8:32 am
and that begs the question if there was more corrosion >> more than one dozen refinery workers were exposed to toxic vapors and could have easily been killed when hit ignited. the full investigation is likely to take months. some people are pointing the finger at chevron and others for a sudden rise in gas prices. bay area prices have topped $4 per gallon in the last week. there are only a small number of companies refining oil in california but one woman has written extensively about the industry the reality is that we have not seen any change in the actual supply of gasoline hit gasoline stations. we had a fine amount of stock when the incident happened in there was no reason for the very same day for gasoline prices to go shooting up. >> she says it is only one of several factors including the

rising cost of crude oil. we made easy for you to find the cheapest gas in your neighborhood. click on the pump patrol to get the bay area best prices. >> the latest poll for the national democratic party is earning the support of the under voting democrats generation. it says doing so will attract young people to the party and it also calls for a repeal of a federal law that recognizes marriage between a man and woman. mitt romney selection of paul ryan to be his running mate might reshape the presidential race. it will likely bring debates on a number of issues. >> ryan stepped off the retired battleship uss wisconsin and on to the national stage, energizing the conservative base and injecting substantive
8:34 am
issues into the campaign >> there are a lot of people in the other party who might disagree with paul ryan but i don't know anyone who doesn't respect his character or judgment >> as chairman of the house budget committee the seventh turn from wisconsin has handled fiscal responsibility. cutting trillions of dollars of recessionary spending and reforming the tax code. as he put it in his first speech, >> we are on an unsustainable path that is robbing america of our freedom in security. it doesn't have to be this way. >> beyond energizing the base which has been lukewarm to mitt romney, he can also help pick up support in key swing states including wisconsin. the president one wisconsin by 14 points in 2008. recent polls show a decline in his support. he now leads by six points in wisconsin. all ryan and mitt romney spent
8:35 am
the rest of the day in virginia. >> he will divide and distract the country to win an election by default and we will not fall for that. >> for all the enthusiasm on the right, the morning was not perfect. he had a little trouble introducing his running mate >> join me in welcoming the next president of united states, paul ryan. >> it was the same mistake that then senator barack obama made four years ago when introducing joe biden >> the next president, the next vice-president >> this morning mitt romney did not realize the gaf right away and went back to the podium to clarify. >> every now and then i'm known to make a mistake. i did not make a mistake with him but i can tell you that he will be the next vice president of united states. >> we found out a little more about how mitt romney came to make the decision. he called brian 10 days ago and
8:36 am
told him that day but on august 15th learned that he would be the nominee and the rest of us found out on saturday. >> congressman ryan went through considerable lengths to keep his election secret >> point was to keep the decision out of the media. ryan slip through airports in casual clothing, a baseball cap and sunglasses. last friday out of his home he walked through the woods behind his house to avoid a reporter >> two people died in a free car crash on highway 680 in san ramon near the crow canyon off ramp. one car started leaking gas and another caught on fire. that accident shut down traffic for five hours this morning >> the glenn parked bart station

>> firefighters have contained 20 percent of a brush fire northeast of fresno that was started by a cigarette tossed along the highway. the flames spread across 150 a., 200 homes were evacuated and traffic was closed on for lands of the highway as a precaution. it will be another hot day for the weather in the bay area >> the big question is how long
8:41 am
will it last? it looks like we will have hot temperatures for a few more days. sunshine around most of the bay area, it is a little bit foggy along the coast. it is now 60 degrees in concord, 64 in livermore. 50 in santa rosa, but the temperatures will be warming. >> a good sunday morning after a very hot saturday. numbers reach more than 100, 110 at the pinnacles which is 25 mi. south of hollister. plenty warm in the bay area with 104 in livermore. another day of warm weather as the high pressure continues. we will be seen temperatures drop down a degree or two by monday and tuesday but out the door, it is cloudy along the shoreline, partly cloudy skies around the bay. some fog and low clouds will be
8:42 am
pouring through the gate and over into the east bay. last night at the walled o'grady was effectively raining. there was so much fog that it was raining. only about 300 yds but was actually coming down and the visibility was down to about 200 yds. futurecast shows the fog and low clouds will pull back to the shoreline leaving england under warm temperatures again, not quite as warm as yesterday. the bay area will be in the low 80s and inland will be near 100 degrees again today. the overnight low tonight will be 56 with westerlies about 25- 30 mi. per hour. new york city has partly cloudy skies.

