night athey tried to take over a company of buildings and ended up breaking into city hall. vandalism there and several acts of vandalism all over downtown. including private businesses we'll be talking about that and have a look at some of the pictures with last night's tear gas. how much more can go on? mean while less than two days to the florida primary and newt gingrich has picked up a key endorsement. herman cain. susan mcginniss live in florida with the latest on what the candidates are saying about each other. good morning, susan. >> reporter: good morning, the odds keep on stacking up, at least here in florida, against newt gingrich. he is behind mitt romney in the poll in his two of the latest polls in the double digits. so he did pick up this latest endorsement from herman cain. will it be enough though, is the big question. newt gingrich on television this

morning saying he is going to take this all the way to the convention win or lose here. newt gingrich is getting a big boost from former presidential candidate herman cain. >> we are going to elect speaker newt gingrich as the next president of the united states. saturday night's surprise endorsement comes just in time for gingrich. he is well behind mitt romney in the florida polls. this morning the former speaker admitted it is going to be hard to catch up. we have a shot at winning. but frankly, it is uphill against the sheer weight of romney's money and the negativity of his campaign. the candidates continue to trade verbal jabs on the campaign trail. he was fine for ethics violations. he ultimately had to resign in disgrace. >> you can come out to do this you can't debate somebody who is dishonest. you just can't. >> reporter: gingrich says he will stay in, even if he loses tuesday's primary. santorum cancelled his

sunday morning campaign events to be with his daughter isabella, who was taken to the hospital saturday. the three-year-old has a genetic condition, and needs frequent medical care. ron paul is campaigning in future caucus states, like maine. romney continues to dominate the race when it comes to money. he is out spending gingrich nearly 4-1 in florida. gingrich hopes cain's endorsement will help him stage a last minute come from behind victory here like he had in south carolina. now romney's lead is being attributed to his very good debate performances in the last couple of debates. all the money, the great funding he has there in florida and ann and phil, a barrage of negative ads. >> speaking of we heard there was a romney ad down there featuring tom brokaw, causing some controversy. >> it is. extremely negative.

it features tom brokaw. it is nothing but a clip from an old news program on nbc. it is brokaw reporting on the house finding gingrich guilty of ethics violations. it says the colleagues in the house are questioning his future effectiveness. nbc has asked the romney campaign to pull that ad and romney's folks are saying unlikely that is going to happen. they feel it is legal under fair use standards. locally a day of action ends in 200 to 300 arrests asses protesters took to the streets of oakland. 500 protesters marched yesterday. police say the three officers were injured after being pelted with bottles, rocks. and some sort of explosive device. the protesters clashed with police and tried to occupy a company of buildings. news crews were targeted at oakland city hall. demonstrators jumped on the roof of our truck and hit another

television van. threw bottles and rocks that missed our crew but ended up breaking two windows in the van. the protesters had planned to occupy near lake merit but police stopped them with tear gas and flash grenades. protesters then broke into city hall, vandalizing exhibits while another group broke into the nearby w mca. it became a very chaotic scene. the bulk of the arrests were made just before 58:00 p.m. no the crowd came over here to the ymca and the doors were locked and the crowd forced their way into the build snog protesters planned to meet again today. in other occupy news across the country in washington, d.c., senator joe lieberman was one of the people showered with glitter from occupy protesters. guests for the annual alfalfa club dinner were forced to move

a barricade. that protest comes two days before the national park service is set to end the occupy camping permit. new this morning gunfire injured at least one person outside of a party out of an elk's lodge in concord. police say at least two people opened fire. a 19-year-old man from antioch was hit in the leg. he is now in a local hospital being treated. more than 100 people were there when police got there. that made it difficult for them to find suspects. a deadly crash this weekend in the central valley it involved a light rail train and an suv. it happened in south sacramento near the fruit ridge station. video of the crash shows the suv driver tried to go around the guardrail crossing. this is all that is left of the vehicle right now. four passengers a man a woman

