major accusations. we will hear what the state has to say about that as well. all coming up here in the next hour. >> first, headline news. newt gingrich was the headliner at the state republican convention in burlingame. >> former house speaker was the only candidate running for president who showed up. they were all invited. according to a new field pole gingrich is at bottom of the pack in california. rick santorum has seen a surge amongst registered republicans but still behind mitt rom nee. gingrich is aiming high. >> i am running for president. to be president of all the people. to reach out to run a campaign while i seek the republican nomination. i want to run an american campaign. >> and there is a surprise appearance by former candidate herman cain who supports gingrich. kane said the key to winning california is attract young people moderates and independents. michigan is holding a crucial republican primary on

tuesday. mitt romney and rick santorum crisscrossing the state trying to attract conservatives and undecided voters. as danielle nottingham tells us, one key question is which candidate stacks up better against president obama. >> reporter: for mitt romney, michigan is personal. it's where he was born and raised and now looking for another primary win. >> is that critical time. i think i'm the only guy in this race that will be able to beat barack obama. >> romney also attacked his chief rival rick santorum trying to portray him as a washington insider with an iffy record. >> this is not time for lifelong poll -- to explain why they voted for this or that based on what they were asked to do by their foal colleague. >> santorum fired back. he says he thinks he can win michigan as the only consistent conservative in the race. >> you vote for someone that says one thing one day and says anything else that's necessary the next day to win. or are you going to vote for someone you trust.

west of highway 101. top floor was fully engulfed with flames. they were shooting through the roof. firefighters had to help one person get out of that home. there were no injuries though to the two people that live there or to the firefighters that were able to get the fire under control around 6:00 this morning but there is significant damage as you might imagine looking at that video damage from the fire, smoke and water. >> one person is dead this morning and three others injured in two separate shootings in san jose overnight. one man called 911 just after midnight saying he was shot. he is expected to be okay and the second shooting happened outside of a restaurant on murphy avenue early this morning. a lot of people were inside the restaurant at the time. one person was killed. two others were hurt after some started a fight. there those shootings are not believed to be related. >> tomorrow the marin county planning commission. >> will discuss a development meeting proposed film maker

george lucas. he wants to build a movie making complex with two large indoor sound stages each the size of a department store and build an outdoor stage as well. neighbors in the countryside are concerned about the adverse effects that it might have on their rural lifestyles. supporters say that the proposal for the sound stage is consistent with the area's master plan. and there is a new wrinkle in the saga of alameda county supervisor nadia lock here and the male acquaintance which she had an incident at a motel with where the cops had to come. according to law enforcement sources, a sex tape of the supervisor and unnamed man was given to the husband, straight treasure bill lock some weeks earlier before the newark hotel incident. and that incident landed her in the hospital and since there was also investigation launched into the domestic violence. now lockyer claimed his wife was being stalked by the man but investigators found that the relationship might have actually been more consensual

than first explained. nadia lockyer isn't talking. she has checked into rehab and her acquaintance is recently been released from jail for drug possession and driving under the influence and not talking either. >> more bay area headlines now as part of an ongoing shake up of schools. dozens of oakland teachers have been told they have to reapply for their jobs. the new positions will have more responsibility and a shorter summer. but also higher compensation. this covers teachers who want to continue working at three oakland high schools. a man who was fired from a south san francisco business is under arrest along with three accomplices after police say they confronted his former manager. they got into some sort of fight reportedly with a group of employees who tried to intervene. one of the suspects fired a hand gun but nobody was hit. the ex-employee later surrendered at his house. firefighters attending a funeral in crockett yesterday ditched their formal uniforms to bat altwo alarm blaze that broke out just around the

corner. fire authorities believe repairs to the building may have started that fire. fire crews contained the flames within a half an hour. a shocking plot by three fifth graders to kill their teacher unraveling at a fresno elementary school. the teacher's association says student put rat poison in their teacher's coffee and one of the kids then had a change of heart and knocked the coffee cup out of the teacher's hand as she was about to drink. it also allegedly poisoned the frosting on a cup cake which the teacher luckily never ate. there is now a battle brewing how to punish the kids. >> they find out that you can hatch a plan to kill a teacher and the worse you are going to happen to you will be expelled from a elementary school. what is that saying? >> the fresno police department is working with the district attorney's office right now and they say if there is enough evidence they will prosecute. a strong earthquake struck taiwan today. >> 5.9 quake caused minor

