement. so i thought i would come in today and open up a new account. >> bank transfer day caught fire with the occupy wall street protest and has almost 54,000 supporters on facebook.

it is credited with helping change bank of america's plan to start charging a $5 debit card fee. but many customers here are transferring from other big banks because of other new monthly fees. >> it was not the occupy movement, it was wells fargo's actions that stimulated it. >> it is ridiculous. they have my money already. >> we visited some of the big banks today and found plenty of the people staying put. >> i have been with them for a long time. you know, i have faith in bank of america. >> are you moving your money today? >> just from the atm to my pocket. >> i'm not against the people's movement. that's fine. i just don't want to move it. >> they are glad they moved theirs, not on occupy, but their own. >> several billion dollars worth of profits this year. or this quarter. i don't think they need my $10. >> in san jose, cbs 5. the building took matters into his own hands during

violent protests near city hall on wednesday. don knapp on the steps the owner took to protect his property and what he has to say about the demonstrators. >> wednesday night, hundreds of more radical elements of the gathering moved down 16th street and took over a vacant building. trash fires burned at 16th and broadway. police and demonstrators clashed. >> what we could see on the security cameras, there was a lot going on outside. >> inside another building on 16th. phil was watching his street security camera monitors. he provided the video to cbs 5. >> hundreds of people who are destroying private property, who clearly have an abandon for any rule of law, and there was no order there. it was chaos. >> got on the phone with emergency operation center and spoke with councilman, larry reid. >> i asked him, we are going to get a police response?

he said no. he said we couldn't count on it. >> one of the owners of the restored building. a tone throw from the city hall. with crowds at the door and no assurance of police protection, he felt he had no choice. >> i went upstairs, got the shotgun, came downstairs, and stood at the desk. when i thought they were coming closer to the entry and a group did come in, i approached the door and let them know that this is not a good idea. maybe go somewhere else. >> let them know how? >> took a wide stance and racked the shotgun. >> he has been in constant communication with city leadership and wants to find common ground with those of different ideas and opinions, but says the tent city should be cleared out. the loaded shotgun was his last resort and he hopes he never has to use it again. >> i was very scared. i did not do anything that you can't unfire the gun, as they say. >> in oakland, cbs 5.

mocking the one year anniversary of the sentencing of measurely, friends and family of oscar grant gathered near the occupy camp today. he is the former bart police officer convicted of killing grant new year's day 2009. the group says he got a slap on the wrist for killing grant. measurely was sentenced to two years in jail. he served 11 months. measurely claims he was going for a taser and a accidentally fired his gun. >> hundreds of occupy wall street protesters in san francisco had a police escort as they marched through the rain today. the march was one of many throughout the bay area in support of bank transfer day. unlike demonstrations elsewhere, there were no problems and no violence. a group calling itself occupy

99% contra costa held a march today. marchers stopped at several bank offices. many say this is the first time they have ever joined a protest. they say they represent the working class, which suffered the most in this recession. and the driver who hit three occupy dc protesters with his car last night will not face charges. that's according to washington, d.c. police. that's because he had a green light. officers concluded the collision was unavoidable. hundreds of protesters shut down streets. people who say they witnessed the accident offered conflicting stories about what happened. the people were hit by the car were taken to the hospital and later released. well, a cold, wet, and windy day in the bay area and the showers aren't done yet. jim bernard with what we can expect next. jim. >> a fast moving cold front moving across the state here today. left good rain fall as it came through the bay area late this

afternoon into the early evening hours. a little more rain fall left than expected. it's not over yet. but the brunt of the precipitation has passed with the frontal boundary. we will look for cold showers to continue through the night tonight. here's a few locations reporting in here tonight. mill valley, 1.24 inches of rain. napa 1.2. oakland about a half an inch and sfo showed up with a quarter and a tenth by the time you get into mountain view and san jose. again, we'll look for cold showers to continue on and off tonight. and tomorrow, a drying trend to take us into the beginning of the week and don't forget, it's time to turn those clocks back as well. so get up at 2:00 a.m. and do that, or do it now if you want to not wake up at 2:00 a.m. we'll have more cold showers coming up in your complete forecast in a few minutes. >> all right jim, turn the clocks now. all right, a 3.2 magnitude earthquake rattled the east bay.