and a baby boy died. a fourth person, a woman is in critical condition. six people from the trains were sent to the hospital with minor injuries. and a rookie standout for the san francisco 49ers has been charged with driving under the influence. miami beach police arrested outside linebacker al qaeda don smith friday night. he is due in court today. smith was the overall definite draft pick out of the your of missouri last year. the 23-year-old also ranked first in the nfl for sex among rookies in a statement the 49ers say we take these issues very seriously, but will reserve further comment at this time as this is an ongoing legal matter. a federal crack down on illegal immigrants is stirring a lot of controversy here in california. people gathered at st. mary's cathedral yesterday to speak out against the program called secure communities. led to tens of thousands of deport stations in the last couple of years. it requires local law enforcement to share information

with the feds on people they arrest. the goal is to deport criminals who are here illegally. but state assembly man says it unfairly targets the latino population. >> we need transparency on this and oversight and above all, we have to treat people who live here with dignity. he is backing a bill right now that would allow local governments to opt out of the federal program. meanwhile, the catholic church is denying accusations by opposing the federal program it is trying to quote replenish its flock? attention students. those heavy backpacks may be a thing of the past. yeah, apple is already transporting the laptops and cell phones, now the tech giant is eyeing the textbook industry. sharon joins us next to take a look at the new books. subtle shifts in our wind flow, back to an onshore breeze. will cool things down and bring a few more clouds to the bay for the work week. we'll have a look at your forecast details, coming up in

gradually shift to more of an onshore flow. by there afternoon, that will cool the temperatures down out of the 70s. back into the mid-60s range. increasing clouds bring with it a slight chance of showers to the north, but that is not going amount to much more than a few sprinkles. if that. continuing dry and mild through the week. by this afternoon, we'll be partly cloudy, mid to low 60s at the bay, mid to upper 60s across the interior valleys here. i hope it is a few dealings cooler than yesterday. i don't expect to see the remaining 70s out there yesterday both checked in with mid seven for daytime highs. again a few more clouds beginning to drift into the area. the tail end of a weak cold front will cross the north bay tonight into tomorrow, and bring you upper level moisture into the area. as a few sprinkles across the north bay, but i would look for more clouds than rain out of this as we see this cooling trend continue into the beginning of the week.

nothing dramatic. a slight cool down. most of our rain stays to the north. up near the oregon border. better chance as you go north of course. you see the moisture crossing the area with a few more clouds to talk about. other than that, we'll stay mostly dry through the week. temperature-wise across the state, looking for mid to upper 60s across the state. could even pick up a few showers in the high country to add to their recent snowfall, which nods stands at about two feet of snow at the base of the resorts. four to five feet at the summit. they picked up some snowfall here last week. temperatures today in the mid to low 60s for the most part. again, not expecting any 70s for today. nor for the beginning of the week here as we see another week disturbance headed our way by midweek, which will once again bring a few clouds and a slight cool down in the area. then we dry it all out, clear out and look at the 70s creeping back into the picture

by the weekend as we continue this very dry pattern into the beginning of february here. can't complain too much about the spring weather. ann, back to you. looks gorgeous. apple fans got their fix this week at mac world. the company got a boost on water. now apple wants to transform textbooks for students. associate editor for cnet.com. thanks for being here. >> thank you for having me. how practical is this? replacing all those big, old textbooks with digital books. >> it sounds perfect. nobody wants to lug around heavy books all over campus. what apple wants to do is bring digital textbooks to k-12 education. actually this is something that was on steve jobs's to-do list. tim cook is bring that go wish through. and what they want to do is make these textbooks interactive. so they don't just want to dig ties textbooks, they want to, they are embedding videos in

these books. they have interactive grass. you can highlight, like you would a regular textbook. when you highlight the text, it turns into flash cards. so it is completely new experience for kids. but it is not going to be easy. >> it seems like a significant cost involved. >> of course. an i-pad right now is at least $500. now the nice thing is, these textbooks are going to be $15 orr less. that is significantly cheaper than hard cover is right now. but it is not just the price of i-pads, and these textbooks. according to the national center for education statistics, the u.s. government is spending $12,000 per student on public education. add in the price of i pads and those textbooks, plus these schools are going to need it departments to keep up with the hardware. maybe implement wi-fi throughout the school. apple has a pretty big

challenge ahead of them. when you think of traditional textbooks, the school has to buy them once. and they can use them for many, many years. would that be the thing if they could by the software, they could put it on several students's i pads? >> apple has already are drafted contracts with a few. it is going to be a question of how many licenses will each school have per textbook. it can't add -- it can add up. is it going to be $15 per year? how much is that going to be per student. apple isn't the only one dipping their fingers in the education market. google is also trying to do something. they have also set up a contract with school districts in the u.s. to send 27,000 of their chrome books into the classroom. those are google's flagship laptops, they are browser they run on a browser. so what is the difference between them and an i-pad?

