they'll be holding off for another year. we'll sit down with the team president and find out why the delay. this week in the state of the union president obama made lofty goals. this morning we brought in congressman eric to see if the president is a lame duck or if he can get these things done. it is raining if you have not looked outside your window. which is good news since we have been dealing with this drought for months. this is our live doppler radar. you can see light to moderate rain and lightning strikes off the coast. we are going to see that rain continue through the day. live look at san francisco where there are arrival delays up to two hours. check your flight if you know somebody coming in or if you are flying out. that can have a rip. le effect. in the 40s around the bay area. we'll make it into the 50s. it will be raining all day

long. breezy conditions. possibility of more rain ahead in the next seven days. details coming up. developing news. a violent night in west oakland. two people are dead. police are looking for clues this morning. the shooting happened on 24th and market street. shots rang out at 10:45. please are unclear if victims are adult or teens. police in napa are investigating the murder of a 4- year-old girl. they are looking for this couple. sarah krueger is the victim's mother. ryan warner is krueger's boyfriend. they were last scene leaving an apartment yesterday while carrying luggage. three hours later police found the girl dead in a bed inside the same apartment. they say there are signs of foul play. krueger and warner are wanted for questioning. call napa police if you know where they are. new this morning, there appears to be plenty blame to

go around in the death of lynn spalding. 57-year-old went missing in a san francisco general hospital last september and was found dead in a stairwell two weeks later. a federal report says the hospital staff and sheriff's department made mistakes. nurses failed to carry out written orders to watch spalding around the clock. sheriff deputies did not check all the hospitals stairwells as ordered. autopsy found he died of dehydration and liver problems. al sharpton will be in town to open a civil rights organization. it aims to address social and economic indifferences experienced by african- americans. agriculture is taking a big financial hit from the drought. lack of rain could cost california farmers and ranchers $5 billion in revenue.

with water at a premium, everything from milk and beef to basic crops could be harder to produce. for more on the drought let's go over to ann and phil. >> statewide drive has gone from bad to worse over the past 11 days. >> trivalley will be among the hardest hit areas in california. >> 80% of the districts water supply comes from the state. that's been cut to zero. >> it is drastic. it will be a severe hardship to the communities that we serve. >> zone seven is a special water district that contracts with the state to bring sierra water here. luckily they have been saving water. there is concern the delta water in the district's backup reservoir will get too salty to drink. that capping off a week of concerning drought regulations. >> there will be no water if

these conditions exist. >> reporter: water districts need to tap into other supplies. they are at 37% capacity and with 750,000 acres of farm land depending on reservoirs like these, it will be one of the toughest years on record for agriculture. >> we have a problem. as governor, i'm responsible for the whole state. >> reporter: 17 communities sate wide could run out of water in the next few months. southern california water officials met with the governor to talk about how extra reserves in the south could help communities in the north. president obama personally called the governor offering federal assistance. >> he pledged his support to help california. >> reporter: several local water agencies are calling for cut backs in water use.

marin water district mandatory 25%. santa clara 10%. san francisco puc services 2.6 million users in the bay area. it is asking for a 10% cut in water use. >> it won't be that long if things do not change we'll start to consider higher levels and consider it mandatory. >> as the drought continues we are adding resources online. you can go to kpix.com/drought to find advice on how to conserve water. on tuesday san francisco supervisors are introduce a tax proposal on sugar beverages. the money would then go to fund health programs in schools and city parks, focus on nutrition and physical activity. some consumers are skeptical about paying more for their soda fix.

