the flights left from san antonio, texas. on the anniversary of a movie theater shooting there's a new lawsuit. two years ago a retired tampa, florida police captain allegedly shot and killed another theatergoer in an argument over the use of a cell phone. that case is still pending but now the victim's widow is suing the movie theater and an employee. she claims they didn't enforce the company's prohibition on weapons. to texas now and the affluenza mom is back home after being released from jail. tonya couch is wearing an electronic monitoring bracelet while she's out on bail. abc's lauren lister with more. >> reporter: the so-called affluenza momo tonya couch, leaving jail. >> how are you feeling right now? >> reporter: saying nothing to reporters. posting bond after this texas judge reduced it from $1 million to $75,000. >> we're talking about a third degree felony here. we're not talking about a capital murder. i don't make my decisions based upon the law and that alone.

out tonya couch is accused of a non-violent t ime, hindering the apprehension of a fugitive, her 18-year-old son ethan. the mother-son pair disappearing last month after this video was posted onli appearing to show ethan at a party where others were seen playing beer pong. he's been accused of violating his probation for killing four people in this 2013 drunk driving crash. his attorneys arguing the teen suffered from affluenza, that he was too spoiled to know right from wrong. the mother's arrest warrant says the duo drove to mexico after tonya took $30,000 out of her bank account. couch's older son, ethan's half brother, tellinghe judge authorities have frozen his mother's bank accounts and she has no access to other assets. >> your testimony under oath is that there is nothing --? there's all rightliterally nothing. >> reporter: as for ethan couch, he's still in mexico fighting extradition to the u.s. there will be a hearing in texas next week to decide if his case will be moved from juvenile to

on a busy wednesday, i'm kendis gibson. >> and i'm reena ninan. we're going to actually start with the drama involving u.s. sailors held by iranian forces >> and we're anxiously waiting for an update on this one. the ten u.s. servicemen were on a training mission in two small boats when one of the vessels became disabled. iran's revolutionary guard navy took them into custody for what the country's official news agency called snooping. officials say they were to be released at daylight iraraan time, but at this hour the sailors and their boats are still in iranian hands. abc's chief global affairs correspondent martha raddatz with more. >> reporter: the two small navy vessels with the sailors on board were transiting between kuwait and bahrain when an ofcial says one of the boats experienced a mechanical problem, with both then possibly drifting into iranian territorial waters near farsi island. according to u.s. officials, the

that the sailors will be allowed to continue their journey. secretary of state john kerry personally reaching out to his iranian counterpart to find a diplomatic resolution to the situation. incidents with iran have exacerbated tensions in the already tense persian gulf region. last month as the aircraft carrier "harry s. truman" was entering the gulf, iranian navy boats cocoucted live fire exercises just 1,500 yards away. over the summer u.s. officials claim iranians targeted u.s. ships and helicopters with laser devices. and in 2007 the iranians held british sailors for 13 days despite early promises to release them, claiming they had entered their territorial waters. martha raddatz, abc news, washington. >> andnde'll stay on top of f at story.

developments after isis targeted an area of turkey popular with tourists. the turkish prime minister is pledging to fight isis until it's no longer a threat to his country or the world. the pledge comes after an isis suicide bomber killed ten people in the historic district of istanbul. most of the dead were german tourists. it's believed that 28-year-old bomber recently entered turkey from syria. and there are also some new developments in the crcris with north korea. the south has just fired shots at a north korean drone that crossed the border. in the meantime, the south wants china to punish the north for its so-called h-bomb nuclear test, specifically enforcement of international sanctions. there are doubts, though, about that test and also about north korea's claim of a successful missile launch from a submarine. analysts say the video was probably faked. president obama made his own history, delivering his eighth and final state of the union address. >> and rather than introducing new legislativivproposals, he focused instead on his broader visions for the future.

we've got some new developments in the worsening water crisis plaguing flint, michigan. >> the governor activated the national guard to deliver water and filters starting in flint this morning. volunteers accompanied by state troopers and state deputies went door-to-door with bottled water. tap water became contaminated switched its drinking water supply in an effort to save live some stunning new video from inside the takedown of el chapo, the notorious drug lord. it shows the marines wearing body camera descending on his compound from helicopters. this is all in his mountain hideout. just a day after that meeting with actor sean penn, el chapo wasn't there, but for three months the marines circled, tracking penn and the mexican actress who helped arrange the meeting. finally last week, they got their man. fire crews in oakland, california, worked for hoursrs overnight to free a worker trapped in a sewer line.

our top stories this morning, ten u.s. sailors on two small boats are expected to be released from iranian custody later today. they were detained after one of their boats became disabled in the persian gulf. president obama vowed protecting americans from terrorists is priority number one in his final state of the union address last night. he also warned that america cannot move forward until we, quote, fix our politics. lake-effect snow in the northeast will dump up to another two feet of snow on top of the 30 inches that's already on the ground in some parts. areas of western new york could end up with a total of four to five feet. elsewhere, northern california, oregon and washington could see another 2 inches of rain with snow in the sierra and northern rockies. dry and chilly across the south. and as we watch the president's final state of the union address last night, you can't help but thinking there's a lot more gray in his hair now w than, say, seven, eight years ago.