>> so it is an actual computer. but it is browser base and uses all of google's applications. and you have to ask here, what is the real intention of these companies? it could very well be that by bringing the apple's i-pad and google's chrome books early on in these children's lives, they will be developing brand loyalty that by the time they go to college the only thing they were asking for is apple or google. >> is amazon getting into the game? >> amazon released kindle fire this holiday season. and at $200, it could be the sweet spot for textbooks. so if amazon can bring digital textbooks on to their devices, we could be looking at a serious competitor for apple and google. >> it does look cool if school district and his the tech companies can pull it off. all right today, occupy oakland, cleaning up after violent protests, city

la fuentes joined us and said the city has been overly tolerant. >> oakland has been picked as the center of the movement and i think maybe partly, it is for our fault. partly it has been that we have been too tolerant on the people that come and destroy our city. last night, i can tell you the direction to the police department and our people was to do whatever was necessary to make sure that these people get the message that we will not continue to tolerate this. >> that seems to be the strategy. at first you allowed them to occupy and it was okay. we are going to give them the right of free speech and take over the park and then try to get rid of them. it steamed like the strategy was not to let them get in, anywhere. >> with exception of the we, yes. i was not one of the people that actually wanted to allow them to do anything from the first day. but you are correct. last night, the direction was

different. we arrested more than almost 300 people. three officers got injured. tires were slashed. cars were vandalized. windows are broken. a lot of things happen at night that would not allow them to occupy oakland. okay but oakland has a split mission, it appears, initially you tell the cops facilitate the free speech. now that includes when they take over streets. when they march through the downtown, you guys clear the intersections and pretty much let them have it. even when the protesters decide that is not enough and they want to take over a building, then you have to move in. is there any thought being given to try to prevent the initial start ups? >> absolutely. speaking for myself and other members of the council, absolutely.

again we'll continue. we can't allow it. it is a violation of the law. you cannot block streets, you cannot cover your face. you cannot stop people. >> but there is, oakland has adopted a policy that that is free speech. taking over a street is free speech and san francisco does it too. it is called facilitating the first amendment right. >> cities across the country do for protesters, that is generally allowed. right. there was a time when you said no. when you walk on the sidewalks you get a permit. now it is okay to take over the intersections, right? >> my -- in my book it is not okay. i feel at this point not only are they targeting our key, place in the city, that would be the port, the p.d. building, they burned a flag last week, they actually burned the flag last night too. they broke into it. i think enough is enough. i think the citizens of oakland

are demanding now we stop this and we will stop it. there is no way to continue spending. >> how can you stop it? how can you stop it without incurring more trouble, more violence and more lawsuits against the city? >> you know, i believe there is going to be losses against the city either way. i think sometimes losses come with, with the justification of us doing our job or not. and i think that is what it is going to take. for us and for the judges and for the people that are watching what's happening. to realize that things are escalating to the point that really, at this point, i see it as domestic triesism -- terrorism. taking over buildings. you don't know what could happen when you have actual equipment, propane tanks, you have things that you lose control over it. you never know. and i don't think we are going to have an excuse if something major happens, because the escalation has been cleared. we have been covering that story for months. i don't know oakland gets out

of this. it has become grans -- ground zero for occupy violence. >> we are not seeing attacks against financial industries or financial institutions, we are seeing people carrying anarchy signs and walking around, battling with police. it seems to be a departure from the occupy movement in general. occupy's target. >> in san francisco they go to the banks and do policy state's noccupy oakland it is about rock and go rolling after dark. i don't know how the city gets to change that. it has been a long time coming and it is there. it is not no berkeley and oakland can't afford it. ignacio mentioned this. at some point people need to put pressure on the people doing this. perhaps it is the original occupy movement. perhaps they need to say you are hijacking our message. it is not about anarchy or

its walking shoes in honor of a fallen officer. plus, all eyes are florida republican presidential hopeful as they pull out the stops in the sunshine state. welcome back to weekend early edition. the time is, what is it now? 9:00 straight up and january 2nd. we have a pattern working here. good morning, thanks for joining us today. lots to talk about here in the next half hour. we are talking about occupy oakland. things got dramatic there -- in downtown last night. big questions about redevelop. you would hear about it, but it is a big debate. what does it really mean? and the latest on the presidential nomination race down in florida. but first our top story, occupy protesters vowing to return to oakland this morning. >> it is recalling a violent day of action that ended in hundreds of arrests. three officers were injured in the clashes, according to police. protesters also ended up with cuts and bruises.