it was centered 2 miles north of piedmont and southeast of berkeley. it struck at 2:52 p.m. in the same area that has experienced several 3.0 or larger tremors recently. here's how it looked. bart trains experienced minor delays because of the quake and that's standard procedure. there were no reports of damage or injuries. well, less than an hour ago, a 5.6 magnitude earthquake hit central oklahoma. it follows a series of earthquakes early this morning that caused minor damage. the largest overnight was a 4.7- centered 50 miles east of oklahoma city. u.s. geological survey says the quakes were felt in arkansas, kansas, missouri, and texas. >> yeah, it woke us up and shook us out of bed and in our house, we have several mirrors fall and stuff. so it's a biggest earthquake i have ever been in. >> oklahoma geological researchers say the quake and aftershocks happened on a known fault line. it's not known yet if there are

damage or injuries from this latest quake. andy rooney dreaded the day he had to end his signature 60 minutes commentaries about life's large and small absurdities. he kept at it. one month after signing off, rooney has died. drew talked to some of his colleagues which made his work so memorable. >> andy rooney died friday night just a month after stepping away from the job he adored. >> not many people in this world are as lucky as i have been. >> he never recovered after complications from an undisclosed surgery. rooney's commentaries became part of the american fabric. woven together by the words and praises most everyone thought. >> i don't know anything offhand that mystifies americans more than the cotton they put in pill bottles. >> he worked with rooney for decades. >> what made andy rooney a

wonderful journalist? >> what made him a wonderful writer, which he would prefer that term, by the way, was he had a remarkable eye for detail. people would say, i never really thought about it. he is right. there isn't enough cereal in that box. >> 60 minutes correspondent, bob simon. >> i think it will be retired like joe's number 5 was retired. there will never be another, even though there will be great baseball players and there will never be another andy rooney. >> he was the same person on camera and off. and in his last commentary on october 2, he looked into the lens and told america just how he felt. >> this is a moment i dreaded. i wish i could do this for ever. >> he wanted to work until he died. essentially, he did that. >> he got what he wanted and he had a wonderful life. as he says himself, great writer, great life. great family. >> andy rooney was 92 years

shot wounds. police arriving at the scene saw a car speeding away from the area and chased it. they arrested five suspects, one of them a juvenile on suspicion of homicide and attempted homicide. this was the first homicide in morgan hill in two years. the last murder was gang related and it still has not been solved. there have been no arrests in that death. homeowner who interrupted a burglary shot and killed a suspect who police say was trying to steal copper. it happened this afternoon in antioch. police say the homeowner defended himself by shooting the burglar after the burglar threatened him. the vacant house had been robbed several times in the past. this time police confirm copper piping and wires were being taken. the homeowner is cooperating with police and he has not been arrested. outsourcing police protection. in the last year, that's what two cities have done. they will decide soon whether

to ban their police department. the move could save the city more than $1 million a year. if the police department goes away, a santa clara county sheriff's office would take over. the number of deaths in one of the worst car crashes in britain's history is expected to reach double digits. seven people were killed in a massive chain reaction pileup more than 40 other injured. many of them critically. people trapped in their cars were heard screaming for help. a total of 34 vehicles, many involved were trucks. the witnesses say the collision triggered a massive fire ball as many vehicles desin grated. it's not certain exactly what caused the pileup, but some say they were suddenly blinded by a thick wall of fog. so ever wish you could turn back time? you have your chance to do just that. daylight saving times ends at 2:00 a.m. remember to set your clocks back one hour before you go to bed. what are the effects of the time change on your body?

coleen jones on why it may take more than one hour to adjust. >> i'm going to have to look for a sleep deprived person. sandy smith is the early radio news guy. >> he rises at 3:30 a.m., leaves the house at 4:00. prepares the newscast and is on the air at 5:30. with the clock falling back this weekend, it's heaven. >> this time change i like because you get that extra hour of sleep. spring don't like so much. >> get eight hours of sleep, but in this busy world, few get that. >> i would say six. >> dr. neil stanley has been researching sleep for 29 years. he is a member of the european sleep research society and the american academy of sleep medicine. as we turn the clocks back this weekend, he says it takes a while for the body to adjust. >> the one hour time change will take you three days to get over. our body is an exquisite clock.

