this is kpix5 news on kbcw. >> a tragic accidental shooting ends with the first ever line of duty death for the bart police force. good evening, i'm juliette goodrich. >> we have team coverage in dublin where this all started earlier this evening. >> reporter: take a look behind me. technicians are still on the scene out here in dublin trying to process exactly what happened here this afternoon. hours after the shooting, alameda county sheriff's crime lab technicians were looking at this dublin apartment. >> e with are in the process of going through the whole scene and trying to reconstruct what happened and ultimately, find out what led up to this. >> the tragic shooting began unfolding at 1:07 when four bart officers were conducting a probation search at the home of a bart robbery suspect in the

bark sierra apartments. the officers all wearing vests went in and as is standard protocall, had their weapons drawn. >> they knew the suspect was in custody, but they were doing a probation search of his apartment in connection with the robbery, so he went in and obviously, you don't know who is inside somebody's apartment. that's why they did the way they did. >> less than an hour the way the search began, one of the guns discharged, firing a single round and medical reportly wounding officer smith. smith was rushed to the medical center in castro valley, but it was too late. in an instant, smith became bart police's first death in the line of duty. now this case is being handled by the dublin police department. three officers were in the apartment when this shooting happened are right now. they are being interviewed to piece together what happened

here. kpix5. >> thank you for that. after the shooting, an initial investigation, the officers body was wheeled out to a coroner's van, dozens of officers saluted as the casket went by. the body was taken by police escort from dublin to the coroner's office in oakland where the autopsy will be done. joe vasquez continues our live coverage now from castro valley. joe. >> dozens of officers, family members, friends gathered here today to pay their respects to the family of sergeant tom smith. i have to tell you, it was a somber moment. a lot of people knew him and loved him and some of our viewers might be familiar with him as well. >> it appears there were words exchanged. >> detective sergeant, tom smith, was on kpix5 telling our viewers about a shooting. he was 42 years old. a member of the law enforcement family. his two brothers are copped at two other law enforcement

agencies. his wife, kelly, was his colleague. sergeant tom smith leaves behind a young daughter. >> condolences goes out to our immediate family and friends. >> tom's brother told me outside that tom was a great guy with a wicked sense of humor. loved his 49ers. just this past weekend, he and his brothers were comparing notes about off how far off they were for retirement. >> everyone give us a chance to catch our breath, breathe, and we'll be doing an update, probably tomorrow morning. >> we learned a lot of the information about tom smith from his brother, who is a newark cop. the family is taking this as well as they can right now. they are having to break the news to officer smith's young

daughter. reporting live, joe vasquez, kpix5. >> this is the first time a bart police officer has been killed in the line of duty. before today, the last bart police shooting was 2 1/2 years ago. an officer shot and kill add homeless man with a knife at a san francisco bart station. and then, of course, there was the oscar grant shooting that happened in 2009. he was going for his taser that he pulled out his gun and shot and killed an unarmed passenger. bart has since made a lot o changes. the officers receive about 40 hours a year of extra training on the use of force. >> a bizarre ending to a break in at a san jose medical marijuana clinic. betty says the incredible part is how the guy tried to make his get away. >> apparently, the easy part was getting into this club behind me. the burglar was a customer of

the dispensary. the tough part was getting away from officers. he took an elevator out of service. >> he was in the elevator shaft. >> this is how police officers confirmed a burglar was indeed hiding for two hours this morning. they broke through the wall to find him trapped, on top of the elevator car in west san jose. >> that was the hard part. we needed to force open the elevators and convince him to come down. it was a small, catched space. >> this is the stuff he was of. and the strip mall on hillsdale avenue. police say he broke in through the roof and tripped the alarm. >> he got up on his tippy toes. >> 30 minutes later, he made his way into the dance boulevard through the window. >> from what i saw, he was trying to escape from his own

mayhem. >> the crook did quite a bit of damage to the office. at one point, he kicked down this door. >> i think he was high and he wasn't thinking straight. >> schmidt is looking at more than $100,000 in damages to his elevator. the thief is looking at jail time. he got away with nothing. he did complain of pain after being stuck in the spot for too long. and police have not released his name, but he is 50 years old. he is now facing two counts of commercial burglary. one count of criminal mischief. live in west san jose, betty, kpix5. >> a police canine helped an intense standoff in san jose. a man held himself up in an apartment after attacking two officers. a s.w.a.t. team evacuated the building and four hours later, the suspect tried to run, but the dog got him first. he was arrested and booked at santa clara county jail.
