oakland. we have a slight chance of showers next week. first, here's mark with your headlines. >> good morning. an alert bystander may have saved the life of a 7-year-old girl kidnapped. the suspect, david douglas, followed the girl and her mother home from a wal-mart and showed a gun. he forced the 7-year-old into his car and drove off. a few hours had later at the antioch marina, a woman got a call from the sister, who had seen the amber alert. she realized the car , matching the description, was nearby. >> i was going to knock on his window, guy's window. i saw him laying down. i'm like there cannot be an adult laying under him, because he was laying too flat. i went to my car and honked the horn. the car that stopped was a police officer. >> the 7-year-old was safe and

sound. investigators are still searching for motive. douglas is in jail on $4 million bond and also a suspect in two attempted kidnappings at the same wal-mart. neighbors say he recently lost his job. if your health insurance is now through cover california, you have a little extra wiggle room to make your first payment. the deadline is extended until january 15th that's for policies affective january 1st. as long as you pay by the new deadline, you will be covered all month. the extension was granted. the santa rosa city council is considering a plan that would relax rules for marijuana dispensaries. a proposal would extend operating hours. dispensary workers would be able to use marijuana on the job on a limited basis. santa rosa has the two

dispensaries. the city council is expected to consider the changes on tuesday. a saturday afternoon trolley ride in san francisco sent four passengers to the hospital. the streetcar crashed into a big ridge on the embarcadero yesterday. passengers and witnesses say the truck driver ran a red light. it happened near the intersection of bay street and traffic was jammed for hours. >> we were in the front seat. my wife had her leg pinned underneath the seat on the grading on the front. we had to rip the seat out to get her leg out. >> fortunately, no one was seriously injured. police are investigating the cause of the crash. a close call on the highway in the bronx. a small plane made an emergency landing on the roadway. the pilot reported engine trouble while en route to connecticut. the passenger and pilot were treated for minor injuries. the u.s. cost guard polar

the national trend. santa clara county leads the pack. and despite the crime rate, uptown oakland is enjoying a resurgence with businesses and housing. local governments are having trouble keeping up with the economic recovery. the association of bay area government says housing remains a challenge, but transportation issues are improving. >> you see the increasing number of bikes, buses, private shuttles and otherwise, major efforts in supporting the transportation infrastructure in the major cities, in the major corridors. >>reporter: sometimes that even backfires. recently protestors attacked a google bus in san francisco. people are angry at how new tech jobs are driving up rent. >> cities have to do a better job planning what they allow to come in and what -- if their

get even colder in a wide s of let's take a look at your sunday morning forecast. here is a live look over san jose, a little breezy this morning, mostly cloudy. today, finally not a spare the air day. we've been hearing that all month long. of course, today is the big game, kickoff 1:40 this afternoon, very cold there at lambeau field, 49ers versus the packers. it's going to be 5 degrees. the wind chill is going to knock that down to a whole lot colder. it's already cold and going to get colder in the nation. >> a deep freeze is going to continue in the midwest, new england, and south. record low temperatures are possible. the fridged weather is prompting a rare move in minnesota. the governor ordered all schools

closed and the park and recreational department shut down all facilities until tuesday. >>reporter: the northeast is suffering from you sub freezing temperatures. >> it's so cold. >>reporter: parts of maine dipped down to near 20 below zero. >> it's bitter. it makes my nose feel like it's falling off. >>reporter: nearly half the nation is about to feel the freeze from the dakotas to georgia. sunday's playoff game at lambeau field could be the coldest nfl matchup ever. the wind chill may drop to 30 below zero. a volunteer group in boston, called show crew, shovelled out rosemary, who has been stuck in her home since the storm started. some costal towns in new england are cleaning up ice water.