cities in the u.s. they use government data and spending transaction information from citi bank. san francisco ranks 6 and san jose 7th. the top shopaholic city in the country, washington, d.c. crab season is underway along the northern california coast and state biologists expect plenty of crab after a record harvest last season. recreational fishermen started setting traps at midnight last night. a new law limits the number of traps allowed per boat. the commercial crab seasons begins november 15. next we'll take a look at the u.s. capital christmas tree cut down today in the sierra. also dramatic passengers video. the jet landing without landing gear. watch as people make an emergency exit. crab season weather outside the bay tonight as we see cloudy, cold showers out there. we can expect the showers to taper off. still a few scattered showers expected in the morning.

and al the 2012 election takes place one year from tomorrow. already the phone lines are heating up. president obama's reelection campaign kicks things off today. operating a phone bank in the san francisco cafe. volunteers called voters across the state to talk up their candidate. organizers say they held more than 2,000 events like this across the country. from campaign season to the holiday season, the u.s. capital christmas tree is preparing to head east tonight. why do we care? because it comes from right here in california. the 65-foot white fur was cut today in the national forest in the sierra. it's the first time the tree has come from california since 1995. >> for us, it's a great honor. it's a once in a lifetime opportunity. it's something that hasn't opinion done. it's the fourth time california had the tree. we are excited. >> the dusting of snow may not last, but hope the trees freshness will. a bag of water will be attached

to the tree's base to keep it hydrated. the tree arrives in washington, d.c. november 28. the lighting ceremony is december 6. in the bay area, we went from summer to winter in the past week, doesn't it? >> a lot of patchy frost. we were warmer in the overnight hours, thanks to all the clouds moving in. cold showers prevail. even a dusting of snow possible in the local mountains, down to 4,000 feet. with a winter weather advisory up for the high country. cold scattered showers tonight, turning to cool scattered showers early tomorrow. high pressure rebuild come the beginning of the week and that should hold through midweek to dry us out. temperatures will warm up a little, but nothing dramatic as we see temperatures today mid to upper 50s for most locations. oakland got to 62. mountain view to 61. a will the of 57's throughout the bay today. napa, san francisco, and

pacifica, has a very cool weather pattern preveiled out there with the showers moving in late tonight from north to south across the region and pretty productive showers. as we did see, up to an inch or better rain fall in the north bay. the leading edge of that front is moving out of the area as we take a look at the doppler. we'll see a few scattered cells still remaining in the north bay and in vacville with most of the energy moving to our south. however, we will continue with the scattered shower activity through the night tonight as we take a look at the forecast map. the showers will be tapering off through early tomorrow and begin to see things dry out as this high pressure system moves in to rebuild through midweek. then by the end of the week, we're going to take a turn back to the cool and wet once again. timing on that pattern is a little off. so at this point, we'll call it a chance of showers beginning thursday and continuing through the weekend. as you see tomorrow, widely scattered shower activity out here. i don't think it will mess up

the game or your festivities out there. any rain fall amounts should be light. while up in the sierra, winter storm warnings up, 3 to 7 inches above 4,000 feet. 10 to 15 inches of feet above 6,000 feet and winds up to 30 miles an hour. that's a winter-like pattern. temperatures slightly warmer tomorrow. upper 50s. few more low 60s popping up and around the bay. the warming trend will continue through the beginning of the week and as i mentioned, by the end of the week, we'll be looking at another weather system approaching with temperatures falling off and the chance of showers moving back into the picture once again. and that will likely continue right on through the weekend as we see those low 60s preveiling out there. and for game time tomorrow, looks like we can expect low 60s with widely scattered showers. so kim, no excuse not to go. >> she got rained on today. thank you jim. >> sorry. >> that was nice last weekend.