damage, but there were no reports of injuries. at the epicenter was a mountainous area in the south of the country, about 20 miles from the coastal city. >> rupert murdock's newest newspaper launched today in great britain. the sunday edition of the sun came out about two weeks after five employees were arrested and accused of -- paying bribes to police and defense officials. the new sunday tabloid replaces news of the world. you may remember that closed down last july amid a phone hacking scandal. a scathing report on the state agency charged with protecting california's most vulnerable citizens. >> the investigation on the care of developmentally disabled as well. california watch reporter ryan gabrielson joins us next. still to come, all of the politics and money involved in the america's cup in san francisco. >> and after the record setting temperatures last week we are looking at a bit of a chill down across the bay. we will see breezy and cool

people who show up in a public space silly together. 8:41. you heard of flash mobs. large groups of people who show up in a public space to do something fun or silly together, usually dancing. there is a twist apparently for economic hard times that's called a cash mob. large groups gather to help out a struggling business by spending money there. in this case it happened at fresh mex express restaurant in folsom. the message spreads through twitter and facebook. the cash mobs are popping up all over the country. and in canada. very cool idea. i bet you probably have to wait a long line a long time unless

they are expecting a huge influx. >> all right, around here we were waiting for some rain. jim says that it is on the way. >> we like to have some rain. we will see if you like showers here. mostly cold air moving into the bay area late this afternoon into tomorrow. it will chill things out especially from our record setting pace of last week where we saw upper 70s to low 80s. back down into seasonal norms now. we are talking mid- to upper 50s today. cooler yet tomorrow and a cold start to the day here with temperatures below freezing for moderate chop of the north and east bay here. upper 20s and low 30s. right now looking at a bit of warm up in the mid- to upper 30s for the cooler locations at the bay, mid- to low 40s for veil on your -- vail at clear and dry conditions. increasing clouds through the day and a chance for showers as mentioned by late tonight and doesn't look like it will amount to much but we could get a sprinkle or two or snow possible in the local peaks. as the snow level drops to 2500 feet as once again this is to

remind what season it really is, still got three weeks of winter left so we could see a dusting of snow in the high country as next front approaches the center of circulation still in the offshore waters where all of the cold air is and will parallel the coast as it drops south here by the bay area. it's through the night into early tomorrow morning. again rainfall amounts will remain very light and not looking for much in accumulation of precipitation out there. just light shower activity mainly at the coast and more clouds than rain for most of us as we see this system it brushed the bay area as it crosses the region. i doubt it will make up much ground on the rainfall deficits at this time of year. you see anywhere from 14 to seven inches of rain short of where we ought to be for february and march which typically are some of our wettest rainfall amounts. moist of the moisture to our south and confined to the coast late tuesday into wednesday. a better chance of rain approaches the area. we could see up to an inch of

rain. temperatures are a little warmer. snow level back up above mountaintop levels here as we look for warmer air with that midweek system. right now chilling out around the bay. mid- to upper 50s for highs and maybe a low 60 or two in the south county area and cooler yet tomorrow as we see mid-50s prevailing around the bay and that slight chance of light showers early drying out through the day and better chance of rain arrives late tuesday and into wednesday as we continue cool through midweek and warm things back up as we dry out again into next weekend. there is a little bit of winter for you. now let's check in with ann. all right, thank you. inadequate investigations and lack accountability at state run development for the developmentally disabled those are the conclusions of a huge investigation by the group california watch. now the state senate is planning to hold a hearing on the problem that the investigation identified. california watch reporter ryan gabrielson joining us live now. good morning, ryan.

tell us what you found. >> basically we found that there is a police force that operates at california five institutions for the severely developmentally disabled. and that for about 20 years they heard people saying they don't know how to do basic criminal investigative work or collect evidence and we went back in and looked again and found out that's still the case. >> this is a police force that has been investigating allegations of abuse, we are talking about hitting, sexual assault, on developmentally disabled people at the state run institutions. in many states you would have the normal police going in and investigating that but that's not the case here in california. >> in california has a different system. unique police force that operates at these developmental centers and only at these centers and investigating abuse and suspicious deaths at these facilities involving people with severe autism, mental retardation and cerebral palsy. >> how rampant this is? >> well, we found over 300 cases in the past five years of substantiated patient abuse

