toppled... to power lines down... the major problems windy weather proves deadly for one man from trees toppled to the power lines down. the major problems brought by the strong gusty winds tonight. hate crime allegation on the san jose state campus. what three students are accused of doing to their roommate. what's the hod -- what's the hold up? i'm ken bastida. >> i'm elizabeth cook. tonight tens of thousands in the bay area are in the dark. strong winds have toppled trees and power lines, creating dangerous conditions. our joe vazquez is in oakland's district tonight. joe? >> reporter: liz, the high winds killed a man tonight here in oakland around 8:00, a couple blocks from where i'm standing. a large branch broke loose falling right on top of him. >> we heard like a loud bang from the house and he came out

and then we saw when the paramedics showed up. pretty much the paramedics told us to stay away from the area. >> reporter: according to witnesses, the branch fell from way up there. you can see how it came right down in this yard. and now it is parallel to the yard and fell right on top of a man who was sitting on his motorcycle. >> pretty scary. >> reporter: and the winds, they're still whipping here tonight in oakland throughout the east bay as we've been driving around. officials are advising everyone to play it safe and slow down. reporting live in oakland, joe vazquez, kpix 5. strong winds are to blame for this tree in concord. the tree fell on the street east of port chicago highway as they came crashing down from the front yard of someone's home. it's blocking the entire road. this is just one of many reports we're getting about down trees in the debris all over. just how long will the wind

last? >> it's in effect through 10:00 tomorrow morning. we're seeing these winds right now, gusting to 45 miles per hour. a part of the concern, increase in a concern for the down trees and the down power lines and the fact you just saw the saturated soil as you can combine it with high winds and branches falling off the trees. but they're being uprooted as well. take a look at the current wind speeds outside right now upwards of 18 miles an hour. 17 miles an hour winds. and 17 miles per hour winds right now in san rafael. we're at 29 miles per hour in fairfield. 22 in vallejo. some of the highest winds for tonight and tomorrow morning before they do begin to gradually die down coming up in just a bit. we'll take a look at future cast and tell you when they will die down and what it looks like for this weekend in terms of winds and sun. >> all right, thanks. it is shocking and

disturbing. what apparently happened in a college dorm room now three san jose state students are facing not only getting kicked out of school, but also hate crime charges. betty liu learned that there may have been signs of the questionable behavior. betty? >> reporter: a number of students saw a confederate flag hanging in the window of this dorm room. they never thought much of it. they thought it might have been a prank or a silly joke. we know now that it was something much more serious. it happened on this 7th floor of the san jose state university dorm. the bullying supposedly went on for months and only came to light when the victim's parents visited their son's suite and saw confederate flag and the n word. >> it is just awful. i mean, just the fact that i live across the hall. i feel bad because i feel like i should have known something was going on. >> reporter: the university police report states that three

white roommates used racial name calling and attempted to put a bike lock around the victim's neck. >> i thought it was some stupid kids trying to be funny. >> reporter: didn't make anything of it? >> not really, no. >> reporter: things had gone serious for the three college fresh -- things have gotten pretty serious for the college freshmen. they've been suspended and charged with misdemeanor hate crimes. >> they stayed indoors a lot. even if we did see them, they were very quiet. they didn't acknowledge you and stuff when they passed you. >> reporter: students could be heard loud and clear. >> i'm not surprised. a lot of people say racism is not alive, but in reality it is a slap in the face to say yes, it still happens. >> reporter: howard played video games with the victim as he never let on about the abuse. >> i couldn't tell. you know he seemed perfectly

fine. >> i had a couple classes with him. he was a real nice kid. he definitely didn't deserve it. >> reporter: the young man will each face a year up -- will face up to a year in county jail. live in san jose, kpix 5. they looked like your average coffee shops from the outside. but inside it's another story. ozone cafe was one of six sights in san jose that the feds and police officers swarmed today. fbi and dea agents simultaneously raided ten locations in all across the bay area seizing illegal gambling and extortion. seven people arrested now facing federal charges. >> i think the bottom line is that it is very profitable for the coffee shops to have the illegal gaming devices inside their businesses. and it brings in a lot of money for these businesses. >> now police think gambling is

just a part of the problem. this is hidden cameras going on inside the so-called bikini bar. turning san jose into the bay area's sin story. a story you'll only see on kpix 5 tonight at 11:00. a man arrested and charged with the fatal shooting at the fairground. back in september an oakland woman was shot to death and two other people were hurt at the roller skate rink. the 20-year-old jones was arrested this week. investigators say the shooting happened following a fight. if you lost your health insurance because of obama care, you won't be getting it back. cover california today decided not to extend the policies. they found that this could be costly for thousands of people. >> remember this? >> if you like your insurance plan, you will keep it. >> reporter: this is the reality. >> i will take it up from them.

