>> i would not use the word can't but california is known as having strong vested rights for pension benefits but that is not an absolute right. there have been court decisions that have allowed adjustments, ironically in san diego where they just passed a measure were they authorized actuarial adjustments that did allow contributions from employees but that was based on the narrow exceptions. there have been other court decisions that have actually held that what they did in san jose did violate vested rights in that unilaterally increasing contributions that the employers are required to pay does violate those rights and any changes need to be reasonable, the courts have the knowledge that government entities can change pension obligations but they have to be reasonable and when there is a take away many

decision say you also need to provide comparable favorable benefits for the employees so the unions will certainly argue that there was nothing favorable >> and the city will argue that what you're saying is that we ask you to give in more than we need to give you something someplace else but we have nothing to give and the reason we're here is that we're going broke and we cannot afford the payments so where is the law on that? >> there have been a couple of situations in bankruptcy where retiree benefits have been able to be changed. the city's own outside legal opinion in this case it knowledge that what is in this measure is untested. if they seem to be trying to create a new rule that there is a separate segregated issue dealing with underfunded liabilities and that seems to be a new fear that they are trying to create. they're trying to say that there is significant unfunded liabilities and it is not unreasonable for the employees

to pay a portion of that and there's no court decision that says that or opinion that knowledge is that but, you know, the court has emphasized that the courts have to analyze each situation on individual facts, past practice, specific language in the charter, specific language and ordinances in a historical context, so it is the classic legal response that it depends on the facts but with the premise that there are strong vested rights here in california >> we have a lawsuit from the firefighters union and the police officers' union but the question is, how much power do the unions have? are we seeing the downfall of labour unions? >> i don't think so. these things go through cycles. 10 years ago after 911 voters were giving greater benefits for police and firefighters so we are in an unprecedented bad
