dakota access, is designed to pump crude oil from north dakoa to illinois, travelling diagnally across the state of iowa. the project is nicknamed the bakken pipeline because it travels from the bakken oil fields in northwest north dakota. in court paperwork filed tuesday, the judge presiding over the suit, dismissed the case, saying the three landowners who brought forth the case needed to go through the proper channels and quote "exhaust the immediate administrative remedies required" before they can sue a state agency. no judgement came on whether dakota access is able to use eminent domain. stay tuned right here on abc9 news for the latest in this case. jessica rae: this morning, opening statements began in washington, into yet another hearing about the deadly attacks in benghazi that claimed the lives of four american soldiers. former secretary of state and current democratic presidential caniddate hillary clinton took a seat before the congressional committee designed to

uncover details about the benghazi incident and set future preventative measures to stop an attack from happening again. republican representative trey gowdy of south carolina said in opening statements, the committee owes it to those lost in the attacks to find answers. why were there so many requests for more security requests for more personell and equipment, and why were those requests denied in washington? when hillary clinton got the chance to speak, she commented on what she believes is at the heart of the issue during the benghazi hearings. saying the fault of the issues lie with the republican's political agenda. we need leadership at home to match our leadership abroad.leadership that puts national security ahead of politics and ideology but clinton wasnt the only one at the hearing who had a problem with the questioning. democrat committe member elijah cummings had something to say about the timeliness of the

congressional meeting, adding there are ulterier motives for the hearings. the problem is that the republican caucus did not like the answers they got from those investigations, so they set up this select committee with no rules no deadline and an unlimited budget, and they set them loose madam secretary because you are running for president. representative cummings also mentioned the select committee spent 17 months and 4 point 7 million dollars of taxpayer money pursuing answers about details surrounding the benghazi attack. jessica rae: a new poll says donald trump is being out-trumped by a republican rival in iowa. jessica rae: university poll of likely iowa republican caucus-goers says ben carson now leads the g-o-p presidential field in the state with 28 percent. trump is second at 20 percent, followed by senator marco

planned in norfolk to honor a special guy from the city. here's paul hughes with more. " after months of discussing flow meters, the board of directors of the lower elkhorn natural resources district is scheduled to take action on the issue tonight. tonight's meeting begins at 7:30 in the lifelong learning center on the northeast community college campus. tax revenue for the city of norfolk continues to show the impacts of last june's hail storm. at this week's meeting of the norfolk city council, accountant sheila rios said the september sales tax receipts - representing july sales - totaled a little more than $906,000, down 12- percent from the same time last year. she said the drop is because july of last year saw a spike in retail activity and sales tax receipts related to hail- storm repairs. the elkhorn valley museum is having a big party tomorrow night to celebrate johnny carson's 90th birthday. elkhorn valley museum director ryan leichenhauer says

" jessica rae: volunteers from beth shalom congregation here in sioux city have been busy in the kitchen all week long. it's all in preparation for the annual super latke fundraiser, cooks in the kitchen are busy making 3 to 4 thousand motzah balls. organizers say the majority of the ingredients for this year's meal come straight from local farmers, " this year we're having latkes and matzah ball soup, so today we're preparing the soup and the matzah balls." motzah ball soup is a jewish dumpling in a chicken broth. the fundraiser will be held on sunday november 8th from 11-30 a-m to 5-30 p-m tickets are just 12 dollars. jessica rae: still to come... there's a shortage of a popular kids toy...

chocolate, vanilla, or tapioka... howard has a corn pudding recipe you must give a try "have you ever wondered how certain dishes came to be? let's take this corn pudding for example. native americans first introduced early settlers to the method of cooking corn with water. after some time, the settlers added eggs, cream, and butter . making it more of a custard. well, let's fast forward to today, and although there are many variations, its popularity is still going strong. let me show you the shortcut version that we're making today. all we do is combine a few cans of corn that we've drained, along with a couple cans of cream style corn, a bit of milk, some sugar, a few beaten eggs and a couple tablespoons of cornstarch. once that's all mixed, we pour it into a baking dish and into the oven it goes for just over an hour, or until the center is set and the top is golden. and even after all these years, you still can change it up if you want. try using frozen corn instead of canned, or brown sugar instead of white. you get the idea. and when it comes out of the oven all piping hot, get ready for a side dish that's as welcoming at a weeknight dinner as it is on your holiday table. i do hope you'll go online and get the recipe for what we call, "easy

artist is helping a family's last wish come true. wilbur meyer has always wanted a sculpture of herk hawkeye in his back yard... but given only a few weeks to live, his family didn't think he'd ever see it happen. abc9 news reporter deborah souverain has this one a die hard hawkeye fan....all wilbur meyer...wanted was for this tree...to be transformed into his favorite mascot. but suffering from lung cancer...and given a few weeks to live. his family didn't know if he'd be around to see it happen. "it's something that we wanted together but he said i'm not going to see it, so you might as well cut it down," said donnette meyer. however, his three children had different plans. natpop -- yeah but dad what you've done for us in all the years you've been alive, this is nothing," they reached out to woodcarving artist...jeff klatt...who wilbur is a fan of. natpop-- you dropped everything you were doing justcome carve herky, that really made my day," said meyer. "it was an honor," said klatt jeff..who lost both parents to colon cancer....dropped

complete the project in time for natpop -- chain saw "i've been through a before and i know helps and i was and do it for them," said jeff klatt, chainsaw artist. wilbur hasn't seen the sculpture in person yet...because he's to weak to move but, he's seen herky in photos..and his daughter nicole..says she's father's last wish come true. it's awesome to see him cry because you think he's sad but it's amazing. seeing him soo happy especially in the situation he's great," said nicole florine. the sculpture is art from the heart...that loved one say is strength to keep fighting.