ticket is now said. >> cbs five political analysts show is joining us with more on how the spokespeople for both campaigns see this picture of paul ryan. >> the spinning is happening fast and hard this morning. on face the nation a few minutes ago we had representatives from both campaigns and a big surprise, they are both looking at this from their own self interest. the mitt romney people see this as a bold choice >> that is funny >> that is the word they're using because they say rahm not only wants to go after job creation but is committing himself to fiscal reform and that he will be the real change can it. the democrats not surprisingly are looking at congressman's publications that he has, the
8:45 am
book that he wrote about the path to prosperity which is about reforming entitlement programs and tax codes and there is lots of meat for them to pick at in terms of criticism and they have definitely focused on medicare reform and the tax changes that will favor the wealthy. this will be a class warfare kind of election and ryan actually plays into the democratic narrative. the end result is that they both cannot be right and it remains to be seen whether or not ryans choice will help governor romney it or not >> congressman ryan has a record himself on the chair of the house budget committee, he is behind some controversial proposals, how is his record on the committee going to play? >> i think he actually has a good record as far as that is concerned and on a personal level he has had a bit of a duel going with the president for the last year or two. he spoke forcefully against him
8:46 am
in some of those meetings saying to his face that your reforms cannot do much. $40 billion per year is not much when we have trillions of dollars of deficit. what you have done is for show but doesn't make effective changes. obama gave it back to him on a personal level when he invited ryan and others and gave a speech but was very critical of rhine's proposals to his face and i would not save his personal but is kind of personal so romney is getting someone who's not afraid to be confrontational with the president on a national stage and i think he gets kudos for that in the republican party. at the end of the day allot of rhine's proposals are about big changes and asking questions that need to be asked. medicare needs reform, we need to look at social security but at the end of the day these things still threaten benefits that people to vote today received >> is a huge voting block when
8:47 am
you talk about people concerned about medicare. is that the wise political move for him to be trying to reform that system? that is the question >> you need to ask those questions, and democrats do as well but one of the things i think republicans miss the point on is that it is not easy to change these kinds of programs and still maintain political power. seniors are a very powerful political group. the american association of retired persons is an enormous lobby and seniors are as diverse as any other group but on issues that affect seniors, but they vote in lockstep and they give money to campaigns and their turnout numbers are huge and they study the issues. you go against that group at your own peril in this country. many of the proposals that ryan is putting out will threaten seniors. democrats will lead on that and
8:48 am
definitely fan the flames. it will be difficult for romney to do that unless he starts making concessions in saying he is really not a fan of that part of ryan's plan and the man he does that, obama will say now you know what is like for me. the problem for the wrong people is they are promising change will happen now but the kinds of changes they are going after will take decades to achieve. >> thanks for that and we will continue to watch this. >> before the sikh temple shooting there was the colorado movie massacre >> how that could mean big changes for hundreds of thousands of gun owners. a very controversial proposal, we will talk about it next.
8:51 am
>> the feds are inviting competition from school districts for millions of dollars of education grants as part of the education department's race to the top program. to qualify districts must show how they will use it. districts have until the end of october to apply. >> hundreds of california, thousands of california gun owners could be forced to
8:52 am
register their guns or even modify them. a lawmaker first took action after a cbs five reports that we aired in may but as allen martin reports he upped the ante this week. >> the gunman in the colorado movie massacre fired off most of his shots with an ar-15 semiautomatic rifle equipped with a 100 round magazine purchased legally had a gunshot. here in thrall for india state assault weapons was limit you to make 10 round magazine with some exceptions but you can own and ar-15. is a military style weapon with all the features that california law bans. you can buy it legally as long as it has a bullet button that allows you to quickly detach a magazine even though under california law detachable magazines in combination with other features are illegal. under california regulations
8:53 am
written to enforce the law, the bullet button makes the magazine fixed and therefore illegal because you need the tip of a bullet to detach it >> that assault weapon is in part of the band >> senator leland yee introduced a bill that banned conversion kits and devices to make the button easier to use such as this magnet. these days you do not need a do-it-yourself kit. all the major gun manufacturers make them with bullet buttons built in so the senator is amending his bill >> with the new thing there is a lot of support out >> in the new language the definition of an illegal detachable magazine now includes one >> the change would be that a bullet button weapon is in fact part of the band and therefore
8:54 am
you cannot in fact possess that particular kind of weapon unless you make certain modifications so that the dangers features are not part of it >> it also called on the attorney-general to amend the state's regulations and bring them back into conformity with the law. >> everybody sense that there was a wink wink going on and that the bullet button was in fact ok >> after three months of no common the attorney general now says, i applaud the legislature's interest in expressing this problem and support efforts to pass legislation to reform the laws of original intent. it is a call to war for california's gun rights lobby. >> these are real problems >> gene hoffman is president of the cal guns group >> the people who bought these could now be felons and that is a real issue >> because if the bill becomes
8:55 am
law gun owners would need to register and modify their rifles. beginning next july gun stores in california would no longer be able to sell them >> it would take very serious reconfiguration or maybe destruction of a firearm to comply >> senator reese says he is ready for battle >> i think in the capital, people now realize that we need to do something about these assault weapons and if there is a widely kids in this ban we need to plug the hole >> several lawmakers have already signed on as co-authors including senate president pro tem care of steinberg but leland yee says support so far has not been bipartisan. >> coming up, we will take another look at the pension