>> i don't know if the government taxing people any more than they are already taxing us would really help the situation. >> approach is similar to the approach with tobacco taxes. scott weaner and three other supervisors came up with the proposal. they spent millions of dollars to defeat legislation in new york and richmond. is it going to fly here? >> it will be interesting to see. they can put it before voters. some people will say why not? others will say i'm going to be paying this. it is interesting when you put a tax on this, they have done it with alcohol and tobacco you are targeting a small group. smokers pay and pay as the taxes go up. because as a voting block they are not big. people that drink sodas and juices and with kids is a lot bigger group. >> it will come in front of the board of supervisors on

this comes as cost estimates doubled for renovating piers 30 and 32. >> this is one of the most ambitious sport developing deals and buildings we have seen on the west coast in the history. and the latest with the project, we have rick welch, president of the warrior. what's behind the decision to hold off for a year? >> we are doing what we said we would do. which is fully embrace all the public input, all the regulatory input we got. as a result it takes longer to complete. we'll open in 2018. >> how did you pick 2017 deadline? was it something out of the air? >> it was possible to do. absolutely everything fell into place at the right time. in sacramento they announced a year after we did they would open an arena a year earlier than we did. the timeline is available. >> what makes its appealing? >> number one, access of public

transportation. there is no site west of the hudson that's as transit rich as this site is. it is on 13 acres of piers falling in the bay built in 1912. it gives us a chance to bring 13 acres of the city back to life again and create something for the warriors and hosts events from entertainment and business events and provide ways for the city to interacted with the water that don't exist now. >> it is a massive undertaking. 13 acres on the water on crumbling piers. you are finding out the cost of rehabbing piers doubled. people say do they have the money for this? two, are they nuts? >> well. we have the money. no we are not nuts. this is about what the current warriors ownership group wants to accomplish in creating something great in term of the warriors franchise. if you look over the last three year of everything we said we would do everything has

happened. finance is the last of the problems. we are comfortable with the project as it stands today. even as expensive as it is today. we'll get it done. >> redesign is one reason. trying to accommodate various coastal commissions. are we going to see more redesigns? >> we committed to take all the public input available to us. we have over 100 public meetings. we have regulatory input. we'll create a project that san francisco is proud of. that requires taking the time to incorporate those suggestions into our design. which is what we have done. >> next thing, tomorrow a group of san franciscoians is going down with 15,000 signatures to go on the ballot saying if you want to build the waterfront arena you'll have to go to voters on height limits. where do you stand on that idea of this proposition mandating you have to go to the voters.

>> first thing we want to see if it qualifies, how it affects our project. this is not a warriors focus initiative. this affects all development along the water front. whether it is pier 70 or the giants project. we'll look at what that means. we have fully embraced the process from day one. if the rules are going to change we'll fully embrace the process as the rules change. >> some people suggested, as it stands for you to finance this deal without public money, you are asking for permission to build a condo tower across the street and a hotel. and use that money to help pay for the arena and the work. some people suggested knocking those off the project knocking those off the project in order pass easier. are you thinking of eliminating the hotel and condos? >> this is across the street

from the market. they are not on the piers themselves. >> this is the path the city gave us to absolutely have the ability to invest $180 million of warriors money in the city's infrastructure in rehabilitating the piers. there has to be some value derived from that. exactly what it will be we are not hundred percent committed to. >> it is an interesting interview. it is tough to tag you down. yes or no you are still studying and looking. i'm going to ask an easy question. broncos or seahawks? >> i'm rooting for the 49ers to be back in the superbowl next year. >> this arena will definitely be the centerpiece of san francisco and bay area talk this coming year. bay area weather watchers

please are unclear if victims are adult or teens. california department of water resources is getting stingy with the water supply. turns out the state won't be funneling a drop from its reservoir to local directs. that includes the bay area's trivalley. it really needs more. >> community is thirsty for every last drop. >> reporter: irrigation water continues to flow in the dublin office park. drought reality about sunk in yet. residents are about to feel drought pain. 80% of the trivalley's water normally comes from the state. that's been cut to zero. >> it is drastic. it will be severe hardship to the communities that we serve. >> reporter: jill is the general manager of zone seven, a special water district that contracts with the state to bring water here.