which means department of public health went in and found there was proof backing up allegations made from the centers. there are over 700 injuries of unknown origin which means broken bones and cuts and bruises that are unexplained and unwitnessed events. >> i would find it would be difficult to get reports of abuse. people are talking about maybe they can't talk or they are not able to express themselves. so we are talking about the number of cases that you have reported and then those are being investigated poorly, according to your report. >> that's what we found. there is little reason to believe that police force that was responsible for doing these cases knew how to do basic police work. they didn't know how to process a crime scene. they didn't know how to question witnesses. they would ask leading questions or require special training to go in and do this and these officers had just the bare minimum to be certified as peace officers. >> we have a couple of examples, a couple of people that were victimized according to your report some cases that

you uncovered and some of their pictures starting off. >> timothy was a patient. he was quadraplegic and he had died in october 2005. he had been found with glycerin -- four inches long that had somehow ended up inside of him and he was fed through feeding tube and didn't have the ability to put the swabs in his own mouth. someone put swabs in his own mouth and he swallowed them or something worse. and we never actually found out what happened with him. the case was colonialsed as undetermined. police hadn't gone in until 24 hours later and by then the entire room had been cleaned up. no evidence to collect. records had gone missing and other records were eliminated. >> that's shocking to hear actually. the next one is van ingram. >> a patient down in orange county. fairview developmental center. severe autism. had an iq in the single digits and june 2007 he was found on the floor of his bedroom with a broken next. another one of those cases where they didn't collect

physical evidence. didn't start questioning witnesses until five days after the incident. just a day before the patient died at the hospital. and they omitted evidence from the case files. a lot of serious errors in that investigation and that one, too, was never solved. it was left undetermined. >> we want to show you a statement we got because knowing you will be here today we could contact the department of developmental services and they sent us this. quote, we were fully committed to working with the legislature to further enhance resident protection at developmental centers because the health and safety of the individuals we serve is our highest priority. so that is what they have to say about this. and also say we recognize there is room for improvement when resident care is involved and that's why we have contracted with national experts to strengthen all law enforcement protocols including investigations and that's not it. since your report came out, talk about journalism affecting change. senator carol luis now

candidates. republicans eight minutes before 9:00 and the recent spike in gas prices has become fuel for presidential candidates. the republicans blaming the president. and the demand in the u.s. has dropped each of the last 48 weeks. it's now 5.7% below last year at this time. you think the price would go down but that's not the case. it shot higher. republican presidential candidates are promising cheaper prices at the pump but the president says not so fast. >> i have developed a program for american energy so every american will look forward to $2.50 a gallon gasoline. >> you know there are no quick fixes to this problem and you know we can't just drill our way to lower gas prices. >> still, what is behind the gas price increases? china gets some the blaine as demand is rising and taking more world oil and tensions with iran over its nuclear

program and threat to cut off oil sales and then traders and speculators also in that mix. locally a meeting of the san francisco board of supervisors on tuesday could decide the fate of san francisco hosting next year's america's cup race once and for all. yes vote will commit the city to the deal. but the price tag nearly doubled what was proposed two years ago. on the other hand, voted down a couple likely find a new city to host it. >> and at the heart of the disagreement is use of port of san francisco property and issue who gets to keep the rent from future tenants. >> and how much the city has to put up to cover the cost of the event. and for answers we turn to our political insider former mayor willie brown and examiner columnist melissa griffin who is covering the issue with the board. and i ask melissa, okay, a lot of booster but are there legitimate reasons for board members to be concerned? >> absolutely. the city is on the hook for any

port improvement over $55 million and really no limit as of yet what exactly it is we will be able to on the hook to reimburse the event authority for. so far they have not been able to raise the money they were supposed to raise by the end of january. there are local hire issues that aren't yet involved in these agreements. the board of supervisors has reason to be concerned. >> mayor brown, this race has been touted as a big event coming to san francisco. but i wonder how much of this are we trying to get in order to mask the fact that the 49ers are leaving? >> well, no, it has nothing to do with the 49ers. directly or indirectly. we are after the americas cup for a long time. just as we were after the olympics for a long time, we want to bring something here that brings people into san francisco. that's the basis of our economy. and believe me, the americas cup will. >> there is a question is how many people it will bring. is this going to be the event

worth the millions of dollars we are investing in it? >> it's questionable. turnout in san diego in the preliminaries was not as great as what has been projected for the race this year. and we only had three teams sign up where they were projecting between seven and nine. serious concern about this. >> there has to be concern about it because peopleerant spending much money on the water craft any more. >> not a big market. >> exactly. and the newcomers to the world of richness and wealth don't seem to be interested in boats. they aren't interested in surfs and no interest in boats so far. >> the board of supervisors, it comes down to, this is on one hand you don't want to necessarily say no to any event that will bring tourism. but on the other hand you will be labeled did you give a giveaway to larry ellison a billionaire? are we making a billionaire richer and he did did drive a