reform debate in sacramento. it will really be heating up over the next several weeks. >> a congressman from wisconsin now on the republican presidential ticket. how the race for the white house could be affected >> remembering the victims of the movie theater shooting in colorado. the act of kindness that is helping others feel, we will be right back.

of the course of the next 30 years are reducing formulas for new orders and changing some of the rules that have allowed for some abuse and that the same time to make sure that we don't take everybody down to the bottom here. seen it democrats ran an impasse with governor brown in july that the latest decision to sutter said it's not true in fact he says that are very close to an agreement. what happened in the middle of july is that we just needed more time to work to the details we really were not far apart from the governor in my view. he and the eldest pension reform plan nearly 10 months ago and wants to increase the retirement age for new state employees to 67 and have everyone contribute 50 percent of the cost of their pension and put a cap on the retirement benefits these types of plants of have some unions on edge.

as we said before the pension reform will be a big deal for sacramento lawmakers this week. the assembly member does a earlier serving as the assembly's assistant asking us to tell us how close the assembly is to agreement. been working in the conference committee and pensions for six months since the governor is come out with his 12th point plan putting the final touches on a right now in negotiations with the governor's office and the committee to get it right before it goes to the floor of the assembly and the senate. a lot of people a weary with the debate because with been talking about for years and there's just no action are we to believe there's going to be action this time round will try to convince people that we are going to do something and i think people be very surprised and gratified by the work we've done them very optimistic right now we're down to the details is the potential that everything will fall apart at
9:11 am
the very end this a very controversial issue always the potential that things could come apart the the republicans very early on said they supported the governor's plan we feel there's a strong chance that they will recognize that it's actually putting into place with the governor suggested we do expect some support. also talk of this being a political father in the cap of people trying to push the plan something we read the to see before widespread support the tax initiative in november. i think it should look at it as part of the effort to say to the states in the residence ever in our house in order me ask for new tax revenue people what to say and look at this and senate were doing what we need to really be stable and unstable economy suffered talking about for the economy and for education people what to see that essentially what we're doing scanning rican and saving

money long term and having sustainability going forward the works for everyone. we already have pension reform moves in san jose few months ago episcopate the plan that we would see statewide to outpace other locally. and think what you see is it's much more comprehensive plan including state county city and special districts so it's much work on a comprehensive agreement greater amounts of public employees and it and it would be in my estimation much more comprehensive talking about tens of billions of dollars saved in the next couple of decades. there has been a lot of fear of how we're going to milt with a and the other cities but rather than trying to do it county by county this would be state wide. with the legislatures of us only three former weeks away the key issues that great that you're focusing on
9:13 am
i think some of the final key issues are trying to figure out the proper approach for the age of when people will be retiring with special needs of public safety versus others in the whole idea right now there's two things we are debating as to whether we have a hybrid plan shift the risk of higher paid workers to a defined contribution plan as opposed to a defined benefit of the risk is shifted off the taxpayers to the folks higher paid workers or whether we have a cap to say it cannot earn over a certain amount and pension so that we don't have what we call the cadillac pensions that was the assembly member alan on this committee in sacramento with six members to legislators to democrats and one republican from each house the six of them trying to get to the finish line in the next three or four weeks to get something else