news trucks and news crews were also targeted. don knapp, with more on the demonstrations. >> reporter: by evening occupy protesters left city hall for another protest. an attempt to take over the kaiser center. instead they marched to new inner city telegraph. police moved in behind and boxed them in at the back of a large, fenced-in vacant lot. as tensions mound the group pushed through the fence around police and headed for the street. moving at-will through the city with police behind them, they made their way to 24th and broadway, forced the doors and ran inside the ymca. police rounded up 30 inside and 40 outside and made arrests. >> we got total a rough estimate, about 100 people being detained and possibly going to be arrested. >> reporter: meanwhile, back at city hall, other demonstrators entered the front door, made their way into the building and

trashed things. the american flag burned at the door. officers arrived and held the open door. this evening administration said it is enough. >> occupy oakland has got to stop using oakland as its playground. >> it is not a lawful protest by any means. these people gathered with the intent of unlawfully entering a building that does not belong to them and assaulting the police. it won't go away. newt gingrich has picked up the endorsement of herman cain two days before the presidential primary in florida. it is not clear if cain's backing will enable newt gingrich to catch up with mitt romney. but nonetheless this morning, the former speaker acknowledged he faces an uphill battle.

we have a shatat winning. frankly it is uphill against the sheer weight of romney's money and the negativity of his campaign. gingrich says in theee vent of -- the event of a loss in florida, he plans to stay in the race. rick santorum and ron paul are also promising to go the distance as well. san francisco sheriff's choice of defense attorney is raising a few eyebrows. the sheriff is charged with domestic abuse and stems from a new year's incident involving his wife, who is not cooperating with police. since then, supporters have hinted that the city's law enforcement community, including the police officers' union, have been out to get him. but his new attorney is actually an attorney who represents the police officer's on or aboutiation and a number of cops who have been in trouble. she is one of their network's top defense lawyers. a police officer is dead on the central coast. shot and killed by fellow officers.

it was an officer in santa maria being investigated for sexual misconduct with a minor. the officer, a four year veteran of the force, resisted arrest according to his fellow officers and fired his gun. no one else was hurt. hundreds came out this weekend to honor the life of a fallen officer. people hit the road for a 2- mile trek -- a 2-9d mile trek. the walk was followed by dinner at mission church. all the money raised will go to his family. as we all know, silicone valley companies have a reputation for attracting top talent. but google, apple and others stand accused of trying to prevent workers they hired from going to other companies.

at issue is whether some conspired to prevent employees from moving elsewhere by agreeing not to hire each other's workers and raise their pay. >> these were agreements that were hatched and implemented and spread and concealed at the highest levels of these companies. a probe by the u.s. justice department found six companies had do not call lists. the companies settled that antitrust complaint and now the employees are seeking damages. tomorrow president obama is going to be hanging out in a google chat room answering questions about his state of the union address. >> the president is going to sit down for some q & a, in a special google plus hang out. live from the white house and broadcast over the youtube

channel. afghan president karzai has been meeting with british leader david cameron. cameron says brittish combat forces will remain there well into 2014 when nato forces are due to hand over responsibility for security to the afghans. 9500 british -- troops are there right now. the price of crude oil is predicted to go up to $150 a girl. it comes as iran considers a ban on crude oil sales to europe. that is in response to a european union embargo by summer the european union is upset about iran's nuclear program. spanish airlines spanner has filed for bankruptcy and is not honoring tickets that people already bought. that left hundreds of passengers with void tickets. the last flight landed friday

february 1. because it is located on the portion of the city's landfill that needs grading and capping. use of the recycling center where people bring their stuff has dropped significantly in recent years, because the city's curb side collection program has expanded. most of the items taken to the center are simply accepted in the curb side program again. 11 minutes after 9:00. do we have a very nice day on tap. i almost just bought you a couple of extra hours. jim? >> reporter: as i was saying before, i got the hook there a minute ago. we got a working microphone this time. we'll dry it again. a gradual cool down, nothing dramatic. weatherwise we will continue with this dry and mild pattern into and through the work week here as wind shifts suitely to more of an onshore breeze that. will cool us down. bring the low clouds and fog back into the area.