hard bargain. >> and everybody is trying to get exactly to the breaking point. everyone is trying to negotiate just as far as possibly c. but ultimately even the board of supervisors no one there wants to be the guy who stopped the americas cup from coming to san francisco. >> and if there is any reason why it will pass the board of supervisors that is the biggest one. because nobody wants to be the one to pull the plug on possibly could be a very profitable party for the city as a whole. >> that's right. i think most people thought it was a done deal. >> it was until, you know, at the end of these there is going to be last minute pushes for little better deal. for example, david chu was concerned about one of the piers that's a prime location. not only ellison will develop it but how tall the development would be. upset other people. and by the way, the board of supervisors, so we set it straight, made another step along the way. let's not forget that friday opponents of the plan filed

arizona and michigan takes center stage tuesday in the republican's race for the white house. that is when they hold their primary contest. >> and the polls show that it is turning into a two man race in michigan. candidates mitt romney and rick santorum crisscrossing the state trying to court conservatives and win over undecided voters. michigan native romney facing a tough battle in his home state against santorum. the most recent poll results have them just about tied and now each candidate is attacking the others conserve five values -- conservative values. >> i think santorum wishes he could take back what he said. he talked about how he voted for things because he took one for the team. the team has got to be the people of america. >> is it absolutely laughable to have a liberal governor of massachusetts to suggest that i'm not the conservative in this race. >> now neither niewt gingrich nor ron paul have been actively campaigning in michigan. in fact, newt gingrich was in burlingame yesterday pulling in

breaks out at an apartment building in san rafael. the fire started at around 5:15 this morning at a three story building on lincoln avenue west of highway 101. the top floor was fully engulfed in flaisms flames were shooting out of the roof. firefighters had to help one person get out of that apartment. there were no injuries luckily to the two people that live there had or to the firefighters. they were able to get this fire under control by 6:00 this morning. but as you can see from this video significant damage from that fire also from the smoke and water. in other bay area news, new revelations in the saga of alameda county supervisor nadia lackier and the male acquaintance who she got into a fight with at a newark motel room. according to law enforcement sources there is a sex tape of the supervisor and unnamed man and was given to her husband weeks before the incident occurred. at that time there were concerns that she was being

stalked by the man but revealed that it may not have been a stalking situation but actually the relationship was consensual. and one person is dead this morning and three others injured in two separate shootings in san jose overnight. one man phoned 911 just after midnight saying he had been shot at the 1100 block of chin street. he is expected to be okay. the second shooting however which happened on murphy avenue did not have the same outcome. one person was killed and two others were hurt. shootings are not believed to be related. and in the east bay a traffic mess was a very big mess last night at the caldecott tunnel after a power failure shut down the center bore of the main artery. it took crews about two hours to restore power. opened traffic to all lanes and boy were they ready to go. and in southern california, an 11-year-old girl has died after getting into a fight believe it or not with a classmate outside of a long beach elementary school. >> the police say that fight

was preplanned. there was a group that had gathered around. and they say the fight only lasted a minute and no weapons were used. no one was even knocked to the ground. >> they were fighting for a boy. just for a boy. >> what do you think about that? >> it was stupid. >> because of the little girl's death has not been determined but an autopsy is planned. voting began in syria this morning at a new draft of country's constitution. >> the vote is seen as a way to possibly placate the government's critics and in the 11th month ups aring that claimed thousands of lives. whether the country ba'ath party that has ruled for five decades will cede power remains to be seen. >> they have identified a suspect in the killing of two u.s. military advisers inside an afghan ministry. local police are trying to track down an employee of the interior ministry to arrest

him. nato has ordered all military workers out of afghanistan ministries after yesterday's double murder. and osama bin laden's hideout in pakistan has been destroyed. crews tore it down overnight. pakistan's government did not want the location to become a tourist attraction or a shrine or some sort of other monument to the world's most hunted terrorist. last may u.s. navy seal team six tracked down and killed bin laden at the strike. a big shake up for oakland schools forcing teachers to reapply for their jobs. >> where some wives got the experience of what a day in the life of a marine is like. california is now of the opinion that 35, 40 years ago we had the best educational system. one of the best in the world. all of that has gone and eroded because of an absence of money. motivation for california voters to approve a tax hike still to come. the new poll that shows some