and causing from general areas. because they only got a few. not from the policy. >> reporter: he doesn't feel like he's getting the full benefit of his name these days. after three years lucky that they had their plans canceled. lucky is one of the estimated one million californians whose coverage went the other way once the affordable care act kicked in because the policy didn't cover everything the aca required. >> i don't have extended care. >> reporter: he deals with health insurance every single day. >> medicare on private insurance. >> reporter: none of the supply claims were dropped. just him and the switch is going to cost him a bundle through covered california. >> it's about 25% more for the bronze coverage. >> reporter: here is the

official line. >> 1% of the americans faced with financial challenges because of this. >> reporter: but lucky's bottom line will be an extra $1,600 a year. and the board is at odds with what the president and even the california insurance commissioner has requested. their unanimous vote didn't come with any reasoning for letting the policies lapse, other than that it was dangerous and a disservice to let the confusion continue. >> and the fight between bart and its unions is heating up again. it's over the contract of what they had been negotiating for six months now. today the board approved most of the deal, except a prevision dealing with the family leaves. it's a part in the contract including six weeks of paid leave for the union workers to take care of a seriously ill family member. now, the bart management says they are mistaking the contract as the unions are serious. >> it's a fair andic table contract for our employees in

my opinion. and it is affordable and sustainable for our riders. >> they put it mildly. i'm deeply disappointed in the action that the board took. >> reporter: unions have choices here as they could go back to their members to ratify or they could negotiate for a new contract or strike. unions are meeting with a legal team to decide what to do. plans to build a much- needed youth center in one oakland neighborhood finally came to life. if you look around, you won't find any young people insight. why the expensive property has never been open. >> reporter: for years, robinson has been waiting and hoping for this youth center across from the school where she works to open. she says that the children of west oakland need it. we've had a lot of students, straight bullets hit. they're walking home as they see needles. >> reporter: but five years

after the west oakland youth center first broke ground. the lights are on and the renovations are done. but the building remains empty. >> what's the point of having a building, you know, if you're not going to open. it was suppose to open last summer and then they pushed to the fall, but they could not come up with $250,000 needed to run the center. and the cash problem was eventually solved. but now, they have it open. and we are still finishing the murals and the inside construction. but we discovered the issues in keeping it closed and not cosmetic. the problem is the center was built at a cost of about $8 million with no operating plans. so now it has to sit closed while the city officials, they will try to figure out what kind of programs to bring here. >> the council member's office told me that the bottom line is nancy, the former council member got the center built, but claims on how to run the

center lags. >> how does it get built without a clear plan for what will go inside of it? >> we've been putting out proposals for youth groups to come in and operate the center. we're in the process of picking a group of groups to come together. >> reporter: but still no timeline on when the center will open. >> when it comes to west oakland, this is what you get. tax dollars wasted. >> kpix 5. >> to move forward, they will eventually run the west oakland youth center. that contract should be in place by january. tonight pandora hosts their own party for the new company logo. the new illuminated sign has happened in oakland. it's been based in oakland since 2005. and in this building since 2009. it's been battle of two of the biggest tech companies in the world. apple accusing samsung of stealing their idea. and today a jury agreed.

samsung now owes apple $900 million in damages. the silicone valley jury decided samsung copied vital iphone features in several of their devices. we've talked to one of the jurors on the case who said that their decision wasn't all about the money. >> they had been infringed upon, which is serious. in this particular business it's serious. we believe there was a message about it. >> apple and samsung were in court last year. they determined that patents were violated. this jury was in charge of determining the extent of the damage. samsung expected to appeal. the dow closed above 16,000 for the first time. it pushed off fire as the dow picked up 109 points. nasdaq gained 1,400. a secret kept for three

it does expire tomorrow morning around 10:00. but as we move on to the afternoon hours, the winds, they will start to move up again, not quite as high today. certainly we'll keep an eye on the next 24 hours as they should die down though, heading into this weekend. here is what to expect as we move towards the weekend. the area of low pressure is what brought us rain over the last couple of days. a gradiant, increasing the winds. however, high pressure will continue to build out. as it does, it will diminish this weekend as we'll see plenty of sunshine. high pressure dominating on through for the next week. the first chance of showers just in time for the turkey bowls. in the meantime here is what's next. gusty winds tonight with a sunny weekend in stored and plenty of sunshine. your pinpoint forecast overnight shows overnight lows are not too chilly thanks in part to the winds. 46 degrees. 39 at redwood city and napa and 36 tonight in santa rosa.