the slight chance of showers to our north here. by this evening as a weak frontal system crosses the california oregon border. would this catch the tail end of it? continue dry and mild for the most part. looks like into next weekend as well. temperatures down a couple of degrees. no 70s showing up here today. mid up to per 60s for the warmer locations, back to the 60s at the beach as the winds shift through the afternoon, bringing in the clouds from the weak frontal boundary. right across the oregon border. we'll look for clouds and showers out of this system and it will bring cooler temperatures to the area here, through today. nothing dramatic, as i mentioned, just a coupal of degrees cooler today and yet again tomorrow we'll see more cooling as the low actually crosses to our north here. the slight chance of showers for the extreme north bay is in the forecast for this evening, but i doubt if we'll see much hit the rainfall bucket as it looks to be more clouds than rain for us. we'll see another weak system

on wednesday. again, the moisture crossing quickly through the area, leaving us with low clouds and fog and a cool down in to and through next week. we are still above normal for this time of year. normal temperatures will be mid to upper 50s. we are looking for mid to low 60s here today and pretty much through the week as we see temperatures peaking out in the upper 60s for the warmer locations here. otherwise the low six tis range will pretty well cover everybody throughout the region. a mix of clouds at the beach. upper 50s to low 60s likely and again, continued dry and mild through the week on wednesday with more clouds than rain for us as we continue this dry pattern into and through next weekend. again no rainfall in sight at this time in the long-range forecast, we should see a change by early next week, which puts us into the beginning of february. and still, longer dry pattern. back to you. well, ann took a break. left it to me jim. i'll have to live with that.

those temperatures they look like basketball scores. a major financial blow to city government is in the works. in just a couple of days, you are going to have a deadline to close down redevelopment agencies across the state. now mark evan off, the head of union's city's redevelopment, joins us now. good morning. first off for everybody out there, they have heard about redevelop. , seen it in the news. what is redevelopment? >> it is a critical tool for revitalizing areas. areas for the capital markets can't develop. in a nut show what do you do? if you declare an area a redevelopment zone what do you do? >> we did can use locally collected taxpayer dollars, issue bonds. invest capital clean up build infrastructure, streets, roads, water lines, sewer lines. >> what that is, is the area that as taxes are earned from that area, you use those to pay back the bonds, right? >> yes.

but the governor now wants to take that money and give it to the state right? >> well, it's always been collected locally. >> uh-huh. >> and the state, basically the governor does not want us to be able to collect any more tax increment and simply divide all the money among all the taxing entities. >> what's interesting is what you have done in union city very successfully was take this money and in one example, you built housing around the bart station correct? >> correct. you install the sewer lines? what is you do to the within i? >> in the situation around bart, we actually removed physical barriers to bart. so the neighborhoods that were once a mile walk to bart are now a quarter mile to bart. we have land adjacent, it's been cleaned up and now ready for housing to be built. >> what you do was you took the money and actually invested it in a one time investment to say we are going to improve the property so it can be built on and you can get house not guilty there, you can change what was on one side of the screen

largely abandoned land and turn it into a housing development because you put the basic infrastructure roads. what has the city of oakland done? they are in the hot seat now. they are looking at laying off hundreds of people, who were getting paychecks from redevelopment without actually doing redevelopment work. how did that work? >> oakland may have spent too much in operations. union city made a priority to make a capital investment and focus jobs and housing around the bart station. we made a commitment to mtc, to do focused develop. we made a commitment to the voters to encourage affordable housing and market rated housing around bart. we intend to produce the housing. >> you invested it in building, while let's say the city of oakland investigated it in maintaining its staff. police on the payroll, half the city council payroll came off the bart. what does the governor want to do with the monday any.