going on for weeks. the hospital has been court ordered to keep her on a ventilator through tuesday evening. the family is hoping to move her to a new facility. >> what happens when a hospital and family disagree on death? these are some questions being asked at the hospitals. joining me is chris, the lawyer for the family. how did you get involved in the case? >> a random phone call from an uncle, telling me his niece was going to be killed. >> we had a surgery that went bad. now we're in a question about whether or not is the girl is legally death. >> there are two definitions of death, brain death and cardiac

death. the legal definition of death was designed when a prosecution on homicide could go forward, not for a hospital to move aggressively to, in essence, take a way what they have done wrong and take a way a life. >> a lot of questions being asked is what the hospital did or didn't do. the hospital is barred from giving their side of the story. could you allow them to speak? >> that's ause. when we asked why don't you tell them what happened, he says we don't no. that's a pr technique . this family would like to be told first what happened before they tell the news media. >> when i talk to people on the street, their question is this, is girl, tragic as it may be, can't live on her own and without the ventilator, what are

we trying to accomplish? >> there are two things your talking about. the only thing jahi is getting from assistance -- they haven't given her food for 26 days. so she hasn't the nutrients to get her brain to be at its optimum place to see if she can regain that. there are a lot of people on the ventilators. are we going to pull them all? do we let the hospital decide or the parents decide? i'm on the side of us deciding, especially when there may have been negligence by the hospital. >> as it stands now, the court has begin permission for the mother to sign over, take custody, and for someone to come in, put a ventilator in, and move her. where are we in that? >> we are in motion. until friday, there were road blocks after road blocks. i would move forward. we didn't have a clear path. on fishing we had a --

that heart beating in my body before jahi entered this world. i feel her heart beating now. my daughter, after 26 days, still has her heart beating. that girl is fighting. i'm a mother. i'm going to fight for her. we need to get her, where she can get care, treated like a person and not a dead body. >> therein lies the questions. are we dealing with a person, who is going to live or with someone, who has passed? >> she's not passed. her heart beats. her kidneys function. she regulates her body temperature. she's moving more now than ever. this is a real human being, not a dead body. it's been callous. the hospital won't use her name. it's a person. >> if you get her to another facility, what then? >> the optimum care.

yesterday afternoon near some train tracks in delmar. witnesses say when the train hanged its horn, the dog got spook and ran on to the tracks. the 75-year-old owner went after the dog and pulled it away from the train. investigators say that's when the man was hit. >> he's done this probably a million times and for the train to come by like that, it's pretty tragic. we've never seen anything like this. >> as you can see, the dog survived the deal. the man is reportedly the former mayor of delmar. two men suspected of robs banks in santa clara county are behind bars. they were arrested last month. the duo having on the run. >> flu season in the bay area will peak in the next few weeks.

one woman has already died. >> health officials want everyone to know it is not too late to get vaccinated. >>reporter: the california department of health is urging people get flu shots, reminding the public the flu virus lives longer than area. a woman died of h1n1 december 23rd. >> i would expect the cases of the flu to go up. >>reporter: according to the centers for disease control, the imaginety of the cases of flu this -- majority of the flu cases this year are h1n1. public health experts say swine flu targets a different democrat from other flu strains, which often sicken infants, the

the warriors, we've been talking about their stadium. it is going to see major hurdles. first, this morning's top stories. >> computer hackers have reportedly gotten into yahoo's advertising servers. they say the servers have been distributing malware to hundreds of thousands of users since at least december 30th. it exploits vulnerables in java. whoever is behind the attack may be trying to sell control over victims' computers to other online computers. yahoo said it recently identified the malicious ads. actions by an alert bystander apparently helped free a 7-year-old girl kidnapped the at gun point. police say the suspect, david douglas, followed the girl and her mother home from a wal-mart

promises to transform this crumbling, 13 acre pier too a world crass entertainment complex. to answer the critics, they've changed their plans a third time, calling the renderings a new slimmed down version of arena. a coalition of waterfront activists are not impressed. the same group who defeated the luxury condo project is behind a new measure that would force all waterfront developers to get voter approval if their project exceed the 40-foot height limit. becky evans is one of them. >> it's a positive thing in terms of reenforcing the voters' wishes. >>reporter: if the measure gets on the ballot and wins, it would impact the new arena. plans call for it to be 125 feet high. voters would have to okay that.