they have been saving water for a year, recharging aquafers and conserving. >> from last year we tried to conserve what water we could. that water is currently be transfer today the extent possible into the lake. they are pumping into the lake and then it will be available locally if they have to stop pumping through the delta. >> reporter: what's happening with the trivalley's drought and loss of state water is being repeated in districts across california. >> we have 17 water agencies across the state in danger of running at of drinking water in the next 60 to 100 days. >> reporter: even though water agencies like zone seven may have unused allocations due them, the drought may cut that short if delta water gets too salty to drink. >> impacts will be on the landscape this summer. we have enough well capacity to serve all public health and safety needs of the community. >> reporter: trivalley residents will be asked to cut

back water use 20%. maybe more if rain or snow doesn't arrive in the sierra any time soon. population increase in the trivalley strained the water supply. you can see it in the number of people in dublin. it has more than tripled since 1980. next door pleasanton doubled its population. one bay area county is doing okay with the water supply. officials expect cities and farms to get the water they need. a few cities may have to buy water from other sources to avoid a shortage. while they may be in good shape now, officials are urging people to conserve water. at what point does a convict deserve a fresh start? >> san francisco is mowing over a proposal to prohibit employers and landlords from asking applicants if they were ever arrested or convicted of a felony. it is part of a nationwide movement called ban the box.

supporters say housing and jobs are so difficult for ex-con's to find, having them check that box may turn them back on the wrong path feeling defeated before they get a chance to return to society. >> here are details about the proposal. no up front inquiry about criminal history. you could ask after the first interview or after offering someone a job. some things would be off limits like erased convictions or older than seven years. this is something people have an emotional reaction to initially. you like to see people get a second chance. then again, a lot of people are leery about people who made very bad mistakes in the past. living next to them, working next to them. >> right. this would not make that mandatory. what it would to, say when you are filling out that application you don't have to check the box. you get to at least explain yourself. the idea is explain yourself to the employer, the landlord. they say too many times people just feel after checking that

announced they were retiring. in part i suspect it seems like it is a tough job. it is wearing on them. we just had a statistic that shows over 50% of congressional representatives are millionaire. what is so tough about being in congress. >> most were millionaires before they went to congress. i'm 415 out of 435. i worked as a prosecutor before i went to congress. i'm at the bottom end. george miller and henry waxman, two lions of the house. we'll miss them both. if congressman miller has a vacancy in the house he rents out, i would like to apply for the vacancy. >> he rents his house and has four roommates that live with him. >> chuck schummer and dick durbin. >> where do you live in washington? >> rent a room ten minutes away from the house. i fly back and forth. >> so you don't get living expenses?

downtown, a lot of people see apartments. but if you are a foreign investor, you see basically a safety deposit box where you can park $500,000 to $1 in real value. it is safer than keeping money in india, china and indonesia. we are competing with that market as well. >> the city of san francisco can't act just alone. i have to talk to counter parts to build enough housing around the transportation corridors we have been building the last couple decades. >> your problem is while oakland becomes the brooklyn to your manhattan, or san jose becomes the connecticut to your new york, the people in the city feel like they are getting priced out. >> if we don't build more housing, by the way to change ways evictions happen to protect long term tenants. if we don't build more housing that pressure will be there and get worse. there are more people coming to

the bay area region. >> when you say affordable to a lot of people that's a combined income of under $70,000. in san francisco to be middle class it is $90,000. middle class doesn't qualify for affordable housing and can't afford market housing. >> middle class in san francisco ranges more between $75,000 to $50,000. they are being priced out of two or three bedroom apartments and housing. that's the kind of housing we want to build. that's what we are building in hunter's point shipyard and treasure island. these are the types of housing want to to build. when we are doing that people are saying we like what's happening in the public school system. those two things are the most important things for all of residents including the middle class to stay here and grow here. foreign investment is an

interesting part of all of this. is there anything good about it? it is driving up the price. >> it gets the projects off the ground and provides seed money and guarantee for somebody out there thinking of building that they'll get a return. on the overall is it good for people living here? that's the big question. people say no because it makes it too high priced for locals. >> a lot of other cities in this country would be craving the investment san francisco has. >> they don't have a tight squeeze on affordable housing for the rest of the city where everything is impacted because we are small. ,,