>> the governor simply wants to divide up the revenues among all the taxing entities. the governor also would like to order union city to liquidate our assets. and sell off all the land. we are intend not guilty union city to honor our commitment to the taxpayers and produce the housing we promise good already doing what he criticized oakland for doing? and using them to finance his payroll on the state? >> that is exactly what he is trying to do we are going to honor our commitment to produce the housing and jobs. that we promised back in 2007. the state legislature wants the money and the supreme court rules they can do it. aren't you guys out of luck? >> the legislature may be able to ban redevelopment. it doesn't have the authority to force us to abandon the existing contracts. >> this is going to be quit a battle because this is a way a lot of towns, including san francisco got mission bay out

of it. we have gotten ballparks out of it. used well this has been quit a boone for california and jobs. can you think can you beat the governor? or is he just going to win? >> we have contracts with all the agencies that invested grants with the expectations that union city produced jobs and housing around the bart station and we intend to honor that commitment. >> mark, i want to thank you for coming in. we are going to see where this goes. i think it is going to be one of the biggest changes in california we have seen in decades. >> yes. its a domestic violence case that has made headlines around the country. the san francisco sheriff ross mercury any -- ross mercury any is fighting to save his name. when we come back.

week - a judged the domestic violence trial against san francisco sheriff is set for february 24th. this week a judge denied ross mirkarimi's request to modify a protective order that is stopping him from seeing his wife and son. >> with all this pressure, why won't mirkarimi at least step aside? take a leave? >> he is making a mistake by not doing so. but if he steps aside, that is the end of his career. he needed to do what mayor brown suggested in an early column, cop to this plea and move forward and have it over with. unfortunately, he didn't do that. >> mayor brown, he could prevail in court and a politician lives for another day. why shouldn't he just hang in? >> prevailing in court will not matter, for ross. by the time you have five weeks of intensive, laser like strikes at everybody whom he has ever met coming out and saying something negative about him, the court is reaffirming the

fact he cannot be trusted with his wife and children, you can't recover from that very easily, phil. it will take years. it is almost as if you are trying to bury something that is horrible in the system and they have said 35 years from now, it will be okay. that is ross. let's move the spotlight off him and on to mayor lee. rumblings are saying mayor lee, you should have him step aside. >> i don't think he needs to. because ross is hanging himself. as the mayor, he has brought this issue up. i think he has taken a leadership role in it. but now ross is allowing himself to be hung. is mayor lee just standing on the sidelines and letting this unfold? >> mayor lee is doing exactly what mayor lee does. he is not the kind of politician that would see an opportunity here. construct a means by which it would be impossible for ross not to step aside. mayor lee will never do that.

he won't come on the same side of the street with mr. mirkarimi or his detractors. he will keep himself out of the fray, and hope that mr. mercury any does what is in the -- that mirkarimi does what is best for the city. >> the mayor would need to have to prove the sheriff has had misconduct in his duty. and the only charge on that would be dissuading a witness. >> he has two options. one the is question about the duty and official misconduct. the other one is if there is a conflict of interest. he has been meeting with the city attorney to go over what the options are and see what his responsibilities are. we think it is all politics. my bet, because they have moved for a quick trial, nobody is going to make a move until after the trial, because they would just be conflicting with the da's investigation. >> that is what he has been advise today do. all right.

two to three hundr all right. welcome back. and here's a look at this morning's top stories. 200 to 300 occupy protesters, possibly more, police have not given us an official count yet, but a lot after rests made in oakland last night. police say three officers were hurt as these occupy protesters clashed with them. they tried to take over two buildings, including city hall, significant vandalism being reported all over downtown oakland. gunfire injured at least one person outside a party at an elk's lodge in concord. the shooting happened around 11:30 last night on clayton road. more than 100 people were in the area when the shooting started. when police arrived, it was

tough to even find a suspect. newt gingrich this morning picked up the endorsement of america -- herman cain. this morning gingrich admits he is facing an uphill battle against mitt romney, who is leading in the polls. he is hoping the cain endorsement will give him a much needed boost. around here, it has been a gorgeous weekend. sounds like a few more clouds today, but still quite nice. we have seen 70s the last few days, we'll be down in the mid to upper 60s, normal for this time of year is upper 50s. there is a lot of rain, not the case of late here as we see again the winds shifting to more of an onshore breeze that will bring us a few more clouds, slightly cooler temperatures. no rain in sight for the foreseeable future. by the end of the week, we should be back to warming things up. once again as we continue this dry pattern leaving this at 40 to 50% of normal for rainfall this time of year. we'll still be a lot of time