there. as we see temperatures warming rapidly this morning into the low 40s for the colder spots, upper 40s around the bay, even a few low 50s out there. again, we will look for the clear and dry conditions to continue flew the -- through the day here. a little wit this afternoon to chill things out as clouds increase around the bay here and that slight chance of showers creeps back into the forecast for late tonight and into early tomorrow morning. it doesn't look like it will amount to much but nonetheless we will make catch a few sprinkles as this system passes to our south here and center of circulation still offshore will parallel the coast and that's where all of the cold air is at which will likely cross the region through the day tomorrow. look for cooler temperatures tomorrow in the mid- to low 50s. may even upper 40s for many of the locations for a high tomorrow as again we see this cool and dry pattern bringing a bit of winter back to the bay area here. after our big warm up last week and that chance of light showers will appear late tonight into early tomorrow

morning. probably more clouds and rain for most of us. a better chance of measurable precipitation arrives late tuesday and into wednesday. here is what we stand on the year. we were at 30 to 40% normal for most locations. little less down in san jose. this rainfall will not catch up on those but we should hold our own here through the end of the week staying at about the 40% spot for this time of year as it looks like a dry season will continue here, typically february and march are couple of our wettest months and not so much this year as we see just light showers across the area here through early monday morning and better chance of rain arrives late tuesday into wednesday as the second system approaches with maybe up to an inch of rain out of that one if it holds together. again we will dry things out through the end of 9 week and into next weekend and this is a brief little bit of winter headed our way. with temperatures today peaking out cooler than yesterday and mid- to upper 50s and a few low 60s and the south county and

out around east bay we will be cooler as we see those mid-50s prevailing and maybe even upper 40s for 9 cooler spot. slight chance of showers monday. a better chance come wednesday morning as again we see a brief little period of winter here. couple days worth before we dry it out and warm things back up through the end of next week and continue our dry pattern into early march. there you go. a bit of winter just to mix things up. >> looks like more california voters are willing to pay higher taxes to bail out the state from its huge budget crunch. the latest field pole shows 63% support for the tax initiative by the california federation of teachers. governor brown's initiative earned 58% and another initiative proposed by los angeles lawyer molly munger got 45%. all three initiatives are in the signature gathering phase. is that before they can be placed on the november ballot. what happens if voters see all three of these proposals on the ballot?

>> there is a fear they might just vote them all down. you see tax, tax, tax and you say no, maybe, maybe, no, no. and that's one of the questions we asked our political insiders, former mayor and state assembly speaker willie brown, no stranger to taxes on the ballot. and the examiner's melissa griffin who is watching this and the question is, who is right? is the governor if all three wind up on the ballot do all three wind up on flames? or is he just trying to hedge his bets? >> he is wrong. i think if all three wind up on the ballot they pass whichever one ends up on the ballot will pass. california is now of the opinion that 35, 40 years ago we had the best edging canle system and one of the best in the world. 35 or 40 years, 50 years ago we were thinking, globally about how we can make this the most livable state. all of that has gone and eroded because of an absence of money. this is a chance for the people

who really want to see that happen again to vote and they are going to do it in my opinion. >> well, actually, a new poll came out that showed that if all three measures are on the ballot all go down. there is support. no, go down. there is support. there is support for a tax measure. there is not necessarily support for three tax measures. if 55% of the population is in favor of a tax measure, they will dilute their support and very few people will vote for all three. people will pick one. that's the one i think will pass and that dilutes support for a tax measure and they all go down and that's what the poll numbers show. >> i think each case your conclusion and jerry's conclusion is wrong. if i'm for a tax increase, i vote for all three. period. i just go yes, yes. >> you are going to be like one of 11 people to do that. >> my question is -- >> we will be the majority. >> and willie's world he fix it so 11 votes will be the

majority. >> the way the campaign is undertaken it's that. literally identify how your son or your daughter or your relative is going to be able to get that seat in the community college, in the state university system and then the university of california system and at a price you can afford. >> that's two of the measures. but jerry brown's measure doesn't have that specific. he will sell it that way but nothing there that says the money goes there. he says unless you pass this i will cut more. >> ultimately i don't know that all of the voters agree a lack of money is the problem. they believe that mismanagement is the problem and they aren't eager to give money for in jerry brown's measure which isn't necessarily earmarked for education. >> they had a chance to test that theory about mismanagement. they had it with gray davis. recalled it and had it with arnold swarzennegger and he is gone. literally they are of the opinion that maybe it is not the epidemic of mismanagement. it's in fact the absence of resources, period.
