what caused diesel fuel to flow from a research lab into a nearby creek -- that empties into the bay. a gooey mess. what caused the products to flow into the bay. protesters are vowing to shut down the port of portland. the problem these protesters have from other people joining in. more than 1,700 gallons of diesel fuel shuts down a building at uc berkeley, which had happen at the stanley hall where crews are still cleaning up the toxic mess. the clean up effort goes far beyond the berkeley campus. >> reporter: pumping out hundreds of thousands of diesel fuel from uc berkeley's housing

hall. the research lab and classrooms, where last night the emergency generators spilled over. >> it sounded like a bunch of lanterns that were just poured out basically. a lot of fumes, gasoline fumes. it gives you a headache. >> reporter: there are concerns that the fuel could head into the bay. they are all monitoring the spill. >> right now, the coast guard is watching to make sure that it doesn't go into the marine environment, where we are setting up the booms, different types of booms that will, if it does go, it'll block it and we can gather it from there. they are taking and monitoring air air samples.

the cause of the generator malfunction is under investigation. at uc berkeley, linda yee, cbs5. in a massive demonstration last month, the occupy movement managed to shut down the port of portland. this time they won't be welcome. >> what macaw is the coast coast's most powerful action, coming on november 2, when thousands marched and shut it down overnight. since then the movement has taken many hits. city after city has evicted campers, setting up tents. occupy plans another attempt to shut down the west coast ports, including the port of portland with some support.

children would still be exploited. we would not have health care benefits and the only way we got that was through struggle. >> they said the shut down is in part to show support for the dock workers, labor disputers. but the international president says that the union has not voted to support the shutdown. they said that support is one thing, organization from outside groups attempting to struggle, in order to advance the general idea is one another. it's not like they will get much support from their load. >> we don't want them monitoring it. what they don't realize is the more they occupy, the less money they will make. it is just so important to this country. our business depends on it. >> reporter: they pleaded with occupiers not to shut down the port. ed today, she hope to shut -- today, she hope to shut it

down. as does the trucker from utah says. >> they are not hurting these guys. they are only hurting us. >> reporter: she questions the tactics. and it is connected to more than 800,000 jobs across the country. a better tactic might be to get involved in politics. >> we need to find a candidate of their own and try to take berkeley away from good honest people. >> reporter: the port of portland has issued their own open letter. they said in loss revenue, wages, taxes, that the port says they are still feeling the impacts of the last shutdown. reporting live, don knapp,

cbs5. police in riot gear moved on in. one was pushed by demonstrators, but no one hurt. the trucks were loaded with confiscating belongings. it follows a stand up on wednesday when officers eruptedat the plaza and then backed off. one by one now, occupy camps around the bay area had been shut down. but quietly the occupy camp in berkeley has grown. as we explain, even the cities themselves are weary of going violent and drug use. >> each occupy movement represents and reflects the community and what they represent. >> welcome to occupy berkeley, the only remaining look. it was not always large. when started with a couple of tents in october has ballooned to around 100 after absorbing people from other occupy camps.

victims in court on tuesday -- as they prepare to testify former penn state assistant football coach could be facing his alleged sex abuse victims in court on tuesday as they testify for the preliminarying hearing. the former coach blowing the whistle on sandusky is now in doubt. >> reporter: the former assistant coach is among those expected to testify on tuesday. he told a grand jury that in

2002, he saw jerry sandusky in the locker room campus, sexually assaulting a young boy. he saw a boy, estimating to be about 10 years old with his hands up against the wall being raped by a naked sandusky. but today, a local newspaper report raised new questions about whether he may have told a different story back then. and the harrisburg patriot news quoting a source saying after the incident, he went to his father's home, where a family friend was present. they said that he reportedly said at the time that he heard sex sounds, saw a young boy, stuck his head around the corner and the adult arm reached around and pulled the boy back. and the paper said that he told the grand jurors that he asked mccreery several times if he saw anything sexual and he said

no. at his home today, a woman declined to comment. >> we're not opening up the door, good-bye. >> reporter: and his account could be important to the former penn state administrators. when mccreery told them about the incident, he did not report seeing actual activity. lawyers for the two men would see powerful evidence and the charges against our client should be dismissed. earlier this year, sandusky's lawyer said this about mccreery. >> it would be a shame. you know, it's what comes out of all of this, all he reported was, he feels uncomfortable with his kid playing around. and all of a sudden over years, he involved that into the sex allegations. >> reporter: if the information is accurate, it'll help his case. he said confirming everything that his client has been saying all along.

anna warner, cbs news. and stephen king the author, he would have been proud. the thrilling encounter with a shark. but it was another stephen king. this one a 51-year-old australian surfer taking in the waves. and out of nowhere, a shark jumped out of the water and came right for him. he was thrown in the air and suffered minor bite marks on his leg. his world, not so lucky. a nice size chunk taken out of it. >> i'm probably the luckiest guy on two legs at the moment. yeah, unbelievable. >> the scariest part of the whole ordeal was just hours after the attack. he spotted kids playing in the water at the same beach. no other a. they were flying from denver to los angeles when the right engine died. 125 passengers were on board and the plane was forced to

will be clear it's being pushed back offshore, allowing these disturbances out of the gulf of alaska to parallel the coast. one is going by right now. heading to southern california where it will be first thing in the morning with another one that will be arriving on thursday. once again bringing the threat of some light showers down to north bay. so for the most part, it looks like a minor wave of precipitation here through the week as we see tomorrow, the center of the circulation will be moving off. take the clouds and rain with it. it will leave us with temperatures once again in the upper 50s to the lower 60s and moderate air quality across the eerie john. finally you're looking at a little bit of the mixing in the atmosphere after four to five days of bad air quality there. again, they are closer to the 60s in and around the in and around the bay. by thursday comes the next week

debuted on top of the weekend box office. but th the star-studded holiday theme romance new year's eve movie debuted on top of the weekend box office. but there's little holiday cheer in hollywood where movies only brought in about $77 million this weekend. that's the worst weekend in more than three years. and new year's eve brought in just $13.7 million.

the comedy, "the sitter," opened up at number 2. "the twilight saga," are at the top three. beer sales are down because of the recession, but they have crafted beer from small independent brewers that have gone up about 21% for the past three years. they found have group ofbrothers who saved their failing business by ignoring the standard business model. >> reporter: like millions of beer drinkers in america, these two gentlemen discovered in college they really enjoyed beer. >> not just drinking the beer, but what's behind the beer, the history of the beer, where the flavors came from and where we thought we would be able to take them. so they started their own firm in harrisburg, pennsylvania. they played it safe. but safe didn't sell. >> we're about five years into it. if we're going to go down, have fun doing it. so we started, you know, doing