these warriors season ticket holders do not want to see the team move to san francisco and sympathies with the sympathize with the people. >> i would angry. >>reporter: there are others who like the idea of a new arena. >> actually, i want them to build it. i don't think they're going to build it too high. >>reporter: the mission would also support the mission bay project the giants are pushing. this development includes space for 2,000 residents and parks, restaurants, and shops. >> this is our city. it's not the city for a billionaire developer, who wants to have something on the waterfront. >>reporter: linda yee, kpix 5. >> talk about going through the

ballot process, that is a risky proposition. >> that's one you usually have to do until san francisco, especially for projects in size. between the environmental concerns and affordability concerns and everything else, it's going to wind up on the ballot. the only question is when. >> it is consequential. when you're talking about changing the waterfront, you're usually change it for good. >> you're right, it's complicated. the other story we've been following closely, jahi mcmath, her family planning to take her out of children's hospital oakland. the 13-year-old was declared brain death last month after complications from surgery. the coroner even signed a death certificate. her family believes she's alive and want to keep her on a ventilator and want a feeding tube inserted in her stomach. the hospital has refused to do so, saying it won't perform surgery on a dead body.

difficult for her family to accept that death, and i wish and i constantly think that wouldn't it be great if the they were able to come to terms with the terrible, tragic event and that i didn't have to stand here in front of y'all. >> it's emotional. you can see the lawyer is choking up. >> it is emotional and one that everyone has an opinion on. that's why this story has gone national. as a result of that national attention, the lawyer tells us they're getting offers for institutions to come in and take over. >> we're continue to follow that for you as the tuesday deadline approaches. still to come, a potentially record-setting playoff game for the 49ers and packers. also, what is in store for

clear this morning. it is breezy. much different in green bay, wisconsin, where the frisk 49ers -- san francisco 49ers woke up thio work at several bart stations is going up. >> starting january 14th, the cost to park will rise by 50 cents to $2 a day. it will cost $6 to park at west oakland. the extra revenue will be used for station improvements. parking at other stations will not change. >> the parking fee hike coincides with an increase in ticket prices as well. fares went up about 5% on new year days. joining us to talk about the price hikes is joel keller, newly-elected president of the bart board. my first question is did anybody else want you job?

>> i think that's probably why i am the president. there was no second in line. >> because the public's impression on bart is not at all favorable right now. they like the service. they like the rides, but they're not happy at all about how things are being managed. what do you think is going to change this year or anything? >> i think you're right. i think we've had a hard year. our brand has suffered. i think it's important that the board and staff rededicate themselves on focussing what we do best, providing world class transportation. we have to work with our employees. we have had a tough negotiating period. there's hard feelings. we have to revisit the employees' needs. >> one of the questions that the riders i talked to asked is at what price? the cost of transportation is continuing to rise. most people say if it was cheaper, i might take it more and take my family on it on weekend, but it's not a cheap

system. >> that's a good observation, phil. the world has changed in transportation funding. in order to qualify for state and federal monies to restore the system , we have to come up with about 25% local match. so all the money from this cpi fare increase will go into a dedicated fund to help pay for the new rail cars, the new man answer in facility. >> as you increase prices, aren't you afraid people are going to take it less or are people takes it more? >> transportation prices are elastic. there's a point at which people will not pay any longer. we're seeing continued ridership growth. our ridership over the new year's celebration was the highest history. we're continuing seeing support for the. as long as we provide a service that's equivalent in price, i think we'll be final. >> let's go with parking,

mentioning automobiles. one of the big complaints people have is they want more parking at bart. i understand there's a debate about the cost of parking, providing parking but also the environmental concerns. people say they would take bart more if they could get a parking space. >> it is a double edged sword. we have to work with our communities and try to find ways people can get to our station without using a single occupancy vehicle, because there's an unlimited the demand for parking, the congestion around our stations, the environmental advantage that would do is significant. we have to find alternate ways with of getting people to the station, by walking, bicycling, taking a bus, car pooling. >> i'm not sure people are going to do that, but we'll see that in the coming years. you just approved this contract. two questions i get from people out there watching are, one, is

anybody going to get fired over what happened? yes or no? >> we've already separated ourselves from the chief negotiator. the general manager is investigating. once that's understood, she's take appropriate action. >> okay. the second question i hear is that bart workers are in line for bonuses if ridership goes up. are we rewarding them? >> no. i think that's what happened is you're aware of the mistake that was made during the negotiations on the 4.8 or paid medical leave. so we went back to the negotiating table. the riders -- the workers will be eligible for a bonus but only if ridership grows by 1%. that will generate about a million and a half dollars for district. the bonus is equivalent to three quarters of a million dollars.
